McEvoy offered the following: AN ORDINANCE. 11 ORDINANCE granting the Illi- nois Central Railroali Company the right to extend its yard track known as Track No. Seven (7), lo- cated on the Levee and now termin- ating at Camp Street, a distance of Three hundred and twenty -four (324) feet northerly along said le- vee, from said present terminals, and across Camp Street, and regu- lating such grant. BE IT ORDAINED by the City Coun- cil of the City of Dubuque: SECTION 1. That to enable the Illinois Central Rairoad Company to reach one of the large ice houses of )e Thomas J. Mulgrew Company, .emission be and the same is here - granted to said Illinois Central Rail- Company, its successors and as- kis, to extend its yard track known .Track No. 7, located on the Levee tow terminating at Camp Street, a Regular Session, May 4, 1911 145 distance of Three hundred and twen- four (324) feet northerly along said levee from said present terminus, and across Camp Street, provided that the east rail of said extension track shall not extend over six inches onto said levee and the public highway consti- tuted by the same. SECTION 2. That the northerly end of said spur track shall at all times be held open so as to make possible an extension of said track at any time in the future, should exten- sion be directed or authorized by the City Council of the City of Dubuque. SECTION 3. That the said Illinois Central Railroad Company shall as a condition of the grant now made to it, extend said track now authorized to be laid, or lay additional spurs therefrom, at any time in the future, when ordered to do so by the City Council of said City of Dubuque, for the facility and convenience of other interests desiring to make use of said track, provided, that said railway company be made safe as to the cost of such extension by the party desir- ing same made. • SECTION 4. That the laying down of said spur track shall be done under the supervision of the City Engineer and the Committee on Streets of said City. SECTION 5. That in the laying down and operation of said track the same shall be so constructed and maintained as to create the least pos- sible obstruction to ordinary travel on and the use of the streets crossed. That cars shall not be allowed to stand on said street so crossed and used by said track in such manner as to unnecessarily interfere with the use thereof, and said track shall at all times be used in accordance with all lawful regulations, now or hereafter enacted by said City. SECTION 6. That said spur track shall be laid to the established grade of the street crossed by it, or over which it runs, and should the grade of the street be changed at any time, said track shall be changed to con- form to such grade, at the expense of the said railway company without claim of any kind against said City. SECTION 7. That said railway company shall keep the space between the rails of said spur track, and the space to the end of the ties at all places where said track crosses any street, so graded that carriages may easily pass over the same, and shall keep such spaces properly planked, paved, macadamized, or otherwise im- proved, afid shall keep any sidewalk crossing said track properly planked, or otherwise improved, as said city may direct. SECTION 8. That said spur track shall be so constructed and maintain- 146 Regular Session, May 4, 1911, ed as not to dam up or obstruct the flow and drainage of water in the gutters or on the surface of said street, and said railway company shall be subject to, and strictly comply with all reasonable police regulations bear- ing on the use and operation of said track. SECTION 9. The City of Dubuque reserves the right to revoke the priv- ilege hereby granted at any time after twenty (20) years from the time this ordinance becomes operative, or soon- er in case the said ice house of the said Thomas J. Mulgrew Company shall cease to be operative. A failure to comply with the provisions and conditions of this ordinance, or any part thereof, on the part of the com- pany, shall also be ground for imme- diate forfeiture of the privileges here- in granted, and said track may in such event be ordered removed and taken up by the City Council of said City. SECTION 10. This ordinance shall be in force and effect from and after its passage by the City Council and its publication one time in the Du- buque Times - Journal and the Tele- graph- Herald, official newspapers of the City and its written acceptance duly endorsed hereon by the said Il- linois Railroad Company. McEvoy offered the following: AN ORDINANCE RELATING TO STREET TRAFFIC, AND REGU- LATING THE USE OF THE STREETS, ALLEYS AND PUBLIC PLACES OF THE CITY OF DU- BUQUE BY CARTS, DRAYS, HACKNEY COACHES, OMNI- BUSES, CARRIAGES, WAGONS, MOTOR VEHICLES, AND ALL OTHER VEHICLES, AND PROVID- ING A PENALTY FOR THE VIO• LATION THEREOF. Be It Ordained by the City Council of the City of Dubuque: Section 1. The owner, driver, oper- ator or person in charge of any cart, dray, hackney coach, omnibus, car- riage, wagon, motor vehicle, or other vehicle, drawn, driven or propelled up- on the streets, alleys or public places of the City of Dubuque, shall conform to and comply with the following rules, and regulations.: Sec. 2. Vehicles shall be driven in a careful manner and with due regard for the safety and convenience of pedestrians, also of other vehicles. Sec. 3. Vehicles shall keep to the right side of the center of the street. Sec. 4. On a street divided longitudi- nally by a parkway, viaduct, walk, street railway or sunken way, vehicles shall keep to the right of such division. Sec. 5. Vehicles moving slowly shall keep as close as possible to the curb on the right, allowing more swiftly moving vehicles free passage to their left. Sec. 6. Vehicles turning to the right into an intersecting street shall pass and turn the corner as near to the - right -hand curb as possible. Sec. 7. Vehicles turning to the left into an intersecting street shall pass to the right of and beyond the center of the street intersection before turn- ing. Sec. 8. Vehicles meeting shall pass each other to the right. Sec. 9. A vehicle overtaking another vehicle traveling in the same direction shall keep to the left of the overtaken vehicle in passing. Sec. 10. No vehicle shall back to make a turn in any street if by so do- ing it interferes with other vehicles, but shall go around the block or to a street sufficiently wide to turn in without backing. Sec. 11. Vehicles crossing from one side of the street to the other shall do so by turning to the left so as to head in the same direction as the traffic on that side of the street towards which the crossing is made, and when tho streets is congested with traffic such vehicle shall go to the intersection be- fore turning, and no vehicle Shall stop with its left side to the curb. Sec. 12. No vehicle shall remain backed up to the curb except it be ac- tually loading or unloading, and in such case no longer than the actual loading and unloading requires. The horse or horses attached to a vehicle backed up to the curb shall be turned at right angles to the vehicle and in the direction in which the traffic upon the street is moving. Sec. 13. A vehicle waiting at the curb shall promptly give place to a vehicle about to take on or let off passengers. Sec. 14. No vehicle shall stop or stand within any street intersection nor within ten feet of the line of the intersecting street in the congested district, nor outside of said district for a longer period than is necessary to load or unload, and no vehicle engaged in heavy traffic, to -wit, hauling ice, coal, beer, freight of all kinds, shall be driven on Main street from First Street to Seventeenth Street, unless necessary to load or unload in said street. Sec. 16. Traffic on east and west .streets shall have the right -of -way over traffic on north and south streets. Sec. 17. The driver of any vehicle shall stop upon signal from a police .officer. Sec. 18. The driver of a vehicle, on the approach of a fire wagon or other fire apparatus, shall immediately_ draw up said vehicle as near as practicable to the right -hand curb and parallel thereto, and bring it to a standstill. Sec. 19. The officers and men of the Fire Department and Fire Patrol, with their fire apparatus of all kinds, when going to, or on duty at, or returning from a fire, and the officers and men 'of the Police Department, and all pa- trols and ambulances shall have the right -of -way in any street and through any procession, except over vehicles carrying United States mail. Sec. 20. No vehicle shall be driven through a procession except with the permission of a police officer. Sec. 21. No vehicle shall be allowed to remain upon or be driven through any street of the City of Dubuque so as to wilfully blockade or obstruct the said street; and no vehicle shall be so overloaded that the horse or horses, or motive power, shall be unable to move it. Sec. 22. The driver or operator of every motor vehicle shall give some plainly visible or audible signal of his approach, and the driver or operator of every vehicle as defined herein shall keep his vehicle not less than six feet from the running board or lower step of any street car which is stopping for the purpose of taking on or discharging passengers, and if, by reason of the presence of other vehicles at the place where such car is stopping, or reason of the narrowness of the street, it is not possible to preserve a dis- tance of six feet from such t running - board as herein prescribed, n the driver or operator of said vehicle shall stop the same until such car shall have taken on or discharged its passengers -and again started. Sec. 23. Drivers or operators of mo- tor vehicles of all kinds shall, in ap- proaching or traversing a crossing or street intersection, have their vehicles under control, and shall sound their signals in such a way as to give warn- ing to other vehicles and to pedestrians of their approach, and reduce the speed of such vehicle to a rate not greater than ten miles an hour, and no such vehicle shall turn a corner into an intersecting street at a great- er rate of speed than six miles an hour. Sec. 24. No horse shall be left un- attended in arty street or highway un- less securely fastened, or unless the wheels of the vehicle to which he is harnessed and securely tied, fastened or chained, and the vehicle is of suffi- cient weight to prevent its being draged at dangerous speed with wheels so secured. Sec. 25. No horse shall be unbitted or unbridled in any street or highway unless secured by a halter. Sec. 26. No one, in any street or highway, shall remove a wheel, pole, shaft, phiffletree, splinter -bar or any part of a harness likely to cause ac- cident if the horse or horses start, without first unhitching the horse or horses attached to said vehicle. Sec. 27. No one shall crack or so use a whip as to annoy, interfere with or endanger any person or excite any horse or horses other than that which he is using. Sec. 28. No person shall drive, guide or have the care of two or more horses harnessed respectively to different vehicles. Sec. 29. That no person shall oper- ate a motor vehicle on any street or public highway within the City of Dubuque at a rate of speed greater than is reasonable and proper, having regard to the traffic and use of the highway, or so as to endanger the life or limb of any person, or in any event in the closely built up portion of the city at a greater rate than one (1) mile in six (6) minutes, or elswhere in said city at a greater rate than one (1) mile in four (4) minutes; subject, however, to the other provisions of this section. Upon approaching a crossing of intersecting public high- ways, or a bridge, or a sharp curve, or a steep descent, and also in travers- ing such crossing, bridge, curve or de- scent, a person operating a motor vehicle shall have it under control and operate it at a speed less than here - inbefore specified, and in no event greater than is reasonable and prop- er, having regard to the traffic then on such highway and the safety of the public. Sec. 30. That any person operating a motor vehicle within said city shalt, at request or on signal by putting up the hand from a person riding or driving a restive horse or other draft or domestic animal, bring such motor vehicle immediately to a stop, and, if Adjourned Regular Session, May 22, 1911 157 traveling in the opposite direction, re- -main stationary so long as may be reasonable to allow such horse or •other animals to pass, and, if travel- ing in the same direction, use reason- able caution in passing such horse or other animal, and the operator and occupants of any motor vehicle shall render necessary assistance to the party having in charge said horse or other draft animal in so passing. Sec. 31. That every motor vehicle while in use on a public highway within said City shall be provided with good and efficient brakes, and also with a suitable bell, horn or other signal, and be so constructed as to exhibit, during the period from one (1) hour after sunset to one (1) hour before sunrise, one or more lamps showing white light visible within a reasonable distance in the direction toward which such vehicle is proceeding, and also a red light vis- ible in the reverse direction. Sec. 32. That every motor vehicle within said city shall also at all times have the number assigned to it by the .secretary of state displayed on the back of such motor vehicle in such a manner as to be plainly visible, the number to be in Arabic numerals, each not less than three (3) inches in height, and each stroke to be of a width not less than one -half ( /2 ) inch, and also as a part of such num- ber the initial and terminal letters of .a state's name, such letters to be not less than two (2) inches in height. Sec. 33. All wagons, carts and ve- hicles of every kind and description. except covered vehicles used for the hauling of garbage, manure, dead animals, refuse and offensive offal of every kind and description, are here- by prohibited from using Locust, Main, Iowa and Clay streets, between the hours of 8 a. m. and 10 p. m., pro- viding, however, that nothing in this .section shall be so construed as to prohibit the hauling of such garbage, dead animals, manure, refuse and of- fensive offal through the alleys and street intersections at the time desig- nated herein. Sec. 34. That the words and phrases used in this ordinance shall, for the purpose of the Ordinance, be construed as follows: 1. "Motor Ve- hicle" shall include all vehicles pro - pell by any power other than muscu- lar power, excepting such motor vehi- cles as run only upon rails or tracks, provided that nothing herein contained shall apply to traction engines or road rollers; 2, "Closely built up por- tions," shall mean the territory within said city contiguous to a public high- way devoted to business or where for not less than one - fourth (r /.r) of a mile the dwelling houses on such highway average not more than one hundred (100) feet apart. Sec. 35. The word "vehicle" as used in this ordinance shall be held to include equestrians, lead horses, carts, drays, hackney coaches, omni- buses, carriages, wagons, motor vehi- cles and all other vehicles used for transporting persons or property on the public streets. however drawn, driven or propelled, except street cars and carts, carriages or barrows, propelled by hands. The word "horse" includes all do- mestic animals. The word "driver" includes the rid- er and driver of a horse, the rider of wheels, and the operator of a motor vehicle. Sec. 36. Any person violating any of the provisions of this Ordinance, shall be deemed guily of a misde- meanor, and shall be punishable by a fine not exceeding twenty -five dollars ($25) for the first offense and punish- able by a fine of not less than twenty - five dollars ($25) nor more than fifty dollars ($50), or imprisonment not ex- ceeding thirty days (30) days, for a second or subsequent offense. Sec. 37. All Ordinances or parts of Ordinances in conflict herewith are hereby repealed. Sec. 38. This Ordinance being deemed urgent and necessary for the immediate preservation of the public peace, health and safety, shall be in full force and effect from and after its passage and publication as required by law. McEvoy moved that the Com- mittee on Fire and thief of the Fire Department be authorized to purchase firteen hundred feet of 2 inch, cotton jacket, rubber lined hose, to be of as good quality as that last purchased, guaranteed for three years and to stand a pressure of 300 pounds per square inch. The price net to exceed eighty -five cents per lineal foot. Car- ried. Ald. O'Rourke stated that after con- sultation with Ald. Saul and City En- eineer Baumgartner, he had had the Seventh street bridge closed for traffic until the same was put in safe condi- tion for travel and urged that immedi- ate action be taken thereon by the City Council. Be it Ordained by the City Council of the City of Dubuque: Section 1. That all sidewalks here- after laid on Delhi Street from Asbury Street southwesterly to the City Lim- its shall be made of cement, and monolithically constructed. The said walks shall be of a uniform width of four feet, with expansion joints at each lot line, and set on the proper grade, three feet back from the outside line of curb. Section 2. AN ORDINANCE RELATING TO STREET TRAFFIC, AND REGU- LATING THE USE OF THE STREETS, ALLEYS AND PUBLIC PLACES OF THE CITY OF DU- BUQUE BY CARTS, DRAYS, HACKNEY COACHES, OMNI- BUSES, CARRIAGES, WAGONS, MOTOR VEHICLES, AND ALL OTHER VEHICLES, AND PROVID- ING A PENALTY FOR THE VIO- LATION THEREOF. Be It Ordained by the City Council of the City of Dubuque: Section 1. The owner, driver, oper- ator or person in charge of any cart, dray, hackney coach, omnibus, car- riage, wagon, motor vehicle, or other vehicle, drawn, driven or propelled up- on the streets, alleys or public places of the City of Dubuque, shall conform to and comply with the following rules and regulations: Sec. 2. Vehicles shall be driven in a careful manner and with due regard for the safety and convenience of pedestrians, also of other vehicles. Sec. 3. Vehicles shall keep to the right side of the center of the street. Sec. 4. On a street divided longitudi- nally by a parkway, viaduct, walk, street railway or sunken way, vehicles shall keep to the right of such division. Sec. 5. Vehicles moving slowly shall keep as close as possible to the curb on the right, allowing more swiftly moving vehicles free passage to their left. Sec. 6. Vehicles turning to the right into an intersecting street shall pass and turn the corner as near to the right -hand curb as possible. Sec. 7. Vehicles turning to the left into an intersecting street shall pass to the right of and beyond the center of the street intersection before turn- ing. Sec. 8. Vehicles meeting shall pass each other to the right. Sec. 9. A vehicle overtaking another vehicle traveling in the same direction shall keep to the left of the overtaken vehicle in passing. Sec. 10. No vehicle shall back to make a turn in any street if by so do- ing it interferes with other vehicles, but shall go around the block or to a street sufficiently wide to turn 1n without backing. Sec. 11. Vehicles crossing from one side of the street to the other shall do so by turning to the left so as to head in the same direction as the traffic on that side of the street towards which the crossing is made, and when the streets is congested with traffic such vehicle shall go to the intersection be- fore turning, and no vehicle shall stop with its left side to the curb. Sec. 12. No vehicle shall remain hacked run to the curb except it be ac- Official Notices 177 tually loading or unloading, and in such case no longer than the actual loading and unloading requires. The horse or horses attached to a vehicle backed up to the curb shall be turned at right angles to the vehicle and in the direction in which the traffic upon the street is moving. Sec. 13. A vehicle waiting at the curb shall promptly give place to a vehicle about to take on or let off passengers. Sec. 14. No vehicle shall stop on any street unless within two feet of the curb, nor in such a way as to ob- struct the free passage of the street. Sec. 15. No vehicle shall stop or stand within any street intersection nor within ten feet of the line of the intersecting street in the congested district, nor outside of said district for a longer period than is necessary to load or unload, and no vehicle engaged in heavy traffic, to -wit, hauling ice, coal, beer, freight of all kinds, shall be driven on Main street from First Street to Seventeenth Street, unless necessary to load or unload in said street. Sec. 16. Traffic on east and west streets shall have the right -of -way over traffic on north and south streets. Sec. 17. The driver of any vehicle shall stop upon signal from a police officer. Sec. 18. The driver of a vehicle, on the approach of a fire wagon or other fire apparatus, shall immediately draw up said vehicle as near as practicable to the right -hand curb and parallel thereto, and bring it to a standstill. Sec. 19. The officers and men of the Fire Department and Fire Patrol, with their fire apparatus of all kinds, when going to, or on duty at, or returning from a fire, and the officers and men of the Police Department, and all pa- trols and ambulances shall have the right -of -way in any street and through any procession, except over vehicles carrying United States mail. Sec. 20. No vehicle shall be driven through a procession except with the permission of a police officer. Sec. 21. No vehicle shall be allowed to remain upon or be driven through any street of the City of Dubuque so as to wilfully blockade or obstruct the said street; and no vehicle shall be so overloaded that the horse or horses, or motive power, shall be unable to move it. Sec. 22. Sec. 23. Drivers or operators of mo- tor vehicles of all kinds shall, in ap- proaching or traversing a crossing or street intersection, have their vehicles under control, and shall sound their signals in such a way as to give warn- ing to other vehicles and to pedestrians of their approach, and reduce the speed of such vehicle to a rate not greater than ten miles an hour, and no such vehicle shall turn a corner into an intersecting street at a great- er rate of speed than six miles an hour. Sec. 24. No horse shall be left un- attended in any street or highway un- less securely fastened, or unless the wheels of the vehicle to which he is harnessed and securely tied, fastened or chained, and the vehicle is of suffi- cient weight to prevent its being draged at dangerous speed with wheels so secured. Sec. 25. No horse shall be unbitted or unbridled in any street or highway unless secured by a halter. Sec. 26. No one, in any street or highway, shall remove a wheel, pole, shaft, phiffletree, splinter -bar or any part of a harness likely to cause ac- cident if the horse or horses start, without first unhitching the horse or horses attached to said vehicle. Sec. 27. No one shall crack or so use a whip as to annoy, interfere with or endanger any person or excite any horse or horses other than that which he is using. Sec. 28. No person shall drive, guide or have the care of two or more horses harnessed respectively to different vehicles. Sec. 29. That no person shall oper- ate a motor vehicle on any street or public highway within the City of Dubuque at a rate of speed greater than is reasonable and proper, having regard to the traffic and use of the highway, or so as to endanger the life or limb of any person, or in any event in the closely built up portion of the city at a greater rate than one (1) mile in six (6) minutes, or elswhere in said city at a greater rate than one (1) mile in four (4) minutes; subject. however, to the other provisions of this section. Sec. 30. That any person operating a motor vehicle within said city shall,. at request or on signal by putting up the hand from a person riding or driving a restive horse or other draft or domestic animal, bring such motor vehicle immediately to a stop, and, if traveling in the opposite direction, re- main stationary so long as may be reasonable to allow such horse or other animals to pass, and, if travel- ing in the same direction, use reason- able caution in passing such horse or other animal, and the operator and occupants of any motor vehicle shall render necessary assistance to the party having in charge said horse or other draft animal in so passing. Sec. 31. That every motor vehicle while in use on a public highway within said City shall be provided_ with good and efficient brakes, and also with a suitable bell, horn or other signal, and be so constructed as- to exhibit, during the period from one (1) hour after sunset to one (1) hour before sunrise, one or more lamps showing white light visible within a reasonable distance in the direction toward which such vehicle is proceeding, and also a red light vis- ible in the reverse direction. Sec. 32. That every motor vehicle within said city shall also at all times have the number assigned to it by the secretary of state displayed on the back of such motor vehicle in such a manner as to be plainly visible, the number to be in Arabic numerals, each not less than three (3) inches in height, and each stroke to be of a width not less than one -half ( ) inch, and also as a part of such num- ber the initial and terminal letters of a. state's name, such letters to be not Less than two (2) inches in height. Sec. 33. All wagons, carts and ve- hicles of every kind and description. except covered vehicles used for the hauling of garbage, manure, dead animals, refuse and offensive offal of every kind and description, are here- by prohibited from using Locust, Main, Iowa and Clay streets, between the hours of 8 a. m. and 10 p. m., pro- viding, however, that nothing in this, section shall be so construed as to prohibit the hauling of such garbage, dead animals, manure, refuse and of- fensive offal through the alleys and street intersections at the time desig- nated herein. Sec. 34. That the words and phrases used in this ordinance shall, for the purpose of the Ordinance, be construed as follows: 1. "Motor Ve- hicle" shall include all vehicles pro - 1 Official Notices pell by any power other than muscu- lar power, excepting such motor vehi- cles as run only upon rails or tracks, provided that nothing herein contained shall apply to traction engines or road rollers; 2, "Closely built up por- tions," shall mean the territory within said city contiguous to a public high- way devoted to business or where for not less than one - fourth ( /.r) of a mile the dwelling houses on such highway average not more than one hundred (100) feet apart. Sec. 35. The word "vehicle" as used in this ordinance shall be held to include equestrians, lead horses, carts, drays, hackney coaches, omni- buses, carriages, wagons, motor vehi- cles and all other vehicles used for transporting persons or property on the public streets. however drawn, driven or propelled, except street cars and carts, carriages or barrows, propelled by hands. The word "horse" includes all do- mestic animals: The word "driver" includes the rid- er and driver of a horse, the rider of wheels, and the operator of a motor vehicle. Sec. 36. Any person violating any of the provisions of this Ordinance, shall be deemed guily of a misde- meanor, and shall be punishable by a fine not exceeding twenty -five dollars ($25) for the first offense and punish- able by a fine of not less than twenty - five dollars ($25) nor more than fifty dollars ($50), or imprisonment not ex- ceeding thirty days (30) days, for a second or subsequent offense. Sec. 37. All Ordinances or parts of Ordinances in conflict herewith are hereby repealed. Sec. 38. This Ordinance being deemed urgent and necessary for the Immediate preservation of the public peace, health and safety, shall be in full force and effect from and after its passage and publication as required by law. Be it Ordained by the City Council of the City of Dubuque: SECTION 1. That whenever it shall appear to the Board of Health that any property owner, whose property is situated within two hundred (200) feet of any public sanitary sewer, has failed, neglected or refused to make proper and necessary house connec- tions therewith, said board may by resolution order such sewer connec- tions to be made by such property owner, and said resolution shall state the name of the owner or owners of the property to be thus connected by sewer, with a description of the prop- erty, and fix the time in said order within which connections shall be made, and that the general regula- tions and specifications as to construc- tion of such sewers are on file and may be seen in the City Engineer's office, and shall also recite that if said connections are not made by the time specified, in accordance with such regulations and specifications, that the Board of Health shall then proceed in manner as specified in Section 4 of the Ordinance Requir- ing the Making of Connections with Sanitary Sewers and that said sewer connection shall then be ordered by 181 the City Council and the cost thereof assessed to the specific property as provided in said Ordinance. SECTION 2. Every' owner of any house, tenement, or outbuilding occu- pied or used by a person or persons, which house, tenement, or building, or any part thereof is situated within two hundred feet (200) feet of any public sewer, shall within thirty days from the time of receiving notice from the Board of Health to make such connections, as provided in Sec- tion 3 hereof, connect such house, tenement, or outbuilding with such sewer, by a proper branch sewer con- structed in accordance with the re- quirements of the Board. of Health, and to the satisfaction and approval of the City Engineer, both as to pipes and material, as well as work of con- structing, and to use such sewer for all proper purposes as required by the Board of Health. SECTION 3. A copy of said reso- lution referred to in Section 1 here- of, duly attested by the City Recor- der, shall forthwith be served upon such property owner or owners, or his or their duly authorized agent or at- torney: the service thereof shall be made by the City Chief of Police or Sanitary Officer, who must endorse thereon his return and file the same with the City Recorder. Whenever it appears that such property owner or owners are non - residents and have no duly authorized agent or attorney upon whom service can be made, then the City Recorder shall give ten days' notice thereof by publishing same in the official papers of the city of Dubuque for three consecu- tive times, and the service of a copy of said resolution as herein provided by publication, shall be deemed suf- ficient to require such property own- er to make said sewer connections. SECTION 4. NOTICE OF THE COUNCIL'S INTENTION TO IMPROVE TENTH STREET FROM THE WEST LINE OF MAIN .STREET TO THE EAST 182 to be done under the supervision of the City Engineer and Committee on Sewers, and the City of Dubuque shall have the right by its officers or em- ployees to go upon the premises for the purpose of making such connec- tions, and upon the completion of said work and acceptance thereof by the City Council, the City Enginee shall report to the Council the cost thereof, including the cost of the es- timates, notices, inspection and pre- paring the assessment and plat, and the City Council shall levy an assess- ment against the specific property of the owner thereof, in an amount equal to said costs and expenses in the manner hereinafter stated, and the same shall from the time said work is done be a lien upon the real estate upon which such expenditures are made or expenses are incurred, and such assessment may be collected as other special assessments and the lien enforced by civil action in any court of competent jurisdiction. SECTION 5. GEIGER, 5 -17 -1t City Recorder. AN ORDINANCE. (Official Publication.) AN ORDINANCE GRANTING THE ILLINOIS CENTRAL RAILROAD COMPANY THE RIGHT TO EX- TEND ITS YARD TRACK, KNOWN AS TRACK NO. SEVEN (7), LO- CATED ON THE LEVEE AND NOW TERMINATING AT CAMP STREET, A DISTANCE OF THREE HUNDRED AND TWEN- TY -FOUR (324) FEET NORTH- Official Notices ERLY ALONG SAID LEVEE FROM SAID PRESENT TERMINALS, AND ACROSS CAMP STREET, AND REGULATING SUCH GRANT. BE IT ORDAINED by the City Coun- cil of the City of Dubuque: SECTION 1. That to enable the Illinois Central Rairoad Company to reach one of the large ice houses of the Thomas J. Mulgrew Company, permission be and the same is here- by granted to said Illinois Central Rail- road Company, its successors and as- signs, to ,extend its yard track known as Track No. 7, located on the Levee now terminating at Camp Street, a_ distance of Three hundred and twen- four (324) feet northerly along said levee from said present terminus, and across Camp Street, provided that the east rail of said extension track shall not extend over six inches onto said levee and the public highway consti- tuted by the same. SECTION 2. That the northerly end of said spur track shall at all' times be held open so as to make possible an extension of said track at any time in the future, should exten- sion be directed or authorized by the • City Council of the City of Dubuque. SECTION 3. That the said Illinois Central Railroad Company shall as of condition of the grant now made to it, extend said track now authorized to be laid, or lay additional spurs therefrom, at any time in the future, when ordered to do so by - the City Council of said City of Dubuque, for the facility and convenience of other interests desiring to make use of said track, provided, that said railway: company be made safe as to the cost of such extension by the party desir- ing same made. SECTION 4. That the laying down of said spur track shall be done under - the supervision of the City Engineer and the Committee on Streets of said City. SECTION 5. That in the laying - down and operation of said track the same shall be so constructed and' maintained as to create the least pos- sible obstruction to ordinary travel' on and the use of the streets crossed. That cars shall not be allowed to stand on said street so crossed and used by said track in such manner as to unnecessarily interfere with the use thereof, and said track shall at all times be used in accordance with all lawful regulations, now or hereafter enacted by said City. SECTION 6. That said spur track shall be laid to the established grade of the street crossed by it, or over which it runs, and should the grade of the street be changed at any time, said track shall be changed to con form to such grade, at the expense of the said railway company without Official Notices claim of any kind against said City. SECTION 7. That said railway company shall keep the space between the rails of said spur track, and the space to the end of the ties at all places where said track crosses any street, so graded that carriages may easily pass over the same, and shall keep such spaces properly planked, paved, macadamized, or otherwise im- proved, and shall keep any sidewalk crossing said track properly planked, or otherwise improved, as said city may direct. SECTION 8. That said spur track shall be so constructed and maintain- ed as not to dam up or obstruct the flow and drainage of water in the gutters or on the surface of said street, and said railway company shall be subject to, and strictly comply with all reasonable police regulations bear- ing on the use and operation of said track. SECTION 9. The City of Dubuque reserves the right to revoke the priv- ilege hereby granted at any time after twenty (20) years from the time this ordinance becomes operative, or soon- er in case the said ice house of the said Thomas J. Mulgrew Company shall cease to be operative. A failure to comply with the provisions and conditions of this ordinance, or any part thereof, on the part of the com- pany, shall also be ground for imme- diate forfeiture of the privileges here- in granted, and said track may in such event be ordered removed and taken up by the City Council of said City. SECTION 10. This ordinance shall be in force and effect from and after its passage by the City Council and its publication one time in the Du- buque Times - Journal and the Tele- graph- Herald, official newspapers of the City and its written acceptance duly endorsed hereon by the said Il- linois Railroad Company.
