Bids for the improvement of alley be-
tween Main and Locust streets and
Fifteenth and Sixteenth, also for the
improvement of Fourth street from
Bluff to west end of Fourth street, also
for construction of an 8 -inch Sanitary
Sewer in Rhomberg avenue from a
point opposite Lot 15, Smedley's Sub.,
southwesterly to Kniest street, pre-
sented.
Ald. O'Rourke moved that all the
bids be opened. Carried.

O'Farrell Contracting Co.: Brick pav-
ing $1.79 per square yard, curb 23c per
lineal foot.
Kenety & Lee: Curbing 28c per lineal
foot, brick paving $1.80 per square yard.
Wilmer Cook: Brick paving $1.94 per
square yard.
Ald. Saul moved that the contract
be awarded to The O'Farrell Contract-
ing Co., and the bond be placed at 25
per cent of contract price. Carried.
Fourth Street —
O'Farrell Contracting Co.: Combin-
ation curb and gutter 63c per lineal
foot, gutter 30c per lineal foot.
Kenety & Lee: Combination curb
and gutter 49c per lineal foot.
Ald. E. E. McEvoy moved that the
bids be referred to the Engineer. Car-

Ald. Specht moved that the contract
be awarded to the O'Farrell Contract-

Petition of Metz Manufacturing Co.
asking that a fire alarm box be install-

rules be suspended for the purpose of
hearing from anyone present in rela-

Ald. J. W. McEvoy moved that the
petition of Metz Mfg. Co. be referred
to the Committee of the Whole. Car-

Petition of M. H. McCarthy et al
asking that an electric street lamp be
erected on the south side of Sixth
street, presented.
Ald. J. W. McEvoy moved that the
rules be suspended for the purpose of
allowing anyone present to address the

Notice to Sewer Contractors.
Sealed proposals will be received at
the Council Chamber, City Hall, by the
City Recorder until 8:00 p. m, Thurs-
day, Aug. 3d, 1911, for the construction
of an 8 -inch tile pipe sanitary sewer in
Rhomberg avenue from Kniest street
easterly to a point about the middle
of Lot 15 in Smedley's Sub., in accord-
ance with the plans and specifications
prepared by the City Engineer and
now on file in the office of the City
Recorder.
It is estimated by the City Engineer
that it will require:
162 lineal feet of 8 -inch tile pipe.
1 manhole.
The work to be paid for when said
work is completed and as presented
by Chapter XXXIV. of the Revised
Ordinances of 1901 of the City of Du-
buque, work to be completed on or
before Sept. 1.
Bidders must state price per lineal
foot for tile pipe, and each manhole.
All bids must be accompanied by a
certified check for $50.00 on some Du-
buque bank as a guarantee that a con-
tract will be entered into if awarded.
The City reserves the right to reject
any and all bids.

TWENTY - SECOND STREET.
To Whom It May Concern:
You and each of you are hereby no-
tified that it is the intention of the
City Council of the City of Dubuque to
construct an 8 -inch tile pipe sanitary
sewer in Washington Street from
Twenty -first street to Twenty- second
street.
That ,i plat of said proposed sewer
is now on file in the office of the City
Recorder.
It is estimated by the City Engineer
that it will require:
438 lineal feet 8 -inch tile pipe.
2 manholes.
And will cost the abutting property
owners $372.00.
Any person having objections to the
construction of said sewer are hereby
notified to appear before the City
Council at its regular session to be
held August 3, 1911,` or to file their ob-
jections in writing with the City Re-
corder on or before the 3rd of August,
1911.

You and each of you are hereby
notified that it is the intention of the
City Council of the City of Dubuque
to improve Thirtieth Street from Elm
Street to Pine Street.
That a plat of said improvement is
now on file in the office of the City
Recorder.
It is estimated by the City Engineer
that said improvement will require:
336 lineal feet Comb. curb and
gutter.
514 square yards macadam.
88 cubic yards cutting.
94 cubic yards filling.
Making a total cost to the abutting
property owners of $604.00.
Any person having objections to

Mr. P. McCarthy addressed the coun-
cil and requested that the prayer of
the petitioners be granted at once.
Ald, O'Rourke moved that the prayer
of the petition of M. H. McCarthy et
al be granted. Ald. Sauer moved to
amend that a light be placed on Avon
street, Pleasant street and Sixth street.
Amendment carried by following

Motion lost.
Petition of C. H. Eighmey et al,
asking that the City Treasurer be
instructed to cancel taxes assessed
against the petitioners as stockhold-
ers of First National Bank in the
amounts as shown by statement an-
nexed to the petition, presented. On
motion of Ald. O'Rourke, referred to
the Committee of the Whole.
City Recorder Geiger presented and
read the notice, certified to by the
publishers, of the City Council's in-
tention to levy a special assessment
for the improvement of Delhi Street
from Asbury Street to the City Lim-
its. No remonstrance being filed and
no one in the room objecting, the no-
tice was, on motion of A ld. E. E.
McEvoy, received and filed.
City Recorder Geiger also present-
ed and read the notice, certified to by
the publishers, of the City Council's
intention to levy a special assessment
for the construction of a sanitary
sewer in the alley between Lemon
Street and Couler Avenue from Mill -
ville Road to Thirty - second Street,
easterly in Thirty- second Street to
the alley first east of Couler Avenue.
No remonstrance being filed and no
one in the room objecting, the notice
was, on motion of Ald. Specht, re-
ceived and filed.
City Recorder Geiger also present-
ed and read the notice, certified to
by the publishers, of the City Council's
intention to levy a special assessment
for the improvement of Twenty -sev-
enth Street from Elm to Pine Streets.
Mr. Rooney, Flick and Mr. Louis
Vogt being present, remonstrated
against the assessment. On motion of
Ald. Specht, notice was received and
filed and the remonstrance to be ad-
justed by the City Engineer and City
Attorney.
City Recorder Geiger also present-
ed and read the notice, certified to by
the publishers, of the City Council's
intention to construct a sanitary
sewer in Washington Street from
Twenty -first to Twenty- second Streets.
Mr. Schilling being present, remon-
strated against the sewer being con-
structed in Washington Street and
wanted the sewer constructed between
Washington and Elm Streets. Mr. C.
Jungk being present, asked that the
sewer be constructed as soon as pos-
sible, either in the street or proposed
alley. On motion of Ald. Specht, the
notice was received and filed and the
matter of location referred to the
Committee of the Whole.
City Recorder Geiger also presented
and read the notice, certified to by
the publishers of the City Council's
intention to improve Thirtieth Street
from Pine Street to Elm Street. Also
read the remonstrance of Henry E.
Schell et al, against the improvement.
On motion of Ald. Specht, the notice
and remonstrance were referred to
the Committee of the Whole.
Ala. O'Rourke moved that repair-
ing of Bluff Street by M. Tschirgi &
Son be referred to the Committee of
the Whole to view the ground at the
earliest possible time. Carried.

works Auditing Committee do not find
sufficient time to do the work, I have

Ald. Sauer stated that he was a
member of the committee appointed
to audit the reports of the Water De-
partment and the reason I never act-
ed on that committee was not because
of lack of time, as may have been
surmised, but it was because I felt
that I could not do myself nor the
people justice, because I am of the
confident opinion that no one except
an expert bookkeeper can go over
those hooks and have any compre-
hensive idea about them.
Ald. O'Rourke moved that the ap-
pointments as made by the Mayor be
approved. Carried.

Third and Seventh streets and the
railroad tracks and rivet front. Car-

Ald. Singrin asked to be informed
whose duty it was to have the wreck
from the fire at Ninth street cleared
from the street.
Ald. Specht moved that the clear-
ing of Ninth street be left with the
Mayor and Chairman on Fire with
power. Carried.
Ald. O'Rourke moved that the con-
tract for the improvement of Fourth
street from fluff west be awarded to
the O'Farrell Contracting Co., and the
bond be placed at 25 per cent of the
contract price. Carried.

Gentlemen: Your Board of Health
met in regular session July 28, 1911.
M1•. Jackson appeared before the
Board and stated that there were
some property owners along West
Fifth street and Hill street who had
connected their sanitary sewer with
the storm water sewer. Same referred
to the Sanitary Officer and Sewer In-
spector.
Mr. T. A, Herdman was also present
and stated that he would connect
with the sanitary sewer as soon as the
council had one constructed in Six-
teenth street. Same referred to the
City Engineer and Sanitary Officer to
ascertain the most feasable way to
construct a sewer in Sixteenth street,

and sent to the county for payment:

Recorder's office, would respectfully
recommend that a warrant in the suns
of $5.00 be ordered drawn on the
City Treasurer in payment for the
clock purchased by the Committee
Clerk for such use.
Your Committee of. the Whole, to
whom was referred the bill of Kenety
& Lee for $12.00 for 8 yards of ma-
cadam used in filling a trench dug by
plumbers in Bluff street, would re-
spectfully recommend that said bill be
returned to the makers thereof. -
Your Committee of the Whole, to
whom was referred the communica-
tion of the Telegraph - Herald relative
to the number of 1911 directories that
will be required by the city, would re-
spectfully recommend that thirteen
directories be ordered and that they
be distributed as follows: One for
each engine house, one for the patrol
house, one for police headquarters
and one for each of the following of-
fices: the Mayor's office, the Recor-
der's office, the Treasurer's and Aud-
itor's office, the City Engineer's office
and the City Attorney's office.
Your Committee of the Whole, to
whom was referred the petition of
the Dubuque Biscuit Co., asking that
its taxes be remitted for the year L910
in accordance with the recommenda-
tion of the City Council of April 26th,
1909, would respectfully recommend
that on account of said firm having
discontinued business, the said peti-
tion be not granted.

Gentlemen: I herewith submit my
report of defective lights for the month
of July, 1911. I find from the reports
of the Police Department that the to-
tal hours that 19 lamps failed to burn
would equal 2 lamps burning for one
month, or $10.00.

Committee on Supplies ascertain as to
what is needed in the line of beds and

Ald. Specht offered the following:
Whereas, The present custom of
excavating in streets and alleys for
the purpose of making gas, water or
sewer connections, in many cases al-
most immediately after the street or
alley has been improved, is very det-
rimental to the wearing surface of the
street or alley, and
Whereas, Section 4 of Chapter
XXXIII. of the Revised Ordinances of
1901 provides that all such connections
should be made prior to the improve-
ment of any street, alley or avenue
and makes it the duty of all persons,
co- partnerships, corporations or com-
panies to comply therewith, but af-
fixes no penalty for violation thereof,
therefore,
Be It Resolved by the City Council
of the City of Dubuque, that the Or-
dinance Committee and City Attorney
be and they are hereby instructed to
prepare an amendment to said ordin-
ance compelling the making of all
such connections, outlining the pro-
ceedings to be taken by the city in or-
dering the same made and providing
a penalty for failure to make such
connections.

Mayor Haas stated that this was a
special meeting and called for the pur-
pose of acting on the reports of the
Committee of the Whole, and any other
matter which may come before a regu-
lar meeting of the City Council.
Ald. Specht moved that the Council
proceedings for the month of June be
approved as printed. Carried.
Ald, Sauer moved that action on the
Council proceedings for the month of
July be deferred until next meeting of
the Council. Carried.
Petition of Dubuque Park Commis-
sioners stating that the sidewalk re-
cently built near the Eagle Point high
bridge had been damaged and asking
that the Council have the same re-
paired and prevent any further dam-
age being done to same, presented.
Ald. O'Rourke moved that this matter
be referred to the Street Commissioner
and the Sidewalk Inspector to investi-
gate and they report to the Committee
of the Whole. Carried.
Ald. O'Rourke moved that a warrant
be drawn in favor of E. J. Voggent-
thaler & Co., against the Deficiency
Fund in payment of their bill against
the Old Water Works account. Car-
ried.
Ald. E. E. McEvoy offered the fol-
lowing:

TON ZWACK PERMISSION TO
LAY AND MAINTAIN A SEWER
IN RIES STREET, IN THE CITY
OF DUBUQUE, TO CONNECT LOT
21, OSCAR TAYLOR SUB- DIVIS-
ION, WITH THE SANITARY
SEWER IN WINDSOR AVENUE,
AND REGULATING SUCH PER-
MISSION.
Be It Ordained by the City Council of
the City of Dubuque:
Section 1. That permission be and
the same is hereby granted Anton
Zwack, of the City of Dubuque, Iowa,
to lay at his own expense, a ewer
along Ries Street, connecting Lot 21,
Oscar Taylor Sub - division. with the
sanitary sewer now in Windsor avenue,
in said City.
Sec. 2. Said sewer shall he laid under
the direction and supervision of the
city • Engineer and Committee on
Sewers of said City, and in accordance
with plans and specifications prepared
by the City Engineer, said plans and
specifications to cover a sewer of such
size and location as to make the im-
provement practicable and serviceable
for present and future use in connec-
tion with the general sewerage system
in that vicinity.
Sec. 3. The City of Dubuque may at
any time grant the right to any other
person or company to connect with
said sewer, upon the latter paying to
the said Anton Zwack the proper pro-
portion of the cost of construction of
said sewer then due, any parties mak-
ing subsequent connections to reim-
burse, in turn, the said Anton Zwack
and parties having made prior connec-
tions, in accordance with the just pro-
portions then due the said Anton
Zwack and parties having made such
prior connections, the intention hereof
being to reimburse those having paid
for the cost of said sewer in such just
and fair proportions as the then total
number making use of said sewer bears
to the cost of the sewer, no one to be
reimbursed, however, in an amount in
excess of the actual expense advanced.
Sec. 4. —The said Anton Zwack shall
be entitled to the benefit of the pro -
visions contained in Section 3 hereof,
only on his written acceptance of the
terms of this ordinance, and on filing,
within 20 days from the time of the
completion of said sewer, in the office
of the City Recorder of said City, an
itemized sworn statement of the actual
cost of the construction of said sewer.
Failure to file such statement shall be
deemed to constitute a waiver of said
benefits, and shall entitle any person
or company to make connections with
said sewer without cost, provided due
consent to the making of such connec-
tions be first obtained from said City.
Sec. 5. This ordinance shall be in
force and effect from and after its
passage by the City Council and its
publication one time in the Times -
Journal and Telegraph - Herald, official
newspapers of said City, and its writ-
ten acceptance, duly indorsed hereon,
by the said Anton Zwack.

Maurice Brown, stating that through
an error the City Assessor had placed
the valuation of Lot 1 of 88 in Cox's
Addition at $2,500:00 and asking
therefore that the same be reduced,
would respectfully recommend that
the valuation on said lot be placed at
$850.00 and that the City Treasurer
be instructed to accept the taxes for
the year 1910 on the valuation so
fixed.
Your Committee of the Whole, to

J, Nagle, asking that the valuation
on the South 78 feet of City Lot 661
be reduced from $30,000.00 to
$25,000.00, would respectfully recom-
mend that the prayer of the peti-

the Park Board of the City of Du-
buque, asking that arrangements be
made by the City Council for widen-
ing the approach to the Eagle Point
high bridge to its full width of fifty
feet, would respectfully recommend
that the prayer of the petitioner be

would respectfully recommend that a
committee composed of the Mayor,
the two Aldermen -at- Large, Alder-
man Specht and the City Engineer be
appointed to prepare plans and
specifications for a levee at North
First Street and to submit the same
with an estimate of the cost thereof
to the City, Council at as early a date
as possible.
Your Committee of the Whole, to
whom was referred the petition of
the Misses H. R. and M. C. Hagger-
ty, stating that Lot 1 in Cooley's
hub. had been erroneously assessed
for the re- setting of curb in front
thereof and asking therefore that that
part of the assessment against said
lot for the improvement on Bluff
Street which was levied for the re-
setting of curb be canceled, would re-
spectfully recommend that the pray-
er of the petitioners be granted and
that the City Treasurer be instructed
accordingly. We would further rec-
ommend that the City Engineer be in-
structed to prepare a re- assessment
for said curbing, charging the same
to the property benefitted thereby.

proposed improvement on Jackson
Street, from the north curb line of
Seventh Street to the south lot line of
Eighth Street, and the kind of material
to be used, and an estimate of the en-
tire cost thereof, and the amount and
cost of such improvement, and the
amount assessable upon any railway
or street railway company, the amount
and cost thereof, to be paid by the city,
if any, and the cost thereof and
amount assessable upon each lot or
parcel of land adjacent to or abutting
upon ssch improvement per front foot,
and to file such plat and estimate in
the office of the city recorder; that af-
ter the filing of said plat and estimate
in his office, the city recorder shall
publish in three consecutive issues of
a newspaper published in this city, a
notice stating that such plat and esti-
mates are on file, the location and na-
ture of the improvement, kind of ma-
terial to be used, and an estimate of
its cost, and the time before which ob-
iections thereto can be filed, and the
time fixed for hearing, which time shall
not be less than five days after the
last publication of such notice, and af-
ter such publication shall have been
made, the city recorder shall, at the
next regular session of the City Coun-
cil, notify the Council thereof in writ-
ing, with a printed copy of such notice

gineer be instructed to prepare a profile
snowing the proposed grade of Valeria
Street from Kaufman Avenue to Hart
Street and submit same to the Coun-

at the earliest possible date to view

the construction of a sanitary sewer as

to provide for the cost of constructing
a sanitary sewer in the alley between
Couler Avenue and Lemon Street from
Millville Road south to Thirty- second

execute and deliver to the City Re-

Therefore be it resolved by the City
Council of the City of Dubuque:
That the City Engineer be and he
is hereby directed to prepare a plat
showing generally the location, nature
and extent of the proposed improve-
ment on the west side of Adams Ave-
nue between Reed Avenue and First
Avenue, and in front of and abutting
N. E. 1 /a of Lot 571 and S. W. 1 /2 of
Lot 571 and Lot 570, Ham's Add., and
the kind of material to be used, and
an estiamte of the entire cost thereof
and the amount and cost of such im-
provement, and the amount and cost
thereof, to be paid by the city, if any,
and the cost thereof and amount as-
sessable upon each lot or parcel of
land adjacent to or abutting upon such
improvement per front foot, and to
file such plat and estimate in the of-
fice of the City Recorder; that after
the filing of said plat and estimate in
his office, the City Recorder shall no-
tify said abutting and adjacent prop-
erty owners, as provided by ordinance,
that such palt and estimate are on
file, the location and nature of the im-
provement, kind of material to be
used and an estimate of its cost, and
the time before which objections
thereto can be filed, and the time fixed
for hearing, which time shall not be
less than five (5) days after the ser-
vice of such notice, and after such
service shall have been made, the
City Recorder shall, at the next reg-
ular session of the City Council, notify
the Council thereof in writing, with a
copy of such notice accompanying the
same.

a Sanitary Sewer in alley between
Rhomberg avenue and Garfield avenue
from Middle avenue to Reed , avenue,
and as soon as the said waiver is sign-
ed by the property owners the City
Recorder to advertise for bids for con-
struction of sewer. Carried.
Ald. O'Rourke moved that the City
Engineer be instructed to prepare
plans and specifications for the widen-
ing of Hill Street from the Diamond
House southerly, and the Committee of
the Whole with the Engineer to view
the ground as soon as possible. Car-

be appointed to arrange for the cover-

Whereas, by virtue of a resolution
adopted by its City Council on the 1st
day of September, 1904, the City ' of
Dubuque, Iowa, did issue a series of
numbered 271 to 284, both inclusive,
amounting to Seven Thousand Dol-
lars ($7,000.00), for the purpose of
refunding the unpaid balance of prior
issues of improvement bonds designat-
ed in said resolutions, and
Whereas, said refunding bonds were
to be paid from the proceeds of the
special assessments levied on the
property on and along the streets and
alley for which the original bonds
were issued, and
Whereas, of the assessments levied
to meet these bonds, amounting to
Seven Thousand Dollars ($7,000.00),
there has been paid into the City

the expense of certain improvements
in, upon and along certain streets and
an alley in the City of Dubuque, name-
ly: Sixteenth Street from Pine Street
to Sycamore Street, Hall Street from
Grace Street to Delhi Street, alley be-
tween Edith Street and Booth Street
from West Third Street to O'Neill
Street, Iowa Street from Third Street
to Fourteenth Street, North Glen Oak
Avenue from West Fourteenth Street
to Julien Avenue, Wood Street from
West Fourteenth Street to the south
line of Lot 4 in Myrtle Addition, Al-
pine Street from Julien Avenue to
West Third Street, West Third Street
from College Avenue to Walsh Street
and Wood Street from the south line
of Lot 4 in Myrtle Addition to the
south line of Mineral Lot 180, which
cost is payable by the abutting prop-
erty benefited thereby and by law a
lien on said abutting property and is
payable in seven annual installments,
with interest on said deferred pay-
ments at the rate of six per cent. per
annum, and it is hereby certified and
recited that all the acts, conditions
and things required to' be done pre-
cedent to and in the issuing of this
bond, have been properly done, hap-
pened and performed in regular and
due form, as required by law, and for
the payment hereof, both principal and
interest, the full faith and credit of
the City of Dubuque is hereby irrevo-
cably pledged in accordance with r, aid
Sections 848 and 849, Chapter 8, Title
V. of the Code of 1897 and the resolu-
tion of the City Council referred to.

spectfully report that we have exam-
ined the improvement of Tenth Street
from Main to Locust Street, Twelfth
Street from Locust to Bluff Street and
Fifteenth Street from Locust to Bluff
Street, I {enety & Lee, contractors, and
would respectfully recommend that the
curbing, gutering and paving on said
streets be accepted and that the City
Engineer be instructed to prepare a
special assessment against the lots or
parcels of real estate subject to as-
sessment for such improvement and
file the same in the office of the City
Recorder, who will thereupon publish
the notice of said assessment as re-
quired by ordinance. We further
recommend that the City Attorney be
instructed to give his opinion as early
as possible as to the liability of the
contractors for the completion of said
streets between the present curb and
the sidewalks.
Your Committee on Streets would re-
spectfully report that we have exam-
ined Bluff Street from Eighth Street to
Third Street and would recommend the
same for final acceptance. We further
recommend that the contractors, M.
Tschirgi & Sons, be paid the five per
cent retained for one year on said con-
tract and that a warrant in the sum
of $311.87 be ordered drawn on the
City Treasurer in their favor.
Your Committee on Streets would re-
spectfully report that we have exam-
ined the improvement on Fourth
Street from Bluff Street westerly to the
foot of the elevator, The O'Farrell Con-
tracting Co., contractors, and would
respectfully recommend that said work
be accepted and that the City Engi-
neer be instructed to prepare a,special
assessment against the lots or parcels
of land subject to assessment for said
improvement and file the same in the
office of the City . Recorder who will
thereupon publish the notice of said
assessment as required by ordinance.

Ald. Singrin moved that the Chief
of Police be instructed to enforce the
Ordinance in regard to the blocking of
railroad crossings. Carried.
Ald. Saul moved that the Street Com-
mi.sicner be instructed to notify the
C. M. & St. P. Ry. Co. and C. G. W.
Ry. Co. to repair the crossing at
Eighth street. Carried.
Aid. Singrin moved that the Recorder
notify the C., M. & St. P. Ry. Co. and
C. G. W. Ry. Co. to have a watchman
rlaced at the Fourteenth street cross-
ing and one on each side of the Elev-
enth street crossing. Carried.
Ald. E. E. McEvoy moved that the
City Attorney give his opinion as to
whether the railroad companies could
be required to light their right of way
in the city at intersections with streets
and alleys. Carried.

Notice to 'Sidewalk •Contractors.
Sealed proposals will be reoeived
at the Council Chamber, City Hall, by
the City Reoorder, until 8:00 p. m.,
Thursday, August 17, 1911, for the
improvement of the following streets
by laying cement sidewalks on a
foundation of cinders, in accordance
with the plans and specifications pre-
pared by the City Engineer, and now
on file in the office of the City Re-
corder:
A four -foot sidewalk on the south
.side of Leibnitz Street, between
North Main Streets and Paul Street,
abutting Lot 2 of 1 of (G. D. Wood's
Add.
Also: A six -foot sidewalk on the
north side of Seminary Street, be-
tween Madison Street and Paul Street.
abutting Lot 94, Cox Add.
Also: South side of Dodge Street,
between Bluff Street Extension and
Rising Avenue, abutting Lot 10, New-
man, Cooper and Smith 'Sub., six feet
wide.
Also: East side of Lincoln Avenue,
between Kniest Street and Johnson
Avenue, abutting Lot •6 of High
Street Sub., four feet wide.
Also: East side of Booth Street,

The work is to be paid for when
said work is completed and as pre-
scribed by the Ordinance relating to
the construction of sidewalks • in the
City of Dubuque, work to be com-
pleted on or before the 15th of Sep-
tember, 1911.
Bidders must state price per square
foot for sidewalks laid.
Each bid must be accompanied by
a certified check of $50 on some Du-
buque bank as a 'guarantee that a
contract will be entered into if
awarded.
The City reserves the right to re-
ject any and all bids.

Notice of Special Assessment.
Notice is hereby given to all con-
cerned that .a special assessment as
provided by law will be levied at a
regular session of the 'City Council to
be held August 17, 1911, to pay for
the brick paving of Twelfth Street,
from Clay to Main Streets, by O'Far-
rell Contracting Co., ,contractors.
Amount of special assessment,
$4,640.95, same to be assessed against
the abutting property upon and along
said street.
And that there is a plat and sched-
ule on file in the office of the City
Reoorder of said City of Dubuque,
showing the street in which said im-

provement was made, and the sepa-
rate lots and parcels of ground, or
specified portions thereof, subject to
assessment for such improvement, the
name of the owner thereof, as far as
practicable, and the amount to be as-
sessed against each lot or parcel of
ground, which plat and schedule are
subject to public inspection.
And that any and all persons ob-
jecting to said special assessment or
to said plat must file his or their ob-
jection in writing with the City Re-
corder of said City of Dubuque on or
before said session of the City Coun-
cil, to be held August 17, 1911, or to
appear at said session of the Council
to show cause, if any you have, why
'said assessment should not be levied.

AN ORDINANCE GRANTING THE
DUBUQUE PACKING CO. PER-
MISSION TO RUN PIPES ACROSS
AND OVER THE BEE BRANCH
SEWER IN THE ALLEY BE-
TWEEN CEDAR AND SYCAMORE
STREETS AND SIXTEENTH AND
SEVENTEENTH STREETS, IN
THE CITY OF DUBUQUE, AND
REGULATING SUCH GRANT.
Be • It Ordained by the City Council
of the City of Dubuque:
Section 1. That permission be and
the same is hereby granted the Du-
buque Packing Co. to run water,
steam and ammonia pipes over and
across the Bee Branch sewer in the
alley between Sycamore and Cedar
Streets and Sixteenth and Seven-
teenth Streets, in the City of Du-
buque, between the buildings of said
company located at the present time
on either side of said sewer, subject
to the conditions herein contained.
Said pipes are to be constructed and
placed in a safe manner, and are to
be at least twenty -two feet above the
upper surface of the covering over
said sewer, leaving a clear space of
said distance between such covering
and the lower portion of said pipes,
and in any event such pipes are to be
so placed and maintained as not to
interfere in any way with travel
upon and over said alley, and said
pipes are to be so maintained, guard-
ed and located as not to endanger
persons or animals passing over and
along said ,alley.
Sec. 2. Said pipes are to be 'con-
structed subject to the approval of
the City .Engineer and Street Com-
missioner of said 'city.
Sec. ,3. Said Dubuque Packing Co.
,shall, as .a condition to the granting
of this permission, guaranty, by .ac-
cepting the terms hereof, to fully
protect and save the City of Dubuque

harmless as to any claims, damages
or liabilities of any kind which
might arise because of the construe
tion and maintenance of the pipes
aforesaid, and in any suit which may
arise against the City because of
such pipes, said Company shall, at
the request of the City, make all
necessary defense thereto and fully
indenmnify the City as to any ex-
penses, liabilities or outlays made
necessary because of such suit.
Sec. 4. Should the City of Du-
buque at any time deem said pipes
or any part of them unsafe, or for any
other reason deem their removal
necessary or advisable, said City may
order the immediate removal of said
pipes or any part of them, and, on
the refusal of said company to
promptly remove same as directed,
said City may do so, charging the ex-
pense 'incident thereto to said com-
pany.
Sec. 5. This ordinance shall be in
force and effect from and after its
passage by the City Council and its
publication one time in the Dubuque
Times- Journal and Dubuque Tele-
graph- Herald, official newspapers of
said City, and written acceptance
hereof duly indorsed hereon by said
Dubuque Packing Co.

Public notice is hereby given that
at the session of the City Council
held on August. 3, 1911, the follow-
ing special assessment was levied on

and that in case of failure to pay
the one- seventh part within the time

AN ORDINANCE GRANTING AN-
TON ZWACK PERMISSION TO
LAY AND MAINTAIN A SEWER
IN RIES STREET, IN THE CITY
OF DUBUQUE, TO CONNECT LOT
21, OSCAR TAYLOR SUB- DIVIS-
ION, WITH THE SANITARY
SEWER IN WINDSOR AVENUE,
AND REGULATING SUCH PER-
MISSION.
Be It Ordained by the City Council of
the City of Dubuque:
Section 1. That permission be and
the same is hereby granted Anton
Zwack, of the City of Dubuque, Iowa,
to lay 'at his own expense, a sewer
along Ries Street, connecting Lot 21,
Oscar Taylor Sub - division, with the
24 13 sanitary sewer now in Windsor avenue,
in said City.
Sec. 2. Said sewer shall be laid under
8 04 - the direction and supervision of the
32 18 City Engineer and Committee on
Sewers of said City, and in accordance
32 18 with plans and specifications prepared
by the City Engineer, said plans and
5 63 specifications to cover a sewer of such
size and location as to make the im-
provement practicable and serviceable
5 36 for present and future use in connec-
tion with the general sewerage system
5 36 in that vicinity.
47 19 Sec. 3. The City of Dubuque may at
any time grant the right to any other
32 18 person or company to connect with
said sewer, upon the latter paying to
32 18 the said Anton Zwack the proper pro -
portion of the cost of construction of
said sewer then due, any parties mak-
32 18 ing subsequent connections to reim-
burse, in turn, the said Anton Zwack
32 18 and parties having made prior connec-
tions, in accordance with the just pro -
32 18 portions then due the said Anton
Zwack and parties having made such
32 18 prior connections, the intention hereof
being to reimburse those having paid
32 18 for the cost of said sewer in such just
and fair proportions as the then total
32 18 number making use of said sewer bears
to the cost of the sewer, no one to be
32 18 reimbursed, however, in an amount in
excess of the actual expense advanced.
32 18 Sec. 4. —The said Anton Zwack shall
be entitled to the benefit of the pro -
32 18 visions contained in Section 3 hereof,
only on his written acceptance of the
32 18 terms of this ordinance, and on filing,
within 20 days from the time of the
32 18 completion of said sewer, in the office
of the City Recorder of said City, an
32 18 itemized sworn statement of the actual
cost of the construction of said sewer.
32 18 Failure to file such statement shall be
deemed to constitute a waiver of said

benefits, and shall entitle any person
or company to make connections with
said sewer without cost, provided due
consent to the making of such connec-
tions be first obtained from said City.
Sec. 5. This ordinance shall be in
force and effect from and after its
passage by the City Council and its
publication one time in the Times -
Journal and Telegraph- Herald, official
newspapers of said City, and its writ-
ten acceptance, duly indorsed hereon,
by the said Anton Zwack.

AN ORDINANCE ESTABLISHING A
GRADE ON THE ALLEY BE-
TWEEN MAIN AND LOCUST
STREETS FROM FIFTEENTH TO
SIXTEENTH STREETS.
Be It Ordained by the City Council of
the City of Dubuque:
Section 1. That a grade on the alley
between Main and Locust Streets from
Fifteenth to Sixteenth Streets in the
City of Dubuque, Iowa, be and the
same is hereby established and adopt-
ed as shown by the profile of said street
and grade prepared by the City Engi-
neer and approved by the City Coun-
cil on the 3rd day of August, 1911, be-
ing Profile No. 693 and marked "Pro-
file alley between Main and Locust
from 15th to 16th Streets, B. M. Top
step of high school entrance, ele. 71:18.'
Said grade begins at the north line of
Fifteenth Street, which is station 0,
elevation east side 62.13, west side 63.77;
thence to station 2 +56.2, which is the
south line of Sixteenth Street. eleva-
tion east side 60.30, west side 61.05.
Sec. 2. This ordinance shall be in
force and take effect from and after
its passage by the City Council and Its
publication one time in the Dubuque
Telegraph - Herald and Times - Journal
newspapers.

posite the intersection on Union Ave.
That a plat of said proposed sewer
is now on rile in the office of the City
Recorder.
It is estimated by the City Engineer
that it will require
3,780 lineal feet 8 -inch tile pipe.
2,892 lineal feet 10 -inch tile pipe.
29 manholes,
and will cost the abutting property
owners $6,360.00.
Any person having objection to the
construction of said sanitary sewer
are hereby notified to appear before
the City Council at its regular session,
August 30th, 1911, or to file their ob-
jections in writing with the City Re-
corder on or before the 30th day of
August, 1911.

Sealed proposals will be received at
the Council Chamber, City Hall, by
the City Recorder until 8:00 p. m.,
Wednesday, August 30, 1911, for the
construction of a re- inforced concrete
storm water sewer, (known as the
Bee Branch sewer), across Thirty -
first Street, between Jackson and
Washington Streets, in accordance
with the plans and specifications pre-
pared by the City Engineer and now
on file in the office of the City Re-
corder.
The bidder will state the price per
lineal foot for completed sewer. Each
bid must be accompanied by a cer-
tified check of $250.00 on some Du-
buque bank as a guarantee that a
contract will be entered into if
awarded.
The City reserves the right to re-
ject any and all bids.

You and each of you are hereby no-
tified that it is the intention of the
City Council of the City of Dubuque,
to construct an 8 -inch tile pipe sani-
tary sewer in Broadway from present
manhole about opposite north line of
Lot 5 in Wulweber's Sub., southerly to
Blocklinger Lane, thence easterly in
said Lane to present sewer in Couler
avenue.
That a plat of said proposed sewer
is now on file in the office of the CitY
Recorder.
It is estimated by the City Engineer
that it will require:
710 lineal feet 8 -inch tile pipe,
4 manholes, and will cost the abut-
ting property owners $580.00.
Any person having objections to the
construction of said sewer are hereby
notified to appear before the City
Council at its regular session to be
held September 7th, 1911, or to file their
objections in writing with the City Re-
corder on or before the 7th of Septem-
ber, 1911.

mound Street.
Be It Ordained by the City Council
of the City of Dubuque:
Section 1, That a grade on the
alley first east of Belmound Street
from Rose Street to West Fourteenth
Street In the City of Dubuque, Iowa,
be and the same le hereby established
and adopted as shown by the profile
of said street and grade prepared by
the City Engineer and approved by
the City Council on the 3rd day of
August, 1911, being Profile No. 694
and marked "Profile showing grade
of alley first east of Belmound Street,
13. M. East ourb corner of Rose and
Delmottnd Streets, elevation 266,24."

Ald. Singrin moved that the Seventh
avenue matter be made the first order
of business. Carried.
Remonstrance of Sarah Ham, Christ.
Braun, J. A. Rhomberg estate, by A. L.
Rhomberg, against the levying of spec-
ial assessment for the improvement, of
Seventh avenue, read, Ald. Sauer
moved that the rules be suspended for
the purpose of allowing anyone pres-
E nt to address the council. Carried by
the following vote:

Miss Sarah Ham addressed the coun-
cil and asked that the proposed special
assessment for the improvement of
Seventh avenue be reduced and a por-

improvement be used for the payment.
Ald. O'Rourke moved, that the re-
monstrance of Sarah Ham be referred
to the Committee of the Whole. Car-
ried.
' Ald. Singrin moved that the other re-
monstrance against the Seventh ave-
nue assessment be referred to the Com-
mittee of the Whole. Carried.
