Notice to Contractors.
Sealed proposals will be received at
the office of the City Recorder until
2 p. in. Thursday, May 29, 1913, for the
construction of a retaining wall on the
south side of Seminary street, east of.
Foye street, in accordance with the
plans and specifications prepared by
the City Engineer and now on file in
the office of the City Recorder.
It is estimated by the City Engineer
that it will require:
245 cubic yards of dry wall masonry.
40 cubic yards of concrete footing.
Bidders must state price per cubic
yard of dry wall masonry and per
cubic yard of conerete footing.
Each bid must ne accompanied by a
certified check for $200.00 on some Du-
buque bank as a guarantee 'that a con-
tract will be entered into if awarded.
The city reserves the right to reject
any and all bids,

AN ORDINANCE AMENDING AN
ORDINANCE REGULATING AND
PROVIDING FOR AN ADDITION-
AL TAX ON THE TRAFFIC IN IN-
TOXICATING LIQUORS IN THE
CITY OF DUBUQUE, IOWA,
ADOPTED DECEMBER 18TH, 1908.
Be it Ordained by the City Council
of the City of Dubuque, Iowa:
Section 1. That Section one of the
Ordinance regulating and providing
for an additional tax on the traffic in
intoxicating liquors in the City of
Dubuque. Iowa, adopted December
18th, 19098, be amended to read as
follows:
Section 2. That there shall be as-
sessed against each and every person
within the City of Dubuque, (other
than registered pharmacists holding
permits in compliance' with law,) en-
gaged in selling and keeping with in-
tent so to sell intoxicating liquors, and
Official Notices
against any real estate and the owners
thereof wherein or whereupon intox-
icating liquors are sold or kept
with intent to sell, a tax of Four Hun-
dred ($400) dollars yearly, payable in
four equal installments, quarterly, in
advance, on the first day of January,
April, July and October of each year,
the first quarterly payment hereunder
to become due on the first day of July,
A, D., 1913, Said taxes shall be assess-
ed by the City and shall go int')
the general fund of the City, and shall
oe a perpetual lien on all property,
oath real, and personal, used in con-
nection with sucn business, and shall
constitute .. a valid claim against the
persons engaged in such business and
against the owners of real estate
wherein or whereupon said business is
conducted.
Section 3. This Ordinance shall be
in force and effect froni and after its
passage by the . City Council, and its
publication in the official newspapers
of the City.. -

City Engineer Daniels reported Tibey
Bros. the lowest bidders for construct-
ing the storm water sewer in West
12th Street. Ald. Wallis moved that
the contract be awarded, to Tibet'
Bros., they •being the lowest bidders
and their bond placed at one - fourth the
amount of the. contract. The work to
be done under the direction of the City
Engineer and Street Committee. Work
not to exceed the appropriation of
$400.00. Carried. _

City Engineer be and he is hereby di-
rected to prepare a plan and specifi-
cations for an eight -inch tile pipe
sanitary sewer in the alley between
Elm and Pine Streets from Thirteenth
to Fourteenth Streets, . showing the
locations and general - nature - of such
improvement, the extent thereof, the
size and kind of material to, be used,
and to prepare an estimate of the
cost thereof and the amount assess -
able upon each lot or parcel of land_
adjacent to ''bl, abutting, per
front feet or square feet in area, and
to file such plat, specifications and
estimate in the office of City Recor-
der.
That after such plat is so filed, the
City Recorder shall cause to be pub-
lished notice of the intention of the
Council to make such improvement,
which notice shall be published in
three consecutive issues of the of-
ficial paper - of the City of Dubuque,.
stating that such plat is on file, and
generally the nature of the sewer, its
location, size and kinds of material
to be used, and the estimate of its
cost, and 'fixing the time before which
objections can be filed, which time
shall not be less than five days after'
the last publication of said notice,.
and after the completion of the pub-
lication of such notice, he shall at
its next session, notify the Council
thereof in writing with a printed
copy of such notice accompa„nying the
same.

Be it Ordained by the City Council
of the City of Dubuque:
Section 1. That Section 10 of the
Ordinances for carrying into effect
certain rules, regulations and provis-
ions of the Board of Health of the
City of Dubuque, Iowa, and providing
a penalty for violations thereof, adopt-
ed March 21st, 1907, be repealed, and
the following adopted in lieu thereof:
"Sec. lo. GARBAGE COLLECTED
AND REMOVED. Householders, own-
ers, lessors, lessees, managers and
agents of any building or tenement,
restaurant or hotel within the City of.
Dubuque where slops, or decaying
vegetables accumulate, shall provide,
keep and cause to be used a galvan-
ized iron can with tight cover for such
waste in a convenient place for re-
moval from premises designated by
the City Council as the scavenger dis-
trict, the collecting thereof to be done
by the City Scavenger."
(a) That galvanized iron cans be
provided as in said Ordinances, re-
quired and shall be of sufficient dimen-
sions to contain all garbage and other
matters therein to be deposited, so
that the said cans shall not overflow
and the cover at all times be kept on
the same. Said cans to be so equipped
and of such size that they can be
readily handled by the garbage col- -
lector on his regular rounds.
(b) It shall be the duty of every
person making use of such galvanized
iron cans, to properly drain all garbage
and other refuse placed in such cans
so that there shall be no unnecessary
liquids therein, and there shall not be
placed in such cans anv articles or
substances which are not required to
be collected by the garbage collector,
and which under the terms of the
contract entered into with the City of
Dubuque by said garbage collector, in-
clude only garbage, swill, slops, table
refuse, decayed or spoiled fruit, fish,
meat, vegetables, or tin cans containing
any decayed or spoiled fruit, fish,
meat, or vegetables, all other matters
and substances to be deposited in sep-
arate receptacles as otherwise provid-
ed in the rules and regulations of the
Board of Health and the Ordinances
of the City of Dubuque.
This Ordinance shall be in force and
effect from and after its passage and
its publication in the official news-
papers.

Mayor Lyons stated that the object
of the meeting wds to take action on
the reports of the Special Committee
appointed to make arrangements for
the opening of a street and water way
from Alpine Street to Alta Vista
Street and also for the widening of
Blocklinger Lane from Couler Avenue
to Broadway.
Alderman McLaughlin submitted the
following:
Your Special Committee, to whom
was referred the matter of making
arrangements to secure a etreet and
water way from Alpine Street to Alta
Vista Street, would respectfully report
that we can secure lot 10 in Martin's
Dubuque for 31,000, and • Lots 2 of 55
and 2 of 1 of 56 in Oxford Heights for
$650. As we consider that a forty
foot- street is ample for the purposes
contemplated, we agreed, subject to
the approval of the City Council, to
sell the northerly ten feet of said Lot
10 to John Phillips, the owner of the
adjoining lot for 3200, so that we
might have more money to apply on
the contemplated storm sewer. We
respectfully recommend that the pro-
perty above described be secured for
the purposes stated, and that war-
rants be ordered drawn in favor of
the Mayor for the total amount of
$1.450 in nayment thereof, and that the
deeds and plat of said property, when
secured and approved by the City At-
torney, be placed on record in the
office of the County Recorder.

posed widening of Blocklinger Lane
from Couler Avenue to Broadway.
would respectfully report that we held
a meeting with the parties interested
ir the proposed improvement and in-
formed them that the jurors selected
to make the appraisement of the dam-

ages caused the abutters by said pro-
posed widening had awarded the sum
of $650. for the southerly ten feet of
Lots 3 and 4, and $1,000 for the south-
erly ten feet of Lot 5, all in Wull-
weber's subdivision. - Mr. Albert
Jaeggi had already agreed to accept
$1,250 for the southerly ten feet of Lot
11 in the same subdivision, making a
total cost for the property required
for the widening of $2,900. In order to
pay this amount the City has appro-
priated 31,200, and parties interested
$1,575, leaving a balance of 3125 un-
provided for. As the improvement is
acknowledged to oe a very necessary
,one, and as those interested have done
all that can be expected of them, we
respectfully recommend that the dif-
ference be paid by the City from the
General Expense fund, and that war-
rants be ordered drawn on the City
Treasurer in favor , of the Mayor, to be
paid C. Steiner, Josephine Wander -
scheid estate, and Albert, Adolph and,
Joseph Jaeggi for $650, $1,000 and $1,250
respectively, upon the approval of the
abstracts and deeds to said property
by the City Attorney, and that when
said transfers are completed, the City
Recorder shall cause said deeds, to-
gether with a plat of said street as
widened, to be filed for record in the
office of the County Recorder.

West Locust Street to a point about
one hundred and fifty (159) feet easi
of Catharine Street be improved on
the switchback principle, with neces-
sary stone retaining wall, parapet and
riprapping, by 'grading, curbing and
guttering with combination cement
curb and gutter, and macadamizing
said portion of said street, in accord-
ance with the plans and specifications
for such improvement prepared by
the City Engineer and now on file in
the office of the City Recorder, and,
be it further
Resolved, That said improverri,ent
shall be completed on or before the
1st day of September, 1913, and shall
be paid for in the manner prescribed
by Chapter XXX'II; of the Revised
Ordinance of the City of Dubuque for
the payment of the cost of street im-
provements.
The proposals for doing said work
shall be acted upon by the Council
en the 19th day of June, 1913, and
the City Recorder is hereby ordiered
to give ten days' notice by publica-
tion asking for proposals as pro-
vided by ordinance.

City Council of the City of Dubuque,
That to provide, for the cost of curb-
ing, guttering and macadamizing the
westerly side of Elm Street from
Twenty- fourth to Twenty- seventh
Street, the Mayor be and he is hereby
required to execute and deliver td the
City Recorder, to be by him registered
and cdtintersigned, eight bonds for
two hundred and fifty dollars each and
one bond for two huridred severity =two
and 27 -100 dollars, numbered 1776 to
1784 inclusive, dated June 21st, ' 1913,
payable on or before seven year after
the date thereof, and bearing interest
at the rate of five per 'cent per an-
num, payable semi - annually.

Mayor Lyons stated that this meet-
ing is called for the purpose of re-
voking twenty -one saloon permits in
the City of Dubuque, Iowa, and any
other business that mignt come before
a regular meeting of the City Council.
Ald. Frith moved tt. nave the re-
port of the Committee of the Whole
read. Carried.
Your Committee of the Whole, act-
ing on the petitions of the retail liquor
dealers of the city asking for permis-
sion to continue in the business after
July 1st, 1913, would respectfully report
that under the statutes of Iowa, it
becomes obligatory on the part of the
City Council to reduce the number of
saloons in operation in excess of one
for each one thousand of the city's pop-
ulation by one -third before July 1st
next, and in accordance with said
provision, we respectfully recommend
that the resolutions of consent to sell
intoxicating liquors issued to the fol-
lowing named retail liquor dealers be
revoked, and that all rights granted
thereunder shall cease and determine

Your Committee of the Whore
would respectfully report that a joint
meeting was held by the Water Works
Trustees, Tibey Bros. and your com-
mittee relative to the best means to
pursue in order to lay the proposed
sanitary sewer in the alley between
Main and Locust Streets, there being
the main 20" water feeder on one
side of the alley, the high pressure
main on the other, and a 4" supply
pipe through the center, which latter
is directly in the line in which it is
proposed to lay the sewer. The
Water Works Trustees agreed that if
the contractor will guarantee to pro-
tect the 20" main from all damage,
they will remove the 4" pipe and
transfer the connections to the 20"
main. The Water Trustees to re-
move the said pipe as far north as
Third Street immediately, and, if
found! necessary after the contractors
have dug test holes further north, to
remove the entire line to Seventh
Street. The work to be carried on
simultaneously by both the contrac-
tors and the Trustees and each to
help the other so far as possible.
We respectfully recommend that
agreement be approved.

with asphaltic concrete on a cement
concrete foundation, in accordance with
the plans and specifications for such
improvement prepared by the City
Engineer and now on file in the office
of the City Recorder, and be it fur-
ther
Resolved, that said improvement
shall be completed on or before the
1st day of September, 1913, and shall
Lemon Street relative to the disposi-
tion of same. Carried.

Recorder instruct the Union Electric
Co. to stop all street cars on the near

southerly to West Fourth Street, did
petition the City Council, asking for
the vacation of said alley, and -
Whereas, Said petition was re-
ferred to the Committee of the Whjle,
which committee, on May 18th, 1911,
reported favorably thereon and rec-
ommended the vacation as prayed
for, which recommendation, through
some oversight, has not been complied
with, and
Whereas, It is now deemed advis-
able to complete the proceedings
necessary for such vacation; there-
fore
Be It Resolved by the City Coun-
cil of the City of Dubuque, that the
City Engineer be and he is hereby
instructed to make a survey and plat
of the alley so proposed to be va-
cated, to be filed in said Engineer's
office, subject to public inspection,
and give the notice required by or-
dinance to all owners of property
abutting said ground proposed to be
so vacated, and to publish the notice
required by ordinance of said pro-
posed vacation.

Mayor Lyons stated that this meet-
ing is called for the purpose of con-
sidering the changes in saloon loca-
tions and transfers, if any, and such
other business as may properly come
before a regular meeting of the City
Council.

To the Honorable Mayor and City
Council of the City of Dubuque,
Iowa.
Gentlemen: The undersigned, a
resident and qualified elector of Du-
buque, Iowa, states that beginning
midnight June 30, 1913, he is the as-
signee and grantee of a certain reso-
lution of consent heretofore adopted
by your honorable body consenting
that Frank P. Heim may sell and keep
for sale intoxicating liquors and deal
therein in the City of Dubuque, Iowa,
according to law, his place of business
being No. 3403 Couler Avenue in said
city, also located on Lot No. 2 of Min-
eral Lot No. 363 in said city; that said
resolution of consent has not been
canceled or withdrawn and is still in
full force, the party to whom issued
having in all things conformed with
the law of Iowa in respect of intoxi-
cating Liquors and otherwise; that the
undersigned as such assignee and
grantee desires to conduct the busi-
ness at the same place in the City of
Dubuque, Iowa, and thereby asks that
you cause the following resolution to
be adopted.

he being the assignee and grantee of
said Frank P. Heim, to whom such
resolution of consent still in full force
was heretofore granted by this coun-
cil, and this being a continuation of
such resolution of consent to said as-
signee, L. S. Heim, beginning mid-
night, June 30, 1913.

AN ORDINANCE AMENDING SEC -
TION 10 OF THE ORDINANCES
FOR CARRYING INTO EFFECT
CERTAIN RULES, REGULATIONS
AND PROVISIONS OF THE
BOARD OF HEALTH OF THE
CITY OF DUBUQUE, IOWA, AND
PROVIDING A PENALTY FOR
VIOLATIONS THEREOF, ADOPT-
ED MARCH 21, 1907.
Be it Ordained by the City Council
of the City of 'Dubuque:
Section 1. That Section 10 of the
Ordinances for carrying into effect
certain rules, regulations and provis-
ions of the Board of Health of the
City of Dubuque, Iowa, and providing
a penalty for violations thereof, adopt-
ed March 21st, 1907, be repealed, and
the following adopted in lieu thereof:
"Sec. 10.. GARBAGE COLLECTED
AND REMOVED. Householders, own-
ers, lessors, lessees, managers and
agents of any building or tenement,
restaurant or hotel within the City of
Dubuque where slops; or decaying
vegetables accumulate, shall provide,
keep and cause to be used a galvan-
ized iron can with tight cover for such
waste in a convenient place for re-
moval from premises designated by
the City Council as the scavenger dis-
trict, the collecting thereof to be done
by the City Scavenger."
(a) That galvanized iron cans be
provided as in said Ordinances re-
quired and shall be of sufficient dimen-
sions to contain all garbage and other
matters therein to be deposited, so
that the said cans shall not overflow
and the cover at all times be kept on
the same. Said cans to be so equipped
and of such size that they can be
readily handled by the garbage col-
lector on his regular rounds.
(b) It shall be the duty of every
person making use of such galvanized
iron cans to properly drain all garbage
and Other refuse placed in such can
so that there shall be no unnecessary
liquids therein, and there shall not be
placed in such cans anv articles or
substances which are not required to
be collected by the garbage collector,
and which under the terms of the
contract entered into with the City of
Dubuque by said garbage collector, in-
clude only garbage, swill, slops, table
refuse, decayed or spoiled fruit, fish,
meat, vegetables, or tin cans containing
any decayed or spoiled fruit, fish,
meat, or vegetables, all other matters
and substances to be deposited in sep-
arate receptacles as otherwise provid-
ed in the rules and regulations of the
Board of Health and the Ordinances
of the City of Dubuque.
This Ordinance shall be in force and
effect from and after its passage and
its publication in the official news -

struction of an 8 inch tile pipe sewer
in Walnut street from a point about
opposite the northerly line of Lot 8
in Bissel's Dubuque, northerly to the
present sewer in West Fourteenth
street. in accordance with the plans
and specifications prepared by the
City Engineer and now on file in the
office of the City Recorder. It is es-
timated by the City Engineer that the

Notice to Sidewalk Contractors.
On and after the 24th day of May,
1913, all sidewalks constructed on the
streets of the City of Dubuque, will be
subjected to the ordinance relating to
building of permanent and temporary
sidewalks in the City of Dubuque.
This ordinance requires all con-
tractors to apply for permits for all
sidewalks they build in the city of
Dubuque, and to file a, bond with the
City Recorder in the sum of 51,000.00
subject to the approval by the City
Attorney, condition that they will hold
the city harmless from damage be-
cause of the carelessness of himself or
his employes while constructing said
walks and as a guarantee of proper
construction of the work.
All sidewalks shall be constructed
according to the specifications on file
in the office of the City Engineer.

Section 1. That a grade on Walnut
St eet from West Fourteenth Street to
Chestnut Street be and the same is
hereby established and adopted as
shown by the profile of said street and
grade prepared by the City Engineer,
being Profile No. 768. B. M.: Coping
on wall N. W. corner Chestnut and
Walnut Streets, elevation 255.66.
Said grade begins at the south curb
line of West Fourteenth Street, which

Sealed proposals will be received
at the Council Chamber, City Hall, by
the City Recorder until 8:00 P, M.
Thursday, July 3, 1913, for the con-
struction of an 8 -inch tile pipe sani-
tary sewer in the alley between Elm
and Pine streets, from Thirteenth
street to Fourteenth street, in accor-
dance with the plans and specifica-
tions prepared by the City Engineer
and now on file in the office of the
City Recorder. It is estimated by the
City Engineer that said improvements
will require:
260 lineal feet of 8 -inch tile pipe.
1 manhole.
Bidders will state price per lineal
foot of completed sewer: also state
price per manhole.
The work to be paid for when said
work is completed and as prescribed
by Chapter XXXIV of the Revised
Ordinance of 1901 of the City of Du-
buque, work to be completed on or
before the 1st., day of August, 1913.
Each bid to be accompanied by a
certified check of $20.00 on some Du-
buque bank as a guarantee that a
contract will be entered into if award-
ed.
Check and bid in seperate envelope.
The City Council reserves the right
to reject any and all bids.

The work to be paid for when said
work is completed and as prescribed
by Chapter XXXII. of the Revised
Ordinances of 1901 of the City of Du-
buque. Work to be completed on or
before the 1st day of September, 1913
Bidders must state price per cubic
yard for dry stone wall; price per
square yard for rip rap; price per
lineal foot for combination cement
curb and gutter; price per square yard
for macadam; the cost for grading to
he bid in total. The City Engineer
will show the location of this work to
all Contractors who wish to bid. It
will be necessary for the Contractor to
