Notice to Garbage Contractors.
Sealed proposals will be received
at the office of the City Recorder up
to 2 o'clock p. m. of May Ist, 1913,
for the removal of garbage and dead
animals for the season of 1913 -1914,
in the City of Dubuque, as per speci-
fications on file in said office. Garb-
age to be disposed of outside of the
City Limits. Separate bids to be re-
ceived for one year and for five years.
Wagons for conveying garbage to be
non- leakable and equipped with cov-
er. Bids to be accompanied by a
certified check of $250.00 . on some
Dubuque bank that a contract will be
entered into if awarded. A surety
bond of $1,000.00 for fulfillment of
contract is demanded from the suc-
cessful bidder. The City reserves the
right to reject any and all bids.

Notice to Waterworks Bondholders.
To the Holders of Dubuque Water -
\yorks Bonds Numbered Three
Hundred and One to Three Hun -
dred and Thirty -Five, Both In-
clusive.
The Board of Water Works Trus-
tees has directed that Dubuque Water
Works bonds, numbered from Three
Hundred and One (301) to Three
Hundred and Thirty -Five (335), both
inclusive, dated June 1st, 1900, be re-
deemed in accordance with the ordi-
nance and contract entered into by
the City of Dubuque and the holders
of said bonds.
The above bonds should be present-
ed at the City Treasurers office, Du-
buque, Iowa, on the first day of
June, 1913, for payment. All inter-
est ceases on above bonds June 1st,

Be it Ordained by the City Council
of the City of Dubuque:
Section 1. That a grade on Twenty -
second Street from Couler Avenue to
the Chicago Great Western Railroad
Tracks be and the same is hereby es-
tablished and adopted as shown by the
profile of said street and grade pre-
pared by the City Engineer, being Pro-
file No. 771. B. M.: Door sill Heeb's

of the City of Dubuque, that the City
Recorder be and he is hereby instruct-
ed to issue a venire to the Chief of
Police commanding him to summon a
jury of twelve freeholders, citizens of
said city not directly interested, and
having - the qualifications required by
ordinance, for the purpose of assess-
ing any damages which may be sus-
tained by reason of the widening of
said lane by any owner of the property
proposed to be taken for such im-
provement.

Gentlemen: In the matter of the
levy of a special assessment against
the Chicago Great Western Railroad
Company for the improvement of Elm
Street, I find from the facts as re-
ported by the City Engineer, that the
macadamized portion of the street in
question does not extend beyond a
foot outside the rails of said Com-
, pany; the Company would be assess-
able for any paving between the rails
:and for a foot outside the rails, but if
the paving in question does not cover
this space no assessment can be levied.
Code, Sec.. 968, provides for the as-
sessment of the easement or right of

way (which assessment probably may
in no event exceed special benefits con-
ferred), but under the definition and
limitation contained in said section i
do not believe the action would be held
to give power of assessment for a mere
franchise over a street. This statute
has not yet been passed ai pon by our
Supreme Court, but the rule above set
out seems to be the general holding in
other states where the question has
arisen.

the City of Dubuque to widen the ex-
tension of Thirty - second street from
the easterly line of the Chicago Great
Western Railroad Company's right of
way to the westerly line of the pro-
posed extension of Pine street by tak-
ing twenty -five feet off from the
southerly side of Lot 1 of 8 of Min-
eral Lot 322, therefore
Pe it Resolved by the City Council
of the City of Dubuque, Iowa, That
the City Engineer be and he is hereby
directed to make a plat and survey
of such proposed improvement, show-
ing the land or lots through or over
which the same is proposed to be
made, the names of the owners there_
of, and the quantity of land proposed

When said plat is so prepared, said

-Ordinance regulating and providing
for an additional tax on the traffic in
intoxicating liquors in the City of
Dubuque, Iowa, adopted December
18th, 1908, be amended to read as fel-
lows:
Section 2. That there shall be as-
sessed against each and every person
within the City of Dubuque, (other
than registered pharmacists holding
permits in compliance with law,) en-
gaged in selling and keeping with in-
tent so to sell intoxicating liquors, and
.against any real estate and the owners
thereof wherein or whereupon intox-
icating liquors are sold or kept
with intent to sell, a tax of Four Hun-
dred ($400) dollars yearly, payable in
, - _four equal installments, quarterly, in
advance, on the first day of January,
April, July and October of each year,
the first quarterly payment hereunder
to become clue on the first clay of July,
A. D., 1913. Said taxes shall be assess-
ed by the City and shall go int
the general fund of the City, and shall
ne a perpetual lien on all property,'
both real and personal, used in con-
nection with sucn business, and shall
- constitute a valid claim against the
persons engaged in such business and
against the owners of real estate'

gineer be instructed to set stakes en
Solon Street showing the grade and
that Mr. J. Kintzinger be allowed to
grade said Street under the supervis-
ion of the City Engineer. Carried.
Ald. Saul moved that the Sidewalk
Inspector be instructed to inspect the
sidewalk and area -ways on the south-
east corner of Third and Bluff Street
and report back to the Council. Car-
ried.
Ald. Saul moved to have the report
of the Committee of the Whole read.

Your Committee of the Whole would
respectfully recommend that the City
saloon license be fixed at $400.00 per
annum, payable quarterly, and that
the City Recorder be instructed to no-
tify all saloonkeepers to this effect,
and also that it is the intention of the
City Council to reduce the number of
saloons in the city, on or before July
1st next, by twenty -one, and notifying
them further, that those among them
who desire to continue in business
after said date, must file their appli-
cation for consent on or before the 2nd
day of June, 1913, and accompany said
application with a certified check for
$100.00, as a guarantee of their good
faith in making said application
which check will be returned to those
whose applications are rejected, We
further recommend that the Ordinance
Committee and City Attorney amend
the present ordinance to conform
herewith.

Be It Ordained by the City Council
of the City of Dubuque:
Section 1. That a grade on Wilson
Avenue from Julien Avenue to West
Eighth Street be and the same is
hereby established and adopted as
shown by the profile of said street
and grade prepared by the City En-
gineer, being Profile No. 773, B. M.:

intoxicating liquors in the City of
Dubuque. Iowa, adopted December
18th, 19098, be amended to read as
follows:
Section 2. That there shall be as-
sessed against each and every person
within the City of Dubuque, (other
than registered pharmacists holding
permits in compliance' with law,) en-
gaged in selling and keeping with in-
tent so to sell intoxicating liquors, and
Official Notices
against any real estate and the owners
thereof wherein or whereupon intox-
icating liquors are sold or kept
with intent to sell, a tax of Four Hun-
dred ($400) dollars yearly, payable in
four equal installments, quarterly, in
advance, on the first day of January,
April, July and October of each year,
the first quarterly payment hereunder
to become due on the first day of July,
A, D., 1913, Said taxes shall be assess-
ed by the City and shall go int')
the general fund of the City, and shall
oe a perpetual lien on all property,
oath real, and personal, used in con-
nection with sucn business, and shall
constitute .. a valid claim against the
persons engaged in such business and
against the owners of real estate
wherein or whereupon said business is
conducted.
Section 3. This Ordinance shall be
in force and effect froni and after its
passage by the . City Council, and its
publication in the official newspapers
of the City.. -
