The application, staff report and related materials are attached for your review. Discussion The applicant spoke in favor of the request, reviewing the reasons behind the submitted plat and explaining how access will be provided. Staff reviewed the previous plat approved for the property. There were no public comments. The Zoning Advisory Commission discussed the request, noting that the submitted plat is in substantial compliance with the City of Dubuque Subdivision Regulations. Recommendation By a vote of 7 to 0, the Zoning Advisory Commission recommends that the City Council approve the request. A simple majority vote is needed for the City Council to approve the request. Location: Olde Massey Road (next to 7326 Olde Massey Road)in Dubuque County MEMORANDUM November 25, 2003 TO: Zoning Advisory Commission FROM: Guy Hemenway, Assistant Planner ~ SUBJECT: Final Plat of Ricann Farms, Inc. No. 4 INTRODUCTION The submitted final plat subdivides a small portion of the northeast corner of an approximately 40 acre lot located in Dubuque County, creating two additional small lots. DISCUSSION The proposed final plat of Ricann Farms will create Lot 1, which is a one-quarter acre, non-buildable lot with no frontage, and Lot 2, which is an approximately one-acre lot, with approximately 200 feet of frontage along Old Massey Road. The primarily lot, Lot 3, will retain approximately 38 acres of area, and have in excess of 1,500 feet of frontage along Old Massey Road. It is the applicant's intent to develop Lot 2 as a building site, with the option to include Lot 1 with it, or potentially sell Lot 1 to the adjacent residence on Massey Road. RECOMMENDATION Staff recommends that the Zoning Advisory Commission approve the submitted plat waiving Section 42-19 Lots and Blocks for lot frontage and noting that Lot 1 has been labeled non-buildable. NO. 4 IN DUBUQUE COUNTY, IOWA Whereas, there has been tiled with the City Clerk a Final Plat of Ricann Farms, Inc. No. 4 in Dubuque County, Iowa; and Whereas, said plat has been examined by the Zoning Advisory Commission and its approval endorsed there: and Whereas, said su~/ey plat has been examined by the City Council and they find that it conforms to the statutes and ordinances relating thereto. NOW THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF DUBUQUE, IOWA: Section 1, That Section 42-19(b) of the Subdivision Regulations is waived to allow Lot 1 to have 0 feet of frontage, where 50 feet of lot frontage is required. Section 2. That the Final Plat of Ricann Farms, Inc. No. 4 is hereby approved and the Mayor and City Clerk are hereby authorized and directed to endorse the approval of the City of Dubuque, Iowa upon said subdivision plat. Section 3. That the City Council hereby waives Article IV, Design and Improvement Standards of the Subdivision Regulations, except Section 42-19, Lots and Blocks.
