Ald, Saul moved to open all bids. Carried. Bids for improving Third Street — Kenety & Lee: Brick block paving, per square yard average $2.95; new curbing, per lineal foot 82 cents; 6 "x30" headers, 90 cents; 6 "x14" head- ers, 65 cents; reset curbing, per lineal foot 30 cents; concrete block under ties, per lineal foot $1.00. C. B. McNamara & Co.: Curbing, per lineal foot 75 cents; reset curbing, per lineal foot 35 cents; headers, 6 "x14 ", 60 cents; headers, 6 "30 ", 87 cents; brick block on 6 -inch concrete outside street car tracks, $2.85; brick block, 6 -inch concrete under ties on railroad tracks, $3.75; cement block put in place same as concrete, 95 cents per lineal foot. Ald. Saul moved to refer bids to the City Engineer and he to report later in the evening. Carried. Improvement of Wrest Fifteenth Street — Wilmer Cook: Grading, per cubic yard 40 cents; combination curb and gutter, per lineal foot 65 cents; ma- cadam, per square yard 85 cents. C. B. McNamara & Co.: Grading, per cubic yard 60 cents; combination curb and gutter, per lineal foot 67 cents; macadam, per square yard 70 cents. Ald. Singrin moved to refer bids to the City Engineer and he to report later in the evening. Carried. Improvement of alley between Mt. Rose and Sixteenth Street — C. B. McNamara & Co.: Concrete, Ter square yard $1.50; grading, per cubic yard 50 cents. Thos. R. Lee: Concrete, per square yard $1.29. Ald. Wallis moved that the contract be let to Mr. Lee, he being the lowest kidder. Carried. Brick guttering on Julien Avenue— _ C. B. McNamara & Co.: Brick gut- ter, $2.25 per square yard. Thos. R. Lee: Brick gutter, $1.98 per square yard. Ald. McLaughlin moved that the contract be let to Mr. Lee, he being the lowest bidder. Carried. Improvement of Vernon Street from Mt. To the Honorable Mayor and City Council of the City of Dubuque: Gentlemen: I herewith return the petitions of the Dingman Ball estate, Jacob Welty and Nicholas Glab, in each of which petitions the petitioner objects to a special assessment levied against their respective properties for the construction of sanitary sewers and in each case the petitioner con- tends that there has been levied and paid special assessments against the same property for the construction of other sewers abutting the same. Under the law as it exists at this time, special assessments can only be levied according to the benefits con- ferred upon the property by the im- provement. It is my opinion that a second sewer abutting any particular lot would confer no additional benefit thereon providing the sewer first con- structed was still in working order, serviceable and properly drained the territory through which it ran. Eacn instance of this character, however, must be governed by the facts in the particular case. Referring to the petitions returned herewith, if the Council is satisfied that the sewer for which an assess- ment was levied and paid is still in working order, a second assessment for a sewer running along another side of the respective lots would in my opinion confer no benefit upon them, and the prayers of the petition- ers should be granted. If, however, from long usage they have become worn out, defective or insufficient and a new sewer was constructed because of such fact, then the second assess- ment would be legal and proper. Mayor and City Council of the City of Dubuque: Gentlemen: I herewith return the petition of the Illinois Central Railroad Company, which was presented to the Board of Review of the City of Du- buque, and wherein they complain and object to the assessment returned by the City Assessor against what is known as The Banana Cooling Plant," located within the city limits of Du- buque. Under Section 1334 of the Code of 1897, it is made the duty of the Exe- cutive Council of the State of Iowa to assess all the property of railway cor- porations in the state excepting lands, lots and other real estate belonging thereto not used in the operation of a railway, and excepting railway bridges across the Mississippi and Missouri rivers, and excepting grain elevators. The property of such corporations is not subject to assessment by the local authorities except as above indicated, and it is my opinion that if the con- tention of the railroad company as ex- pressed in their petition, that the warehouse which is constructed within the limits of the city Is exclusively used in the operation of its railroad, for the purpose of storing or taking in fruit which has been shopped upon or over the line of said company, is,borne out by the facts, then the assessment as returned by the City Assessor is er- roneous and invalid and should be can- celled as prayed in the petition. If, however, the lessee, the Fruit Dispatch Company uses the premises for any other than railroad purposes, then it would be subject to local taxation and the assessment would stand providing the sum for which it is assessed is not excessive. I have made some Investigation id an attempt to ascertain the true facts regarding the matter and from the in- formation I receive it appears that the sheds are used exclusively for the purposes stated in the petition, and are not used in any manner which would authorize the levy of a local assess- ment against the property. Under Sec. 1342 of the Code of 1897. railway bridges across the Mississippi river are subject to assessment and taxation on the same basis as proper- ty of individuals in the several coun- ties where situated, and it is my opin- ion that the City Assessor has a right. to assess the property as a whole, in- cluding the approaches thereto, with- out specifically setting out the sepa- rate items 'going to make up the valu- ation placed upon the bridge, and he Lad a right in reaching his conclusion as to its valuation, to take into con- sideration the fact that it was a go- ing concern and any other facts which would tend to give value to the property. I have been informed by the As- sessor that the value placed upon this property for the year 1911, is the same - as was placed upon it for a number of years in the past and is as return- ed by a represntative of the bridge company, and would therefore recom- mend that the petition be received and filed.
