I find from the reports of the Police Department that the total hours that 724 lamps. failed to burn would equal 301 -3 lamps burn- ing for one month, or $151.66. Respectfully submitted, WM. City Attorney Lyon reported as fol- lows: To the Honorable Mayor and City Council: Gentlemen: I beg to report that there has been submitted to me, Quit Claim Deed as to lots 2 and 5 of the Charles Klingenberg Third Subdivision in the City of Dubuque, Iowa, executed by the heirs of William Hintrager, de- ceased, said deed being given in the matter of the adjustment of an action brought by said Wm. Hintrager against the City of Dubuque and num- bered 14,862 Equity, being an action to quiet title to said lots in accordance with the action of the Council based on the recommendation of your Com- mittee on Claims, under date of Feb- ruary 17th, 1910. To the Honorable Mayor and City Council: Gentlemen: In response to your re- quest for an opinion relative to the rights of contractors for the improve- ment of 10th, 12th and 15th street, be- tween Locust and Bluff Streets, with reference to the question of the re- moval of old curbing in the sidewalks, I desire to report that I have examined the specifications and gone into the Matter carefully otherwise and that it is my belief that the obligation of re- moving the curbing where the same still remains, rests with the contractors. And I am of the further opinion that after reasonable notice given the contractors to remove said curbing and failure on their part to comply with such notice, the committee on streets and City Engineer may em- ploy sufficient help to have the re- quired work done and deduct the ex- pense of the same from any money which may be clue, or which may hereafter become due to the contractor. O'Rourke moved the adoption of the report. Carried. Your Committee of the Whole, to whom was referred the report of the City Engineer, stating that it is impos- sible for the abutters on the north side of Dodge Street, immediately west of Bluff Street, to connect with the pres- ent sewer in Dodge Street, but that connection could be made with a lat- eral sewer running on the north side of the storm sewer and connecting with the present sanitary sewer about forty feet west of the west line of Bluff Street, would respectfully recommend that the project be approved and that the City Engineer be instructed to prepare the necessary plans and that such sewer be constructed without de- lay from a point about sixty feet west of the present manhole in Bluff Street, northwesterly about severity feet to a point back of the north curb of said Dodge Street. Your Committe of the Whole, to whom was referred the special assess- ment prepared for the improvement of Delhi Street from Asbury Street to the City Limits, would respectfully recommend that said assessment be levied and that the City Engineer be instructed to deduct the sum of $250.00 from the amount now due on said con- tract, to he withheld until such time as the minor defects now apparent in said contract are remedied. Your Committee of the Whole, to whom was referred the communication of Chas. Schwinn relative to water flowing from the alley and adjoining Lots .into his cellar, would respectfully recommend that the Street Commis- sioner be instructed to do the neces- sary grading at a cost of not to exceed $30.00. Your Committee of the Whole would respectfully recommend that the City Electrician be instructea to notify the proper parties to have all telephone, power and other poles removed without delay from along the line of the pro- posed widening of Hill Street. Your Committee of the Whole, to whom was referred the statement showing the valuation of assessment purposes fixed by the State Executive Council for the year 1911 on railroads and express companies entering the City of Dubuque, would respectfully recommend that said statement be re- ferred to the City At *orney and City Assessor. Your Committee of the Whole, to whom was referred the remonstrance of A. W. Austin et al against the levy- ing of the special assessment for the improvement of Delhi Street from As- bury Street to the City Limits, would respectfully recommend that said re- monstrance be received and filed and that a special committee composed of Aldermen Saul and McEvoy, City En- gineer Baumgartner and Street Com- missioner Mahoney be appointed to see that the necessary repairs be made in said street. McEvoy offered the following: Be it Resolved by the City Council of the city of Dubuque, That it is deemed necessary and advisable to construct a sanitary sewer in Arling- ton Street as follows, to -wit: An eight inch tile pipe sanitary sewer in said Arlington Street from present manhole at the intersection of High- land Place westerly to a point about opposite the center of Lot 796 in A. McDaniel's Sub., and to assess the cost of said sewer against the abutting property. Ald. E. E. McEvoy moved the adoption of the resolution. Carried by the following vote: Yeas—Alds. E. E. McEvoy, J. McEvoy offered the following: Be it Resolved by the City Council of the City of Dubuque, That the City Engineer be and he is hereby directed to prepare a plat and speci- fications for an eight inch tile pipe sanitary sewer in Arlington Street from the present manhole at the in- tersection of Highland Place, wes- terly to a point about opposite the 324 Adjourned Regular Session, Sept. 8, 1911 City Engineer Baumgartner pre- sented the plat showing the location of proposed brick paving on First street. Ald. Saul moved that the plat be approved and the City Recorder ad- vertise for bids for doing said work. Carried. City Engineer Baumgartner re- ported as follows: To the Honorable Mayor and City Council: Gentlemen: Under instructions from your Honorable Body I beg to report that I have examined the conditions on Arlington street, and find that if said street were improved to a width of thirty feet between curbs it would ne- cessitate the chopping down or cut- ting of shade trees. As the amount of travel along Arlington street does not require a thirty foot driveway, I would respectfully recommend that the width of same from westerly curb line of Highland Place to the easterly curb line of Prairie street be reduced to twenty -six feet. To the Honorable Mayor and City Council: Gentelemn: I beg to report to your Honorable Body that the time for which the Assistant City Engineer has been engaged has about expired. We have a large amount of work to be done within the next few months. Some of the jobs are as follows: Mt. Pleasant Avenue sewer, sewer between Rhomberg and Garfield, sewer in West Eighth street, improvement of First street, improvement of Arlington street, improvement of Mt. Rose Ter- race and Highland Place, improve- ment of Grandview Heights, Booth street, sewer in Blocklinger Lane and a great many other small jobs. Be- cause of this large amount of work I would recommend that the Assistant City Engineer be retained at present. Respectfully submitted, C. H. BAUMGARTNER, City Engineer. Ald. Singrin, chairman of the Com- mittee on Sewers, reported as follows: Your Committee on Sewers would respectfully report that we have ex- amined the sanitary sewer in Rhom- berg Avenue from a point opposite the center of Lot 15 in Smedley's Subdiv- ision easterly to Kniest street, The O'Farrell Contracting Co., contractor, and would recommend that said sewer be accepted and that the City Engi- neer be instructed to prepare a Special Assessment against the lots and par- cels of real estate subject to assess- ment for said improvement and file the same in the office of the City Re- corder, who will thereupon publish the notice of said assessment, as re- quired by ordinance. Your Committee on Sewers would respectfully report that we have ex- amined the sanitary sewer in Wash- ington Street from Twentieth Street to Twenty -first Street, Street & Steuck, contractors, and would recommend that the said sewer be accepted and that the City Engineer be instructed to prepare a special assessment against the lots or parcels of land subject to assessment for said improve- ment and file the same in the office of the City Recorder, who will thereupon publish the notice of said assessment as required by ordinance. The City Engineer presented a profile showing proposed grade on Clifford Street from Seminary street to the al- ley first north of Seminary street. Ald. E. E. Petition of The Dubuque, Iowa, Knights of Columbus Building Assn., asking that they be granted permis- sion to connect with Sanitary Sewer now in the alley between Main and Locust Streets and for that purpose it be allowed through some duly au- thorized firm of plumbers to exca- vate in Locust Street from said build- ing south to Seventh Street, thence east in Seventh Street to the said sewer in alley between Main and Lo- cust Streets. Also that they be granted permis- sion to construct and maintain an area -way in rear of their building, running the length of said building, and not to encroach more than four feet on the alley. The walls of said area -way to be constructed of con- crete and to be surmounted by an iron railing of sufficient strength to prevent accidents, presented. Ald. Singrin offered the following: Whereas, It is deemed necessary and expedient to improve the east side of Elm Street between Thir- teenth Street and Fourteenth Streets in front of and abutting the premises hereinafter described by laying down a permanent sidewalk thereon com- posed of cement material; Therefore, Be it Resolved by the City Council of the City of Dubuque, That the City Engineer be and he is hereby directed to prepare a plat showing generally the location, na- ture and extent of the proposed im- provement on the east side of Elm Street between Thirteenth and Four- teenth Streets, and in front of and abutting Lot 165, East Dubuque Add., and the kind of material to be used, and an estimate of the entire cost thereof and the amount and cost therof, to be paid by the City, if any, and the cost thereof and amount assessable upon each lot or parcel of land adjacent to or abut- ting upon such improvement per front foot, and to file such plat and estimate in the office of the City Re- corder; that after the filing of said plat and estimate in his office, the City Recorder shall notify said abut- ting and adjacent property owners, as provided by ordinance, that such plat and estimate are on file, the lo- cation and nature of the improve- ment, kind of material to be used, and an estimate of its cost, and the time before which objections thereto can be filed, and the time fixed for hearing, which time shall not be less than five (5) days after the service of such notice, and after such service shall have been made, the City Re- corder shall, at the next regular ses- sion of the City Council, notify the Council thereof in writing, with a copy of such notice accompanying the same. Krahl, secretary, and about 185 other citizens asking that the City Council to name an Arbitration Committee, consisting of one of the following gentlemen for the citizens of Dubuque, Hon. Judge Shiras, O'Donnell and Matthews, or any other disinter- ested citizen, which is to be agreed upon by the following committees of the Open Shop Contractors and the Dubuque Trades and Labor congress, to -wit: Messrs. W. S. Molo, J. W. Newburg and H. B. Martin for the Open Shop contractors and the Citi- zen's Alliance, and the following rep- resentatives of the unions of the city of Dubuque: Hon. John D. Denison, Jr., Maximillian Rathberger and, Wm. Griebling, of the United Brotherhood of Carpenters and Joiners of America; for the purpose of hearing and to cause an investi- gation immediately and to summon before them any or all officers and those affiliated with any of the unions, Citizen's Alliance or Open Shop con- tractors organizations. We further petition your honorable body, that the committee be vested with full power to do any and all things they deem wise and prudent in bringing about an amicable settlement between the factions mentioned above. We further ask that this petition be kept intact, and no changes be made, either in wording or the committees asked for unless said changes, if there be any, be first submitted to the ma- jority of said committees herein named, and further we ask whatsoever ex- pense shall be incurred by said corn= tnittee shall be borne by the city of Dubuque. City Recorder Geiger presented and read the notice, certified to by the publishers, of the City Council's intention to levy a special assessment for the improvement of Tenth Street passage of such resolution, which no- tice shall contain a copy thereof, on the owner of each of the lots, or parts of lots, fronting or abutting upon the said contemplated improvement, when the owner can be found in the city, or upon his agent or attorney for the property, if he has any in the city, which notice shall be personally served. When the person attempting such service has made sworn return to the City Recorder that no one is found upon whom such service can be made, then the Recorder shall imme- diately publish such notice twice in the official newspaper in the city. Publication of such .notice herein pro- vided for shall be held sufficient no- tice as to such absentee or non -res- ident; the personal service or last publication to be at least 15 clear days before the date upon which the City may begin the construction of such walk. And the officer, serving such notice shall make due return of the service, or in case of publication in the newspaper, proper return thereof shall be made as in the case of pub- lication of legal notices, and the no- tice and return shall be filed with the Recorder and by him preserved among the records of the City. Sec. 5. That during the time pro- vided in the notice in the preceding section referred to, the property hold- er may procure a permit and build or have such sidewalk built, but if he does not do so within said time then it shall be built by the City and the cost thereof assessed against his property as hereinafter provided. Sec. 6. If the owner or holder of any lot, or part of lot, shall neglect to lay his sidewalk in conformity with the order hereinbefore provided for, the City Council shall contract for the same to be ,done at the expense of the City and shall let such contract to the lowest bidder after advertising for bids, said advertisement to consist of ' two publications in the official paper of the City, the last publication to be five (5) clear days before the letting of the contract. When such sidewalk is built the Engineer shall make his report of :he expense thereof to the City Council, and. if the same be ap- proved by said Council they shall forthwith levy a special tax on each let,. or part of lot abutting on such improvement, sufficient to pay the costs of the improvement made in front thereof, which assessment shall conform to the provisions of Section 792' A of he Supplement of 1907 of the Code of Iowa. Said assessment shall be a lien on the lots or parts of lots and shall be levied' and collected the same as other special assessments. Sec. 7. Any person or firm desir- ing to engage in the construction of permanent sidewalks for private busi- ness, or for the City of Dubuque, shall Regular Session, Sept. ,21 1911 execute a surety company bond in the sum of $1,000, to be approved by the City Attorney, conditioned that he will hold the City harmless from damage because of the carelessness of himself or his employes while con- structing said walk and that he will keep the walk in good and perfect re- pair for the time stated in the plans and specifications and shall be liable on said bond to the City and property holder for any damage, loss and ex- pense caused by reason of his failure to build such walk according to speci- fications, and for any breach of the . .ond. One of the conditions of the bond shall be that the Engineer's decision that the walk needs repair shall be final. No bond shall be good for a longer period than one year. Sec. 8. All permanent sidewalks built shall be subject at all times to inspection and control by the City and shall be approved by the Engineer and Street Commissioner before the person or firm doing the work shall be entitled to demand or receive pay from the property owner for building the same, and the Engineer and Street Commissioner must report to the Coun- cil on every permanent sidewalk built by private contractor, or by the City contractor. The contractor building a walk under private contract shall re- port its completion to the Street Com- missioner. The Council may order any sidewalk which is not in accordance with the plans and specifications taken up and replaced and the person or firm build- ing the same shall be liable on their bond for failure so to do within the time specified. The City Council or the Mayor may revoke any permit without notice. Sec. 0. Permanent sidewalk certifi- cates may be issued in the same man- ner and to the same effect as street improvement and sewer certificates provided for in Chapter 8 of Title V. of the Code and the owner of any lot or parcel of land against which an as- sessment for permanent sidewalks is made may at the time of making said special assessment take advantage of the provisions. of Sections 791b, to 7911i inclusive of the Supplement of 1907 to the Code of Iowa, which assessments shall bear interest at the rate of 6 per cent per annum. Sec. 10. All objections to the cost of construction of permanent sidewalks, as provided by the Code, against the lots or parcels of land in front of which the same are constructed and all ob- jections to the prior proceedings, on account of errors, irregularities or in- equalities must be made in writing and filed with the City Recorder prior to the date fixed' for said assessment; and all objections not so made shall be deemed waived except where fraud is shown. 340 Regular Session, Sept. 21, 1911 Approved by Committee on Sewers. Sec. 1. That all permanent side - walks hereafter built or laid on any street, shall not be laid until the body of the same shall have been graded, so that when complete such sidewalk shall he at the established grade, 'and all sidewalks, unless otherwise order- ed, shall be permanent sidewalks and shall be constructed of cement or ar- tificial stone, as provided in the plans and specifications for permanent side- walks prepared by the City Engineer and approved by the City Council. Sec. 2. It shall be the duty of the City Engineer, upon the taking ef- fect of this ordinance, to sub}' ;rit plans and specifications for permanent and temporary sidewalks to the Council, and the Council upon making such changes as they deem advisable, shall approve the same and such plans and specifications' so approved shall con- stitute the plans and specifications for permanent and temporary sidewalks and shall continue in force until changed by the Council. Sec. 3. Any property owner may build a permanent sidewalk in front of or along his property at any time at his own expense, by securing a per - hrit as hereafter provided, but such sidewalks shall conform strictly to this ordinance and the plans and specifications then in force, and no permanent sidewalk shall be built by any person without securing the per- mit therefor, and whoever shall build or undertake to build, or have any per- son build for him any permanent side- walk, without having first secured a permit therefor, shall be uilty of a misdemeanor, but no perm' shall ex- tend for more than fifteen (15) days. Sec. 4. The City Council may by resolution order a permanent sidewalk constructed in front of any piece of property abutting upon any street, giving the name of the owner, if known, describing the place where the same is to be built, and stating the kind of material to be used, and when the sidewalk is to be completed. Section 2. This ordinance shall be in force and take effect from and after its passage by the City Council and its publication one time in the Dubuque 342 Regular Session, Sept 21, 1911 Sec. 11. The Council may by resolu- tion or order direct the building of a temporary sidewalk along or in front of any lot, part of lot or parcel of land in front of which a permanent sidewalk cannot be constructed, and describe the place and the time in which the same may be done, which shall not be less than ten days from the date of such order or resolution. Such sidewalks so ordered shall not be less than 4 feet in width, unless otherwise ordered by the Council and shall be constructed in the manner provided for in the specifica- tions hereinbefore referred to. Sec. 12. Notice of said resolution or order shall be given the owner or his agent or attorney for the property in the manner specified in Section 4 of this ordinance. Sec. 13. The cost of building such temporary sidewalks shall not exceed 40c the lineal foot and shall in all cases be in proportion to the special benefits conferred on the property thereby, and not in excess thereof. Sec. 14. If the holder or owner of any lot, parcel of ground or land shall ne- glect or refuse to comply with such order within the time therein stated the City may at once proceed to con- struct said sidewalk as provided in said order, by contractors or such other agencies as the Sidewalk Inspec- tor may select, but the same shall be done under the supervision of the City Engineer and such Sidewalk Inspector. Sec. 15. That whenever it shall be deemed necessary or expedient by the Sidewalk Inspector of the City to re- pair any temporary or permanent side- walk within the limits of said City, said Inspector shall give to the owners of each or any lot abutting upon such sidewalk, a notice of not less than 24 hours, requiring said owner to repair said sidewalk or any portion thereof under the direction of said Inspector, which notice shall be in writing and Personally served upon said owner, his agent or attorney in charge of said property, if found in the City. If such owner, agent or attorney cannot be found within the City then said repair may be made by said Inspector with- out giving any notice. In the event of failure to make such repair so ordered, the said Inspector shall repair said sidewalk promptly at the expense of said abutting property and the owners thereof and report the same to the City Council. In the event said sidewalk Inspector deems an immediate repair or removal of any defective sidewalk necessary he shall have authority to make such re- pair or removal without notice. Sec. 16.. As soon as any temporary sidewalk or any repair on any sidewalk has been completed as hereinbefore provided, the Sidewalk Inspector and City Engineer shall report the cost of such sidewalk or repair to the City Council, and if the same shall be ap- proved by said Council they shall forth- with levy a special tax on each lot, part of lot or land abutting on said . sidewalk sufficient to pay the Costs of the improvement or repair made in fr:int thereof, said .. assessment to be a lien on the lot or parts of lot or land in question and shall be levied and collected the same as other special assessments, • Sec. 17. One of the conditions of the bond shall be that the Engineer's decision that the walk needs repair shall be final. No bond shall be good for a longer period than one year. Sec. 8. All permanent sidewalks built shall be subject at all times to inspection and control by the City and shall be approved by the Engineer and Street Commissioner before the person or firm doing the work shall be entitled to demand or receive pay from the property owner for building the same, and the Engineer and Street Commissioner must report to the Coun- cil on every permanent sidewalk built by private contractor, or by the City contractor. The contractor building a walk under private contract shall re- port its completion to the Street Com- missioner. The Council may order any sidewalk which is not in accordance with the plans and specifications taken up and replaced and the person or firm build- ing the same shall be liable on their bond for failure so to do within the time specified. The City Council or the Mayor may revoke any permit without notice. Sec. 9. Permanent sidewalk certifi- cates may be issued in the same man- ner and to the same effect as street improvement and sewer certificates Provided for in Chapter 8 of Title V. of the Code and the owner of any lot or parcel of land against which an as- sessment for permanent sidewalks is made may at the time of making said special assessment take advantage of the provisions of Sections 791b to 791h inclusive of the Supplement of 1907 to the Code of Iowa, which assessments shall bear interest at the rate of 6 per cent per annum. Sec. 10. All objections to the cost of construction of permanent sidewalks, as provided by the Code, against the lots or parcels of land in front of which the same are constructed and all ob- jections to the prior proceedings, on account of errors, irregularities or in- equalities must be made in writing and filed with the City Recorder prior to the date fixed for said assessment; and all objections not so made shall be deemed waived except where fraud is shown. The Council may by resolu- Official Notices $67 tion or order direct the building. of a temporary sidewalk along or in front of any lot, part of lot or parcel of - land in front of which a permanent sidewalk cannot be constructed, and describe the place and the time in which the same may be dOne, which shall not be less than ten days from the date of such order or resolution. Such sidewalks so ordered shall not be less than 4 feet in width, unless otherwise ordered by the Council and shall be constructed in the manner provided for in the specifica- tions hereinbefore referred to. Sec. 12. Notice of said resolution or order shall be given the owner or his agent or attorney for the property in the manner specified, in Section 4 of this ordinance. Sec. 13. The cost of building such temporary sidewalks shall not exceed 40c the lineal foot and shall in all cases be in proportion to the special benefits conferred on the property thereby, and not in excess thereof. Sec. 14. If the holder or owner of any lot, parcel of ground or land shall ne- glect or refuse to comply with such order within the time therein stated the City may at once proceed to con- struct said sidewalk as provided in said order, by contractors or such other agencies as the Sidewalk Inspec- tor may select, but the same shall be done under the supervision of the City Engineer and such Sidewalk Inspector. Sec. 15. That whenever it snail be deemed necessary or expedient by the Sidewalk Inspector of the City to re- pair any temporary or permanent side- walk within the limits of said City, said Inspector shall give to the owners of each or any lot abutting upon such sidewalk, a notice of not less than 24 hours, requiring said owner to repair said sidewalk or any portion thereof under the direction of said Inspector, which notice shall be in writing and personally served upon said owner, his agent or attorney in charge of said property, if found in the City. If such owner, agent or attorney cannot be found within the City then said repair may be made by said Inspector with- out giving any notice. In the event of failure to make such repair so ordered, the said Inspector shall repair said sidewalk promptly at the expense of said abutting property and the •owners thereof and report the same to the City Council. In the event said sidewalk Inspector deems an immediate repair or removal of any defective sidewalk necessary he shall have authority to make such re- pair or removal without notice. Sec. 16. As soon as any temporary sidewalk or any repair on any sidewalk has been completed as hereinbefore provided, the Sidewalk Inspector and City Engineer shall report the cost of such sidewalk or repair to the City Council, and if the same shall be ap- 366 you have, why said assessment should not be levied. AN ORDINANCE RELATING TO BUILDING OF PERMANENT AND TEMPORARY SIDEWALKS, AND PROVIDING FOR THE REPAIR OF SIDEWALKS, IN THE CITY OF DUBUQUE. Be It Ordained by the City Council of the City of Dubuque. Sec. 1. That all permanent side- walks hereafter built or laid on any street, shall not be laid until the body of the same shall have been graded, so that when complete such sidewalk shall be at the established grade, and all sidewalks, unless otherwise order- ed, shall be permanent sidewalks and shall be constructed of cement or ar- tificial stone, as provided in the plans and specifications for permanent side- walks prepared by the City Engineer and approved by the City Council. Sec. 2. It shall be the duty of the City Engineer, upon the taking ef- fect of-this ordinance, to submit plans and specifications for permanent and temporary sidewalks to the Council, and the Council upon making such changes as they deem advisable, shall approve the same and such plans and specifications so approved shall con- stitute the plans and specifications for permanent and temporary sidewalks and shall continue in force until changed by the Council. Sec. 3. Any property owner may build a permanent sidewalk in front of or along his property at any time at his own expense, by securing a per- mit as hereafter provided, but such sidewalks shall conform strictly to this ordinance and the plans and specifications then in force, and no permanent sidewalk shall be built by any person without securing the per- mit therefor, and whoever shall build or undertake to build, or have any per- son build for him any permanent side- walk, without having first secured a permit therefor, shall be guilty of a misdemeanor, but no permit shall ex- tend for more than fifteen (15) days. Sec. 4. The City Council may by resolution order a permanent sidewalk constructed in front of any piece of property abutting upon any street, giving the name of the owner, if known, describing the place where the same is to be built, and stating the kind of material to be used, and when the sidewalk is to be completed. And it shall be the duty of the Side- walk Inspector or the Chief of Police, or some other police officer by him designated, to serve a notice of the passage of such resolution, which no- Official Notices tice shall contain a copy thereof, on the owner of each of the lots, or parts of lots, fronting or abutting upon the said contemplated improvement, when the owner can be found in the city, or upon his agent or attorney for the property, if he has any in the city, which notice shall be personally served. When the person attempting such service has made sworn return to the City Recorder that no one is found upon whom such service can be made, then the Recorder shall imme- diately publish such notice twice in the official newspaper in the city. Publication of such notice herein pro- vided for shall be held sufficient no- tice as to such absentee or non -res- ident; the personal service or last publication ti be at least 15 clear days before the date upon which the City may begin the construction of such walk. And the officer serving such notice shall make due return of the service, or in case of publication in the newspaper, proper return thereof shall be made as in the case of pub- lication of legal notices, and the no- tice and return shall be filed with the Recorder and by him preserved among the records of the City. Sec. 5. That during the time pro-. vided in the notice in the preceding section referred to, the property hold- er may procure a permit and build or have such sidewalk built, but if he does not do so within said time then it shall be built by the City and the cost thereof assessed against his property as hereinafter provided. Sec. 6. If the owner or holder of any lot, or part of lot, shall neglect to lay his sidewalk in conformity with the order hereinbefore provided for, the City Council shall contract for the same to be none at the expense of the City and shall let such contract to the lowest bidder after advertising for bids, said advertisement to consist of two publications in the official paper of the City, the last publication to be five (5) clear days before the letting of the contract. When such sidewalk is built the Engineer shall make his report of ;he expense thereof to the City Council, and if the same be ap- proved by said Council they shall forthwith levy a special tax on each let, or part of lot abutting on such improvement, sufficient to pay the costs of the improvement made in front thereof, which assessment shall conform to the provisions of Section 792 A of the Supplement of 1907 of the Code of Iowa. Said assessment shall be a lien on the lots or parts of lots and shall be levied and collected the same as other special assessments. Sec. 7. Any person or firm desir- ing to engage in the construction of permanent sidewalks for private busi- ness, or for the City of Dubuque, shall execute a surety company bond in the 36$ Official Notices Official Notices 369 proved by said Council they shall forth- with levy a special tax on each lot, part of lot or land abutting on said sidewalk sufficient to pay the costs of the improvement or repair made in front thereof, said assessment to be a Mien on the lot or parts of lot or land in question and shall be levied and collected the same as other special assessments. Sec. 17. All other ordinances or amendments to ordinances heretofore enacted by the City Council of the City of Dubuque, in reference to the build- ing of permanent or temporary side- walks or the repair of sidewalks, are hereby repealed and declared to be no lcnger in force and effect. Provided: That the laying of perma- nent or temporary sidewalks, or the repairs of any sidewalk, that may have been heretofore ordered under existing ordinances, may be completed in ac- cordance with the terms thereof in the discretion of the City Council. Sec. 18. This Ordinance shall he in force and effect from and after its passage by the City Council and its publication in the official newspapers of said City. Adopted Sept. 21, 1911.
