City Engineer Gus Psihoyos recommends initiation of the public bidding procedure for
the Historic Millwork District Complete Streets Project, and further recommends that a
public hearing be set for December 20, 2010.
In 2009 the City Council adopted the Historic Millwork District Master Plan. Since that
time the City has been moving forward with plans to encourage the revitalization of the
Millwork District to help in providing market rate housing and to reconstruct the streets.
In March of 2010 the City of Dubuque received notification that it received $5.6 million
from the US Department of Transportation to create complete streets in the Historic
Millwork District. This TIGER (Transportation Investment Generating Economic
Recovery) grant is administered by the Federal Highway Administration. Complete
Streets are streets that provide for equal transportation modes for motorized vehicles,
bicycles and pedestrians. The intent of this project is to be a model for communities
under 200,000 in population in how complete streets can be integrated in historic
districts.
The Historic Millwork District Complete Streets Project will provide for the reconstruction
of underground utilities, roadway sub -base, concrete streets, concrete sidewalks,
pervious pavers in some of the parking areas, and re -use of existing brick pavers in
streetscape areas. In addition, energy- efficient historic street lighting will be installed. In
September, 2010 the final funding agreement with FHWA was signed between all
parties. In this agreement the streets were identified that would be included in the base

The project will be constructed over two years. It is anticipated that the first year

The following year (2012) would include construction on Jackson Street from 5 to 11
streetscaping of 1 0 tH Street from Main to White Street and any work on alternates
selected.
Under current assessment guidelines, financial assistance is only eligible to owner -
occupied residential properties. However, City Staff is recommending to the City Council
that property owners being assessed for streets being reconstructed in the Historic
Millwork District have two opportunities to reduce their assessment. One -half of the
Public Street Assessment may be forgiven by making qualifying investments in the
property as follows:
(1) One dollar of assessment will be forgiven for every five dollars of expenses incurred
for improvements made but only for improvements which require a building permit and
which result in an increase of the assessed valuation of the property. The property
owner must provide paid invoices to City for substantiation of the costs incurred.
(2) One dollar of assessment will be forgiven for every two dollars of expenses incurred
for improvements to the primary fagade of the property but only if the improvement is
approved by the Historic Preservation Commission of the City of Dubuque. The
property owner must provide paid invoices to City for substantiation of the costs
incurred.

The project will incorporate upgrades to the existing sanitary sewer system that include:
the complete reconstruction of approximately 2,000 lineal feet of 8 -inch mainline sewer;
the reconstruction of 18 deteriorated brick manholes; and the replacement of private
sanitary sewer laterals. The cost for the individual sanitary sewer lateral replacements
will be assessed to each respective private property owner.
The project will also include the reconstruction of approximately 3,500 lineal feet of
watermain, mainline valves, 14 fire hydrants, and the replacement of lead residential
water services. The cost of the individual lead residential water service replacements
will be assessed to each respective private property owner.
The project also provides for the: construction of approximately 3,800 lineal feet of new
storm sewer, 20 manholes and 30 catch basins to improve the storm water conveyance
in the area; installation of fiber optics and telecommunications conduit infrastructure;
and replacement of existing sidewalks.
City staff met with the City Forester on this project to discuss the types of trees and
locations that can be planted within the project corridor. Trees can be planted in the
streetscape areas west of White Street; however, due to a stipulation by the State
Historic Preservation Office during the environmental review, no trees can be planted in
the main core of the Historic Millwork District. The City does have 10 free - standing
planters that will be installed by City crews after the street reconstruction is complete.
The streetlights will have accommodations for both banners and hanging baskets.
PROJECT COORDINATION
In an effort to inform the impacted properties in the Historic Millwork District and other
impacted corridors, the Engineering Department staff conducted four public
informational meetings. The open forum meetings allows staff to discuss the scope of
the project, construction schedule, special assessment procedures, availability of
financial assistance, as well as to answer any questions relating to the project. The
public informational meetings proved to offer mutual benefit to both staff and property
owners. In addition, City staff met weekly with the warehouse property owners in the
Millwork District to discuss project coordination and schedule.
Engineering staff discussed the preliminary assessments that have been calculated.
Staff also discussed the probable construction schedule and their ability to coordinate
with the contractor for private utility work.

Based on discussions with Federal Highway Administration (FHWA), it has been
requested that the FHWA be given sufficient time to review the plans and specifications
prior to issuance. Also the FHWA determined that it would be in the best interest of the
City to have the bid - letting on January 25, 2011 so as not to conflict with the Iowa DOT
monthly bid - letting (January 19). This change has the potential of increasing the
number of potential bidders.
RECOMMENDATION
I recommend that the City Council give preliminary approval to the construction plans
and specifications, approve the Resolution of Necessity, approve the Preliminary
Schedule of Assessments, establish December 20, 2010 as the date of the public
hearing, and hereby authorize the City Clerk to advertise for bid proposals for the
Historic Millwork District Complete Streets Project.

above in the amount of $7,327,150.76. The project, as outlined, will require Special

Improvements made after the Millwork District were included in the Greater Downtown
Urban Renewal Plan (December 12, 2007) are eligible for the assessment reduction.

assessment schedule for the project (estimated to be early 2013).

ACTION TO BE TAKEN
The City Council is requested to give preliminary approval to the Resolution of

Time and Place for Filing Sealed Proposals. Sealed bids for the work
comprising each improvement as stated below must be filed before 2:00 p.m. on
January 25, 2011, in the Office of the City Clerk, City Hall - First Floor, 50 West
13 Street, Dubuque, Iowa.
Time and Place Sealed Proposals Will be Opened and Considered. Sealed
proposals will be opened and bids tabulated at 2:00 p.m. on January 25, 2011, at
City Hall - Conference Room B, 50 West 13 Street, Dubuque, Iowa, for
consideration by the City Council (Council) at its meeting on February 7, 2011.
The City of Dubuque, Iowa, reserves the right to reject any and all bids.
Time for Commencement and Completion of Work. Work on each
improvement shall be commenced within 10 days after the Notice to Proceed has
been issued and shall be fully completed by November 30, 2012.
Bid Security. Each bidder shall accompany its bid with a bid security as security
that the successful bidder will enter into a contract for the work bid upon and will
furnish after the award of contract a corporate surety bond, acceptable to the
governmental entity, for the faithful performance of the contract, in an amount
equal to one hundred percent of the amount of the contract. The bid security
shall be in the amount of ten percent (10 %) of the amount of the contract and
shall be in the form of a cashier's check or certified check drawn on a state -
chartered or federally chartered bank, or a certified share draft drawn on a state -
chartered or federally chartered credit union, or the governmental entity may
provide for a bidder's bond with corporate surety satisfactory to the governmental
entity. The bid bond shall contain no conditions excepted as provided in this
section.
Contract Documents. Paper copies of the construction documents may be
obtained at the Engineering Department, City Hall — Second Floor, 50 West 13
Street, Dubuque, Iowa 52001 beginning December 27, 2010. No plan deposit is
required.
Preference for Iowa Products and Labor. By virtue of statutory authority,
preference will be given to products and provisions grown and coal produced
within the State of Iowa, and to Iowa domestic labor, to the extent lawfully
required under Iowa statutes.
Sales Tax. The bidder should not include sales tax in its bid. A sales tax
exemption certificate will be available for all material purchased for incorporation
in the project.
General Nature of Public Improvement.
Historic Millwork District Complete Streets Project

The City of Dubuque, Iowa intends to rebuild /build and create complete streets
within the Historic Millwork District. This will include utility
replacements /extensions, sidewalk reconstruction and enhancements and street
reconstructions as well as new lighting. These efforts will be respectful of the
area's history and focused on the Base Construction Efforts, which includes utility
improvements along 11 Street from Elm to Jackson as well as and including the
reconstruction Jackson Street from 7 to 11 Streets, 1 0th Street from Jackson to
Elm and Washington Street from 9 to 10 An enhanced walking /biking trail
connection will be made from 5 Street in the Port of Dubuque to 7 Street in the
Millwork District along the Jackson Street right -of -way and paralleling the
overpass for US Highway 61/151. Streetscaping improvements along 10 Street
from Jackson to Main will incorporate walk improvements, corridor
enhancements, new lighting and designated bike lanes (pavement markings)
paralleling the vehicular travel lanes.
Alternate Construction Bid - Additional to the Base Construction efforts as
described in the above, the City intends to maximize the grant award by bidding
alternates for streetscape improvements to the following streets: 9 Street from
Washington to Main, Elm Street from 9 to 11 11 Street from Elm to White
and on Jackson and Washington from 11th to 12th Streets. Possible
reconstruction efforts of the follow segments may also be included: Washington
Street from 10 to 11 and 8 Street from White to Jackson. The streetscape
and reconstruction efforts in the alternate items as identified would coincide with
those identified in the above Base Construction Effort.
Total Project - The City's intent is to maximize the construction from the grant
award and possibly add City funding beyond the grant to build selected options
from the alternates. The alternates are not prioritized to the extent that
reconstructions or streetscaping efforts could both occur. The amount of the
additional funding from the City has yet to be determined. Project award will be
based on Base Construction Effort (Base Bid) plus potential selected Alternate
Construction Bids consistently compared between bidders. Final award will be
approved by Council and verified by the Federal Highway Administration.
Pre -Bid Construction Conference. Each prospective bidder is encouraged to
attend the Pre -Bid Construction Conference to be held at 1 PM on January 13,
2011, in Conference Room B, City Hall, 50 West 13 Street, Dubuque, Iowa.
Attendance by all prospective bidders is not mandatory but highly recommended.

HISTORIC MILLWORK DISTRICT COMPLETE STREETS PROJECT
APPROVING THE PLAT, SCHEDULE OF ASSESSMENTS AND ESTIMATE OF
TOTAL COST AND SETTING DATE OF PUBLIC HEARING ON RESOLUTION OF
NECESSITY
Whereas, the proposed Resolution of Necessity for the Project has been
introduced for the Project.
NOW THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY
OF DUBUQUE, IOWA:
The attached plat, schedule of assessments, and estimate of total cost for the
Historic Millwork District Complete Streets Project and the proposed Resolution of
Necessity are hereby approved and ordered placed on file in the Office of the City Clerk.
The City Council will meet on the 20 day of December, 2010, at 6:30 p.m. at the
Historic Federal Building Council Chambers (second floor), 350 West 6 Street,
Dubuque, Iowa, at which time the owners of property subject to assessment for the
proposed improvement or any other person having an interest in the matter may appear
and be heard for or against the making of the improvement, the boundaries of the
district, the cost, the assessment against any lot, or the final adoption of a resolution of
necessity.
A property owner will be deemed to have waived all objections unless at the time
of hearing the property owner has filed objections with the City Clerk.
The City Clerk be and is hereby authorized and directed to cause the attached
notice of the time and place of such hearing to be published in a newspaper having
general circulation in the City of Dubuque, Iowa, which notice shall be published once
each week for two consecutive weeks, the first publication of which shall be not less
than ten days prior to the day fixed for its consideration.

Notice is given that there is now on file for public inspection in the office of the
clerk of the City of Dubuque, Iowa, a proposed Resolution of Necessity, an estimate of
cost and schedule showing the amounts proposed to be assessed against each lot and
the valuation of each lot within a district approved by the City Council of the City of
Dubuque, Iowa, for a public improvement of the type(s) and in the location(s) as follows:
Reconstruction of underground utilities, roadway sub -base, concrete streets,
concrete sidewalks, pervious pavers in some of the parking areas, and re -use of
existing clay pavers in streetscape areas.
The proposed district to be benefited and subject to assessment for the cost of
such improvements is described as follows:
