Aug, 17, 1911, the following special as-
sessment was levied on the real estate

of failure to pay the one - seventh part
within the time prescribed by the ordi-

for the purpose of considering any
matters that may come before any reg-
ular session.'
Ald. Singrin moved that the Seventh
avenue matter be made the first order
of business. Carried.
Remonstrance of Sarah Ham, Christ.
Braun, J. A. Rhomberg estate, by A. L.
Rhomberg, against the levying of spec-
ial assessment for the improvement, of
Seventh avenue, read. , Ald. Sauer
moved that the rules be suspended for
the purpose of allowing anyone pres-
€ nt to address the council. Carried by
the following vote:

Miss Sarah Ham addressed the coun-
cil and asked that the proposed special
assessment for the improvement of
Seventh avenue be, reduced and a por-
tion of the appropriation made for the
improvement be used for the payment.
Ald. O'Rourke moved that the re-
monstrance of Sarah Ham be referred
to the Committee of the Whole. Car-
ried.
Ald. Singrin moved that the other re-

remonstrance having been presented in
the early part of the meeting the no-
tice was, on motion of Ald. Specht, re-
ceived and filed.
City Recorder Geiger also presented
and read the notice certified to by the
publishers, of the City Council's inten-
tion to construct a Sanitary Sewer in
Broadway and Blocklinger Lane. No
remonstrance being filed and no one in
the room objecting, the notice was, on
motion of Ald. Specht, received and
filed.

Gentlemen: I herewith submit my
report of defective lights for the
month of August, 1911. I find from the
reports of the Police Department that
the total hours that 724 lamps. failed
to burn would equal 301 -3 lamps burn-
ing for one month, or $151.66.

City Attorney Lyon reported as fol-
lows:

Gentlemen: I beg to report that there
has been submitted to me, Quit Claim
Deed as to lots 2 and 5 of the Charles
Klingenberg Third Subdivision in the
City of Dubuque, Iowa, executed by
the heirs of William Hintrager, de-
ceased, said deed being given in the
matter of the adjustment of an action
brought by said Wm. Hintrager
against the City of Dubuque and num-
bered 14,862 Equity, being an action to
quiet title to said lots in accordance
with the action of the Council based
on the recommendation of your Com-
mittee on Claims, under date of Feb-
ruary 17th, 1910.

To the Honorable Mayor and City
Council:
Gentlemen: In response to your re-
quest for an opinion relative to the
rights of contractors for the improve-
ment of 10th, 12th and 15th street, be-
tween Locust and Bluff Streets, with
reference to the question of the re-
moval of old curbing in the sidewalks,
I desire to report that I have examined
the specifications and gone into the
Matter carefully otherwise and that it
is my belief that the obligation of re-
moving the curbing where the
same still remains, rests with the
contractors. And I am of the further
opinion that after reasonable notice
given the contractors to remove said
curbing and failure on their part to
comply with such notice, the committee
on streets and City Engineer may em-
ploy sufficient help to have the re-
quired work done and deduct the ex-
pense of the same from any money
which may be clue, or which may
hereafter become due to the contractor.

Gentlemen: I have examined re-
newal certificates on bonds of George
Ragatz, John Trexler and Matt. Staf-
ford, Police and Fire Commissioners,
for a period of one year, beginning
July 1, 1911, and also the original.
bend of Matt. Stafford, police and fire
commissioner, for the terns of six
years, dated the 4th of April, 1911.
Also renewal certificates of Philip
Breithaupt, plumber, for a period of
one year from June 2, 1911, and the
renewal certificates of John Mahoney,
street commissioner, for the period of
one year from May 2, 1911; also bond
of Eagle Point Lime Works covering
permit to blast within the city limits,
for one year from June 29th, 1911;
and find said bonds and renewal cer-
tificates executed in proper form, and
herewith return same.

Ald. O'Rourke moved the adoption of
the report. Carried.
Your Committee of the Whole, to
whom was referred the report of the
City Engineer, stating that it is impos-
sible for the abutters on the north side
of Dodge Street, immediately west of
Bluff Street, to connect with the pres-
ent sewer in Dodge Street, but that
connection could be made with a lat-
eral sewer running on the north side
of the storm sewer and connecting with
the present sanitary sewer about forty
feet west of the west line of Bluff
Street, would respectfully recommend
that the project be approved and that
the City Engineer be instructed to
prepare the necessary plans and that
such sewer be constructed without de-
lay from a point about sixty feet west
of the present manhole in Bluff Street,
northwesterly about severity feet to a
point back of the north curb of said
Dodge Street.
Your Committe of the Whole, to
whom was referred the special assess-
ment prepared for the improvement of
Delhi Street from Asbury Street to
the City Limits, would respectfully
recommend that said assessment be
levied and that the City Engineer be
instructed to deduct the sum of $250.00
from the amount now due on said con-
tract, to he withheld until such time
as the minor defects now apparent in
said contract are remedied.
Your Committee of the Whole, to
whom was referred the communication
of Chas. Schwinn relative to water
flowing from the alley and adjoining
Lots .into his cellar, would respectfully
recommend that the Street Commis-
sioner be instructed to do the neces-
sary grading at a cost of not to exceed
$30.00.
Your Committee of the Whole would
respectfully recommend that the City
Electrician be instructea to notify the
proper parties to have all telephone,
power and other poles removed without
delay from along the line of the pro-
posed widening of Hill Street.
Your Committee of the Whole, to
whom was referred the statement
showing the valuation of assessment
purposes fixed by the State Executive
Council for the year 1911 on railroads
and express companies entering the
City of Dubuque, would respectfully
recommend that said statement be re-
ferred to the City At *orney and City
Assessor.
Your Committee of the Whole, to
whom was referred the remonstrance
of A. W. Austin et al against the levy-
ing of the special assessment for the
improvement of Delhi Street from As-
bury Street to the City Limits, would
respectfully recommend that said re-
monstrance be received and filed and
that a special committee composed of
Aldermen Saul and McEvoy, City En-
gineer Baumgartner and Street Com-
missioner Mahoney be appointed to see
that the necessary repairs be made
in said street.

Be it Resolved by the City Council
of the city of Dubuque, That it is
deemed necessary and advisable to
construct a sanitary sewer in Arling-
ton Street as follows, to -wit: An
eight inch tile pipe sanitary sewer in
said Arlington Street from present
manhole at the intersection of High-
land Place westerly to a point
about opposite the center of Lot 796
in A. McDaniel's Sub., and to assess

Gentlemen: Under instructions from
your Honorable Body I beg to report
that I have examined the conditions on
Arlington street, and find that if said
street were improved to a width of
thirty feet between curbs it would ne-
cessitate the chopping down or cut-
ting of shade trees. As the amount of
travel along Arlington street does not
require a thirty foot driveway, I would
respectfully recommend that the width
of same from westerly curb line of
Highland Place to the easterly curb
line of Prairie street be reduced to
twenty -six feet.

Gentelemn: I beg to report to
your Honorable Body that the time for
which the Assistant City Engineer has
been engaged has about expired. We
have a large amount of work to be
done within the next few months.
Some of the jobs are as follows: Mt.
Pleasant Avenue sewer, sewer between
Rhomberg and Garfield, sewer in West
Eighth street, improvement of First
street, improvement of Arlington
street, improvement of Mt. Rose Ter-
race and Highland Place, improve-
ment of Grandview Heights, Booth
street, sewer in Blocklinger Lane and
a great many other small jobs. Be-
cause of this large amount of work I
would recommend that the Assistant
City Engineer be retained at present.

amined the sanitary sewer in Rhom-
berg Avenue from a point opposite the
center of Lot 15 in Smedley's Subdiv-
ision easterly to Kniest street, The
O'Farrell Contracting Co., contractor,
and would recommend that said sewer
be accepted and that the City Engi-
neer be instructed to prepare a Special
Assessment against the lots and par-
cels of real estate subject to assess-
ment for said improvement and file
the same in the office of the City Re-
corder, who will thereupon publish
the notice of said assessment, as re-
quired by ordinance.
Your Committee on Sewers would
respectfully report that we have ex-

Grace Street and the alley first north
of Grace Street and running parallel
therewith, between East Street and
Louisa Street, and for the vacation of
said alley from the easterly line of
said unnamed street extended, wester-
ly to East Street in the city of Du-
buque;
And, whereas, it is represented in
said petition that said corporation is
the owner of all the land on both sides
of the said street, and also the prop-
erty on both sides of said alley, and
that this street and alley can be of no
use to the public,
And, whereas, the City Council sees
no valid objection to granting said
petition and giving the use of the land
so vacated to said school for school
purposes,
Therefore be it ordained by the City
Council of the City of Dubuque:
Section 1. That the unnamed street
lying between Grace Street and the al-
ley first north of Grace street and run-
ning parallel therewith between East
Street and Louisa Street, and for the
vacation of said alley from the easterly
line of said unnamed street extended,
westerly to East Street in the City of
Dubuque, be and the same is hereby
vacated and the use thereof granted
to the said Dubuque German College
and Seminary for school purposes, sub-
ject to - the conditions hereinafter nam-
ed, provided, that if at any time the
said Dubuque German College and
Seminary should cease to exist, or
should cease to use said vacated land
for school purposes, then the land now
vacated shall revert back to the City
of Dubuque, and this ordinance shall
be null and void.
Sec. 2., This Ordinance is based on
the condition that the terms of the ac-
ceptance hereof endorsed hereon, be
signed by the said Dubuque German
College and Seminary.
This Ordinance shall be in force and
take effect from and after its passage
by the City Council and its publication
one time in the Telegraph - Herald and
Times - Journal, official newspapers.

mittee on Fire stated that the commit-
tee thought that the old_ fire truck now
at the Ninth street engine house ought
to be sold. Ald. O'Rourke moved that
the Committee on Fire advertise the
truck for sale in the Midland Munici-
palities. Carried.
Ald. Sauer, chairman of the Public
Grounds and Buildings Committee, re-
ported that the floor in the Ninth
street engine house needed repairs. Ald.
Saul moved that the Committee on
Public Grounds and Buildings be em-
powered to have the floor at Ninth
street engine house repaired. Carried.
Ald. E. E. McEvoy moved that the
contract for construction of Mt.
Pleasant Avenue sanitary sewer be
awarded to T. J. Hassett and the bond
be placed at 25 per cent of contract
price. Carried.
Ald. O'Rourke proved that the mat-
ter of securing the proper deeds for
the widening of Hill street be referred
to the City Attorney. Carried.
Ald. E. E. McEvoy moved that as
soon as the proper waivers are signed
and filed with the City Recorder for
the improvement of Clifford Street he
shall advertise for bids for doing said
work. Carried.
The City Engineer presented a profile
showing proposed grade on Clifford
Street from Seminary street to the al-
ley first north of Seminary street.
Ald. E. E. McEvoy moved the grade
be adopted and the Ordinance Com-
mittee be instructed to draft the proper
ordinance. Carried.
Ald. O'Rourke offered the following:
Whereas, the contract heretofore en-
tered into by the City of Dubuque for
the improvement of a street as here-
inafter described has been completed,
and the City Engineer has computed
that the cost and expense of said im-
provement amount to $6,339.81,
Therefore, Be it Resolved by the City
Council of the City of Dubuque, That
to provide for the cost of improving
Delhi Street from Asbury Street west-
erly to the city limits, the Mayor be
and he is hereby required to execute
and deliver to the City Recorder, to be

Petition of The Dubuque, Iowa,
Knights of Columbus Building Assn.,
asking that they be granted permis-
sion to connect with Sanitary Sewer
now in the alley between Main and
Locust Streets and for that purpose
it be allowed through some duly au-
thorized firm of plumbers to exca-
vate in Locust Street from said build-
ing south to Seventh Street, thence
east in Seventh Street to the said
sewer in alley between Main and Lo-
cust Streets.
Also that they be granted permis-
sion to construct and maintain an
area -way in rear of their building,
running the length of said building,
and not to encroach more than four
feet on the alley. The walls of said
area -way to be constructed of con-
crete and to be surmounted by an
iron railing of sufficient strength to
prevent accidents, presented. Ald.
Singrin moved that the prayer of pe-
titioner be granted. Carried.
Communication from Hurd, Lene-
han & Kiesel, attorneys for National
Meter Co. of New York, asking that
the Council provide for the issuance
of a warrant for the sum of $1,516.19,
the amount claimed to be due the
said firm, and the warrant to be paid
out of next year's tax to be levied
for that purpose and to draw 6 per
cent interest. Ald. O'Rourke moved
that communication be referred to

their factory in the City of Dubuque

Resolved, that said improvement
sha'l be completed on or before the
first day of December, 1911, and

a permanent sidewalk thereon com-

City Council of the City of Dubuque,
That the City Engineer be and he is
hereby directed to prepare a plat
showing generally the location, na-
ture and extent of the proposed im-
provement on the east side of Elm
Street between Thirteenth and Four-
teenth Streets, and in front of and
abutting Lot 165, East Dubuque
Add., and the kind of material to be
used, and an estimate of the entire
cost thereof and the amount and
cost therof, to be paid by the City,
if any, and the cost thereof and
amount assessable upon each lot or
parcel of land adjacent to or abut-
ting upon such improvement per
front foot, and to file such plat and
estimate in the office of the City Re-
corder; that after the filing of said
plat and estimate in his office, the
City Recorder shall notify said abut-
ting and adjacent property owners, as
provided by ordinance, that such
plat and estimate are on file, the lo-
cation and nature of the improve-
ment, kind of material to be used,
and an estimate of its cost, and the
time before which objections thereto
can be filed, and the time fixed for
hearing, which time shall not be less
than five (5) days after the service
of such notice, and after such service
shall have been made, the City Re-
corder shall, at the next regular ses-
sion of the City Council, notify the
Council thereof in writing, with a
copy of such notice accompanying the
same.

Your Special Committee, appointed
to audit the reports of the Water
Works Trustees, would respectfully
report that we have examined the six
quarterly reports submitted, covering
a period of from 'January' 1, 1910, to
June 30, 1911, and find the same to
correspond with the books and vouch-
ers in the said Trustees' office, and
the balance on hand: as shown by
said reports, to agree with the books
of the City Treasurer.
We further report that we find the
system of keeping acdounts in both
the Water Department and the City
Treasurer's office to be so arranged
as to greatly facilitate the work of
auditing the reports, and that
through the kindly assistance of the
officers in both of said offlce5, we
were enabled to complete our labors
much more expeditiously than wee' an-

he had connected his property with the
sanitary sewer in West Seventh street,
and tound in making said connection
that there are no water mains in said
street and. was tieretol•e..1orced to con-
nect with the mains in Hill street, at
a cost of over $300.00 entailed on him
by reason of having to go so far for
connection with the water mains, and
us a that he be granted some relief in
the way of reducing the assessment
levied against his lot for the construc-
tion of the sanitary sewer in West Sev-

Petition of Dubuque Trades and Labor
congress, signed by Joseph Horner,
president, J. N. Krahl, secretary, and
about 185 other citizens asking that the
City Council to name an Arbitration
Committee, consisting of one of the
following gentlemen for the citizens of
Dubuque, Hon. Judge Shiras, O'Donnell
and Matthews, or any other disinter-
ested citizen, which is to be agreed
upon by the following committees of
the Open Shop Contractors and the
Dubuque Trades and Labor congress,
to -wit: Messrs. W. S. Molo, J. W.
Newburg and H. B. Martin for the
Open Shop contractors and the Citi-
zen's Alliance, and the following rep-
resentatives of the unions of the city
of Dubuque: Hon. John D. Denison,
Jr., Maximillian Rathberger and, Wm.
Griebling, of the United Brotherhood
of Carpenters and Joiners of
America; for the purpose of
hearing and to cause an investi-
gation immediately and to summon
before them any or all officers and
those affiliated with any of the unions,
Citizen's Alliance or Open Shop con-
tractors organizations.
We further petition your honorable
body, that the committee be vested
with full power to do any and all
things they deem wise and prudent in
bringing about an amicable settlement
between the factions mentioned above.
We further ask that this petition be
kept intact, and no changes be made,
either in wording or the committees
asked for unless said changes, if there
be any, be first submitted to the ma-
jority of said committees herein named,
and further we ask whatsoever ex-
pense shall be incurred by said corn=
tnittee shall be borne by the city of
Dubuque.

City Recorder Geiger presented
and read the notice, certified to by
the publishers, of the City Council's
intention to levy a special assessment
for the improvement of Tenth Street
passage of such resolution, which no-
tice shall contain a copy thereof, on
the owner of each of the lots, or parts
of lots, fronting or abutting upon the
said contemplated improvement, when
the owner can be found in the city, or
upon his agent or attorney for the
property, if he has any in the city,
which notice shall be personally
served. When the person attempting
such service has made sworn return
to the City Recorder that no one is
found upon whom such service can be
made, then the Recorder shall imme-
diately publish such notice twice in
the official newspaper in the city.
Publication of such .notice herein pro-
vided for shall be held sufficient no-
tice as to such absentee or non -res-
ident; the personal service or last
publication to be at least 15 clear days
before the date upon which the City
may begin the construction of such
walk. And the officer, serving such
notice shall make due return of the
service, or in case of publication in
the newspaper, proper return thereof
shall be made as in the case of pub-
lication of legal notices, and the no-
tice and return shall be filed with the
Recorder and by him preserved among
the records of the City.
Sec. 5. That during the time pro-
vided in the notice in the preceding
section referred to, the property hold-
er may procure a permit and build or
have such sidewalk built, but if he does
not do so within said time then it
shall be built by the City and the cost
thereof assessed against his property
as hereinafter provided.
Sec. 6. If the owner or holder of
any lot, or part of lot, shall neglect to
lay his sidewalk in conformity with
the order hereinbefore provided for,
the City Council shall contract for the
same to be ,done at the expense of the
City and shall let such contract to the
lowest bidder after advertising for
bids, said advertisement to consist of
' two publications in the official paper
of the City, the last publication to be
five (5) clear days before the letting
of the contract. When such sidewalk
is built the Engineer shall make his
report of :he expense thereof to the
City Council, and. if the same be ap-
proved by said Council they shall
forthwith levy a special tax on each
let,. or part of lot abutting on such
improvement, sufficient to pay the
costs of the improvement made in
front thereof, which assessment shall
conform to the provisions of Section
792' A of he Supplement of 1907 of
the Code of Iowa. Said assessment
shall be a lien on the lots or parts of
lots and shall be levied' and collected
the same as other special assessments.
Sec. 7. Any person or firm desir-
ing to engage in the construction of
permanent sidewalks for private busi-
ness, or for the City of Dubuque, shall

execute a surety company bond in the
sum of $1,000, to be approved by
the City Attorney, conditioned that
he will hold the City harmless from
damage because of the carelessness
of himself or his employes while con-
structing said walk and that he will
keep the walk in good and perfect re-
pair for the time stated in the plans
and specifications and shall be liable
on said bond to the City and property
holder for any damage, loss and ex-
pense caused by reason of his failure
to build such walk according to speci-
fications, and for any breach of the
. .ond.
One of the conditions of the bond
shall be that the Engineer's decision
that the walk needs repair shall be
final. No bond shall be good for a
longer period than one year.
Sec. 8. All permanent sidewalks
built shall be subject at all times to
inspection and control by the City and
shall be approved by the Engineer
and Street Commissioner before the
person or firm doing the work shall be
entitled to demand or receive pay from
the property owner for building the
same, and the Engineer and Street
Commissioner must report to the Coun-
cil on every permanent sidewalk built
by private contractor, or by the City
contractor. The contractor building a
walk under private contract shall re-
port its completion to the Street Com-
missioner.
The Council may order any sidewalk
which is not in accordance with the
plans and specifications taken up and
replaced and the person or firm build-
ing the same shall be liable on their
bond for failure so to do within the
time specified. The City Council or the
Mayor may revoke any permit without
notice.
Sec. 0. Permanent sidewalk certifi-
cates may be issued in the same man-
ner and to the same effect as street
improvement and sewer certificates
provided for in Chapter 8 of Title V. of
the Code and the owner of any lot or
parcel of land against which an as-
sessment for permanent sidewalks is
made may at the time of making said
special assessment take advantage of
the provisions. of Sections 791b, to 7911i
inclusive of the Supplement of 1907 to
the Code of Iowa, which assessments
shall bear interest at the rate of 6 per
cent per annum.
Sec. 10. All objections to the cost of
construction of permanent sidewalks,
as provided by the Code, against the
lots or parcels of land in front of which
the same are constructed and all ob-
jections to the prior proceedings, on
account of errors, irregularities or in-
equalities must be made in writing and
filed with the City Recorder prior to
the date fixed' for said assessment; and
all objections not so made shall be
deemed waived except where fraud is
shown.

AN ORDINANCE RELATING TO
BUILDING OF PERMANENT AND
TEMPORARY SIDEWALKS, AND
PROVIDING FOR THE REPAIR
OF SIDEWALKS, IN THE CITY
OF DUBUQUE.
Pe It Ordained by the City Council
of the City of Dubuque.
Sec. 1. That all permanent side -
walks hereafter built or laid on any
street, shall not be laid until the body
of the same shall have been graded,
so that when complete such sidewalk
shall he at the established grade, 'and
all sidewalks, unless otherwise order-
ed, shall be permanent sidewalks and
shall be constructed of cement or ar-
tificial stone, as provided in the plans
and specifications for permanent side-
walks prepared by the City Engineer
and approved by the City Council.
Sec. 2. It shall be the duty of the
City Engineer, upon the taking ef-
fect of this ordinance, to sub}' ;rit plans
and specifications for permanent and
temporary sidewalks to the Council,
and the Council upon making such
changes as they deem advisable, shall
approve the same and such plans and
specifications' so approved shall con-
stitute the plans and specifications for
permanent and temporary sidewalks
and shall continue in force until
changed by the Council.
Sec. 3. Any property owner may
build a permanent sidewalk in front
of or along his property at any time
at his own expense, by securing a per -
hrit as hereafter provided, but such
sidewalks shall conform strictly to
this ordinance and the plans and
specifications then in force, and no
permanent sidewalk shall be built by
any person without securing the per-
mit therefor, and whoever shall build
or undertake to build, or have any per-
son build for him any permanent side-
walk, without having first secured a
permit therefor, shall be uilty of a
misdemeanor, but no perm' shall ex-
tend for more than fifteen (15) days.
Sec. 4. The City Council may by
resolution order a permanent sidewalk
constructed in front of any piece of
property abutting upon any street,
giving the name of the owner, if
known, describing the place where
the same is to be built, and stating
the kind of material to be used, and
when the sidewalk is to be completed.
And it shall be the duty of the Side-
walk Inspector or the Chief of Police,
or some other police officer by him
designated, to serve a notice of the

FROM KAUFMAN AVENUE TO
HART STREET.
Be it Ordained by the City Council
of the City of Dubuque:
Section 1. That a grade on Valeria
Street from Kaufman Avenue to Hart
Street in the City of Dubuque, Iowa,
be and the same is hereby established
and adopted as shown by the profile
of said street and grade prepared by
the City Engineer and approved by the
City Council on the 17th day of Au-
gust, 1911, being Profile No. 696, and
marked "Profile and Grade of Valeria
St. from Kaufman Ave. to Hart St."
Said grade begins at the center of
Kaufman Avenue, which is station 0,
elevation 40.6; thence to station +20,
elevation 41.0; thence to station 3, ele-
vation 62.5; thence to station 5 +16, ele-
vation 67.0.
Section 2. This ordinance shall be
in force and take effect from and after
its passage by the City Council and its
publication one time in the Dubuque

Sec. 11. The Council may by resolu-
tion or order direct the building of a
temporary sidewalk along or in front
of any lot, part of lot or parcel of land
in front of which a permanent sidewalk
cannot be constructed, and describe the
place and the time in which the same
may be done, which shall not be less
than ten days from the date of such
order or resolution. Such sidewalks so
ordered shall not be less than 4 feet in
width, unless otherwise ordered by the
Council and shall be constructed in the
manner provided for in the specifica-
tions hereinbefore referred to.
Sec. 12. Notice of said resolution or
order shall be given the owner or his
agent or attorney for the property in
the manner specified in Section 4 of
this ordinance.
Sec. 13. The cost of building such
temporary sidewalks shall not exceed
40c the lineal foot and shall in all
cases be in proportion to the special
benefits conferred on the property
thereby, and not in excess thereof.
Sec. 14. If the holder or owner of any
lot, parcel of ground or land shall ne-
glect or refuse to comply with such
order within the time therein stated
the City may at once proceed to con-
struct said sidewalk as provided in
said order, by contractors or such
other agencies as the Sidewalk Inspec-
tor may select, but the same shall be
done under the supervision of the City
Engineer and such Sidewalk Inspector.
Sec. 15. That whenever it shall be
deemed necessary or expedient by the
Sidewalk Inspector of the City to re-
pair any temporary or permanent side-
walk within the limits of said City,
said Inspector shall give to the owners
of each or any lot abutting upon such
sidewalk, a notice of not less than 24
hours, requiring said owner to repair
said sidewalk or any portion thereof
under the direction of said Inspector,
which notice shall be in writing and
Personally served upon said owner, his
agent or attorney in charge of said
property, if found in the City. If such
owner, agent or attorney cannot be
found within the City then said repair
may be made by said Inspector with-
out giving any notice. In the event of
failure to make such repair so ordered,
the said Inspector shall repair said
sidewalk promptly at the expense of
said abutting property and the owners
thereof and report the same to the City
Council.
In the event said sidewalk Inspector
deems an immediate repair or removal
of any defective sidewalk necessary he
shall have authority to make such re-
pair or removal without notice.
Sec. 16.. As soon as any temporary
sidewalk or any repair on any sidewalk
has been completed as hereinbefore
provided, the Sidewalk Inspector and
City Engineer shall report the cost of
such sidewalk or repair to the City
Council, and if the same shall be ap-
proved by said Council they shall forth-
with levy a special tax on each lot,
part of lot or land abutting on said .
sidewalk sufficient to pay the Costs of
the improvement or repair made in
fr:int thereof, said .. assessment to be
a lien on the lot or parts of lot or land
in question and shall be levied and
collected the same as other special
assessments, •
Sec. 17. All other ordinances or
amendments to ordinances heretofore
enacted by the City Council of the City
of Dubuque, in reference to the build-
ing of permanent or temporary side -
wolks or the repair of sidewalks, are
hereby repealed and declared to be no
longer in force and effect.
Provided: That the laying of perma-
nent or temporary sidewalks, or the
repairs of any sidewalk, that May have
been heretofore ordered under existing
ordinances, may be . completed in ac-
cordance with the terms • thereof in the
discretion of the City . .Council.
Sec. 18. This Ordinance shall be in
force and effect from , and ' after its
passage by the • City Council and its
publication in the official newspapers
of said City.

paid by the abutting property, the
valuation of which will not stand the
full assessment, charging the City of
Dubuque with the difference up to
the above mentioned sum of $2,500.-
00, and to file said new assessment
in the office of the City Recorder for
publication. -

titled "An Ordinance relating to

City of Dubuque, that the claim of
the National Meter company against
the Dubuque Water Department, in-
curred during the years 1906 -1907, upon
which there is now a balance due in the
sum of . $1179.60, together with interest
thereon from July 4, 1908, at 6 per cent,
be and the same is hereby admitted
and allowed if found correct.
Resolved further that the amount
due upon said claim, together with in-
terest thereon, shall be paid in the year
of 1912, out of a general appropriation,
or by special appropriation or tax to
be provided for at the time of making
the annual appropriatign for city pur-
poses in said year. And the city here-
by waves all objections to said claim
on the ground of the statute of limita-
tions or the failure of claimant to
prosecute said claim at any time with-
in the period of said statute.

meeting was an adjourned meeting of

in consideration of their deeding to
the city the ground necessary to open
said alley twenty . feet wide through
their property, and stating they were
willing to abide by this agreement.
Ald. Singrin moved that any action
taken previous to this time in regard to
the Wodrich estate and the sewer in
the alley between Garfield avenue and
Rhomberg avenue be rescinded and
the prayer of petitioner be granted.

Ald. Sauer asked why the district
between Third street and Seventh
street and east of the railroad tracks
was not being patroled by a police-
man. The mayor stated he would look
into the matter.
Ald. Singrin reported that the Com-
mittee on Fire had purchased beds for
the Fire department,
Ald. Specht reported that Committee
on Markets had instructed Market -
master Norton to have the necessary
repairs made to the water pipes in
City Hall.
Ald. Sauer presented a bid from Mr.
John L. Drehouse for the repairing of
the ceiling and whitewashing the cala-
boose. Ald. Saul moved that the City
Recorder be instructed to advertise for
bids for the repairing of ceiling anc'
whitewashing the calaboose. Carried.
Ald. E. E. McEvoy moved that the
cost for placing return curb on Penn
street be deducted from the assessment
for the improvement of Delhi street
and the City Treasurer instructed.

Ald. E. E. McEvoy moved that the
City Attorney be instructed to draft
the proper instrument of writing
showing that the return on Penn
street is a temporary one and when a
permanent one is placed the property
owners are to be assessed for same,
and the City Recorder have the same
recorded with the county. Carried.
Ald. Sauer moved that the City
Treasurer be instructed to collect
$1,200 from the County Treasurer for
the County Road Fund and the same
to be divided between the First and
Fifth wards.
Ald. E. E. McEvoy offered the fol-
lowing amendment, but received no
second: That the City Treasurer be
instructed to collect $1,800 from the
County Treasurer for the County Road
Fund and the same be divided be-
tween the First, Fourth and Fifth
wards.
Ald. J. W. McEvoy amended second,
by Ald. Saul, That the City Treasurer
be instructed to collect from the
County Treasurer the sum of $1,200,
to be divided between the First,
Fourth and Fifth wards, and the bal-
ance of the fund available to be ex-
pended on the roads adjacent to and
leading into the county, which are
most in need of same, and the Com-
mittee of the Whole to view the var-
ious roads. Carried.

Ald. Singrin offered the following:
Whereas it is deemed necessary and
expedient to improve the east side of
Elm street between Thirteenth street
and Fourteenth street in front of and
abutting the premises hereinafter de-
scribed by laying down a permanent
sidewalk thereon, composed of cement
material, four feet wide.
Therefore be it resolved by the City
Council of the City of Dubuque, That
the City Engineer be and he is hereby
directed to prepare a plat showing
generally the location, nature and ex-
tent of the proposed improvement on
the east side of Elm street between
Thirteenth and Fourteenth streets,
and in front of and abutting lot 195,
East Dubuque Add. and the kind of
material to be used, and an estimate
of the entire cost thereof and the
amount and cost of such improvement,
and the amount and cost thereof, to
be paid by the city, if any, and the
cost thereof and amount assessable
upon each lot or parcel of land ad-
jacent to or abutting upon such im-
provement per front foot, and to file
such plat and estimate in the office of
the City Recorder; that after the filing
of said plat and estimate in his office,
the City Recorder shall notify said
abutting and adjacent property own-
ers, as provided by ordinance, that
such plat and estimate are on file, the
location and nature of the improve-
ment, kind of material to be used, and
an estimate of its cost, and the time
before which objections thereto can
be filed, and the time fixed for hear-
ing, which time shall not be less than
five (5) days after the service of such
notice, and after such service shall
have been made, the City Recorder
shall, at the next regular session of
the City Council, notify the Council
thereof in writing, with a copy of such
notice accompanying the same,

Gentlemen: Inasmuch as Wm. S.
Molo and J. W. Newburg, appointed by
your Honorable Body to act for the
open shop people, and kindred bodies
in an arbitration of existing industrial
difficulties in our City, declined to act
for reasons given in a written com-
munication, and inasmuch as W. B.
Martin, similarly appointed, failed to
appear, we request that other men be
appointed by your body, to act with
us; these to be named after consulta-
tion with the persons and bodies whom
the above three men were to repre-
sent. All to the end that a fair and
impartial effort may be made to ad-
just our industrial difficulties and se-
cure a return to normal and peaceful
industrial conditions in our commun-

on Fire be empowered to have a new
brake placed on the truck wagon, the
same not to cost over $100. Carried.
Ald. Singrin reported that one of
the fire horses at the Ninth Street
Engine House was in bad shape. Ald.

advertise for the purchase of horse
for Fire Department. Carried.
Ald. Sauer reported that the roof
on the Patrol House was in need of
repairs. Ald. Singrin moved the re-
pairing of Patrol House roof be left
with the Public Grounds and Build-

Ald. Sauer asked why it was there
was no policeman patroling the dis-
trict between Third and Seventh
streets, east of the railroad tracks.
The mayor stated that there is to be
one assigned there.

light on Mt. Pleasant Avenue had

it had been ordered.

Attorney be instructed to notify Mr.
F. Beutin to replace Garfield Avenue
in proper condition and if he fails so
to do in a reasonable time the city
will begin legal proceedings to com-

Sealed proposals will be received at
the Council Chamber, City Hall, by the
City Recorder, until 8:00 p. m., Thurs-
day, September 14th, 1911, for the con-
struction of an 8 -inch tile pipe sanitary
sewer, i.. Mount Pleasant avenue from
Julien avenue to the north end of said
Mount Pleasant avenue, with the low-
est level at Vernon street, thence east-
erly in Vernon street to North Glen
Oak avenue, thence northerly in Glen
Oak avenue and through Mineral Lot
176 and part of Mineral Lot 183 and the
unnamed strip lying east of Mineral
Lot 183 to Rosedale avenue, thence a
ten -inch tile pipe sewer northerly in
Rosedale avenue to West Locust
street, thence easterly in West Locust
street to present manhole at intersec-
tion of Union avenue, in accordance
with the plans and specifications pre-
pared by the City Engineer and now on
file in the office of the City Recorder.
It is estimated by the City Engineer
that it will require:
8780 lineal feet of 8 -inch tile pipe.
2892 lineal feet of 10 -inch tile pipe.

The work is to be paid for when said
work is completed anc as presented by
Chapter XXXII., of the Revised Ordi-
nance of 1901 of the City of Dubuque.
work to be completed on or before the
15th of December, 1911.
Bidders will state the price per lineal
foot of completed sewer, and price per

All bids must be accompanied by a
certified check for $500.00 on some Du-
buque bank as a guarantee that a con-
tract will be entered into if awarded.
The City reserves the right to reject

You and each of you are hereby
notified that it is the intention of
the City Council of the City of Du-
buque, to improve Cornell Street
rom West Fourteenth Street to
West Fifteenth Street.
That a plat of the proposed im-
provement is now on file in the of-
fice of the City Recorder.
It is estimated by the City Engi-
neer that it will require:

the City Attorney, conditioned that
he will hold the City harmless from
damage because of the carelessness
of himself or his employes while con-
structing said walk and that he will
keep the walk in good and perfect re-
pair for the time stated in the plans
and specifications and shall be liable
on said bond to the City and property
holder for any damage, loss and ex-
pense caused by reason of his failure
to build such walk according to speci-
fications, and for any breach of the
one.
One of the conditions of the bond
shall be that the Engineer's decision
that the walk needs repair shall be
final. No bond shall be good for a
longer period than one year.
Sec. 8. All permanent sidewalks
built shall be subject at all times to
inspection and control by the City and
shall be approved by the Engineer
and Street Commissioner before the
person or firm doing the work shall be
entitled to demand or receive pay from
the property owner for building the
same, and the Engineer and Street
Commissioner must report to the Coun-
cil on every permanent sidewalk built
by private contractor, or by the City
contractor. The contractor building a
walk under private contract shall re-
port its completion to the Street Com-
missioner.
The Council may order any sidewalk
which is not in accordance with the
plans and specifications taken up and
replaced and the person or firm build-
ing the same shall be liable on their
bond for failure so to do within the
time specified. The City Council or the
Mayor may revoke any permit without
notice.
Sec. 9. Permanent sidewalk certifi-
cates may be issued in the same man-
ner and to the same effect as street
improvement and sewer certificates
Provided for in Chapter 8 of Title V. of
the Code and the owner of any lot or
parcel of land against which an as-
sessment for permanent sidewalks is
made may at the time of making said
special assessment take advantage of
the provisions of Sections 791b to 791h
inclusive of the Supplement of 1907 to
the Code of Iowa, which assessments
shall bear interest at the rate of 6 per
cent per annum.
Sec. 10. All objections to the cost of
construction of permanent sidewalks,
as provided by the Code, against the
lots or parcels of land in front of which
the same are constructed and all ob-
jections to the prior proceedings, on
account of errors, irregularities or in-
equalities must be made in writing and
filed with the City Recorder prior to
the date fixed for said assessment; and
all objections not so made shall be
deemed waived except where fraud is
shown.
Sec. 11. The Council may by resolu-

tion or order direct the building. of a
temporary sidewalk along or in front
of any lot, part of lot or parcel of - land
in front of which a permanent sidewalk
cannot be constructed, and describe the
place and the time in which the same
may be dOne, which shall not be less
than ten days from the date of such
order or resolution. Such sidewalks so
ordered shall not be less than 4 feet in
width, unless otherwise ordered by the
Council and shall be constructed in the
manner provided for in the specifica-
tions hereinbefore referred to.
Sec. 12. Notice of said resolution or
order shall be given the owner or his
agent or attorney for the property in
the manner specified, in Section 4 of
this ordinance.
Sec. 13. The cost of building such
temporary sidewalks shall not exceed
40c the lineal foot and shall in all
cases be in proportion to the special
benefits conferred on the property
thereby, and not in excess thereof.
Sec. 14. If the holder or owner of any
lot, parcel of ground or land shall ne-
glect or refuse to comply with such
order within the time therein stated
the City may at once proceed to con-
struct said sidewalk as provided in
said order, by contractors or such
other agencies as the Sidewalk Inspec-
tor may select, but the same shall be
done under the supervision of the City
Engineer and such Sidewalk Inspector.
Sec. 15. That whenever it snail be
deemed necessary or expedient by the
Sidewalk Inspector of the City to re-
pair any temporary or permanent side-
walk within the limits of said City,
said Inspector shall give to the owners
of each or any lot abutting upon such
sidewalk, a notice of not less than 24
hours, requiring said owner to repair
said sidewalk or any portion thereof
under the direction of said Inspector,
which notice shall be in writing and
personally served upon said owner, his
agent or attorney in charge of said
property, if found in the City. If such
owner, agent or attorney cannot be
found within the City then said repair
may be made by said Inspector with-
out giving any notice. In the event of
failure to make such repair so ordered,
the said Inspector shall repair said
sidewalk promptly at the expense of
said abutting property and the •owners
thereof and report the same to the City
Council.
In the event said sidewalk Inspector
deems an immediate repair or removal
of any defective sidewalk necessary he
shall have authority to make such re-
pair or removal without notice.
Sec. 16. As soon as any temporary
sidewalk or any repair on any sidewalk
has been completed as hereinbefore
provided, the Sidewalk Inspector and
City Engineer shall report the cost of
such sidewalk or repair to the City
Council, and if the same shall be ap-

AN ORDINANCE RELATING TO
BUILDING OF PERMANENT AND
TEMPORARY SIDEWALKS, AND
PROVIDING FOR THE REPAIR
OF SIDEWALKS, IN THE CITY
OF DUBUQUE.
Be It Ordained by the City Council
of the City of Dubuque.
Sec. 1. That all permanent side-
walks hereafter built or laid on any
street, shall not be laid until the body
of the same shall have been graded,
so that when complete such sidewalk
shall be at the established grade, and
all sidewalks, unless otherwise order-
ed, shall be permanent sidewalks and
shall be constructed of cement or ar-
tificial stone, as provided in the plans
and specifications for permanent side-
walks prepared by the City Engineer
and approved by the City Council.
Sec. 2. It shall be the duty of the
City Engineer, upon the taking ef-
fect of-this ordinance, to submit plans
and specifications for permanent and
temporary sidewalks to the Council,
and the Council upon making such
changes as they deem advisable, shall
approve the same and such plans and
specifications so approved shall con-
stitute the plans and specifications for
permanent and temporary sidewalks
and shall continue in force until
changed by the Council.
Sec. 3. Any property owner may
build a permanent sidewalk in front
of or along his property at any time
at his own expense, by securing a per-
mit as hereafter provided, but such
sidewalks shall conform strictly to
this ordinance and the plans and
specifications then in force, and no
permanent sidewalk shall be built by
any person without securing the per-
mit therefor, and whoever shall build
or undertake to build, or have any per-
son build for him any permanent side-
walk, without having first secured a
permit therefor, shall be guilty of a
misdemeanor, but no permit shall ex-
tend for more than fifteen (15) days.
Sec. 4. The City Council may by
resolution order a permanent sidewalk
constructed in front of any piece of
property abutting upon any street,
giving the name of the owner, if
known, describing the place where
the same is to be built, and stating
the kind of material to be used, and
when the sidewalk is to be completed.
And it shall be the duty of the Side-
walk Inspector or the Chief of Police,
or some other police officer by him
designated, to serve a notice of the
passage of such resolution, which no-

tice shall contain a copy thereof, on
the owner of each of the lots, or parts
of lots, fronting or abutting upon the
said contemplated improvement, when
the owner can be found in the city, or
upon his agent or attorney for the
property, if he has any in the city,
which notice shall be personally
served. When the person attempting
such service has made sworn return
to the City Recorder that no one is
found upon whom such service can be
made, then the Recorder shall imme-
diately publish such notice twice in
the official newspaper in the city.
Publication of such notice herein pro-
vided for shall be held sufficient no-
tice as to such absentee or non -res-
ident; the personal service or last
publication ti be at least 15 clear days
before the date upon which the City
may begin the construction of such
walk. And the officer serving such
notice shall make due return of the
service, or in case of publication in
the newspaper, proper return thereof
shall be made as in the case of pub-
lication of legal notices, and the no-
tice and return shall be filed with the
Recorder and by him preserved among
the records of the City.
Sec. 5. That during the time pro-.
vided in the notice in the preceding
section referred to, the property hold-
er may procure a permit and build or
have such sidewalk built, but if he does
not do so within said time then it
shall be built by the City and the cost
thereof assessed against his property
as hereinafter provided.
Sec. 6. If the owner or holder of
any lot, or part of lot, shall neglect to
lay his sidewalk in conformity with
the order hereinbefore provided for,
the City Council shall contract for the
same to be none at the expense of the
City and shall let such contract to the
lowest bidder after advertising for
bids, said advertisement to consist of
two publications in the official paper
of the City, the last publication to be
five (5) clear days before the letting
of the contract. When such sidewalk
is built the Engineer shall make his
report of ;he expense thereof to the
City Council, and if the same be ap-
proved by said Council they shall
forthwith levy a special tax on each
let, or part of lot abutting on such
improvement, sufficient to pay the
costs of the improvement made in
front thereof, which assessment shall
conform to the provisions of Section
792 A of the Supplement of 1907 of
the Code of Iowa. Said assessment
shall be a lien on the lots or parts of
lots and shall be levied and collected
the same as other special assessments.
Sec. 7. Any person or firm desir-
ing to engage in the construction of
permanent sidewalks for private busi-
ness, or for the City of Dubuque, shall
execute a surety company bond in the

proved by said Council they shall forth-
with levy a special tax on each lot,
part of lot or land abutting on said
sidewalk sufficient to pay the costs of
the improvement or repair made in
front thereof, said assessment to be
a Mien on the lot or parts of lot or land
in question and shall be levied and
collected the same as other special
assessments.
Sec. 17. All other ordinances or
amendments to ordinances heretofore
enacted by the City Council of the City
of Dubuque, in reference to the build-
ing of permanent or temporary side-
walks or the repair of sidewalks, are
hereby repealed and declared to be no
lcnger in force and effect.
Provided: That the laying of perma-
nent or temporary sidewalks, or the
repairs of any sidewalk, that may have
been heretofore ordered under existing
ordinances, may be completed in ac-
cordance with the terms thereof in the
discretion of the City Council.
Sec. 18. This Ordinance shall he in
force and effect from and after its
passage by the City Council and its
publication in the official newspapers
of said City.
