Haggerty, asking the city council to
instruct the city treasurer to cancel
the special assessment for resetting of
curb in front of lot 1, of Cooley's sub-
division, was on motion on Ald.
O'Rourke referred to the committee of
the whole, and the city engineer is to
investigate.
Communication from the Union
Electric company relative to the ex-
tension of their lines on West Locust
street was on motion of Ald. J. W.
McEvoy received and filed.
Communication from the park com-
missioners asking that the resolution
attached relative to the levying of a
specil tax for park purposes was on
motion of Alderman O'Rourke referred
to the committee of the whole.

square yard for macadam, price per

price per lineal foot for new stone
curb.
Each hid must he accompanied by a
certified check for $50.00 on some Du-
buque bank as a guarantee that a con-
tract will be entered into if awarded.
The City Council reserves the right

Notice to Sewer Contractors.
Sealed proposals will be received at
the Council Chamber, City Hall, by
the City Recorder, until 8:00 p. m.
Thursday, June 15th, 1911, for the
construction of an 8 -inch tile pipe
sanitary sewer in Langworthy Avenue,
from the east line of Lot 25 in Massey's
Heights, easterly to James Street,
thence northerly in James Street to
West Third Street, thence easterly in
Wrest Third Street to a point about 225
feet east of the center of James Street,
in accordance with the plans and
specifications prepared by the City
Engineer and now on file in the office
of the City Recorder.
It is estimated by the City Engineer
that it will require
1,165 feet of 8 -inch tile pipe.
8 manholes.
The work to be paid for when said
work is completed and as prescribed by
Chapter XXXIV. of the Revised
Ordinances of 1901 of the City of Du-
buque, work to be completed on or
before August 15, 1911.
Bidders must state price per lineal
foot for tile pipe, and each manhole.
All bids must be accompanied by a
certified check for $50,00 on some
Dubuque bank as a guarantee that
a contract will . be entered into if
awarded.
The City reserves the right to reject

To the Honorable City Council:
Gentlemen: Your Board of Health
met in regular session June 30, 1911.
Mr. D. Ryan and Mr. E. Frith being
present, were asked their opinion as
to the most sanitary manner of dis-
posing of the garbage. They both ad-
vised that the most feasible manner
would be by burning same. The
board took no definite action, but laid
the matter over to a special meeting
to be called by the mayor.
Mr. J. J. Smith asked the board to
find some way for him to connect with
sanitary sewer. The same was referr-
ed to the Mayor and Sanitary Officer.

by ordinance to audit the annual re-
port of the Dubuque Bridge Company,

have performed the duty and find the
report as submitted to correspond
with the books and vouchers in said
bridge company's office. We would

the company is exempt by ordinance
until such time as the net receipts are
equal to 8 per cent. on $108,868.16,
which would be $8,709.45, and as the
earnings for the year amounted to but
$6,777.14, we would recommend that
the Treasurer be instructed to cancel
the taxes against said bridge company
for the year 1910.

Gentlemen: I herewith . submit my
report of defective lights for the
month of June, 1911. I find from the
report of the Police Department that
the total hours that 68 lamps failed to
burn would equal 31 -3 lamp burning
for one month, or $16.66.

Clay Street to the east line of Main
Street, the Mayor be and he is hereby

Mr. Jones addressed the Council and
stated that the scales at the City Hall
was in very bad condition, and that
there was quite a bit of timber rotten
and should be replaced by new tim-
ber.
Ald. Saul moved that the repairing
of the scales at City Hall be left to
the Committee on Markets with power.
Carried.
The City Engineer presented a pro-
file showing a grade on West Fourth
Street.
On motion of Ald. O'Rourke the grade
adopted and the Ordinance Committee
instructed to draft the proper ordi-
nance. Carried.
Ald. Saul moved that the City Engi-
neer notify Mr. Tschirgi to make the
necessary repairs to Bluff Street. Car-
ried.
Ald. J. W. McEvoy moved that the
salary of the Poundmaster be increased
from $40.00 to $45.00 per month, the
• same to date from May 1, 1911. Carried.
Ald. O'Rourke moved that when we
adjourn we adjourn to Tuesday, July
11, 1911. Carried.
Ald. J. W. McEvoy moved that a
clock be purchased for the Recorder's
office and the two office chairs in said
office be repaired. Carried.

for an eight -inch tile pipe sanitary
sewer in Broadway from present man-
hole about opposite north line of Lot
5 in Wulweber's Sub. southerly to
Blocklinger Lane, thence easterly in
said Lane to Couler Avenue, showing
the location and general nature of
such improvement, the extent thereof,
the size and kind of material to be
used, and to prepare an estimate of
the cost thereof and the amount as-
sessable upon each lot or parcel of
land adjacent to or abutting thereon
per front foot or square feet in area,
and to file such plat, specifications and
estimate in the office of the City Re-
corder.
That after such plat is so filed, the
City Recorder shall cause to be pub-
lished notice of the intention of the
Council to make such improvement,
which notice shall be published in
three consecutive issues of the official
paper of the City of Dubuque, stating
that such plat is on file and generally
the nature of the sewer, its location,
size and kinds of materials to be used,
and the estimate of its cost, and fixing
the time before which objections can
be filed, which time shall not be less
than five da3s after the last publica-
tion of said no *ice, and after the com-
pletion of the f ublication of such no-
tice, he shall al its next session, noti-
fy the Council thereof in writing with
a printed copy of such notice accom-
panying the same.

to provide for the cost of curbing, gut-
tering and paving Bluff Street, from
the end of the brick paving between
Sixteenth and Seventeenth Streets
southerly to the north line of Eighth
Street, the Mayor be and he is hereby
required to execute and deliver to the
City Rectrder, to be by him registered
and countersigned, fifty -two bonds,
numbered 1135 to 1187, inclusive, for
Two Hundred and Fifty Dollars
($250.00) each, and one bond, numbered
1188, for Two Hundred Thirty -nine and
93 -100 Dollars ($239.93), dated July 21,
1911, payable on or before seven years
after the date thereof, and bearing in-
terest at the rate of five per cent. per

ment amount to $4,703.62.
Therefore, Be it Resolved by the City
Council of the City of Dubuque, That
to pr-vide for the cost of brick - paving
Sixth Street, from the west line of
Adjourned Regular Session, July 11, 1911
Ald. Singrin, Chairman on Sewers,
offered the following:
Your Committee on Sewers would
respectfully report that we have ex-
amined the sanitary sewer in the alley
between Lemon Street and Couler Ave-
nue, from Millville Road to Thirty -
Second Street, thence easterly in
Shirty- Second Street to the alley first
east of Couler Avenue, C. B. Mc-
. Namara & Co., contractors, and would
respectfully recommend that said
sewer be accepted and that the City
Engineer be instructed to prepare a
special assessment against the lots or
parcels of real estate subject to assess-
ment for said improvement and file the
same in the office of the City Recorder
who will thereupon publish the notice
of said assessment as required by or-
dinance. WM. SINGRIN,

Ald. Singrin moved the adoption of
the report. Carried.
Your Committee of the Whole, to
whom was referred the petition of Carl
Steuck and James O'Farrell asking
that the alley in Bellevue additon be-
tween Queen and Elm streets be
straightened from the south line of
lot 49 to the south line of lot 51 in
accordance with a plat attached to
said petition, would respectfully rec-
ommend that the prayer of the peti-
tioners be granted upon the dedication
by the petitioners of the proposed new
alley.
Your Committee of the Whole, to
whom was referred the petition of John
N. Berger stating that the assessment
on lots 47 and 48 in Littleton & Saw-
yer's Addition was erroneously in-
creased from $1,300.00 to $1,700.00, and
asking that said error be corrected,
would respectfully recommend that
the prayer of the petitioner be granted
and that the City Treasurer be in-
structed to accept the taxes for the
year 1910 on said lots on a basis of
$1,300.00 valuation.
Your Committee of the Whole, to
whom was referred the petition of the
Dubuque Packing company asking
that it be granted permission to con-
struct overhead piping from its pres-
ent plant to the new building, said
piping to be 22 to 23 feet above the toP
of the present storm sewer, would re-
spectfully recommend that the prayer
of the petitioner be granted and that
the Ordinance Committee and City At-
torney be instructed to prepare an or-
dinance confirming the rights herein
granted and safeguarding the inter-
ests of the city in the premises.
Your Committee of the Whole, to
whom was referred the remonstrance
of J. K. Deming and George W. Kiesel
against the laying at the present time
of a cement sidewalk abutting Lot 2
of Mineral Lot 466, would respectfully
recommend that action on the ordering
of the laying of said walk be deferred
for a period of thirty days from date,
and that if no effort has been made in
the meantime to fill said lots, the City
Council proceed to have said walk laid
without further delay.

To the Honorable City Council:
Gentlemen —Your Board of Health
met in special session July 10, 1911, at
7:40 a. m., and considered the proposi-
tion of Mr. Ryan to dispose of the
garbage, 30 tons per day at $30.00 per
day, the city to deliver same to his
plant. Also the proposition of Mr.

contract, or at $15.00 per day summer

five year contract, in addition to con-
tract already entered into, any person
bringing garbage for disposal to pay
50 cents per yard. After discussing
same it was resolved to recommend to
the City Council the Frith proposition.
After a thorough investigation of the
vault at 1195 Lincoln avenue it was
resolved to permit the owner to fill
same, as there was no offensive matter

improve the north side of Cleveland
avenue between Burns street and Ap-

laying down a permanent sidewalk
thereon composed of cement material;

Council of the City of Dubuque:
That the City Engineer be and he is
hereby directed to prepare a plat
showing generally the location, na-
ture and extent of the proposed im-
provement on the north side of Cleve-
land avenue between Burns and Apple
streets, and in front of and abutting
Lot 66, Union Addition, and the kind
of material to be used, and an esti-
mate of the entire cost thereof and the
amount and cost of such improve-
ment, and the amount and cost there-
of; to be paid by the city, if any, and
the cost thereof and amount assessable
upon each lot or parcel of land adja-
cent to or abutting upon such improve-
ment per front foot, and to file such
plat and estimate in the office of the
City Recorder; that after the filling of

and the same is hereby approved and
that the Mayor and City Recorder be

That this Resolution of Consent is
given in Renewal of Resolution of
Consent heretofore adopted and now
in force, consenting to the sale of in-

suspended for the purpose of permit-

Mr. Wm. McIntosh addressed the
council and requested that the council

gineer'be instructed to prepare p-cfile
showing grade of alley between Gar-
field avenue and Rhomberg avenue be-

to construct 15 -inch tile pipe Storm
Water Sewer in Twenty -fifth street
be awarded to N. J. Staner and bond

accepted and that the City Engineer
be instructed to prepare a special as-
sessrnent against the lots or parcels
of real estate subject to assessment for
said improvement and file the same
in the office of the City Recorder who
will thereupon publish the notice of
said assessment as required by ordi-
nance.

of the City of Dubuque, That Fourth
Street from the west side of Bluff
Street to the foot of the elevator be
improved by curbing and guttering,
the same with combined cement con-
crete curb and gutter in accordance
with the plans and specifications for
such improvement prepare 1 by the
City Engineer and now on file in the
office of the City Recorder; and, be
it further
Resolved, That said improvement
shall be completed on or before the
1st day of September, 1911, and
shall be paid for in the manner pre-
scribed by Chapter XXXII of the Re-,
vised Ordinances of the City of Du-
buque for the payment of the cost
of street improvements.

On motion of Ald. Specht prayer grant-

Original notice of the Illinois Cen-
tral R. R. vs. City of Dubuque et al,
stating that there was now on file in
the office of the clerk of the District
Court of Dubuque County, Iowa, a
petition asking for a writ cancelling a
pretended tax of $53,000 on the east
half of Block Fourteen, Dubuque Har-
bor Company's Add., presented. On
motion of Ald. O'Rourke referred to
the City Attorney, he to report to the
Committee of the Whole.
Quarterly report of City Water
Works presented. Ald. O'Rourke mov-
ed that the report be referred to the
Special Auditing Committee appointed
for that purpose. Carried.
Ald. O'Rourke moved that if the
Mayor deems it advisable to appoint
a new Auditing Committee he is so
empowered to do. Carried.
Ald. Saul, chairman of the Committee
of the Whole, offered the following:

whom was referred the petition of Bert
F. Geeting et al, relative to the pur-
chase of the Dubuque High Bridge,
would respectfully recommend that in
accordance therewith, a committee
composed of John Frantzen, Mert
Laughlin, C. A. Voelker, A. Heeb, J.
F. Stampfer and City Attorney George
T. Lyon he appointed to investigate
and report directly to the City Council,
the most feasible plan in their judg-
ment for the purchase and mainten-
ance by the City of the said bridge.
We further recommend that action
on the second paragraph of said peti-
tion he deferred until after the report
of said committee is submitted.

to the conditions herein contained.
Said pipes are to be constructed and
placed in a safe manner, and are to
be at least tewnty -two feet above the
upper surface of the covering over
said sewer, leaving a clear space of
said distance between such covering
and the lower portion of said pipes,
and in any event such pipes are to be
so placed and maintained as not to
interfere in any way with travel
upon and over said alley, and said
pipes are to be so maintained, guard-
ed and located as not to endanger
persons or animals passing over and
along said alley.
Sec. 2. Said pipes are to be con-
structed subject to the approval of
the City Engineer and Street Com-
missioner of said city.
Sec. 3. Said . Dubuque ..Packing Co.
shall, as a condition to the granting
of this permission, guaranty, by ac-
cepting the terms hereof, to fully
protect and save the City of Dubuque
harmless as to any claims, damages
or liabilities of any kind which
might arise because of the construe
tion and _maintenance of the .pipes
aforesaid, and in any suit which may
arise against the City because of
such pipes, said Company shall, at
the request of the City, make all
necessary defense thereto and fully
indemmnify. the City as to any ex-
penses, liabilities or outlays made
necessary because of such suit.
Sec. 4. Should the City of Du-
buque at any time deem said pipes
or any part of them unsafe, or for any
other reason deem their removal
necessary or advisable, said City may
order the immediate removal of said
pipes or any part of them, and, on
the refusal of said company to
promptly remove same as directed,
said City may do so, charging the ex-
pense incident thereto to said com-
pany.
Sec. 5. This ordinance shall be in
force and effect from and after its
passage by the City Council and its
publication one time in the Dubuque
Times - Journal and Dubuque Tele-
graph- Herald, official newspapers of
said City, and written acceptance
hereof duly indorsed hereon by said
Dubuque Packing Co.

claimed against the city for personal
injuries sustained by reason of defec-
tive sidewalks:
No. 16,661 Law —Ralph B. Luckey
vs. City of Dubuque. —Being an action
to recover $3,000 for an injury sus-
tained by him on the 10th day of Feb-
ruary, 1910, on the southerly side of
Eighteenth street, between Jackson
and White streets, by reason of the
dangerous condition of the sidewalk
as a result of the accumulation of
snow and ice thereon. Plaintiff claim-
ing to have fallen on said walk and
as a result thereof his right leg was
broken and he was otherwise injured.
No. 16,667 Law —Mary Dobmeyer
vs. City of Dubuque. —Being an action
to recover $7,500 for injuries sustain-
ed by her on the 17th day of Feb-
ruary, 1910, on a street crossing just
outside the curbstone on the east side
of Clay street and on the north side
of Thirteenth street. She alleging in
her petition that said crossing was in
a defective condition by reason of an
accumulation of snow and ice thereon,
which caused her to fall and which
fall resulted in her right leg being
broken, and other injuries.
No. 16,662 Law —Helen M. May vs.
City of Dubuque. —Being an action to
recover $3,500 for injuries sustained
by her on the 10th day of December,
1909, on a sidewalk on the west side
of Locust street, between Second and
Third streets, which she claims was
caused by the dangerous condition of
the sidewalk, and that it was allowed
to 'become covered with an accumula-
tion of snow and ice; she claiming

of W. IL Meuser offering to pay $20.00
in full settlement of the special as-
sessment levied against lots 8 and 9 in
Myrtle Addition for the improvement
of Wood Street, would respectfully
recommend that said offer be not ac-
cepted. We would recommend, how-
ever, that the City Treasurer be in-
structed to accept the sum of $50.00 in
full settlement of said assessment.
Your Committee of the Whole, to
whom was referred the petition of C.
B. McNamara & Co., asking that they
be granted the use of the rock crasher
for breaking macadam for the Grand-
view Avenue contract. would respect-
fully recommend that the matter be
taken up by the City Council and that
if acted on favorable to the petitioners,
a time limit be set for the return of
the crusher to the City.
Your Committee of the Whole, - to
whom was referred the petition of
Walter Koerner et al, asking that the
valuation on Lot 2 of Sub. 3 of Min-
eral Lot 63, and also on the personalty
assessed against the estate of Johanha
Koerner be reduced, would respectfully
recommend that the valuation on said
real estate be reduced to $800.00 and
that no reduction be allowed on the
personalty; also, that the City Treasur-
er be instructed to accept the taxes of
said estate for the year 1910 on the
above valuation.

teenth Streets, in the City of Du-

that she suffered a concussion of the
spine, the bones of her right leg near
the thigh being broken and numerous
other injuries.
No. 16,773 Laiv— Pauline W. Pack-
wood, minor, by her father and next
friend, C. W. Packwood, vs. City or
Dubuque. —Being an action to recover
$5,000 for personal injuries sustained
by said minor on the 31st day of
March, 1910, while walking on the
sidewalk on the south side of Eighth
street, between Locust and Bluff
streets, by reason of a large sign used
as an advertisement, which was nailed
to the fence along said sidewalk, being
blown over upon and against her, she
claiming that her scalp, head and body
were severely injured and nervous
system shocked.
The attorneys representing the
plaintiffs in the above described ac-
tions have made an offer to compro-
mise all of said actions, for the sum
of $1,000, same to he payable after
the next appropriation to be made by
the City Council; said One Thousand
Dollars to bear interest from the 24th
day of May, 1911.
Believing it to be to the interest of
the City to accept the proposition
thus made, we therefore recommend
that you authorize the City Attorney
- to adjust the above described actions
upon that basis.

City Council of the City of Dubuque:
That the City Engineer be and he
is hereby directed to prepare a plat
showing generally the location, na-
ture and extent of the proposed im-
provement on the north side of Leib -
itz street, between North Main and
Paul streets, and in front of and abut-
ting Lots 12 and 13 of Klingenberg's
4th Sub. and the east 1 /z of, Lot 45,
Marsh's Add., and the kind of ma-
terial to be used, and an estimate of
the entire cost thereof and the amount
and cost of such improvement, and
the amount and cost thereof, to be
paid by the city, if any, and the cost
thereof and amount assessable upon
each lot or parcel of land adjacent to
or abutting upon such improvement
per front foot, and to file such plat
and estimate in the office of the City
Recorder; that after the filing of said
plat and estimate in his office, the
City Recorder shall notify said abut-
ting and adjacent property owners, as
provided by ordinance, that such plat
and estimate are on file, the location
and nature of the improvement, kind
of material to be used, and an estim-
ate of its cost, 'and the time before
which objections thereto can be filed,
and the time fixed for hearing, which
time shall not be less than five (5)
days after the service of such notice,
and after such service shall have been

Such sidewalk to be constructed of
materials and in the manner as fol-
lows: On a sub -base eight inches
thick composed of cinders or broken
stone shall be laid a base three inches
thick composed of one part Portland
cement, two parts clean sharp sand,
four parts crushed stone, on top of
which shall be laid a wearing'surtace
one inch thick composed of equal parts
Portland cement and finely crushed
hard stone or gravel. Said sidewalk
to be begun within 10 days, and com-
pleted within 30 days from the adop-
tion of this resolution, and the cost
of same to be taxed against said pre.n-
ises and collected in the manner pre-
scribed by law.

Notice to Sewer Contractors.
Sealed proposals will be received at
the Council Chamber, City Hall, by the
City Recorder until 8:00 p. m. Thurs-
day, Aug. 3d, 1911, for the construction
of an 8 -inch tile pipe sanitary sewer in
Rhomberg avenue from Kniest street
easterly to a point about the middle
of Lot 15 in Smedley's Sub., in accord-
ance with the plans and specifications
prepared by the City Engineer and
now on file in the office of the City
Recorder.
It is estimated by the City Engineer
that it will require:
162 lineal feet of 8 -inch tile pipe.
1 manhole.
The work to be paid for when said
work is completed and as presented
by Chapter XXXIV. of the Revised
Ordinances of 1901 of the City of Du-
buque, work to be completed on or
before Sept. 1.
Bidders must state price per lineal
foot for tile pipe, and each manhole.
All bids must be accompanied by a
certified check for $50.00 on some Du-
buque bank as a guarantee that a con-
tract will be entered into if awarded.
The City reserves the right to reject
any and all bids.

tified that it is the intention of the
City Council of the City of Dubuque to
construct an 8 -inch tile pipe sanitary
sewer in Washington Street from
Twenty -first street to Twenty- second
street.
That ,t plat of said proposed sewer
is now on file in the office of the City
Recorder.
It is estimated by the City Engineer
that it will require:
438 lineal feet 8 -inch tile pipe.
2 manholes.
And will cost the abutting property
owners $372.00.
Any person having objections to the
construction of said sewer are hereby
notified to appear before the City
Council at its regular session to be
held August 3, 1911, or to file their ob-
jections in writing with the City Re-

bids be opened. Carried.

be awarded to The O'Farrell Contract-
ing Co., and the bond be placed at 25
per cent of contract price. Carried.
