Present — Alderman Apel, McEvoy, O'Rourke, Sauer, Saul Singrin Specht. City Attorney Lyon and Assistant City Attorney Willging. On motion of Alcl. Singrin, the ap- proval of the Council proceedings for the month of October was deferred to next meeting. Petition of George Collis, asking that the City Engineer locate the alley way and have same opened as shown on Stewart's Subdivision on Cora street, in rear of lots fronting on Grandview Avenue presented. Moved by Ald. Saul the City Engineer be instructed to give lot lines of alley to Mr. Collis. Carried. Communication from Union Electric Co. in reference to the bill for repav- ing Clay Street, between Tenth and Eleventh Streets presented. On motion of Ald. Singrin referred to Committee of the Whole. Petition of H. Trenkle, asking the city to pay for manhole in alley be- tween Iowa and Clay Streets and Twelfth Streets, south of City Hall, presented. On motion of Aid. Singrin referred to Committee of the Whole. Petition of John R. Waller, asking that the assessment on various blocks in Dubuque Harbor Co. Add. be re- duced, presented. On motion of Ald, Apel referred to Committee of the - Whole. A resolution as adopted by Machin- ists' Union, Julien Lodge, No. 379, pre- sented. On motion of Ald. Saul the resolution approved. Petition of F. G. Roedell, et al, ask- ing the Council to grant them the use of Armory Hall for a period of nine days, commencing Dec. 8, 1910, pre- sented. Moved by Ald. Apel that the prayer be granted. Amended by Ald. Saul that it be referred to the Com- mittee of the Whole. Amendment car- ried. Motion lost. Petition of Katherine Rush, asking the city to accept fifty dollars in full for special assessments against lots 23, 24, 25, 26 and 82 in McCraney's Add., presented. On motion Aid. Apel refer- red to Committee of the Whole. A bill for cleaning sewer, $1.60, and paid by Mr. Peter Domenig, who asks city to reimburse him, presented. On motion of Ald. Saul refered to Committee of the Whole. To the Honorable Mayor and City Council of the City of Dubuque: Gentlemen: The undersigned, having purchased the stock and good will of the business of John Hoffmann, who was the assignee and vendee of John Wilhnes, former holder of a resolution of consent to conduct and carry on a place for the sale of intoxicating liquors in the City of Dubuque, Iowa, hereby petitions your Honorable Body to re- new the consent previously granted to them and to regrant said consent to this petitioner to operate a retail liquor store at the Western Htuse, 659 Clay Street, in the City of Dubuque, Iowa, and to express the renewal of that con- sent by the adoption of the following resolution. OR'ourke offered the following: Be it Resolved by the City Council of the City of Dubuque, that consent previously granted _ to John Willmes and later to John_ Hoffmann, his as- signee, to operate a retail liquor store, within the said City of Dubuque, Du- buque County, Iowa, in accordance with the law's of Iowa and the ordi- nances of the City of Dubuque, is here- by regranted to John P. City Electrician Hipman reported as follows: To the Honorable Mayor and City Council: Gentlemen: I herewith submit my report of defective lights for the month of November, 1910. I find from the reports of the Police Department - that the total hours that 27 lamps failed to burn would equal 1 lamps burning for one month, or $6.25. Respectfully submitted, WM. Frith 3.00 On motion of AIc1. Saul, warrants ordered drawn and bills be paid. City Recorder Geiger stated that the City Attorney had filed the contract in duplicate between the city of Dubuque and J. E. Truesdale. On motion of Ald. Saul referred to Committee of the Whole. Plat of extension of alley through Gilliam's Sub. and Sub. of Out Lot 682, also right of way notice as pub- lished and served, presented, also re- monstrance of John W. Norton et al, John Deery and Julia Clark. Moved by Ald. Apel that the rules be sus- pended to permit any one present to address the council. Carried by the following vote: Yeas —Alds. Apel, McEvoy, O'Rourke, Sauer, Saul, Singrin, Specht. Nays —None. Mr. John Norton, Mr. W. Gill, Mr. W. Grings and Mr. C. F. Danzer ad- dressed the council, all remonstrating against the opening of the alley. Moved by Ald. McEvoy any action to the opening of alley through Gilliam's Sub. and Sub. of Lot 682 be entirely stricken from record and any appropri- ation for said improvement referred back to the General Fund. Carried. Mr. J. Ellermann addressed the coun- cil and stated that Mr. Curt Koehler had improved his property and that the water now runs into his (J. Eller - mann's) cellar and requested the coun- cil to have the same attended to. Moved by Ald. Sauer that the Street Commissioner and Sidewalk Inspector investigate the matter and report at next session of the city council. Car- ried. Ald. O'Rourke, chairman of the Fi- nance Committee, reported that there was about $300.00 available from the county and moved that City Treasurer be instructed to collect same and place in county road fund. Carried. The matter of repairing railing on the steps of City Hall, on Thirteenth street, was on motion left to the Com- mittee on Public Grounds and Build- ings. City Recorder Geiger stated that the contract between City of Dubuque and Dr. J. Hagerty expires on June 1, 1911. Moved by Ald. Singrin that the City Recorder be instructed to advertise for bids for furnishing Veterinary services to horses of the various departments of the city of Dubuque ano submit same to the city council at the meet - ing' of December 15, 1910. carried. Alderman O'Rourke offered the fol- lowing: Whereas, The contract heretofore en- tered into by the City of Dubuque for the improvement of a street as herein- after described has been completed, and the City Engineer. has computed that the cost and expense of said im- provement amount to $2,911.95; Therefore, Be it Resolved by the City Council of the City of Dubuque, That to provide for the cost of brick- paving Fifth street from Main to Locust street, the Mayor be and he is hereby required to execute and deliver to the City Recorder, to be by him registered and countersigned, eleven bonds for two hundred and fifty dollars each and one bond for two hundred twenty - seven and 95 -100 dollars, numbered 1045 to 1056 inclusive, dated December 17, 1910, payable on or before seven years after the date thereof. and bearing in- terest at the rate of five per cent. per annum, payable semi - annually. Alderman O'Rourke offered the fol- lowing: Whereas, The contract heretofore en- tered into by the City of Dubuque for the improvement as hereinafter de- scribed has been completed, and the City Engineer has computed that the cost and expense of said improve- ment amount to $2,422.00. Therefore, Be it Resolved by the City Council of the City of Dubuque, That to provide for the cost of brick - paving Windsor Avenue, from a point about 169.9 feet north of the north line of Sanford Street to a point about 327.8 feet further north thereof, the Mayor be and he is hereby required to exe- cute and deliver to the City Recorder, to be by him registered and counter- signed, nine bonds of the denomination of two hundred and fifty dollars each and one bond for one hundred seventy - two dollars, numbered 1035 to 1044, in- clusive, dated December 17, 1910, pay- able on or before seven years after the date thereof, and bearing interest at the rate of five per cent. per an- num, payable semi - annually. Your committee on streets would respectfully report that we have exam- ined the improvement on Grandview avenue from its intersection with South Dodge street to the south line of Mineral lot 31, The O'Farrell Co., con- tractor, and would recommend that said work be accepted and that the City Engineer be instructed to prepare a special assessment against the lots or parcels of real estate subject to assess- ment for said improvement and file the same in the office of the City Recorder who will thereupon publish the notice of the intention of the City Council to levy said assessment as provided by ordinance. Present — Aldermen Apel, McEvoy, O'Rourke, Sauer, Saul, Singrin, Specht. Mayor Haas stated the meeting was called to take up and consider the resolution to sell Funding bonds, also any other matter that the aldermen de- sired. Moved by Ald. Apel that the peti- tion of City Assessor Kelly be taken from the Committee of the Whole and be acted on at this meeting. Carried. Moved by Ald. Saul that any matter pertaining to the Funding Bonds be made first order of business. Carried. City Attorney Lyon requested the Council to designate the manner, time and place they desired the bonds sold and he would then draft the proper resolution. Moved by Ald. McEvoy that the reso- lution the City Attorney had drawn up be read, and if the Council desired to make any change same can be done later. Carried. Resolution as prepared by City At- torney for sale of bonds read. Moved by Ald. Singrin that the rules be suspended to hear from anyone in the room in reference to the bonds. Carried by the following vote: Yeas —Alds. Apel, McEvoy, O'Rourke, Sauer, Saul, Singrin, Specht. Nays —None. Three gentlemen representing differ- ent bonding companies addressed the Council in reference to the purchasing of bonds. Moved by Ald. McEvoy that a spec- ial session of the Council be held Sat- urday, December 10, at 10 a. m. and the Council to receive bids on the Bonds and determine who is the best bidder and adopt the proper resolutions for the selling of Bonds. Carried. Ald O'Rourke voting no. Moved by Ald. Singrin the rules be suspended to hear from the City As- sessor. Carried by the following vote: Yeas —Alds. Apel, McEvoy, O'Rourke, Sauer, Saul, Singrin, Specht. Nays —None. City Assessor Kelly and Deputies Tireidner and Kenneally addressed the Council, explaining the reason they could not complete their hooks by Jan. 1, 1911, unless they worked day and night. The petition of Assessor Kelly was read. Moved by Ald. Apel to allow the CitY Assessor and his deputies one hun- dred ($100.00) dollars eaen, provided they have all books completed before Jan. 8th, 1911. Carried by the following vote: Yeas —Alds. Sauer Petition of William McConnell ask- ing that his salary as Fireman be rais- ed from $55.00 per month to $66.00 per month presented. On motion of Ald. Apel prayer granted. Moved by Ald. O'Rourke that the Harbor committee and chairmen of street and Sewer committee be em- powered to manipulate the city em- ployes and have them prepare and keep in condition a part of the Ice Harbor, thereby giving the public a free skating rink. O'Rourke that the Mayor appoint a committee of three` to act with the Chief of Police to pro- vide certain streets for coasting pur- poses and said committee to provide proper regulations for same and report to Council their arrangement for ap- proval. That, Whereas, the City Council of the City of Dubuque, by resolution duly adopted at a regular meeting held November 23rd, 1910, authorized the issuance of ninety -eight (98) funding bonds of Five Hundred ($500.00) dollars each, in total amount of Forty -nine Thousand, ($49,000.00) dollars, bearing four and one - half per cent (4' %) per annum. payable .semi - annually, said bonds be- ing dated December 10, 1910, and payable fifteen (15) years after date; and Wheeras, Due effort has been made to effect a sale of said bonds for cash, on the best available terms; and Whereas, An offer has been made by Farson, Son & Company of Chi- cago, I11., for the entire issue of said bonds, for $49,000.00, and for an ad- ditional premium of $1,719.90, and said offer is the best which has been made to this council, or to the City Treasurer of said city, and in the opinion of this council and of said Treasurer the terms herein set out are the best available; and Wheras, It is deemed advisable to effect an immediate sale of said bonds on the terms named; Therefore, Be It Resolved by the City Council of the City of Dubuque: That the City Treasurer of the City of Dubuque be and is hereby authorized and directed to sell said bonds for cash, in the manner hereinafter spec- ified, to said Farson, Son & Company, of Chicago, for said stun of $49,000.00 and accrued interest, and said addi- tional sum of $1,719.90 premium of- fere on sane, provided: That said bonds shall be by said Treasurer delivered to the Second Na- tional bank of the City of Dubuque, to be held by said bank as a trustee, to be by said trustee delivered to said Farson, Son & Company of Chicago, Ill., purchaser of said bonds, only when the full amount on the pur- chase price of said bonds, as above specified, has been paid in full, in cash to said trustee, and only after the judgment of the Martin - Strelau Company rendered against said City of Dubuque, and to fund which judg- ment said bonds have been issued, has been paid in full by said Trustee and discharged and released of record so that the debt and obligation arising under said judgment shall be no long- er in existence at the time said bonds are deliveeed to said purchaser, and said bonds shall be of no validity or legality until such time as the in- debtedness under said judgment shall be fully and completely discharged and satisfied. Any sum left over from the sale of said bonds, after sat- isfying said judgment and the reason- able expenses incident thereto and incident to the discharge of said fund, shall be paid back by said trustee in- to the treasury of said City of Du buque. Alderman Specht offered the follow- ing: Be it Resolved by the City Council of the City of Dubuque, That it is deemed necessary and advisable to con- struct a sanitary sewer between Wash- Regular Session, December 15, 1910 407 ington and Elm Streets, and it is here- by proposed to construct such sewer as follows, to -wit: an eight inch tile pipe sewer between Washington and Elm Streets, from Twentieth Street to Lin- coln Avenue, and to assess the cost of said sewer against the abutting property. Alderman Specht offered the fol- lowing: Be it Resolved by the City Council of the City of Dubuque, That the City Engineer be and he is hereby directed to prepare a plat and specifications for an eight inch tile pipe sanitary sewer between Washington and Elm Streets from Twentieth Street to Lincoln Ave- nue, showing the locations and general nature of such improvement, the extent thereof, the size and kind of materia' to be used, and to prepare an esti- mate of the cost thereof and the amount assessable upon each lot or parcel of land adjacent to or abutting thereon per front feet or square feet in area, and to file such plat, specifica- tions and estimate in the office of City' Recorder. That after such plat is so filed, the City Recorder shall cause to be pub- lished notice of the intention of the Council to make such improvement, which notice shall be published in three consecutive issues of the official paper of the City of Dubuque, stating that such plat is on file, and generally the nature of the sewer, its location, size and kinds of material to be used, and the estimate of its cost, and fixing the time before which objections can be filed. which time shall not be less than five days after the last publica- tion of said notice, and after the com- pletion of the publication of such no- tice, he shall at its next session, notify the Council thereof in writing with a printed copy of such notice accompany- ing the sane. A proposition of settlement has been made in this matter by claimant in the sum of $325.00, in full of all de- mands, and we respectfully recommend that said sum be authorized paid upon proper receipt and release being taken. GLOVER COMPANY PERMISSION TO MAKE A TUNNEL FROM BUILDING ON SOUTHEAST COR- NER OF FIFTH AND IOWA STREETS, CITY LOTS 229 AND 230, TO BUILDING ON NORTHEAST CORNER OF IOWA AND FIFTH STREETS, CITY LOTS 227 AND 228. Be it Ordained by the City Council of the City of Dubuque: Section 1. That permission be and the same is hereby granted H. B. Glover & Company to make a tunnel 8 feet wide and 6 feet 6 inches clear head room, with reinforced concrete, from the building of said Company on the southeast cornor of Fifth and Iowa Streets, City Lots 229 and 230, to the building of said Company on the north- east corner of Fifth and Iowa streets, City Lots 227 and 228, said tunnel to be located below all pipes, sewers, etc., and near the line of the alley dividing Iowa street and Clay street, City of Dubuque, subject to the conditions herein contained. Sec. 2. Said tunnel shall be con- structed and maintained in such man- ner as to make travel upon and over Fifth and Iowa streets perfectly safe, and as to preserve the condition of said streets as perfectly as though no such tunnel existed. See. 3. Said H. B. Clover Company shall agree, as a condition to the granting of this privilege, and shall guaranty by the acceptance of the terms hereof, to fully protect and save the City of Dubuque harmless as to any claims, damages or liabilities of any kind which may arise because of the construction and maintenance of of said tunnel, and in any suit which may arise because of said tunnel, said Company shall, at the direction of said city, make all necessary defense to said suit and fully idemnify said city to any expenses or outlays or liabili- ities to which said city may be sub- jected because of such suit. Should the City of Dubuque at any time deem said tunnel unsafe, or for any other reason deem its removal nec- essarw or advisable, said city may or- der the immediate removal of same and the restoration of the streets in ques- tion to proper condition, within a rea- sonal time from such order, and on the refusal of said Company so to remove same, said city may do so, at the ex- pense of said Company. Sec. 5. Said H. B. Glover Company shall, as a further condition to the grant herein contained, file with the City Recorder a bond in the sum of $100.00 as a guaranty that the streets affected by the tunnel aforesaid will be kept in repair for one year after the completion of the work, said furnish- ing of bdnd, however, to he in no way construed as relieving said Company Official Notices from the terms and conditions hereof as hereinbefore set out. Section 6. This orclinance shall be in force and effect and after its pass- age by the City Council and its pub- lication one time in the Times - Journal and the Telegraph- Herald, official newspapers, and written acceptance - thereof duly indorsed hereon by said H.
