WAIVER.
In consideration of the permission
granted to me by the City of Du-
buque to connect with the sewer in
the alley between, Race and Walnut
Street in the City of Dubuque, and
for which sewer there has never been
an assessment levied as against Lot 6,
in Cummings' Subdivision to the City
of Dubuque, and which lot I now
own, I do hereby agree for myself
assigns and grantees, to pay for any
assessment which may at any time
be levied for the construction of a
sanitary sewer in any street, alley or
avenue adjacent to said lot now own-
ed by me, and I wave any rights 1
might have in avoidance of said as-
sessment by :reason of said connec-
tion, having already been made with
said sewer above referred to, or for
any other reason. This waiver to be
subject to the approval of the City
Council of said City and to be bind-
ing when so approved.

Sealed proposals will be received at
the Council Chamber; City 'Hall, by
the City Recorder, unil 8:00 p. ni.
Thursday, October 17, 1912, for an 8-
inch tile pipe sanitary sewer in Delhi
Street from the present manhole
which is about opposite the line divid-
ing Lots 4 and 5 in Hughes' Sub.,
westerly to the present sewer at the
intersection of Grandview Avenue, in
accordance with the plans and speci-
fications prepared by the City Engi-
neer and now en file in the office of
the City Recorder.
It is estimated by the City Engineer
that it will require:
490 lineal feet 8 -inch tile pipe,
3 manholes.
Bidders will state price per lineal
foot of completed sewer, also price
per manhole complete.
The work to be paid for when said
work is completed and as prescribed ,
by Chapter XXXIV, of the Revised
Ordinances of 1901 of the City of Du-
buque, work to be completed on or be-
fore the 1st day of November, 1912.
Each bid must be accompanied by a
certified check for $20.00 on some Du-
buque bank as a guarantee that g
contract will he entered into if
awarded.
The City reserves the right to reject
any and all bids.

provided by law, will be levied at a
session of the City Council to be held
October 17, 1912, to pay for the sani-
tary sewer in Wooten Avenue, from
South Hill Street to McClain Avenue,
Tibey Bros., contractor -,
Amount of special assessment, $241.15.

of the first part herein, be changed so
that planking may in part be substi-
tuted in lieu of such brick paving,
And, whereas it is agreeable to the
said C. B. McNamara & Co., contract-
ors for said improvement, that such
change be made upon the terms and
conditions herein set forth,
Now, therefore, the said City of Du-
buque does hereby consent to allow
the said railroad companies to plank
said Third Street froth the end of the
ties of the most westerly rail of the
said Chicago, Milwaukee & St. Paul
Railway, to the end of the ties of the
most easterly rail of the Chicago, Bur-
lington & Quincy Railway Company's
track, known as its "passing track."
And the said Chicago, Burlington &
Quincy Railway Company is also to
he ] ermitted to substitute plank be-
tween the rails and to the end of the
ties in its "depot track," and also in
its "house tracks" Nos. 1 and 2.
The planking is to be of good 4 -inch
oak plank properly laid, and is to
cover the area shown by the spaces
marked in red on blue print hereto
attached as part hereof.
The undersigned railroads, and each
of them,• do further agree to protect
the said C. B. McNamara & Co., con-
tractors, in that they will purchase
from the latter the cetnent blocks
(some 210 in number), now procured
for said improvement, at the price of
$2.25 each, and they also agree to re-
imburse the said C. B. McNamara &'
Co. for all brick now ordered by them
and which would have been used in
place of the planking now substituted
in the improvement of said Third
Street.
The spaces to be planked as herein -
before specified are indicated in red
ink on the blue print of said improve-
ment attached hereto and hereby re-
ferred to.
The undersigned railway companies
do further agree 'in consideration of
the changes and modifications made
as set forth in this agreement, to pay
all assessments which may be levied
against them, respectively, for the im-
provement of said Third Street, waiv-
ing all objections of a jurisdictional
or any other nature, if any there may
be.
The undersigned C. B. McNamara &
Co. express full acquiesence in the
modifications made as hereinbefore
set out, and waive all claims to dam-
ages or otherwise which they might
have against the said City of Dubuque
by reason of the changes made as
herein set out.
The undersigned railway companies
do further agree, respectively, to main-
tain the said planking in good repair
satisfactory to the City Council of
said City, and to make all necessary,

reasonable alterations and changes
which may be required by the City of
Dubuque from time to time for the -
safe and proper use of said Third
Street for street purposes.
This agreement is not to be deemed
a waiver on the part of said City of
Dubuque of its right to require a
pavement to be constructed in lieu of
such planking and assessed against
said railway companies respectively,
at any time when such improvement
nia' be deemed necessary or desirable
by said City.
Ald. Frith moved that the prayer of
the petitioner be granted provided
parties sign agreement in five days.

City Recorder Shea presented the
notice, certified to by the publishers, of
the Council's intention to levy a spec-
ial assessment to pay for reguttering
Julien Avenue from the west line of
Alta Vista Street to the east line of

Ald. Heim moved that the notice be

of Ald. Wallis the prayer of the peti-
tioners was granted.

Petition of Thos. Hackney relative
to an increase of $5.00 per month in
salary was on motion of Ald. Frith re-

Communication of Fire Chief Rein -
fried relative to closing the "Dream-
land theatre," presented and read.
Ald. Wallis moved that the rules be
suspended for the purpose of allowing
the interested parties to address the
Council.

Ald. Andresen moved that the
"Dreamland theatre" close tonight, re-

Petition of Liza Crunnion asking to
have her taxes on lot 9, Summer Hill
Add., canceled for the year 1911 was
on motion of Ald. Frith referred to the
Delinquent Tax Committee.

Ald. Frith moved that the Fire Chief
be instructed to notify all theatres to
keep chairs and all other obstructions
out of aisles and gang ways. Carried.
Petition of the Sisters of Charity, B.
V, M., asking to be granted permis-
sion to erect a frame building, covered ,
with galvanized iron sheeting, in rear
of St. Joseph's Academy, signed by
abutting property owners, presented
and read.
Ald. Andresen moved that the prayer
of the petitioner be granted, providing
metal lath be used. Carried.
Petition of Mary A. Dolan, asking to
have her taxes on the west 1 -2 of lot
62, Union Add., canceled, was on mo-
tion of Ald. Frith referred to the De-
linquent Tax Committee.
Remonstrance of Chas. Krumbach,
et al, relative to the establishment of
a water way from Alpine Street to S.
Alta Vista Street,' presented and read.
Ald. McLaughlin moved the rule be
suspended for the purpose of hearing
from the interested parties.

Ald. McLaughlin moved that the re-
monstrance be referred to the Com-

Petition of J. Keckevoet asking to
be allowed to fence in a part of the
Ice Harbor for the purpose of conduct-
ing a skating rink, was on motion of
Ald. Saul received and filed.
Notice of appeal of the Dunleith and
Dubuque Bridge Co. against the as-
sessment returned by the City Assesor
presented. On motion of Ald. Frith
notice was referred to the Committee
of the Whole.
Notice of appeal of the I. C. R. R.
Co. against the assessment returned,
by the City Assessor presented. Oh
motion of Ald. Frith notice was re-
ferred to the Committee of the Whole.
City Engineer Baumgartner report-
ed that Kenety & Lee are the lowest
[Adders, according to plans and spe-
cifications, for the brick block paving
of Kaufman Avenue. Ald. Frith mov-
ed that Kenety & Lee be awarded the
contract and their bond placed at one -
fourth the contract. Carried.
This agreement entered into this
14th day of October, 1912, by and
between the Chicago, Milwaukee & St.
Paul Ry. Co.; the Illinois Central
Railroad Company, and the Chicago,
Burlington & Quincy Railway Co.; and
C. B. McNamara & Co., of the first
part, and the City of Dubuque, of the
second part, witnesseth,
That, whereas the said C. B. Mc-
Namara & Co., contractors, have en-
tered into a contract with the said
City for the paving of Third Street
from easterly lot line of Iowa Street
to westerly end present brick paving

MAYOR LYONS' ADDRESS.
"In municipal government whatever
leads to the dissolution of the social
organ is forbidden. That also is for-
bidden which ruins private property,
the foundation stone upon which rests
the social structure, whether in the
individual or in the collectivity elimi-
nate, destroy or minimize unduly its
rights, make it insecure or profitless
and you will have ruled that labor is
not worth the fatigue, that indolence
and improvidence are privileges to be
sought for. You will have stilled per-
sonal and municipal progress. You
will have driven back the human race
to the chaos of barbarism and sav-
agery. There are two things to be
especially considered in government,
the first is that in the enactment of
all legislation no advantage should be
given the one person over another. If
that advantage can be avoided. It is
the duty of government to protect all
from injustice and to do so without
showing partiality to anyone or any
class.
"Again, government must restrain
men from injuring one another.
Thomas Jefferson declared this to be
one of the important duties of gov-
ernment, and the government which
does not restrain the strongest citizen
from injuring the weakest citizens,
fails to do its whole duty. Let me
warn you against confusing govern-
ment itself with the abuses of govern-
ment. Andrew Jackson said that there
were no necessary evils in government,
that its evils existed only in its
abuses. He was right, my friends.
"There are no necessary evils in
government and no man who under-
stands the advantage of government
will ever raise his voice or hand
against it. It is the abuses of gov-
ernment against which we have a
right to complain. There are those
who stand ready to denounce as a
disturber of the public peace anyone
who criticizes the abuses of govern-
ment and his denunciation is generally
most severe from those who are en-
joined. The advantages which arise
from the abuses of which they com-
plain.
"What is the manifest duty of all
statesmanship? It is to see that this
great body of people who constitute
the strength of our city are properly
dealt with by the laws and properly
nurtured and taken care of by the
policy of our city.
"You know that communities are
not distinguished by exceptional men.
They are distinguished by the average
of their citizenship. It therefore be-
comes the city's business to establish
and maintain every condition which
will assist the people to sound, whole-
sale and successful business life. It is

in this sense that government becomes
the instrument of humanity and of
social betterment. And it is for this
reason that I want to keep tax levy
where it rightfully belongs."

levy of 1911 and that fourteen and
one -half mills will be barely sufficient
to cover the absolute necessary ex-
penditures for the coming year, and
"Whereas, we believe the progress,
upbuilding and financial stability of
the city is the wish of all good citi-
zens and taxpayers, and
"Whereas, we believe the pursuit
of said progress, upbuilding and fin-
ancial stability of the city to be our
duty rather than the playing of poli-
tics, and
"Whereas, we regret the attitude of
the mayor in looking to the political
effect of his action (in vetoing the
fourteen and one -half mill levy fixed
by the council) rather than to the
welfare, advancement aid financial
integrity of the city,
"Be it resolved, that the resolution
'submitted November 11, 1912, by the
committee of the whole, adopted by
the council and vetoed by the mayor,
which resolution fixed the tax levy
for 1912 at fourteen and one -half
mills, be and is hereby adopted over
the veto of the mayor."

few taxpayers of this city, last year,

the Brunswick: - Balke - Collender Com-
pany plant, and
Whereas, The members of the Du-
buque Industrial Corporation, com-
prising a very few of the taxpayers of
the city of Dubuque, have. pledged
themselves to the expenditure of $20,-
000 00 per year for five years for the
purpose of helping make Dubuque
grow, and

Dubuque Industrial Corporation have
also contributed liberally by their own
private subscriptions to various civic
improvements and will continue to
contribute liberally, and
Whereas, The total amount of con-
tributions of the members of the Du-
buque Industrial Corporation in the
five years since the inception of the
organization will probably represent
a grand total of close to $300,000.00,
which is approximately equal to the
sum that is now spent by the city of
Dubuque each year in the mainten-
ance of the city government, and
Whereas, The expenditure of this
vast sum of money by private indi-
viduals, who by the way are among
the heaviest taxpayers of this city, is
the strongest possible guarantee of
the faith which the members of the
Dubuque Industrial Corporation have
in the future growth of Dubuque and
the accompanying enhancement in the
value of real estate in the expansion
of business, and the development of
social and industrial advantages, and
Whereas, During the corning year
of 1913 certain definite improvements
for which the Dubuque Industrial
Corporation has been working should
be carried out by the city council as
a guarantee of the faith of the peo•
ple and of the City Council in the fu-
ture growth of Dubuque, and
Whereas, Among such improve-
ments it seems necessary that the so-
called "moonlight schedule" of street
illumination should be abolished;
That the town clock should be il-
luminated for the benefit of all the
people;
That street betterments should be
undertaken on a more extensive scale
than ever before in order to repair the
damages of the past season;
That a suitable fund should be
placed at the disposal of the Levee
Improvement Commission for the pur-
pose of at least cleaning up the river
front;
That the land on which Eighth
street, for which condemnation pro-
ceedings were recently instituted,
should be purchased in order that one
of the main arteries of the city may
be widened and improved;
That the scope of the work of the
board of health should be broadened
so that another sanitary inspector
may be employed and the health of
the community may be more carefully
safeguarded;
That a more efficient collection of
garbage, filth, ashes, etc., should be
undertaken for the purpose of keep-
ing the city in a clean and healthy
condition;
That some small financial assist-
ance should be given to the mainten-
ance of the free public bathing beach
instituted last summer and
That as soon as possible a fund be
provided for the purpose of re-as-
sessing the real estate of the city of
Dubuque and placing the assessments
on an equitable basis, and
Whereas, The construction of the
new Summer hill road may require
the assistance of the city council, and
Whereas, At the present moment,
when the civic conscience is aroused,
thee ity is growing and new demands
are to be made, other projects will
doubtless be placed before the mem -
bers of the city council;
Therefore, Be It Resolved by the
Municipal Affairs Committee of the
Dubuque Industrial Corporation, That
the city is growing and new demands
urged to provide ample appropria-
tions for the carrying out of these
various projects enumerated above
which have our hearty endorsement,
and which we believe have the hearty
endorsement of all good citizens who
have the best interests of Dubuque at
heart and who have come to under-
stand that the cost of public im-
provements in a thriving city increases
the value of private property and
thus, ultimately, finds its way back
into the taxpayer's pocketbook, and
Be It Further Resolved, That it is
the sentiment of the Municipal Af-
fairs committee that the levy to be
made by the city council for the com-

Gentlemen: I would respectfully call
Your attention to the fact that the
motor pumping engine will arrive in
the city in the early part of next
month and that necessary alterations
will have to be made in the house in
which it is proposed to locate the
same. The ought to be done before
the arrival of the engine, so that it
may be put into commission without
unnecessary delay. I would therefore
ask that von designate which house
you deem it advisable in which to
house said engine. Personally I would
recommend the, Central Engine House.
I would also state that it will be
necessary to purchase 1,000 feet of
hose for the department, as there is
not at present (Sufficient hose to
change off with what is being dried.

MAINTENANCE THEREOF.
Be it ordained by the City Council of
the City of Dubuque:
SECTION 1. That perm`ssion be and
the same is hereby granted to the
Chicago, Milwaukee & St. Paul Rail-
way Company, its successors and as-
signs, to lay, operate and maintain a
spur track from a point on the south-
erly line of Twelfth Street about one
hundred feet easterly from Pine
Street, thence running in a northerly
direction across Twelfth Street, curv-
ing slightly easterly for the purpose
of running an additional spur track
branching off from the present track
of said Company, at a point south of
Twelfth Street and extending into the
manufacturing plant o` the A. Y.
McDonald Manufacturing Company
lying northerly of said Twelfth Street.
SECTION 2. That the laying down
of said spur track shall be done under
the supervision of the City Engineer
and the Committee on Streets of said
city.
SECTION 3. That in the laying down
and operation of raid spur track the
same shall be so constructed and
maintained as to create the least pos-
sible ohrtrpction to ordinary travel
and the use of the street crossed.
That cars shall not be allowed to
stand in said street in such manner as
to unnecessarily interfere with the
pse thereof, and said track shall at
all times be used in accordance with
all lawful regulations now or here-
after enacted by said City.
SECTION 4. That said spur track
shall be laid to the established grade
of the street on the street which it
crosses and shou'd the grz.de he
changed at any time said track shall
be changed to conform with such
change in grade at the expense of
said Company without any claim
against said City.
SECTION ' 5. That said Company
shall keep the spice between the rails
of said spur track and the space at
the end of the ties so graded, that
carriages may easily pass over the
same and shall keep sucn spaces prop-
erly planked, paved or macadamized
or otherwise improved as the City
Council may direct, and shall keep any
sidewalk crossing said tracks proper-
ly planked or otherwise improved as
said City may direct.
SECTION 6. That said spur track
shall be so constructed and maintain-
ed as not to dam up or obstruct , the
flow or drainage of water in the gut-
ters or on the surface of said street,
and said Railway Company shall be
subject to and strictly comply with all
reasonable police regulations bearing
on the use and operation of said track.
SECTION 7. The City of Dubuque
hereby reserves the right to revoke
the privilege hereby granted at any
time after twenty years from the time
this ordinance becomes operative, or
sooner in case the said A. Y. McDon-
ald Manufacturing Company fails to
continue the operation of the plant
which said spur track continued is to
connect.
SECTION 8. That this ordinance
shall take effect and be in force from
and after its passage and publication
one time in the Dubuque Telegraph -
Herald and Dubuque Times - Journal,
official newspapers of said City, and
written acceptance thereof on the
part of said Chicago, Milwaukee & St.

whom was referred the petition of
the residents on West Locust Street,
asking for an extension of the street
car lines along said street, together
with a communication from the Union
Electric Company, asking that an ac-
companying ordinance granting it the
right to lay and operate such line be
granted and the remonstrance of the
Sisters of Charity, the School Board
and others against the use of Thir-
teenth to Sixteenth Street in connec-
tion with such extension, would re-
spectfully recommend that said re-
monstrances be received and filed, and
that in granting the prayer of the
petitioners, the attached ordinance be
substituted for that presented by the
Union Electric Company and that the
same be recommended for adoption.

Julien avenue to West Fourteenth
street, Wilmer Cook, contractor.

AN ORDINANCE ESTABLISHING A
GRADE ON THE WESTERLY
SIDE OF ELM STREET FROM
TWENTY- FOURTH TO TWENTY -
FIFTH STREET.
Be it Ordained by the City Council of
the City of Dubuque:
Section 1. That a grade on the
west curb of Elm Street from Twen-
ty- fourth Street to Twenty -fifth Street
be and the same is hereby establish-
ed and adopted as shown by the pro-
file of said grade prepared by the City
Engineer being Profile No. 763.
Bench mark: Water table northwest
corner of Building on the southeast
corner of Kniest Street and Eagle
Point Avenue, elevation 22.53.
Said grade begins at the north curb
line of Twenty- fourth Street, which
is Station 0, elevation 19.90; thence
to Station 6+8, south property line
of Twenty -fifth Street, elevation
west curb 21.10; thence to Station
6+16 south curb line of Twenty -fifth
Street, elevation west curb 20.60.
Section 2. This Ordinance shall be
in force and take effect from and af-
ter its passage by the City Council
and its publication one time in the

Ald. Saul moved that the Council
proceedings for the month of Octo-
ber be approved as printed. Carried.

Petition of Chas. J. Young, asking
to have the rules suspended in order
to addres sthe Council presented and
read.
Ald. Singin moved to have the
rules suspended for the purpose of
allowing Mr. Young to address the
Council.
Carried by the following vote:

Nays -None.
Absent -Ald. Wallis.
Mr. Young addressed the council in
reference to the taxation on his prop-
erty at Tenth and White streets.
Ald. Frith moved hat the peition of
Chas. J. Young be referred to the
Committee of the Whole. Carried.
Petition of T. E. Rhomberg, asking
to have the personal tax of the Rich-
ardson Shoe Mfg. Co. for the year
1904 canceled, and to allow him to
pay the taxes on the lots for 1904 and
subsequent years with 6 per cent per
annum interest, presented and read.
Ald. Frith moved to refer the peti-
- Lion to the Committee of the Whole.
Carried.
Petition of the Holy Ghost church,
. asking to have lot 4 in G. R. West's
Add. exempted from taxation begin-
ning Jan. 1, 1912, was on motion of
Ald. Frith referred to the Committee
of the Whole.
Petitio not Dubuque German Col-
lege and Seminary, asking to have
thei rproperty free from taxation for
the year 1911, and thereafter, was on
motion of Ald. Saul referred to the
Committee of the Whole.
Petition of the Germania Stock Co.,
asking the Council to allow the Treas-
urer to receive one -half of the taxes
for 1911, was on motion of Ald. Sin -
grin referred to the Committee of the
- whole.
Petition of John Kapp et al, asking
to have an electric light placed on
Willow Street where said street inter-
sects the alley next east of Lot 29 in
Finley's Add., - Was on motion of Ald.
Saul referred to the Committee of the
W hole.
Petition of the Real Estate Board
of Dubuque, Iowa, asking the Council
to adopt a plan for a systematic and
complete revaluation for purposes ,of
assessment of all real property in the
city, was on motion of Ald. .Saul re-
ferred to the Committee of the Whole.
Petition of Mrs. Annie Andresen
asking to have her taxes canceled on
Lot 7, East Dubuque Add., -was on
motion of Ald. Frith referred to the
Committee of the Whole.
Petition of Mrs. T. Stoltz asking to
have the tax assessment on her prop-
erty at 659 Clay Street reduced, was
oi: motion of Ald. Frith referred to
the Committee of the Whole.

Locust Street car line extension, was

excavating, in the streets, was on mo-
