Petition of Iowa Telephone Co., by
M. V. Keyes, wire chief, asking to be
permitted to lay conduits underground,
also to build manholes for same and to
place poles in certain parts of city,
presented. Ald. Specht moved that it
be referred to Committee of the Whole
and City Electrician. Carried.
Sworn statement of Anton Zwack as
to the cost to construct Sanitary Sewer
in Ries Street, presented. On motion
of Ald. Saul received and filed.
Petition of Walter G. Cox asking
that the City Engineer be instructed
to prepare a profile showing proposed
grade on street running south from
West Fourteenth street and first east
of Belmound street and that the said
street be graded as early as possible.
Ald. Singrin moved that the Engineer
be instructed to prepare profile show-
ing proposed grade of said street. Car-
ried.
Petition of Mrs. Anna Diet]. asking
that the taxes for year 1910 against
the real estate of Andreas Dietl, de-
ceased, be canceled. On motion of Ald.
J. W. McEvoy referred to the Com-
mittee of the Whole.
Petition of Anton Zwack asking that
Columbia street from Pleasant street
to Linwood cemetery be improved by
grading, guttering, curbing and ma-
cadamizing same, presented. Ald.
Specht moved that the prayer be
granted and the City Engineer be in-
structed to prepare a profile showing
the proposed grade of Columbia street,
Carried.
Invitation from the City Council of
Davenport, Ia., inviting the City Coun-
cil and City Officials to attend the
Fourteenth annual convention of the
League of Iowa Municipalities to be
held in the city of Davenport October
17, 18, and 19, 1911. Ald. Saul moved
that invitation be received with thanks
and Ald. O'Rourke attend as the rep-
resentative of the City. Carried.
City Recorder Geiger presented and
read the notice, certified to by the pub-
lishers, of the City Council's intention
to levy Special Assessment for the con-
struction of a combination cement curb
and gutter on West Fourth street from
Bluff street west. No remonstrance
being filed and no one in the room ob-
jecting, the notice was on motion of
Ald. Specht received and filed.
City Recorder Geiger also presented
and read the notice, certified to by the

publishers of the City Council's inten-
tion to levy a Special Assessment for
the brick paving of the alley between
Main and Locust streets, between Fif-
teenth and Sixteenth streets. No re-
monstrance being filed and no one in
the room objecting, the notice was on
motion of Ald. Saul received and filed.

Street Commissioner Mahoney re-
ported as follows:

Gentlemen: I herewith submit the
pay roll for labor on streets during
the last half of September. 1911:

into the country the last half of Sep-
tember and to be paid from country
road fund, $302.70.

moving old curb and gutter on Tenth

City Electrician Hipman reported as
follows:

Gentlemen: I herewith submit my
report of defective lights for the month
of September, 1911. I find from the
reports of the Police department that
the total hours that 268 lamps failed
to burn would equal 7 1 -3 lamps irurn-
°_ng for one month, or $36.66.

AN ORDINANCE ESTABLISHING
GRADES ON GRAND VIEW
HEIGHTS, VICTORIA AVENUE
AND LINDEN BOULEVARD.
Be it Ordained by the City Council
of the City of Dubuque:
Section 1. That grades on Grand
View Heights, Victoria Avenue and
Linden Poulevard be and they are
hereby established and adopted as
shown by the profile of said 'streets
and grades prepared by the City Engi-
neer and approved by the City Coun-
cil on the 29th day of September, 1911,
being Profile No. 689. Bench mark:
Arrow on top of hydrant corner Grand
View Heights and Grandview Avenue,
elevation 248.85.
The grade on the north ourb line of
Grand View Heights begins at station
+20, which is a point opposite the cen-
ter of Lot 21, elevation 239.0; thence to
station 1 +50, elevation 247.00; thence
to station 2, elevation 249.20; thence to
station 2 +40, elevation 249.80; thence to
station 2 +70, elevation 249.10; thence
to station 3, elevation 247.80; thence to
station 6, elevation 230.64; thence to
station 8 +50, elevation 229.00; thence
to station 11 +50, which is the west line
of Grandview Avenue, elevation 241.32.
The grade on the south curb line of
said Grand View Heights begins at

The grade on Linden Boulevard be-
gins at station 0, which is the south
line of Grand View Heights. elevation
233.00; thence to station 2+60, which is
the north line of Victoria Avenue, ele-
vation 212.00.
Section 2. This ordinance shall be in
effect from and after its adoption by
the City Council and its publication
in the official newspapers.

Ald. Singrin, chairman on Fire, re-
ported that they had purchased a cart
for the Eighteenth Street Engine
House. The same was approved.
Dubuque, Iowa, Oct. 4, 1911.
To the Honorable City Council:
Gentlemen: Your Board of Health
begs to report: That they met in reg-
ular session on September 29th, 1911,
all members present.
Mr. J. H. Becker asked for permis-
sion to construct a cess pool on his
property. The matter was referred to
the City Engineer to investigate the
same and report to the Chairman of
Board his findings.
Also instructed the City Carpenter to
build a chute for the Fourth Street
Dump.
Also instructed the Clerk of the
Board to notify Mr. Murray, Mar-
tin, and Mrs. Beck to connect with
the sanitary sewer, within 20 days' no-
tice, failure on their part to comply,
the City will make said connections
and assess the cost to the property so
connected.
Also recommend that the salary of
Mr. Callahan, foreman of the Fourth
Street Dump, be placed at $50.00 per
month, the same to date from October
1st, 1911.
Also resolutions ordering Mrs. E. P.
Ternes and Mary E. Kenna to connect
their property with the Sanitary
Sewer adopted.
Also recommended to Dubuque Coun-
ty the renewal of contract with C. M.
Linehan, M. D., for care of smallpox
patients.

Ald. Singrin reported that the men
working at the Fourth street dump
were in need of rubber boots. Ald.
Saul moved that Ald. Singrin be ap-
pointed a committee of one to purchase
two pairs of rubber boots. Carried.
Your Committee of the Whole, to
whom was referred the bill of Klauer
Mfg. Co. for $36.00 for garbage cans
furnished the city and also the bill of
C. J. Shannon for $20.85 for meat fur-
nished the female jail during the
months of May, June and July, would
respectfully recommend that said bills
be allowed and that warrants in settle-
ment thereof be ordered drawn on the
City Treasurer.
Your Committee of the Whole, to
whom was referred the bill of Dr. W.
J. Byrne for $38.00 for professional
services rendered Phil Curran, would
respectfully recommend that • said bill
be not allowed.
Your Committee of the Whole, to
whom was referred the remonstrance
of the J. A. Rhomberg estate against
the proposed improvement of Fourth
Avenue from Rhomberg to Lincoln
Avenue, would respectfully recommend
that the said remonstrance be received
and filed.
Your Committee of the Whole, to
whom was referred the petition of the
Nuns of the Presentation stating that
they had purchased Lot 4 of the Sub.
of Mineral Lot 45, for the purpose of
building their convent thereon. which
convent was under roof before the end
of the year 1908, notwithstanding
v hich, the said property was listed for
taxation for the years 1909 and 1910,

and asking that the taxes levied
against the said lot for said years be
canceled, would respectfuly recommend
that the prayer of the petitioners be
granted and that the Treasurer be in-
structed accordingly.
Your Committee of the Whole, to
whom was referred the remonstrance
of Helen M. T. Sauer, administratrix,
against the order to lay a cement walk
adjoining Lot 45 in McCraney's 1st
Addition, would respectfully recom-
mend that said remonstrance be re-
ceived and filed. We would further
recommend that the sidewalk inspec-
tor be instructed to notify the owners
of all the property on Dock avenue
from Rhomberg to Garfield avenue,
and also on Garfield avenue from Mid-
dle to Dock avenue, that sidewalks
must be laid adjoining their property
not later than May 1, 1912.
Your Committee of the Whole, to
whom was referred the petition of R.
P. Roedell and others, asking that
Seventh avenue be improved by grac-
ing, curbing, guttering and macadam-
izing the same from the end of the
present improvement to the city lim-
its, would respectfully recommend
that said petitino be received and filed.
We would further recommend that
the street commissioner be instructed
to make such repairs in said avenue
as he may find necessary.
Your Committee of the Whole, to
whom was referred the remonstrance
of L. H. Hay et al., against the con-
struction of the proposed sanitary
sewer in Arlington Street from High-
land Place to Prairie street on ac-
count of being already connected with
the sewer in Chestnut Street, would
respectfully recommend that the pray-
er of the remonstrators be granted.
We would further recommend that
should the parties desiring said sewer
wish to construct the same at their
own expense, that permission be given
them so to do and that an ordinance
be passed authorizing them to collect
a proportionate share of the cost from
future connectors.
Your Committee of the Whole, to
whom was referred the petition of
Chas. B. Hess, owner of lot 1 in Garri-
gan's Sub., asking that on account of
the hardship imposed on him by rea-
son of having to go such a distance to
connect with the water mains, that he
he granted a reduction in the assess-
ment levied against his said lot for the
sewer in West Seventh street, would
respectfully recommend that one -half
of said assessment be accepted in full
settlement thereof and that the City
Treasurer be instructed accordingly.

Clifford street, not to exceed the
amount appropriated, on approval of

Commissioner be instructed to notify
the Eagle Point Lime Works to replace
the retaining wall at the Eagle Point
high bridge approach within 30 days,
and if they fail to comply with said

City Recorder Geiger presented and
read the notice, certified to by the pub-
lishers of the City Council's intention
to levy a special assessment for the

in the room objecting, the notice was
on motion of Ald. Singrin, received and

and read the notice, certified to by the
publishers, of the City Council's inten-
tion to improve Jackson street from
Seventh to Eighth street; also pre-

the notice be received and filed. Car-
ried. Ald. O'Rourke moved the remon-

Ald. Singrin moved that the City En-
gineer be instructed to ascertain if
there is a grade established on Jack-
son street, between Seventh and
Eighth, by ordinance; if not he shall
prepare a profile showing proposed

Engineer and City Attorney investigate
the Railway Track at Fourth and
White street and ascertain if they are

with traffic and to cause unnecessary
hardship on teams having occasion to
use said avenue; therefore,

junction with the Board of Super-
visors in an effort to change the
course of said avenue, and, by cut-

Petitioned be granted and the work
to be done under the supervision of

Your Committee of the Whole, to
whom was referred the claim of
Mrs. L. H Mraples for $11.60, the
amount paid by her for repairing
damage caused to standpipe by steam
roller while improving Tenth Street,
would respectfully recommend that
said claim he allowed and that a
warrant he ordered drawn in said
amount on the City Treasurer in set-
tlement of the claim.
Your Committee of the Whole, to
whom wes referred the bill of Adam
Stoltz amounting to $160.00 for pull,
ing down the walls of the Kretsch-
mer building and for damage to
ropes and tools resulting therefrom,
would respectfully recommend that
said bill be allowed in full in the
sum of $150.00, and that a warrant
in said amount be ordered drawn on
the City Treasurer.
Your Committee of the Whole, to
whom was referred the bill of J. N.
Graham for $13.00 for feed and
stabling patrol horse, would respect-
fully recommend that said bill be al-
lowed and that a warrant in said
amount be ordered drawn on the City

First resolution ordering the im-
provement of Jackson Street from
Seventh to Eighth Street regularly
adopted.
The question as to the action so far
taken for the improvement of Jackson
Street from Seventh and Eighth
Streets, having been proceeded with in
the proper and legal manner, discussed,
the assistant city attorney was asked
for an opinion in the matter. He stated
that the proceeding had been proper
and legal but if the city engineer was
in doubt as to the bench mark on the
profile he would advise to reconsider
the matter until same was corrected.
Ald. O'Rourke moved that we re-
scind the whole matter pertaining to
the improvement of Jackson Street
from Seventh and Eighth Streets.

and general nature of such improve-
ment, the extent thereof, the size and
kind of material to be used, and to
prepare an estimate of the cost there-
of and the amount assessable upon
each lot or parcel of land adjacent to
or abutting thereon per front feet or
square feet in area, and to file such
plat, specifications and estimate in the
office of City Recorder.
That after such plat is so filed, the
City Recorder shall cause to be pub-
lished notice of the intention of the
Council to make improvement, which
notice shall be published in three con-
secutive issues of the official papers of
the City of Dubuque, stating that such
plat is on file, and generally the na-
ture of the sewer, its location, size and
kinds of material to be used, and the
estimate of its cost, and fixing the time

matter was left with the City Engineer
and Sidewalk Inspector.

Gentlemen: At a meeting of citi-
zens held at the call of the Mayor
in the Council Chamber of the City
Hall, October 26th, the following
resolutions were unanimously adopt-
ed:
Whereas: The City of Dubuque
has contributed more than its share
of the $234,000,000 annual fire
waste: and,
Whereas: Many fires in Dubuque
are plainly due to failure to exercise
due caution in the matter of fire
prevention; and,
Whereas: Dubuque is and will be
in a perilous position so far as sus-
ceptibility to fires is concerned until
the city has a proper building code
and provision for the inspection of
building and adequate fire limits,
which should have been in existence
years ago, affording fire protection
as demanded by the growth of the
city and expansion of its building;
therefore, be it
Resolved: That it is the sense of
this meeting that the attention of
the Honorable Mayor and City Coun-
cil of the City of Dubuque, be called
to Sections 10 and 11 of Chapter 128
of the Acts of the 34th General As-
sembly, copy of which is hereto at-
tached, where inadequate provision

Gentlemen: Referring to the mat-
ter of the right of the City of Du-
buque to require the Chicago Great
Western Railway Company to change
the location of its tracks in Elm
Street, between 25th and 27th Streets,'
to conform with your direction as to
the proper location of said tracks, I
beg to report that, in my opinion, the
City has the authority, in the exer-
cise of a reasonable discretion, and
in furtherance of its purpose, to pro-
vide for the greater convenience and
safety of the public in the use of the
said street, to order the said railway
company, under such reasonable reg-
ulations as may be deemed necessary,
to remove and re- locate its said tracks
at the place named.
The control over and regulation of
streets is vested in the City by legis-
lative authority, as expressed in the
charter, and in Code, Sec. 767. The
supreme court of this state, in a
lengthy opinion in the case of Snouf-
fer vs. Cedar Rapids & Marion City
Railway Company, (118 Iowa, page
287,) holds expressly that "any
authority to use the streets granted
to railway companies must be con-
strued as being subject to the police
power of the city over the streets,
whatever may be the language of the

tion of the tracks is as follows: C.,

Fourth Street, ele. 19.40 and ele.

19.38; I. C. R. R. tracks, south curb
line of Fourth Street ele. 19.30,

Page House is elevation 19.LO. The
only record, showing a grade, that
can be found is an ancient grade

amount assessable upon any railway
or street railway company, the amount
and cost thereof, to be paid by the city,
if any, and the cost tnereof and
amount assessable upon each lot or
parcel of land adjacent to or abutting
upon such improvement per front foot,
and to file such plat and estimate in
the office of the City Recorder; that
after the filing of said plat and esti-
mate' in his office, the City Recorder
shall publish in three consecutive
issues of a newspaper punlished in this
city, a notice stating that such plat
and estimates are on file, the location
and nature of the improvement, kind
of material to be used, and an esti-
mate of its cost, and the time before
which objections thereto can be filed,
and the time fixed for hearing, which
time shall not be less than five days
after the last publication of such no-
tice, and after such publication shall
have been made, the City Recorder
shall, at the next regular session of
the City Council, notify the Council
thereof in writing, with a printed copy
of such notice accompanying the same.

Whereas, the Tax levy for the year
will be very large unless some radical
change can be made, therefore be it
Resolved, That the City Council re-
quest the Mayor to use his hest efforts
to induce the Water Works Trustees
to arrange to pay the interest due this
year on Water Works Bonds in
amount of $12,780.00. which would al-
low the Council to reduce the levy
either 1 -2 or 1 mill. Ald. O'Rourke
moved the adoption. Carried.

tise for bids for the improvement of
Montrose Terrace, bids to be received

Street be and the same is hereby
adopted and established as shown by
the profile of said street and grade
prepared by the City Engineer and
adopted by the City Council on the
30th day of October, 1911, being Profile
No. 704 and marked "Grade for Jack-
son Street from 7th to 8th Streets
showing grade of curb on the east
property line, and grade on a line in
street 20 feet west of the E. line of
the street, and the curb on the west

the Council Chamber, City Hall, by the
City Recorder, until 8:00 p. m., Wed-
nesday, October 25th, 1911, for the con-
struction of a 10 -inch tile pipe sanitary
sewer in Peru Road and Jackson Street
from manhole at alley between Jack-
son Street and Couler Avenue, east in
Peru Road to Jackson Street, thence
north in Jackson Street to alley be-
tween Euclid and Aquin Avenues, in
accordance with the plans and specifi-

Notice to Sidewalk Contractors.
Sealed proposals will be received at
the Council Chamber, City Hall, by
the City Recorder until 8:00 p. m.,
Monday, October 30th, 1911, for the
improvement of the following street
b laying cement sidewalk on a foun-
dation of cinders, in accordance with
the plans and specifications prepared
by the City Engineer and now on file
in the office of the City Recorder.
A 5 -foot sidewalk on Grandview
Ave., abutting Lots 15, 16, 17, 18,
E lock 5, Grandview Park Add.
The work is to be paid for when
said work is completed, work to be
completed on or before the 15th day
of November, 1911.
Eidders must state price per square
foot for sidewalks laid.
Each bid must be accompanied by
a check of $25.00 on some Dubuque
bank as a guarantee that a contract
will be entered into if awarded.
The City reserves the right to reject
any and all bids.
