by the mayor of said City, obligating
the said E. B. Piekenbrock_ & Sons to
keep the street and alley in which ex-
cavations are made in pursuance of
the laying of the pipe in question in
good condition and repair wherever
such excavations have been made, for
a period of one year after the com-
pletion of the work, and that they will
restore said alley and street to the ;
same condition in which they were ;
prior to the commencement of said
work, all of which is to be done to
the satisfaction of the Street: Commis-
sioner and the Committee on Streets.
Section 5. On completion of the
laying of the main as herein provided
for, the said E. B. Piekenbrock & Sons
shall file with the City Recorder a
sworn statement, showing the exact
cost of said main and of installing the
same to point of connection with said
building, said statement to be item-
ized. Failure to file the same shall
preclude the said E. B. Piekenbrock
& Sons from the right 'of collecting
from any person or company hereaf-
ter connecting with ' said main. as
provided in Section 3 hereof.'
Section 6. This ordinance shall be
in. force from and after its' passage by
the City Council and its publication
one time in the Dubuque' Telegraph-
Herald and the Times- Journal news-
papers, and it's acceptance in writing
by said E. B. Piekenbrock & Sons.

PETITIONS AND COMMUNICA-
TIONS.
Petition of Eva W. Faherty et al.,
asking that a sanitary sewer be con-
structed along Needham Place from
West Fifth to West Seventh Streets,
and in the alley between West Sev-
enth and West Fifth Streets, was on
motion of Ald. O'Rourke referred to
the City Engineer to report to the
Committee of the Whole.
Petition of J. M. Keppler, . asking
that the Treasurer be instructed to
accept $66.45 without interest in full
for special assessment levied against
Lots 21, 22 and 23, Newbury & Hale's
Sub., was on motion of Ald. O'Rourke
granted and the Treasurer to be in-
structed accordingly.
Petition of Geo. Pregler, Jr., asking
that he be granted permission to lay
a sidewalk in front of his property
to correspond with adjoining proper-
ty on Sanford Avenue and Washing-
ton Streets, was on motion of Ald.
Haas, referred to the Committee of
the Whole.

Petition of the Eagle Point Lime
Works, asking that they be granted
an extension of time for 60 days to
complete the improving of Julien Ave-
nue by constructing brick gutter, was
read.
Ald. O'Rourke asked that the City
Attorney give an opinion as to
whether the Council could grant the
contractors an extension of time.
City Attorney Lyon then stated that
the matter of an extension is within
the discretion of the Council. Where
there has been reasonable grounds
for delay it is entirely within their
jurisdiction and it will not invalidate
the assessment for the work.
Ald. Saul moved that petition of
Eagle Point Lime Works be granted.
Carried.
Petition of Mrs. Catherine Rhom_
berg et al., remonstrating against the
construction of a brick gutter on Ju-
lien Avenue from Bluff Street to Alta
Vista Street and asking that the
Council have the contract of the Eagle
Point Lime Works for doing the work
cancelled was on motion of Ald. Saul
referred to the Committee of the
Whole to view the grounds.
Petition of Geo. Schumacher, also
of Edward Yunker, asking that they
be granted consent to sell and keep
for sale intoxicating liquors by
them at either or all of the sev-
eral places named in their peti-
tions, namely Lot 96, southwest
corner 19th and Washington Streets,
Lot 156, East Dubuque Add., south-
west corner 17th and Elm Street, 1689
Elm Street, 605 Rhomberg Avenue
and 797 Lincoln Avenue, were read
and, on motion of Ald. Frith, were
referred to the Committee of the
whole.
The petitions of the following re-
tail liquor dealers, asking that the
Council adopt resolutions for consent
to sell and keep for sale intoxicating
liquors in the City of Dubuque, Iowa,
were presented and read and were, on
motion, granted.
Following is the list of saloonkeep-

Public Grounds and Buildings had
asked for bids from the different
florists for beautifying the parks of
the city and presented bids for same
and moved that the bids be opened.

plant flower beds in Phoenix Park,

S. E. Muntz, fill the three flower
beds in Grant Park, opposite the High

ing the date for the reception of bids
thereon to the 17th day of June, 1909.

parking twenty -five feet wide from
Dodge to South Dodge Streets, and it
is hereby proposed to grade, park, gut-
ter, curb and macadamize said portion
of said street, binding the top course
of the macadam with Tarvia or its
equal and to assess the cost of said
curbing, guttering, macadamizing and
binding against the abutting property.

Ald Frith moved that the matter of
bids for improving the Engine Houses
be referred to the City Attorney for an
opinion as to whether the Council can
take money out of the Fire Fund to
pay for making repairs at the different
Engine Houses.
Ald. O'Rourke stated that when the
Council was making the appropria-
tions $29,000.00 was appropriated for
the Fire Fund, with the understanding
that $2,000.00 of the appropriation
was to be used for improving and re-
pairing the various Engine Houses and
asked the City Attorney if he would be
prepared to give an opinion in the
matter.
City Attorney Lyon then stated that
if the Council had appropriated $2,-
000.00 for repairing Engine Houses,
then the money could be spent for
making the repairs.
Ald. Rand moved that the City En-
gineer make a report on the bids for
repairing various public buildings that
had been referred to him to estimate.

Gentlemen, Your Board of Health
begs to recommend to your Honorable
Body, that owing to the difficulties
arising in the inspection of cows, by
reason of the 25c fee noW being charg-
ed for said inspection, that the Ordin-
ance regulating the inspection of
Dairy Herds be amended by abolishing
the fee of 25c for such inspection.
Also, your Board of Health begs to
report that vaults on the premises of
E. P. Spahn have been covered without
having been cleaned out and the mat-
ter has been referred to the Sanitary
Officer, to compel owner of the prop-
erty to comply with the Ordinances
of the City in reference to vaults.

Ald. O'Rourke moved as an amend-
ment that the matter of 25c fee for
inspection of cows be referred to the
Committee of the Whole and the re-
port in reference to vaults be approv-

Whereas, It appears .that stagnant
water 'has been permitted for a long
time past to be and remain on Lots
209, 210 and 211 in Woodlawn Park
addition, City of Dubuque; and
Whereas, Said stagnant water is a
nuisance and a menace to public
health;
Therefore, Be it resolved by the City
Council of the City of Dubuque, and it
is hereby ordered, that the owner of
said lots cause the depression causing
said stagnant water to remain on
same to be filled up to such a level
and height as will prevent the further
accumulation and stagnation of water
thereon, and that such action shall be
taken within a period of twenty days,
after the service of a copy of this res-
olution on said owner.

the City of Dubuque, Iowa, issued
bonds Nos. 85 to 92 inclusive amount-
ing to $4,000.00, and bonds Nos. 124
to 1.56 inclusive amounting to $16,500.-
00 for the purpose of refunding the
unpaid balance of prior issues of im-
provement bonds, and
Whereas, Said bonds were to be re-
deemed from the proceeds of the spec-
ial assessments levied upon the prop-
erty on and along the streets and al-
lys for which the original bonds were
issued, and
Whereas, Of the assessments levied
to meet these bonds, amounting to
$20,500.00, there has been paid into
the, City Treasury the amount of Five

Ald. O'Rourke asked the City At-
torney if he was prepared to give the
Council an opinion as to the authority
of Mr. Rottler to erect a building on
the rear end of Lot 14, Dorgan's Sub.
City Attorney Lyon then stated that
he had investigated the facts in the
case and found that the strip of
ground was taken 16 or 17 years ago
with the consent of the then owner for
street purposes and that the land has
been used since for street purposes,
and that the city has acquired title to
the ground by prescription, therefore,
Mr. Rottler is maintaining a nuisance
by erecting and maintaining a building
on public ground.
Ald. O'Rourke moved that the re-
port of the City Attorney be approved
and the City Attorney serve notice on
Mr. Rottler to move the buildings at
once. Carried.
Ald. O'Rourke, Chairman of the
Committee on Finance, stated that on
April 19th, 1906, the City of Du-
buque purchased from the Thos. Yates
estate for quarry purposes, Lots 1 -2 -3
and 4 in Fairview Sub.
The said lots were sold for the
County Tax of 1906 and the purchaser
at said sale has paid the subsequent
taxes thereon, said Lots, being the
property of Dubuque at the time of
the sale, were not assessable and
therefore should not have been sold
for taxes, and moved that the Council
petition the Board of Supervisors, ask-
ing that said lots be redeemed from
tax sale. Carried.
Ald Martin moved that the City
Electrician be instructed to have the
electric light pole on the corner of
West Third Street and Grandview
Avenue moved 10 feet south. Carried.

follows:
Your Committee of the Whole would
respectfully recommend that the ac-
tion of the City Council of June 3rd.
1909, extending the time for the com-
pletion of the work of brick gutter-
ing Julien Avenue from Bluff Street to
Alta Vista Street be reconsidered and

Ald. O'Rourke moved the adoption
of the report of the Committee of the
Whole. Carried.
Petition of John Kapp remonstrat-
ing against the action of the City
Council ordering him to fill Lots 209,
210 and 211, Woodlawn Park, and
asking that the City remove the trou-
ble by having a small drainpipe laid
down the street a short distance was
on motion of Ald. Frith referred to
the Committee of the Whole.
Ald. Singrin arrived at 9:50 P. M.
Ald. Saul, Chairman of the Commit-
tee on Streets, reported as follows:
Your Committee on Streets would
respectfully report that we have exam-
ined St. Ambrose Street from Asbury
Street to Willow Street, Tibey Bros.,
contractors, and would recommend
that said Street be accepted and that
the City Engineer be instructed to pre-
pare a special assessment against the
land or lots benefitted by such im-
provement and file the same in the
office of the City Recorder, who will
thereupon publish the notice of said
assessment as required by Ordinance.

Ald. Saul moved the adoption of
the report of the Committee on
Streets. Carried.
Ald. Frith moved that the petition
of C. H. Meyer, in reference to mining
shaft on St. Ambrose Street, be recall-
ed from the Committee of the Whole.

Petition of C. H. Meyer, President
of the Busy Bee Mining Co., stating
that they have a mining shaft on the
west side of St. Ambrose Street, and
that said shaft extends 4 or 5 feet onto
the sidewalk, which is 15 feet wide
and asking that they be granted per-
mission to let the shaft project those
few feet onto the sidewalk for a time
at least so as to enable them to work
out their property, was read and on
motion of Ald. Frith was then order-
ed received and filed.
Ald. Rand moved that the contract-
or be ordered to grade the west side of
St. Ambrose Street for a sidewalk, not
less than 7 feet for the present. Car-
ried.
Ald. O'Rourke offered the following:

of the City of Dubuque, That it is
deemed necessary and advisable to
improve Julien Avenue from Bluff
Street to Alta Vista Street, and it is
hereby proposed to curb and reset
curb wherever necessary and gutter
both sides of said Avenue with brick
from Bluff Street to the East Lines of
Alta Vista Street on a macadam foun-
dation, and to assess the cost of said
curbing, guttering and .foundation
Against the abutting property.
Ald. O'Rourke moved the adoption
of the resolution.

Council met at 9:00 p. m.
Mayor Schunk in the chair.

Absent —Ald. Frith.
Mayor Schunk stated that the
meeting was an adjourned meeting of
the regular session of June 17th,
1909, and was called to take up and
consider all matters which may
properly come before a regular ses-
sion of the City Council.
Mayor Schunk stated that action
on the approval of the minutes of
the Council Proceedings for the
month of May, 1909, had been de-
ferred at the last session of the City
Council.
Ald. Martin moved that action on
the approval of the minutes for the
month of May be deferred to the
next session of the Council. Carried.
Ald. Martin stated that there were
parties in the Council chamber who
wi:,hed to address the Council and
moved that rules be suspended to al-
low all who wished to address the
Council to do so. Carried.
Mr. Matt Czizek then addressed the
Council relative to having sanitary
sewer extended in Washington Street
between 20th and 21st Streets. Mat-
ter was referred back to Mr. Czizek
to have interested parties sign peti-
tion asking for sewer in Washington
Street.
Mr. Frank McNear also addressed
the Council, stating that he had pre-
sented a bid to the City Recorder for
the improvement of Stoltz Avenue.
and asked that he he granted per-
mission to withdraw his bid on Stoltz
Avenue improvement. On motion of
Aid. Martin, bid of Mr. McNear was
returned to him.

On motion of Ald. Saul the pay rolls

and warrants ordered drawn to pay
the various amounts and the pay rolls

City Recorder Linehan presented
and read the certified copy of the no-
tice of the Council's intention to con-
struct a sanitary sewer in Hart and
Francis Streets. No remonstrance be-
ing filed and no one in the room ob-
jecting to the construction of the
sanitary sewer, action in the matter
was, on motion of Ald. Haas, deferred.
City Recorder Linehan also pre-
sented and read the certified copy of
the notice of the Council's intention
to improve Louisa Street from Grace
to Bennett Streets. Remonstrance of
Wm. T. Potterveld et al against the
proposed improvement was then read
and, on motion of Ald. Rand, action in
the matter was deferred.
City Recorder Linehan also pre-
sented and read certified copy of the
notice of the Council's intention to im-
prove West Locust Street from Hodg-
don Avenue to the east lot line of
Alta Vista Street. No remonstrance
being filed and no one in the room ob-
jecting to the improvement of said
street, action in the matter was, on
motion of Ald. Rand, deferred.
City Recorder Linehan also pre-
sented and read certified copy of the

were referred to the City Engineer to
estimate.
PETITIONS AND COMMUNICA-
TIONS.
Petition of Edith Lawsen, owner of
Lot 1 of the Subdivision of Lots 30
and 31 of Morehiser's Add., stated that
the property had been assessed for
taxation for the year 1908 on a valu-
ation of $800.00 and asking that the
valuation on said lots be reduced to
$450.00 and the Treasurer be in-
structed to accept taxes for the year
1908 on a valuation of $450.00, was,
on motion of Ald. Rand, referred to
the Delinquent Tax Committee.
Petition of C. H. Meyer, owner of
Lots 1 to 5 and 11 to 15, both in-
clusive, abutting on Ruth Street, in
King's Grove Addition, stating that it
will be impossible to ever use same
for street purposes and asking that
said street be vacated, was, on mo-
tion of Ald. Singrin, referred to the
Committee of the Whole.
Petition of Dubuque Park Commit-
tee by O. P. Shims, chairman, asking
that Mr. Charles L. Korn be appointed
a policeman for the Eagle Point Park
with full authority to maintain good
order and to protect the park and
park property, said appointment to be
made without any expense to the city,
was, on motion of Ald. Haas, granted.
Petition of Helen May, asking that
the taxes on Lot 106, Union Addition,
be canceled for the year 1908, she be-
ing a widow in poor circumstances
and unable to pay same, was, on mo-
tion of Ald. Rand, referred to the De-
linquent Tax Committee.
Petition of Rev. H. M. Leech, pastor
of St. Mark's Lutheran Church, ask-
ing that they be granted permission
to 'lay a six -foot sidewalk on the north
side of Twelfth Street, between Locust
and Bluff Streets, instead of a 12 -foot
sidewalk and that they be granted
further time to complete the work,
was, on motion of Ald. Rand, referred
to the Committee of the Whole.
Petition of R. W. Kemler, asking
that the city erect a retaining wall on
Seminary Street, so that he can lay a
cement sidewalk; also that he be
granted further time to lay a cement
sidewalk, was, on motion of Ald.
Rand, referred to the Committee of
the Whole to view the grounds.

asking that the Council grant them

of September, 1909, and shall be paid
for at the time and in the manner
prescribed by Chapter XXXIV of the
Revised Ordinances of 1901, of the
City of Dubuque, for the payment of
the cost of constructing sewers. The
proposals for doing such work will
be acted upon by the Council on the
1st day of July, 1909, and the City
Recorder is hereby ordered to give
ten days notice by publication, ask-
ing for proposals as provided by Or-
dinance.
Ald. Haas moved the adoption of
the resolution.

Mr. F. D. Collette then addressed
the Council, remonstrating against
the improvement.
On motion of Ali. O'Rourke plans
and specifications for the improve-
ment of both sides of Julien Avenue
were approved whereupon Ald.
O'Rourke offered the following:
Be it Resolved by the City Council
of the City of Dubuque, That Julien
Avenue from the west side of Bluff
Street to the east curb lines of Alta
Vista Street be improved by curbing
and resetting curb wherever neces-
sary and constructing a brick gutter
on both sides of said street in ac-
cordance with the Mans and specifi-
cations for such improvement pre-
pared by the City Engineer and now
on file in the office of the City Re-
corder, and be it further
Resolved, That said improvement
shall be completed on or before the
1st day of September, 1909, and shall
be paid for in the manner prescribed
by Chapter XXXII of the Revised Or-
dinance of the City of Dubuque for
the payment of the cost of Street im-
provements.
The proposals for doing said wofk
shall be acted upon by the Council
on the 1st day of July, 1909, and the
City Recorder is hereby ordered to
give ten days' notice by publication,
asking for proposals as provided by

On motion of Ald. Rand the report
of Harbor Master Carroll was re-
ceived and filed.
City Recorder Linehan presented
and read the certified copy of the no-
tice of the Council's intention to con-
struct a sanitary sewer in Hart and
Francis Street, action in the matter
having been deferred at the session
of the Council of June 17th. No re-
monstrance being filed, notice was on
motion of Ald. Haas ordered received
and filed.
On motion of Ald. Haas rules were
suspended to grant parties interested
in the sewer on Francis and Hart
Streets permission to address the
Council. Mr. Frank Scharle then ad-
dressed the Council, asking that the
sewer be placed in the alley between
Francis and Valeria Streets instead
of in Francis Street.
On motion Council took recess to
examine, plans and specifications.
When Council reconvened Ald.
O'Rourke moved that the plans and
specifications for sewer in Hart and
Francis Streets be approved, subject
to waivers being signed by parties re-
siding on Francis Street. Carried.
Alderman Haas then offered the

Be it Resolved by the City Council

tary sewer of eight inch tile pipe be
constructed in Francis Street from
the present sewer in Kaufman Ave-

Whereas, on the 19th day of April,
1906, the City of Dubuque purchased
from the Thos. Yates Estate for
quarry purposes, loth 1, 2, 3 and 4 in
Fairview Sub, and
Whereas, said lots were sold on
December 3rd, 1907, for the taxes of
1906, therefore,
Resolved by the City Council of the
City of Dubuque, that the City Treas-
urer be and he is hereby directed to
redeem said lots from tax sale.
Ald. O'Rourke moved the adoption
of the resolution. Carried.
Ald. Martin, chairman of the Com-
mittee on Ordinances, presented and
read an Ordinance providing for the
widening and improvement of a part
of Iowa Street and First Street and
for the exemption of certain property
of McFadden Coffee and Spice com-
pany, and moved that the reading
just had be considered its first read-
ing. Carried.

AN ORDINANCE.
An Ordinance providing for the
widening and improvement of a part
of Iowa Street and First Street and
for the exemption of certain property
of McFadden Coffee and Spice Com-
pany,
Whereas, McFadden Coffee and
Spice Company has conveyed to the
City of Dubuque, Lot Number Two
(2) of the subdivision of City Lots,
529 and 530, according to the record-
ed plat of said subdivision, for the
purpose of increasing the width of
First and Iowa Streets in front of
said lots, 529. and 530; now, there-
fore, in consideration of said convey-
ance and other good and sufficient
considerations,
Be it Ordained by the City Council
of the City of Dubuque:
Section 1. That said lot two (2)
of said subdivision phall form and
constitute part of said First and Iowa
Streets and, together with the entire
width of said streets in front of and
abutting upon the remaining portion
of said lots, 529 and 530, shall be
graded, paved, guttered and curbed in
good and substantial manner, accord-
ing to such plans and specification as
may be adopted by the City for that
purpose, and that good and substant-
ilal cement walks shall be laid along
and in front of the entire width of
lot One (1) of said subdivision of
City Lots, 529 and 530, being all of
the remaining part of said City Lots.
All of said grading, paving, guttering
curbing and sidewalks to be con-
structed and laid at the expense of
the City of Dubuque, without charge
to said McFadden Coffee and Spice
Company. When said improvements
shall be completed in accordance
with this Ordinance, then and there-
upon McFadden Coffee and Spice
Company shall assume and occupy
the relation of - owners abutting upon
said Streets and improvements.
Section 2. That lot One (1) of the
said subdivision of City Lots, 529 and
530, being the portion thereof owned
by McFadden Coffee and Spice Com-
pany, together with all the improve-
ments which may be hereafter erect-
ed or placed thereon during the per-
iod of exemption, shall be exempt
from taxation for all City purposes
for the period of ten (10) years from
and after the completion and oc-
cupancy cf any building thereon by
said company, its successors or as-
signs, or from the time any building
erected thereon shall be sufficiently
completed for occupancy.
Section 3. This Ordinance to be
in force and take effect from and af-
ter its passage by the City Council
and its publication one time in the
Telegraph- Herald and Times- Journal.

mittee on Fire, asked whether the
City Attorney had presented the
Council with a report in the matter
of fire protection for Park Hill.
Mayor Schunk stated City Attorney
Lycn was absent and that no report
had been made to the Council in the
matter.
Ald. Frith moved that the report
of the Committee on Fire, recom-
mending that the contract for pipe
line from Couler Avenue to Park
Hill be taken from the Committee of
the Whole. Carried.
Ald. Frith then moved that the re-
port of the Committee on Fire, rec-
ommending that the contract for
construction of a pipe line in Park
Hill Avenue be awarded to Nesler
and Hammel, be approved. and the
contract awarded to Nesler and Ham -
mel, provided the City Attorney finds
it legal to do so. Carried.
Ald. Haas, chairman of the De-
linquent Tax Committee, reported as
follows:
Your Committee on Delinquent
Taxes, to whom was referred the pe-
tition of Mary K. De Lorimie-.r, ask-
ing that on account of her physical
disability, the taxes on her property,
the south sixteen feet of City Lot 159,
be cancelled for the year 1908, would
respectfully recommend that said
taxes be allowed to remain a lien on
the property and that the Treasurer
be instructed accordingly.
Also, Your Committee on Delin-
quent Taxes, to whom was referred
the petition of Mrs. Mary Bizanz, a
widow with five minor children to sup-
port and depending on her own labor
for their subsistence, and asking
therefore that the taxes against her
property, the north one -half of lot 2
in Myrtle's addition be cancelled for
the year 1908, would respectfully re-
commend that the prayer of the pe-
titioner be granted and that the City
Treasurer be instructed accordingly.

stating that they had been assessed
on $8,000.00 moneys and credits part
of which amount had been invested
by them in real estate and in stocks
the taxes on which are assessable to
the corporation issuing same, and
asking therefore that their taxes for
moneys and credits be accepted on a
basis of $2,000.00, would respectfully
recommend that the prayer of the
petitioners be granted and that the
City Treasurer be instructed accord-
ingly.
Also, Your Committee of the Whole
to whom was referred the petition of
the Metz Manufacturing Co., asking
for an extension of the exemption
from taxation granted it March 5th,
1903, for an additional period of five
years, would respectfully recommend
that said petition be received and
filed.
Also, Your Committee of the
Whole, to whom was referred the pe-
tition of Margaret and Clara Ziegler
stating that they are erroneously as-
sessed for $2,100.00 personalty which
they have not got and asking there-
fore that said amount be deducted
from their assessment for 1908,
would respectfully recommend that
the prayer of the petitioners be
granted and that the City Treasurer
be instructed accordingly.
Also, Your Committee of the
Whole, to whom was referred the
communication of City Recorder
Linehan relative to the expiration or'
his commission as notary public,
would respectfully recommend that a
warrant in the sum of $5.00 be order -
ed drawn on the City Treasurer in
favor of B. F. Carroll, Governor' of
the State of Iowa, for the renewal of
said commission.
Also, Your Committee of the
Whole, to whom was referred the pe-
tition of the Standard Lumber Com-
pany stating that an error had been
made in its assessment for 1908 in
not deducting liabilities from the
amount of its moneys and credits and
asking that said assessment be cor-
rected, would respectfully recommend
that the prayer of the petitioner be
granted and that the City Treasurer
be instructed to deduct $24,901.00
from the moneys and credits of said

company and to accept taxes on the
balance in full settlement thereof.
Also, Your Committee of the Whole,
to whom was referred the petition of
Nic. Mannos, asking that he be al-
lowed a refund of $26.66 on the
amount paid by him for pool table
license on account of said license be-
ing revoked after having been in force
but one -third of the period for which
the same was issued, would respect-
fully recommend that said petition be
received and filed.
Also, Your Committee of the
Whole, to whom was referred the pe-
tition of H. Woerdehoff asking that
on account of the loss of his building
and 70 bushels of seed potatoes by a
fire which occurred on the 7th day of
April, 1909, that the City cancel the
taxes assessed against his property,
Mineral Lots, 347 and 348, for the
year 1908 and also re- imburse him
for the loss of his potatoes, would
respectfully recommend that the City
Treasurer be instructed to cancel the
taxes on said lots for the year 1908,
and that the claim for' the loss of his
potatoes be not allowed.

improving O'Neill Avenue be open-

Ald. O'Rourke asked the City En-
gineer if all the property owners had
signed waivers agreeing to pay for
the improvement.
City Engineer Ilg stated that Mr.
Wm. Lowther was willing to sign
waivers, and that all the other prop-
erty would stand the assessment.
Ald. Frith moved that the bids be
opened and contract awarded to the
lowest bidders, provided the City gets
waivers from all the property owners
for • the improvement. Carried.
Bids for O'Neill Avenue were then
opened and read and on motion were
referred to the City Engineer to es-
timate, the storm sewer to be con-
structed of 15 -inch pipe and bids to
be estimated accordingly.

dinance passed granting the Chicago,
Milwaukee and St. Paul Railroad
Company permission to extend their
side track across First Street and
through the alley in the rear of Mc-
Fadden's proposed new building.
Ald. O'Rourke moved that the Or-
dinance Committee and the City At-
torney be instructed to prepare an
Ordinance for the laying of side track
by the Milwaukee Railroad Company
for the McFadden Coffee and Spice
Co., the west rail of said side track
not to exceed 8 feet from the west lot
line of McFadden's property and the
Mayor to procure plan of proposed
side track. Carried.

provement to the west line of lot 4 in
Bennett Street Subdivision and the
kind of material to be used, and an
estimate of the entire cost thereof, and
the amount and cost of such improve-
ment, and the amount assessable up-
on any railway or street railway com-
pany, the amount and cost thereof, to
be paid by the city, if any, and the
cost thereof and amount assessable
upon each lot or parcel of land ad-
jacent to or abutting upon such im-
provement per front foot, and to file
such plat and estimate in the office
of the City Recorder; that after the
filing of said plat and estimate in his
office, the City Recorder shall publish
in three consecutive issues of a news-
paper published in this city, a notice
stating that such plat and estimates
are on file, the location and nature of
the improvement, kind of material to
be used, and an estimate of its cost,
and the time before which objections
thereto can be filed, and the time fix-
ed for hearing, which time shall not
be less than five days after the last
publication of such notice, and after
such publication shall have been
made, the City Recorder 'shall, at the
next regular session of the City Coun-
cil, notify the Council thereof in
writing, with a printed copy of such
notice accompanying the same.

Resolved, That said improvement
shall be completed on or before the
1st day of November, 1909, and shall
be paid for in the manner prescribed

The proposals for doing said work
shall be acted upon by the Council on
the 1st day of July, 1909, and the City
Recorder is hereby ordered to give
ten days' notice by publication, ask-
ing for proposals as provided by Or-
dinance.

Ald. Frith stated that Street and
Steuck had extended water mains
for the water oompany before the
new ruling of the Council in regard ,
to charging 5c a foot for rolling
trenches went into effect and that
they objected to being charged for
rolling said trenches on said basis, and
moved that the matter be referred to
the Committee of the Whole.
Ald. Martin moved that a warrant
in the sum of $1.50 be ordered drawn
in favor of the Mayor to refund the
money paid by Alderman O'Neill, of
Clinton, for a copy of the Ordinances
of the City of Dubuque. Carried.
Ald. Singrin stated that consider-
able complaint has been made to him
by various parties in regard to the
collection of garbage and moved that
the matter be referred to the Board
of Health to compel the contractor to
have the garbage hauled more regu-
larly. Carried.

Notice in Relation to Noxious Weeds.
Every owner, agent, trustee, tenant
or other p erson having the control of
lots or parcels of real estate in the
City of Dubuque, Iowa, is hereby no-
tified that the permitting of noxious
weeds growing to seeds on such lots
or parcels of real estate or on the
walks abutting same is forbidden by
the ordinance of said city, and should
any such owner, agent, trustee, tenant
or other person having control of
lots or parcels of real estate fail or
neglect to destroy such noxious weeds
before the 10th day of July 1909, the
City of Dubuque will cause such nox-
ious weeds to be destroyed, and assess
the property whereon such weeds are
allowed to grow, at the rate of 50
cents per hour for the time required
to do the work of destroying same.

City Recorder Linehan presented

Mayor Schunk stated that Street &
Steuck wished to have the bid which
they submitted to the City Recorder
on June 17th for the improvement of
Stoltz Avenue withdrawn. After much
discusson, on motion of Ald. Saul, City
Recorder was instructed to return
bid of Street & Steuck on improve-
ment of Stoltz Avenue to them un-
opened.

Ald. O'Rourke moved that rules be
suspended to grant Mr. John Frantzen
permission to address the Council in
relation to improvement of Julien
Avenue. Carried.
Mr. John Frantzen then addressed
the Council, remonstrating against
the proposed improvement of Julien
Avenue, stating that remonstrance
had been prepared to be presented
to the Council at their last session,
but through some error remonstrance
was not filed within the proper time.
On motion of Ald. Saul bids for the
improvement of West Locust Street,
Julien Avenue, Stoltz Avenue and
sewer in Hart and Francis Street were
ordered opened and read and were
then, on motion, referred to the City
Engineer to estimate.
PETITIONS AND COMMUNICA-
TIONS.
Communication from Lacy, Brown
& Lacy, attorneys for the Wiliam
Hintrager estate, asking that the City
Treasurer be instructed to accept
$545.93 in full settlement of special
assessments for improving various
streets as set out in their petitons,
was, on motion of Ald. Rand, re-
ferred to the Committee of the
Whole.
Communicaton from Memorial Day
Committee, stating that the commit-.
tee extended their sincere and hearty
thanks to the Mayor and City Coun-
cil for their wise and patriotic action
in making the usual appropriaton of
$200.00 for proper observance of Me-
morial Day, was, on motion of Ald.
Rand, referred to the Committee of

$500.00 damages for personal injuries
claimed to have been sustained by
