Mayor Haas stated that this meeting
was called for the purpose of consid-
ering the establishing of a grade on
Seventh street, Main to Iowa.
City Engineer presented profile No.
709 showing the proposed grade of
Seventh street, Main to Iowa street.
Ald. E. E. McEvoy moved the grade
be accepted and the proper ordinance
be offered. Carried.

AN ORDINANCE ESTABLISHING A
GRADE ON SEVENTH STREET
FROM CLAY STREET TO MAIN
STREET.
Be it Ordained by the City Council
of the City of Dubuque:
Section 1. That a grade on Seventh
Street from Clay Street to Main Street
be and the same is hereby established
and adopted as shown by the profile of
said street and grade prepared by the
City Engineer, being Profile No. 709,
and marked. "Profile Seventh St. Clay
to Main Sts. B. M. Water Table of
building N. E. Cor. of 6th & Clay, ele.
32.0." Said grade begins at the west
curb line of Clay Street which is sta-

Ald. O'Rourke moved that the
rules be suspended for the purpose of
permitting Mr. Morgan to address
the Council.
Carried by the following vote:

Mr. Morgan addressed the Council
and claimed that he had not been
paid for twenty -four days as inspec-
tor of Harvard Street and asked the
Council to order same paid.
The City Engineer and Street Com-
missioner made a verbal report on
same.
Ald. J. W. McEvoy moved that Mr.
Morgan be allowed the twenty -four
days and a warrant be drawn for
same. Carried.
Ald. Specht moved that the con-
tract to construct sewer in Kaufman
Avenue be awarded to C. B. McNa-
mara and bond be placed at 25 per
cent of contract price. Carried.
Ald. Specht moved that the con-
tract to improve Columbia Street be
awarded to F. Beutin and bond placed
at 25 per cent of contract price.

from the reports of the Police de-
partment that the total hours that
156 lamps failed to burn would equal
4 lamps burning for one month, or

respectfully report that we have ex-
amined the following sanitary sewers,
to -wit: In Blocliknger Lane from
Couler Avenue to Broadway and
north in Broadway for a distance of
about two hundred and fifty feet, the
O'Farrell Co., contractors; in Bel -
mound Street from Rose Street to
West Fourteenth Street and in West
Fourteenth Street from Belmound
Street to Prairie Street, .L F. Brown,
contractor: in Langworthy Avenue
from Hill Street to James Street,
thence in James Street to West Third
Street, thence about two hundred and
twenty -five feet easterly in said West
Third Street, McNamara & Co., con-
tractors, and we would respectfully
recommend that said sewers be ac-
cepted and that the City Engineer be
instructed to prepare special assess-
ments against the lots or parcels of
real estate subject to assessment for
said improvements and file the same
in the office of the City Recorder, who
will thereupon publish the notice of
said assessments as required by ordi-

The Sanitary Officer reported that
he and the sewer inspector had inves-
tigated the complaints as to persons
connected with storm water sewer in
Hill Street, but found no such con-
nections.
On the 12th day of September, 1911.
Mr. J. B. Murray was ordered to con-
nect Lot 69, East Dubuque Add., with
sanitary sewer and on June 1st, 1911,
Mr. Frank Fosselman was ordered to
connect N. 1 -2 of Lot 23, L. H. Lang -
worthy's Add., with sanitary sewer;
cn June 2nd, 1911, Margaret Martin
was ordered to connect Lot 15, Out Lot
703, with sanitary sewer; on June 2nd,
1911, Minnie and M. A. Kemler were
ordered to connect Lot 1 of 2 of 4 of
Robert Brown's Sub., with sanitary
sewer, each of them having failed to
comply with the order within the spe-
cified time, we therefore recommend
that the proper resolution be passed

Ald. Saul, chairman of the Committee
on Streets, offered the following:
Your Committee on Streets would
respectfully report that we have ex-
amined the improvement on Grandview
Avenue from Dodge to South Dodge
Streets, C. B. McNamara & Co., con-
tractors, and would respectfully recom-
mend that the same be accepted; the
Engineer, however, to deduct, in addi-
tion to the regular five per cent, the
sum of $500.00 from the amount due
the contractors until all crossings speci-
fied are put in and such other defects
as may appear are remedied. We fur-
ther recommend that the City Engi-
neer be instructed to prepare a special
assessment against the lots or parcels
of real estate subject to assessment
for said improvement and file the same
in the office of the City Recorder who
will thereupon publish the notice of
said assessment as required by ordi-
nance.

Your Committee on Streets, acting on
the report of the Street Commissioner,
would respectfully recommend that
the improvements on the following
named streets be accepted, to -wit:
Harvard Street from Alta Vista to
Yale Street, Wilmer Cook, contractor;
Belmond Street from Rose to West
Fourteenth Street and Auburn Avenue
from Delhi to West Fourteenth Street,
C. B. McNamara & Co., contractors.
We further recommend that the City
Engineer be instructed to prepare spec-
ial assessments against the 'lots or par-

valuation of its stock had been reduced
by the Board of Equalization for . the
year 1909 from '$10,000.000 to $8,000.00,
and that through an oversight the val-

sine be corrected and placed at $8,000.00,
would respectfully recommend that the
prayer of the petitioner be granted and
that the City Treasurer be instructed
to accept the taxes assessed against
said firm for 'the year 1910 on a basis

Kretschmer Manufacturing Co., ask-
ing that in accordance with the ordi-
nance adopted March 5th, 1908, exempt-
ing it from taxation on all personalty

1910 and 1911, would respectfully rec-
ommend that the prayer of the peti-

law in reference to crossing gates ex-

Ald. O'Rourke amended that a watch-
man be placed on the west side and
one on the east side of Fourth street
crossing. The amendment received no
second. The vote on the motion was

of the death of Ald. Specht's brother
he would not 'be present but had re-
quested hini to have the Engineer
instructed to give lines. Therefore he
moved that the City Engineer be in-
structed to give the lines of the alley
between Gmehle's and Stine's addi-
tion, from Stafford avenue east to the
rear end of the lots fronting on Staf-
ford avenue. Carried.
Ald. Sauer moved that the Commit-
tee on Markets investigate the stove
at the First ward scales, and if found
necessary to purchase a new stove.

Ald. O'Rourke . moved that. the
Street Commissioner be instructed to
investigate the sewer grate in alley be-
tween Main and Locust and Fifth and
Sixth streets and repair same if neces-
sary. Carried.
Ald. 'J. W. McEvoy moved that the
City Attorney be requested to report
to council what power the city has to
compel property owners to have suit-
able receptacles for Garbage and
ashes. Carried.

Mayor Haas stated he had reeeiveJ
very many complaints as to the var-
ious lunch wagons and ,stands now
operating on the streets and side-
walks with very good reasons why
they should be removed, and as their
licenses expire on Dec. 31, 1911, would
like to have the council's sentiment
regarding the reissuing of license to
lunch wagons and stands.
Ald. J. W. McEvoy moved that it is
the sense of the council that there be
no more licenses issued to lunch
wagons or lunch stands after Dec. 31,
1911. Carried.

McQuillen:
Whereas, The Board of Supervisors,
in conjunction with the City Coun-
cil of the City of Dubuque, some time
ago met and determined to investi-
gate the probable cost. etc., relative
to a proposed cut through Grand-
view Avenue and also a viaduct
across the tracks of the Illinois Cen-
tral company at Rockdale, and,
Whereas, The City Engineer of the
City of Dubuque was asked to make
preliminary surveys and make ap-
proximate estimates on the cost of
same;
Resolved, That it is the sense of
this body that the desired informa-
tion be furnished this body at the
earliest possible date, that a dopy of
this resolution be forwarded by mes-
senger to the City Recorder of the
City of Dubuque this very date, that
it may have attention at the hands
of the City Council at an adjourned
session of that body which is to be
held this evening.
Supervisor McQuillen moved the
adoption of the resolution. Motion
carried unanimously.

Engineer instructed to report at the
first meeting of Council in January,

AN ORDINANCE TO AUTHORIZE
AND REGULATE THE INSTALLA-
TION AND MAINTENANCE OF
STREET LIGHTS UPON THE
STREETS OF THE CITY OF DU-
BUQUE.
Be It Ordained by the City Council of
the City of Dubuque:
Sec. 1. That permission is granted
to owners and occupants of property
fronting upon the streets of the City
of Dubuque to install and maintain
such street lights and the necessary
poles and fixtures therefor, in compli-
ance with the following regulations,
viz:
(a) —The poles and fixtures must be
maintained in good condition consist-
ent with civic beauty and cleanliness,
and the lights must be kept in good
order and lighted regularly according
to the lighting schedule in force, by
those who are responsible for their
erection.
(b) —The lights and the poles and fix -
tures therefor, on any portion of any
street in the City of Dubuque shall
conform in design, position and color
of pole and fixtures, with the provis-
ions and specifications of a compre-
hensive plan for lighting the streets of
the City of Dubuque, said plan to be
prepared by the City Engineer and ap-
proved and adopted by the City Coun-
cil.
(c) —No lights, or poles or fixtures
therefor, shall be installed upon any
street in the City of Dubuque until
permits for their installation shall
have been issued by the City Engineer,
said permits to be issued for such in-
stallations only as are strictly in ac-
cord with the provisions and specifica-
tions of the above mentioned compre-
hensive plan for lighting the streets of
Dubuque.
Sec. 2. This ordinance shall not be
so construed as to interfere in any
way with poles or fixtures already in-
stalled, nor shall anything contained
in this ordinance be in any way con-
strued so as to prevent said City from
exercising its police power over its
streets or sidewalks, or from ordering
the repair, reconstruction or entire re-
mo /al of any or all of said poles at
any time when such action may be
deemed necessary or advisable.
Sec. 3. All ordinances and portions
of ordinances inconsistent herewith are
hereby repealed.
Sec. 4. This ordinance shall take ef-
fect and be in force from and after its
passage and publication as provided
by law.

AN ORDINANCE CREATING A
LEVEE IMPROVEMENT COMMIS-
SION FOR THE CITY OF DU-
BUQUE.
Be it Ordained by the City Council of
the City of Dubuque:
Sec. 1. That in accordance with the
provisions of Chapter 49 of the Acts or
the 34th General Assembly of the State
of Iowa, there is hereby created the
Levee • Improvment Commission of the
City of Dubuque, to consist of the
Mayor of said City of Dubuque, as
Chairman, the Commissioner of the
Board of Public Works, and three (3)
members to be appointed by the Mayor
with. t11e approval of the City Council,
who must be residents and qualified
electors of the City of Dubuque, and
shall hold no other official position in
said City, and whose terms of office
shall be for one, two and three years
respectively. No member of said Com-
mission shall receive any salary for
his services as a member of such com-
mission. Ceasing to be residents of
the City of Dubuque, or the acceptance
'of any other official .position in said
City, shall be deemed to he a resigna-
tion from the Levee Improvement
Commission.
Whenever vacancies occur in the
appointive membership of said Com-
mission, the same shall be filled by the
Mayor with the approval of the Coun-
cil. Before entering upon the perform-
ance of their , duties, the appointed
members of the Commission shall give
bond for the faithful discharge of their
duties in the sum of Two Thousand -
dollars ($2,000.00), as provided for in
Chapter 49 of the Acts of the 34th Gen-
eral Assembly.
Sec. 2. The Commission thus created
shall possess all the powers and rights
conferred upon such commission by
the provisions of Chapter 60 of the
Acts - of the 33rd General Assembly,
and of Chapter 49 of the 34th Genera'
Assembly of the State of Iowa, and

all other acts that may be hereafter
adopted by the General Assembly de-
fining or creating the duties, powers
and rights of such commission in cities
acting under special charters.
Sec. 3. -'This ordinance shall be h

FROM CLAY STREET TO MAIN
STREET.
Be it Ordained by the City Council
of the City of Dubuque:
Section 1. That a grade on Seventh
Street from Clay Street to Main Street
be and the same is hereby established
and adopted as shown by the profile of
said street and grade prepared by the
City Engineer, being Profile No. 709,

AN ORDINANCE TO AUTHORIZE
AND REGULATE THE INSTALLA-
- TION AND MAINTENANCE OF
STREET LIGHTS UPON THE
STREETS OF THE CITY OF DU-
BUQUE.
Be it Ordained by the City Council of
the City of Dubuque:
Sec, 1. That permission is granted
to owners and occupants of property
fronting upon the streets of the City
of Dubuque to install and maintain
such street lights and the necessary
Poles and fixtures therefor, in compli-
ance with the following regulations,
viz:
(a) —The poles and fixtures must be
maintained in good condition consist-
ent with civic beauty and cleanliness,
and the lights must be kept in good
order and lighted regularly according
to the lighting schedule in force, b5'
those who are responsible for their
erection.
(b) —The lights and the poles and fix -
tures therefor, on any portion of any
street in the City of Dubuque shall
conform in design, position and color
of pole and fixtures, with the provis-
ions and specifications of a compre-
hensive plan for lighting the streets of
the City of Dubuque, said plan to be
prepared by the City Engineer and ap-
proved and adopted by the City Coun-
cil.
(c) —No lights, or poles or fixtures
therefor, shall be installed upon any
street in the City of Dubuque until
permits for their installation shall
have been issued by the City Engineer,
said permits to be issued for such in-
stallations only as are strictly in ac-
cord with the provisions and specifica.-
tioiis of the above mentioned compre-
hensive plan for lighting the streets of
Dubuque.
Sec. 2. This ordinance shall not be
so construed as to interfere in any
way with poles or fixtures already in-
stalled, nor shall anything contained
im this ordinance be in any way con -
strrued so as to prevent said City from
exercising its police power over its
streets or sidewalks, or from ordering
the repair, reconstruction or entire re-
mo'a1 of any or all of said poles at
any time when such action may he
deemed necessary or advisable.
Sec. 3. All ordinances and portions•
of ordinances inconsistent herewith are
hereby repealed.
Sec. 4. This ordinance shall take ef-
fect and be in force from and after its
passage and publication as provided'
by law.

AN ORDINANCE CREATING A
LEVEE IMPROVEMENT COMMIS-
SION FOR THE CITY OF DU-
BUQUE.
Be it Ordained by the City Council of
the City of Dubuque:
Sec. 1. That in accordance with the
provisions of Chapter 49 of the Acts of
the 34th General Assembly of the State
of Iowa, there is hereby created the
Levee Improvment Commission of the
City of Dubuque, to consist of the
Mayor of said City of Dubuque, as
Chairman, the Commissioner of the
Board of Public Works, and three (3)
members to be appointed by the Mayor
with the approval of the City Council',
who must be residents and qualifted
electors of the City of Dubuque, and
shall hold no other official position in
said City, and whose terms of office
shall be for one, two and three years
respectively. No member of said Com-
mission shall receive any salary for
his services as a member of such com-
mission. Ceasing to be residents' of
the City of Dubuque, or the acceptance
of any other official position in said
City, shall be deemed to be a resigna-
tion from the Levee Improvement
Commission.
Whenever vacancies occur in the
appointive membership of said Com-
mission, the same shall be filled by the
Mayor with the approval of the Coun-
cil. Before entering upon the perform-
ance of their duties, the appointed
members of the Commission shall give
bond for the faithful discharge of their
duties in the sum of Two Thousand

dollars ($2,000.00), as provided for in
Chapter 49 of the Acts of the 34th Gen-
eral Assembly.
Sec. 2. The Comrhission thus created
shall possess all the powers and rights
conferred upon such commission by
the provisions of Chapter 60 of the
Acts of the 33rd General Assembly,
and of Chapter 49 of the 34th Genera.
Assembly of the State of Iowa, and
all other acts that may be hereafter
adopted by the General Assembly de-
fining or creating the duties, powers
and rights of such commission in cities
acting under special charters.
Sec. 3. —This ordinance shall be in
force and effect from and after its
publication in the official newspapers
of said. city.
