Washington, DC 20510 November 10, 2003 Dear Senator Harkin: On October 6 Mayor Terry Duggan wrote to you on behalf of the City of Dubuque to express our serious concerns with S.150 and H.R. 49, the ~lntemet Tax Non- Discrimination Acr. While we do not oppose a two-year extension of the recently- expired moratorium on state and local taxes on Internet access itself, we believe the present language Of these bills eventually deprives states and municipalities of billions of dollars in tax and fee revenues in the years ahead and, in the meantime, generates needless confusion and litigation. The Congressional Budget Office reported that'S.150, as proposed, would amount to a substantial unfunded mandate. The amendment offered by managers of the bill does not resolve the problems identified by state and local governments. We Urge you to oppose efforts to pass damaging legislation as a part of an appropriations bill, to oppose attempts to limit debate, and instead to suppor~ the amendment offered by Senators Carper and Alexander, extending the present moratorium to 2005.
