PETITIONS AND COMMUNICA-
TIONS.
Petition of Mrs. Alice McGrath,
asking that the Council instruct the
Treasurer to accept $45.00 without
interest in full settlement of special
assessment levied against her prop-
erty for the construction of a sani-
tary sewer in Union Avenue, was on
motion of Ald. Singrin, referred to
the Committee of the Whole.
Petition of Matilda Elliott, asking
that the taxes on Lots 1 and 9 of
O'Hare's Add., in Grigg's Sub., be
canceled for the year 1908, she being
a widow with four small children de-
pending on her for support, was, on
motion of Ald. Singrin, referred to
the Delinquent Tax Committee.
Petition of Dubuque Packing Co.,
asking that the taxes on their prop-
erty be canceled for the year 1908,
in accordance with agreement made
by a former City Council, was, on
motion of Ald. Singrin, referred to
the Committee of the Whole.
Petition of the Dubuque Altar Mfg.
Co., asking that their taxes be can-
celed for the year 1908, in accord-
ance with the action of the City
Council of April 2nd, 1908, was, on
motion of Ald. Rand, referred to the
Committee of the Whole.
Communication from Mr. Peter J.
Seippel, objecting to the City Council
vacating the east end of Dodge Street
for the erection of a large fruit ware-
house, was, on motion of Ald. Singrin,
referred to the Committee of the
Whole.
Petition of Mrs. Louisa Muntz, ask-
ing that the assessment of taxes on
Lot 287, Davis Farm Add., be cor-
rected, claiming error had been made
in the assessment, was, on motion of
Ald. Rand, referred to the Delinquent
Tax Committee.
Petition of Wm. T. Woodrich, stat-
ing that he has been assessed for
taxes on horse and buggy for the year
1908, claiming same is erroneous, and
asking that the Treasurer be in-
structed to refund amount of the er-
ronous assessment, was, on motion of
Ald. Frith, referred to the Commit-
tee of the Whole.
Petition of C. A. Voelker, asking
that the Council instruct the Treasur-
er to accept $203.59 without interest,
in full settlement of special assess-
ments levied against Lot 216, 217 and
237 for the improvements of Dela-
ware and Decorah Avenues, was, on
motion of Ald. Frith, referred to the
Committee of the Whole.
Petition of J. J. Strayer, asking
that the assessment on his dry goods
stock for taxes for the year 1908 be
reduced from $8,000 to $5,000, and
the Treasurer be instructed to refund
him the excess paid by him on said
taxes, was, on motion of Ald. Singrin,
referred to the Committee of the
Whole. '
Petition of the Morris, Johnson,
Brown Mfg. Co., asking that the as-
sessment of taxes on their plant be
canceled for the year 1908, in accord-.
ance with the ordinance passed by
the City Council Marc] 8th, 1904,
was, on motion of Ald. Frith, referred
to the Committee of the Whole.
Petition of L. A. Douglas et al., ask-
ing that the name of Rigi Street be
changed to Louisa Street, also that
the street be made 40 feet wide, was,
on motion of Ald. Frith, referred to
the Committee of the Wlrgle.
Petition of John C. Althauser et al.,
asking that an electric arc lamp be
placed on Althauser Avenue between
Edison Street and Stafford Avenue,
was, on motion of Ald. Singrin, re-
ferred to the Committee of the Whole.
Petition of Peter W. Herber et al.,
asking that an electric arc light be
placed at the corner of Lincoln Ave-
nue and Third Avenue, was, on mo-
tion of Ald. Haas, referred to the
Committee of the Whole.
Petition of W. J. Graham, present-
ing bill for $11.75 for lumber used
in laying a sidewalk on Union Street
from Rush Street to his property, to
replace sidewalk claimed to have
been destroyed during the im-
proving of Bluff Street Extension,
was, on motion of Ald. Saul, referred
to the Foreman of the First Ward to
report back to the Committee of the
Whole.
Petition of N. E. Brooke et al, ask-
ing that an electric light be placed at
the angle of Hennepin Street, was, on
motion of Ald. Frith, referred to the
Committee of the Whole.
Petition of James A. Westaby, by
C. H. Reynolds, his agent, asking that
the plat of Westaby's subdivision, as
presented, be approved by the City
Council, was, on motion of Ald. Rand,
referred to the Committee of the
Whole.
Petition of T. F. Kane, asking that
the assessment for taxes on Lots 1, 2
and 3 in Southern Avenue Add., be
reduced to $900.00 for the year 1908,
was, on motion of Ald. Frith, referred
to the Committee of the Whole.
Petition of Katharine Blitsch, stat-
ing that she is a widow in poor cir-
cumstances and that she is unable to
pay the taxes for the year 1908 on her
homestead, N. 1/2 of Lot 13, Tivoli
Add., and asking that said taxes be
canceled in whole or in part, was, on
motion of Ald. Rand, referred to the
Delinquent Tax Committee.
Petition of Geo. Oakley et al., ask-
ing that Cherry Street from Asbury
Street to 68 feet west of Finley Street
be improved, was, on motion of Ald.
Rand, referred to the Committee of
the Whole.
Petition of Joseph Welu et al., ask-
ing that Pleasant Street from Viola
Street to the east end of said street
for a distance of 250 feet, be improv-
ed, was, on motion of Ald. Frith, re-
ferred to the Committee of the
Whole.
Petition of J. C. Garland et al., ask-
ing that an arc light be placed at the
junction of Langworthy Ave. and
South Hill Street, was, on motion of
Ald. Singrin, referred to the Commit-
tee of the Whole.
Petition of Margaret and Clara
Ziegler, asking that the Treasurer be
instructed to accept the taxes on Lot
'15 and S. 1 / 2 of Lot 16, E. H. Lang -
worthy's Add., claiming that they
have no interest in the personal prop-
erty of Peter Ziegler, deceased, which
is taxed against said real estate, was,
on motion of Ald. Haas, referred to
the Committee of the Whole.
Petition of Christ. Ellerman, ask-
ing that the special assessment levied
against his property for the improve-
ment of Hennepin Street be canceled
and that the City put up a retaining
wall to protect his property and he
will dismiss his suit now pending for
damages against the City, was, on
motion of Ald. Singrin, referred to
the Committee of the Whole.
REPORTS OF OFFICERS.
Communication from J. R. Rein -
fried, chief of the Fire Department,
asking that the Council order a war-
rant drawn in his favor in the sum of
$225.00 on account of back salary due
him, was, on motion of Ald. Haas, re-
ferred to the Committee of the
Whole.
City Engineer Ilg presented a cer-
tified copy of the Right of Way Notice
served on T. J. Mulgrew Co., A. A.
Cooper Wagon and Buggy Co. and on
the Illinois Central R. R. Co.. of the
Council's intention to vacate Charter
and Dodge Street, lying between west
line of the alley between Main and
Iowa and Water Streets for the Unit-
ed Fruit Company's Warehouse.
Remonstrance of P. J. Seipples
Lumber Co., remonstrating against
the vacating of Dodge Street to the
United Fruit Company, was presented
and read. On motion of Ald. Haas
rules were suspended to allow inter-
ested parties to address the Council
in reference to the vacation to the
street. Mr. C. A. Noyes, president of
the Dubuque Commercial Club, then
addressed the Council. On motion of
Ald. Saul the right of way notice and
remonstrance of P. J. Seipples et al
were referred to the Committee of the
Whole.
Ald. O'Rourke moved that a com-
mittee, consisting of the Mayor, Aids.
Saul and Frith, the president and the
secretary of the Dubuque Commercial
Club, Mr. -T. B. Martin, secretary of
the Shippers' Association, and Mr. P.
J. Seipples and Wm. Lawther be ap-
pointed to meet with Mr. F. J. Bech-
ley, superintendent of the I. C. R. R.
Co., Friday, March 5th, at 2:00 p. m.
to arrange for some definite location
for the United Fruit Company's ware-
house. Carried.
City Auditor Lyons reported as fol
lows:
To the Honorable Mayor and City
Council:
Gentlemen: —I herewith submit my
pay roll for the salaries due city of-
ficers, amounting to $954.00.

On motion of Ald. O'Rourke report
of City Auditor Lyons was approved
and warrants ordered drawn to pay
city officers.
City Auditor Lyons also presented
a communication asking that the
Council notify the various depart-
ments of the city to have 'their an-
nual reports in the Auditor's office not
later than April 1st. On motion, re-
port was approved and the Auditor to
be instructed to notify the various de-
partments to present their reports to
him.
Street Commissioner Dorgan re-
ported as follows:

Council:
Gentlemen: Please find Treasurer's
receipt for money collected for tree
trimming as per enclosed list, amount-
ing to $5.50.

Committee on Finance, reported as

Ald. O'Rourke moved the adoption
of the report of the Committee on Fi-
nance. Carried.
Ald. Martin, chairman of the com-
mittee on Ordinances, presented and
read an Ordinance regulating the use
and operation of moving picture ma-
chines and providing a penalty for a
violation thereof, and moved that the
reading just had be considered its first
reading. Carried.
Ald. Frith moved that the Ordi-
nance be referred to the Committee
of the Whole. Carried.
Ald. Martin also presented and read
an Ordinance providing for the es-
tablishing of a board of examiners of
moving picture operators, consisting
of City Electrician and the Committee
on Fire of the City Council, and
moved that the reading just had be
considered its first reading. Carried.
Ald. Frith moved that the Ordi-
nance be referred to the Committee
of the Whole. Carried.
Ald. Martin, chairman of the Com-
mittee on Police and Light, reported
that the patrol boxes in various parts
of the city were in had shape, and
stated that new iron boxes to replace
the old wooden boxes could be made
for $4.00 each.
Ald. Haas moved that the Commit-
tee on Police and Light be empowered
to purchase iron patrol boxes as rec-
ommended. Carried.
Ald. Martin also stated that the
Committee on Police and Light had
been instructed to get estimate of the
cost of repainting and repairing the
patrol wagon and for putting a cover
on said wagon, and that the Connolly
Buggy Co. had given the committee a
price of $65.00 for repainting and re-
pairing the patrol wagon, without
putting on new top, and moved that
the proposition of the Connolly Bug-
gy Co. be accepted and the Committee
on Police and Light be empowered to
have the patrol wagon repainted and
repaired. Carried.
Ald. Rand, chairman of the Com-
mittee on Public Grounds and Build-
ings, reported that the committee had
had some repairs made at the patrol
house, consisting of a new gutter -put
on the rear end of the building, had
- the main room whitewashed and the
stove repaired and that the beam
over the front doors of the building
was in bad shape and moved that the
committee be empowered to have a
steel beam placed over the front doors
of the patrol house. Carried.
Ald. Haas, chairman of the Com-
mittee on Delinquent Taxes, reported
- as follows:
Your Committee on Delinquent
Taxes, to whom was referred the pe-
tition of Mrs. W. McCauley, stating
that she, through her own earnings,
which were often inadequate, is the
sole support of her mother and three
small children, and asking, therefore,
that the taxes on her property, lots
5 and 6 of the Sub. of Mineral Lots
23 and 24, be canceled for the year
1908, would respectfully recommend
that the prayer of the petitioner be
granted and that the City Treasurer
be instructed accordingly.
Also, your Committee on Delinquent
'Taxes, to whom was referred the pe-
tition of Mrs. Elizabeth Crunion, ask-
ing that her homestead, the N. E.
80 -200 feet of lot 9 in Summer Hill
Add., be exempt from taxation for the
year 1908, would respectfully recom-
mend that the taxes on said lot be al-
lowed to remain a lien on the prop -
erty and that the Treasurer be in-
structed not to sell.
Also, your Committee on Delinquent
- Taxes, to whom was referred the pe-
tition of Henrietta Gruenzig, asking
that on account of her poverty, the
taxes on her homestead, lot 32 B,
Wood's Add., be canceled or allowed
to remain a lien on said property,
would respectfully recommend that
the taxes on said lot for the year 1908
he allowed to remain a lien thereon
and that the City Treasurer be in-
structed accordingly.

Ald. Haas moved the adoption of
the various reports of the Committee
on Delinquent Taxes. Carried.
Ald. Martin, chairman of the
Board of Health, reported as follows:
To the Honorable Mayor and City
Council:
Gentlemen: —Your Board of Health
begs to report that at a session of
the Board of Health contract for tak-
ing care of patients suffering with
small pox was entered into with Dr.
Charles Palen, copy of contract which
we herewith submit for your ap-
proval.
Also your Board of Health begs to
report that at a session of said Board
the following motion was carried,
which we submit to your honorable
body for approval:
Regularly moved and seconded that,
without entering into any contract in
any manner or form whatsoever, the
Board of Health of Dubuque City,
Iowa, does hereby designate Dr.
Mathias D. Linehan, of Dubuque,
Iowa, as the duly constituted physician
to act in the care of all cases of in-
fectious or contagious diseases arising
in said City of Dubuque (except cases
of small pox), as contemplated in
Code Section 2570 -A, as contained in
the Supplement of 1907, without obli-
gation or liability as to compensation
or otherwise on the part of said city.
The said Dr. Mathias D. Linehan is
to agree, by reason of being desig-
nated as the physician to take care
of such cases above referred to, that
he will not charge the County of Du-
buque to exceed Four Hundred Dol-
lars ($400.00) per year for the ser-
vices rendered as aforesaid, nor to in-
cur any liability or obligation in any
form in so far as said City of Du-
buque is concerned.
Also, your Board of Health begs to
report that we have had several neces-
sary repairs made on the Detention
Hospital in order to make the place
more sanitary and habitable for pa-
tients confined therein.

Ald. Martin moved the adoption of
the various reports of the Board of
Health.
Ald. Frith moved that the reports
of the Board of Tlealth be referred to
the Committee of the Whole. Car-
ried.
Ald. O'Rourke, chairman of the
Committee of the Whole, reported as
follows:
Your Committee of the Whole, to
whom was referred the petition of
Margaret Farrell- Branigan, stating
under oath and with the certificate of
the former City Assessor affixed, that
the net value of the personal property

of the estate for which she has been
assessed on $20,000.00 valuation, is
but $14,945.24, and asking, therefore,
that the proper deduction be made,
would respectfully recommend that
the prayer of the petitioner be grant-
ed and that the City Treasurer be in-
structed to accept the taxes on her
personal property on the basis of
$14,945.24.
Also, your Committee of the Whole,
to whom was referred the remon-
strance of Emil S. Levi against the
amount of the assessment levied
against the north 44 z feet of City
Lot 69 for cleaning snow from the
sidewalks abutting thereon, would re-
spectfully recommend that said re-
monstrance be received and filed.
Also, your Committee of the Whole,
to whom was referred the petition of
Mrs. Mary L. Sohl, widow of an hon-
orably discharged soldier of the War
of the Rebellion, asking that the
$800.00 reduction in valuation to
which she is entitled be applied to
the assessment on her homestead, lot
16 in Reche's Sub., would respectful-
ly recommend that the prayer of the
petitioner be granted and that the City
Treasurer be instructed to make the
proper deduction on his books.
Also, your Committee of the Whole,
to whom was referred the petition of
George Tourot, an honorably dis-
charged soldier of the War of the Re-
bellion, asking that the reduction of
$800.00 to which he is entitled un-
der the law be applied to the assess-
ment on his present homestead, lot 30
in Cox's Add., would respectfully rec-
ommend that the prayer of the pe-
titioner be granted and that the City
Treasurer be instructed accordingly.
Also, your Committee of the Whole,
to whom was referred the claim of
Guy G. White for $50.00 for balance
due for services during the months of
March and April, 1908, would re-
spectfully recommend that said claim
be not allowed.
Also, your Committee of the Whole,
to whom was referred the petition of
Allan Wiedner and Frank Kenneally,
deputy assessors, asking that they be
allowed the same rate of salary as
that paid their predecessors, would re-
spectfully recommend that said peti-
tion be received and filed.
Also, your Committee of the Whole,
to whom was referred the petition of
the Eagle Point Lime Works, asking
that the time for brick paving Alpine
Street from West Third Street to Ju-
lien Avenue be extended to May 15,
1909, would respectfully recommend
that the prayer of the petitioner be
denied and that the contract for do-
ing such work be annulled.
Also, your Committee of the Whole,
to whom were referred the bills of
Geo. Ragatz & Son for $136.05 for re-
pairs on steamer 500, would respect-
fully recommend that said bill be al-
lowed and that a warrant in settle-
ment thereof be ordered drawn on the
City Treasurer.
Also, your Committee of the Whole,
to whom was referred the bill of
Berg & Briggs Co. for $72.00 for
printing and binding tax receipts,
would respectfully recommend that
said bill be allowed and that a war-
rant in settlement thereof be ordered
drawn on the City Treasurer.
Also, your Committee of the Whole,
to whom was referred the petition of
the Dubuque Wooden Ware & Lum-
ber Co. et al, asking that the east end
of Lincoln Avenue be filled to such
depth and width as will permit all
boats desiring to do so to land there
at any stage of water, would respect-
fully recommend that the prayer of
the petitioners be granted at a cost of
not to exceed $300.00 and expense for
doing said grading to be taken out of
the expense fund. The work to be
done under the supervision of the
Committee on Streets, City Engineer
and Street Commissioner.
Also, your Committee of the Whole
herewith submits the contract entered
into with the Union Electric Co. for
street lighting. As there are several

RESOLUTIONS AND MOTIONS.
Ald. Singrin offered the following:
Whereas it is deemed necessary and
expedient to improve the east side of
Washington Street between Eigh-
tenth Street and Nineteenth Street in
front of and abutting the premises
hereinafter described by laying down
a permanent sidewalk thereon six feet
wide composed of cement material,
Therefore Be It Resolved by the
City Council of the City of Dubuque:
That the City Engineer be and he is
hereby directed to prepare a plat
showing generally the location, nature
and extent of the proposed improve-
ment on the east side of Washington
Street between Eighteenth and Nine-
teenth Streets and in front of and
abutting lot 101 in East Dubuque Ad-
dition, and the kind of material to be
used, and an estimate of the entire
cost thereof and the amount and cost
of such improvement, and the amount
and cost thereof, to be paid by the
city, if any, and the cost thereof and
amount assessable upon each lot or
parcel of land adjacent to or abutting
upon such improvement per front
foot, and to file such plat and esti-
mate in the office of the City Recor-
der; that after the filing of said plat
and estimate in his office, the City Re-
corder shall notify said abutting and
adjacent property owners, as provided
by ordinance, that such plat and esti-
mate are on file, the location and na-
ture of the improvement, kind of ma-
terial to be used, and an estimate of
its cost, and the time before which ob-
jections thereton can be filed, and the
time fixed for hearing, which time
shall not be less than five (5) days
after the service of such notice, and
after such service shall have been
made, the City Recorder shall, at the
next regular session of the City Coun-
cil, notify the Council thereof in writ-
ing, with a copy of such notice ac-
companying the same.

instructed to enforce the provisions
of the ordinance relating to awnings

tion instructing the City Electrician to
notify the Union Electric Co. to in-
stall an arc light at corner of 10th
and Clay Streets. On motion of Ald.
Saul resolution was referred to the
Committee of the Whole.
Ald. Haas offered the following:
Be it Resolved by the City Council
of the City of Dubuque, That the
City Engineer be and he is hereby in-
structed to prepare plans and specifi-
cations for the improvement of Davis
Avenue and Millville Road and to
submit the same to the City Council
and Board of Supervisors at their next
regular session.

On motion of Ald. Frith rules were
suspended to grant Mr. J. Schreiner
and S. D. Ryan permission to address
the Council in reference to granting
the petition of the Dubuque Sand &
Gravel Co. for space on the river

Ald. Frith moved that the City En-
gineer be instructed to prepare a plat
showing the location asked for by the
Dubuque Sand & Gravel Co., also lo-
cation of proposed sidetrack for said
company.
Ald. Rand moved that the petition
of Dorothea Buetell, which had been
received and filed, be referred to the
City Attorney and Delinquent Tax
Committee to report to the Committee
of the Whole. Carried.
Ald. Martin moved that the Com-
mittee on Public Grounds and Build-
ings get estimates on the necessary
work of putting the various engine
houses in proper shape. Carried.
Street Commissioner Dorgan pre-
sented macadam list graded as per in-
structions of the Council for their ap-
proval.
Ald. Saul moved that the report of
the City Engineer and Street Com-
missioner as originaly presented to
the Council be adopted and approved
and warrants ordered drawn to pay
for all macadam as measured. Car-
ried.
Ald. Martin moved to adjourn to
Thursday evening, March 18th, 1909.

REPORTS OF COMMITTEES.
Ald. O'Rourke, chairman of the
Committee of the Whole, reported as
follows:
Your Committee of the Whole, to
whom waa referred the petition of W.
F. Wodrich, stating that he had been
erroneously assessed for a horse and
buggy for the year 1908 and asking,
therefore, that he be refunded the tax
paid thereon, would respectfully rec-
ommend that the prayer of the pe-
titioner be granted and that a war-
rant in the sum of $1.04 be ordered
drawn on the City Treasurer in favor
of said petitioner.
Also, your Committee of the Whole,
to whom was referred the petition of
Mrs. Alice McGrath, stating that on
account of her property being so
much lower than the sewer in Union
Avenue and therefore of no benefit to
her property and offering, therefore,
to Day $45.00 for said sewer, provided
the same be accepted in full settle-
ment of said assessment, would re-
spectfully recommend that said offer
be accepted and that the City Treas-
urer be instructed to redeem said
property from tax sale and to accept
said amount in full settlement for said
assessment.
Also, your Committee of the Whole,
to whom was referred the petition of
J. J. Strayer, asking that the assess-
ment on his stock of merchandise be
reduced to 35,000.00, would respect-
fully recommend that said petition be
received and filed.
Also, your Committee of the Whole, _
to whom was referred the petition of
the Dubuque Packing Co., asking that
the taxes on its plant be accepted in_
accordance with the action of the City
Council of March 15, 1900, would re-
spectfully recommend that the prayer
of the petitioner be granted and that
the City Treasurer be instructed to ac-
cept the taxes of said company on a
basis of $3,000.00 valuation and to
cancel the balance.
Also, your Committee of the Whole-
would respectfully recommend that
hereafter all parties desiring to break
macadam for the city must first ob-
tain a permit from the alderman of
the ward to which such parties be-
long, and that no macadam be pur-
chased by the city unless broken in
accordance herewith.

Also, your Committee of the Whole,
to whom was referred the petition of
Geo. M. Kimball, an honorably dis-
charged soldier of the War of the Re-
bellion, asking that he be allowed the
exemption from taxation as provided
by law on Lot B in Bell's Sub., would
respectfully recommend that the
prayer of the petitioner be granted
and that the Treasurer be instructed
to deduct $800.00 from the assessed
valuation of said lot and to accept the
taxes on the balance in full settlement
thereof.
Also, your Committee of the Whole,
to whom were referred the bills of
Chas. Oswald for $52.00 for cleaning
and repairing stoves at city hall and
$2.95 for iron flanges for Fourth
Street shanty, would recommend that
said bills be allowed and that war-
rants in settlement thereof be ordered
drawn on the City Treasurer.
Also, your Committee of the - Whole,
to whom was referred the petition of
Nettie Eelle Crandall, asking that the
judgment obtained by her against the
city for $1,800.00 with interest at the
rate of 6% from the date thereof be
paid her, would respectfully recom-
mend that the prayer of the petition-
er be granted and that a warrant in
the sum of $2,133.90 be ordered drawn
on the City Treasurer in favor of the
Mayor to liquidate said claim.
Also, your Committee of the Whole,
to whom was referred the petition of
Chris. A. Voelker in relation to the
special assessment levied against cer-
tain lots in - Wood lawn Park Add. for
street improvements, would respect-
fully recommend that the City Treas-
urer be instructed to accept payment
as follows: Lot 216, for the improve-
ment of Delaware Avenue, $67.55; Lot
217, for the improvement of Delaware
Avenue, $67.93, and Lot 237, for the
improvement of Decorah Avenue,
$67.81; provided said assessments be
Paid on or before the 1st day of April,
1909.
Also, your Committee of the Whole,
to whom was referred the petition of
the Dubuque Altar Co., asking that its
taxes for the year 1908 be fixed in ac-
cordance with the action of the City
Council of April 2, 1908, would re-
spectfully recommend that the
prayer of the petitioner be granted
and that the City Treasurer be in-
structed to cancel the taxes on all ma-
chinery, personal property and im-
provements, not including real estate
assessed against said company for the
year 1908.
Also, your Committee of the Whole,
to whom was referred the petition of
T. F. Kane, stating that he had pur-
chased. Lots 1, 2 and 3 in South Ave-
nue Add. for $650.00 and that the as-
sessed valuation on said lots is
$1,500.00 and that he is willing to pay
taxes on said lots on a valuation of
$900.00, would respectfully recom-
mend that the valuation for assess-
ment purposes on said lots be placed
at $900.00 and that the Treasurer be
instructed to accept the taxes thereon
on said basis.

Ald. O'Rourke moved the adoption
of the various reports of the Commit-
tee of the Whole. Carried.
Ald. Martin, chairman of the Com-
mittee on Police and Light, reported
that the Committee on Police and
Light had been empowered by the
City Council to procure iron telephone
patrol boxes to replace the worn -out
wooden patrol boxes now in use and
that the committee had arranged
with the Dubuque Telephone Co. to
install ten telephones in metal boxes
at a rental of $1.00 per month for
telephones, thus obviating the expense
of purchasing patrol boxes, and moved
that the action of the committee be
approved. Carried.
Ald. Saul moved that the rules be
suspended to allow • all parties inter-
ested in the vacation of Dodge Street
to address the Council. Carried.

railway trainmen, of the C., 1VI. & St.

Ald. Frith moved that the Ordi-
nance Committee and the City Attor-
ney be instructed to draw an Ordi-
nance vacating Dodge Street from
the Milwaukee tracks to Warren
Street to the Illinois Central Railroad
Co. for the erection of a warehouse
for the United Fruit Company.
Motion was lost by the following

MOTIONS AND RESOLUTIONS.
Ald. Frith offered the following:
Whereas it is deemed necessary and
expedient to improve the north side
of Thirty -first Street between Jackson
Street and Washington Street in front
of and abutting the premises herein-
after describing by laying down a per-
manent sidewalk thereon four feet
'wide composed of cement material;
Therefore, be it resolved by the City
Council of the City of Dubuque;
That the City Engineer be and he
is hereby directed to prepare a plat
showing generally the location, nature
and extent of the proposed improve-
ment on the north side of Thirty -first
Street between Jackson and Washing-
ton Streets, and in front of and abut-
ting lot 13, Glendale Addition,. and the
kind of material to be used, and an
estimate of the entire cost thereof,
to be paid by the city, if any, and 'the
cost thereof and amount assessable
upon each lot or parcel of land ad-
jacent to or abutting upon such im-
provement per front foot, and to file
such plat and estimate in the office
of the City Recorder; that after the
filing of said plat and estimate in his
office, the City Recorder shall notify
said abutting and adjacent property
owners, as provided by ordinance, that
such plat and estimate are on file, the
location and nature of the improve-
ment, kind of material to be used, and
an estimate of its cost, and the time
before which objections thereto can
be filed, and the time fixed for hear-
ing, which time shall not be less than
five (5) days after the service of such
notice, and after such service shall
have been made, the City Recorder
shall, at the next regular session of
the City Council, notify the Council
thereof in writing, with a copy of
such notice accompanying the same.

of the City of Dubuque, That it is
deemed necessary and advisable to ex-
tend Washington Street northerly
through Lot 10 of Mineral Lot 322 to
Thirty -first Street, and be it further
resolved that the City Engineer be
and he is hereby directed to make a
plat and survey of such proposed ex-
tension, showing the lands or lots
through or over which the same is
proposed to be made, the names of
the owners thereof, and the quantity
of land proposed to be taken and file
such plat in his office for public in-
spection; that after such plat Is so
prepared and filed, said City Engineer
shall give the owners of the property
through or over which such extension
is proposed to be made, notice as pre-
scribed in Section 2 of Chapter XXXI
of the ordinances of the City of Du-
buque.

In Relation to Cleaning Alleys.
Section 34 of the Ordinance in re-
lation to Offenses and Penalties reads
as follows:
No person shall cast or leave ex-
posed in any street, alley, lot, com-
mon, or water course within the city,
the carcass of any animal, or any pu-
trid or unsound meat, fish, or other
substance, or make use, keep, or per-
mit, in his, her or their dwelling
house, shop, store, factory, outhouse,
cellar, yard, lot or any other place
within the city, any noisome or of-
fensive liquid, or substance injurious
to the health of the citizens, or an an-
noyance to the neighborhood, or throw
any filth, manure, offal, or other of-
fensive matter in any street, alley, lot,
or water course in the city, and any
person who shall reuse or neglect to
remove on being notified by the city
any such offensive substance made,
used or kept by such person, shall be
subject TO A FINE OF NOT LESS
THAN ONE DOLLAR NOR MORE
THAN TWENTY DOLLARS, AND BE
IMPRISONED UNTIL SUCH FINE
AND COSTS ARE PAID, NOT EX-
CEEDING THIRTY DAYS.

1909, for the construction of a 48 -inch
circular reinforced concrete storm wa-
ter sewer in West Locust Street from
the present end to a point about 600
feet west to connect with the old
channel at Alta Vista Street, also for
the construction of a lateral sewer of
30 -inch vitrified sewer pipe 57 feet in
length with concrete head wall, in ac-
cordance with plans and specifications
prepared by the City Engineer and
now on file in the office of the City
Recorder.
It is estimated by the City Engineer
that it will require about 600 lineal
feet of 48 -inch circular reinforced
concrete pipe,, 57 feet of 30 -inch sewer
pipe with concrete headwall, 4 man-
holes.
Bidders must state price per lineal
foot for completed four -foot rein-
forced concrete sewer, manholes in-
cluded, and price per lineal foot for
30 -inch pipe lateral, headwall in-
cluded.

read an Ordinance granting James
Levi & Co. the right to construct and
operate a high pressure water main
for fire protection in the alley between
Main and Iowa Streets from Seventh

same, and moved that the reading
just had be considered its first read-
ing. Carried.
Ald. Martin moved that the rules
be suspended for the purpose of read-
ing the Ordinance by its title for the

AN ORDINANCE.
AN ORDINANCE granting to James
Levi & Company, their successors
and assigns, the right to construct
and operate a high pressure water
main for fire protection in the al-
ley between Main and Iowa Streets,
from Seventh to Eighth Streets,
and regulating the same.
Be It Ordained by the City Council of
the City of Dubuque:
Section 1. That James Levi & Com-
rany, their successors and assigns, are
hereby authorized to construct, main-
tain and operate a high pressure water
main, six inches in diameter, to be
laid in the alley between Main and
Iowa Streets from a connection with
the water main on Eighth Street, in
the City of Dubuque, to a connection
with their dry goods store at Seventh
Street, for the purpose of providing
sufficient and adequate water pressure
for fire protection in said store, to be
used for fire protection only.
Said line of water pipe shall be con-
structed, maintained and operated at
the expense of said James Levi &
Company, and shall be constructed un-
der the direction and supervision of
the City Engineer and the Superin-
tendent of the Water Works Depart-
ment of the City of Dubuque.
Section 2. In the construction of
said water pipe line, the streets and
alley shall not be unnecessarily ob-
structed. All obstructions and exca-
vations made in the streets and alley
shall be properly barricaded and light-
ed, and in any action for damages
caused by such construction or exca-
vation, the said James Levi & Com-
pany, in consideration hereof, shall ap-
pear and defend the same, and shall
pay any judgment rendered against
the City of Dubuque therein.
Section 3. The City of Dubuque
may at any time grant the right to
any other person or company to con-
nect with said high pressure water
main, for fire protection purposes
only, upon paying to the said James
Levi & Company a share of the cost
of construction and maintenance of
said line, to be estimated in the fol-
lowing manner: The payment to be
made the said James Levi & Com-
pany is to be in the proportion which
the distance of the point of connec-
tion (running from Eighth Street
south) bears to the total distance of
the line. Any person or company con-
necting at a point south of the most
southerly point of connection (north
of the connection of said James Levi
& Company,) shall pay said James
Levi & Company only in the propor-
tion which the proposed connection
bears to the total distance Lying be-
tw een the said prior point of connec-
tion and the connection of said James
Levi & Company. Any person or com-
pany desiring to make a connection
al a point north of the last point of
connection, shall pay to the person or
company connected at the point next
south in the proportion of the distance
south which said proposed new con-
nection bears to the total distance be-
tween the two connections intermedi-
ate to which the said new connection
is to be made. The intention hereof is
that no person or company construct-
ing or connecting with said pipe line
is to be reimbursed in an amount
in excess of the actual expenses ad-
vanced. The cost of maintaining said
line is to be borne equally by all per-
sons connecting with same, including
the said James Levi & Company.
Section 4. The said James Levi &
Company shall, at or before the time
of accepting the provisions of this
ordinance and its regular publication
in the official newspapers, file with the
Recorder of the City of Dubuque a
proper bond, in the sum of one hun-
dred dollars, to be approved by the
Mayor of said city, obligating the said
James Levi & Company to keep the
streets and alley in which excavations
are made in pursuance of the laying
of the pipe in question in good con-
dition and repair whereever such ex-
cavations have been made, for a
period of one year after the comple-
tion of the work, and that they will
restore said alley and streets to the
same condition in which they were
prior to the commencement of said
work, all of which is to be done to
the satisfaction of the Street Commis-
sioner and the Committee on Streets
of said city.
Section 5. On completion of the
laying of the main as herein provided
for, the said James Levi & Company
shall file with the City Recorder of
said city a sworn statement, showing
the exact cost of said main and of in-
stalling the same, which statement is
to be itemized. Failure to file such
statement shall preclude the said
James Levi & Company from the
right of collecting from any person or
company making connection with said
line the proportionate amount due
the said James Levi & Company un-
der Section 3 of this Ordinance.
Section 6. This Ordinance shall be
in force from and after its passage by
the City Council and its publication
one time in the Dubuque Telegraph -
Herald and the Times - Journal news-
papers, and its acceptance in writing
by said James Levi & Company.

building was in need of repairs and
moved that the matter of having same

mittee on Sewers, reported as follows:
Your Committee on Sewers, to
whom was referred the bill of J. & P.
Sullivan for harness and supplies for
the Sewer Department, would respect-
fully recommend that said bill be al-
lowed and that a warrant in the sum
of $5.15 be ordered drawn on the City
Treasurer in settlement of the same.

Ald. Martin stated that the fire
alarm boxes were in bad shape and
moved that Committee on Fire be em-
powered to have the boxes painted,

detail men to do the work and the
city to furnish the paint. Carried.
Ald. O'Rourke, chairman of the
Committee on Sprinkling, stated that
the sprinkling of the streets had -not
been commenced, but would be as
soon as the committee thought it was
necessary.
