Minutes_Civil Service Commission 9 1 10Government Body: Date: Time: Place of Meeting: MINUTES Civil Service Commission Tuesday, September 1, 2010 9:00 a.m. City Hall — Conference Room A Present: Chairperson Dan White, Commission Members Jim Schilling, Betty Takes Others Present: Personnel Manager Randy Peck, City Attorney Barry Lindahl, Economic Development Director Dave Heiar, Public Works Director Don Vogt, Teamsters Union Representative Dave Baker, Barbara Morck, Wayne Strohmeyer, Jerome Welsh, John Gotto, Doug Hughes, and John Gillen Chairperson White called the meeting to order at 9:10 a.m. Upon agreement, all witnesses appearing for Mel Schumacher and Jerome Welsh were sworn in. 1. Request of Mel Schumacher, Jr. to Address the Commission Regarding the Civil Service Test for Bus Operator Teamsters Representative Dave Baker presented an opening statement on behalf of Mr. Schumacher requesting that Mr. Schumacher be allowed to test for the position of Bus Operator and be placed on the current list. Wayne Stromeyer and Mel Schumacher gave testimony. City Attorney Barry Lindahl appeared on behalf of the City asking that the request be denied. Personnel Director Randy Peck provided testimony. Motion by Schilling to deny the request. Seconded by Takes. Motion carried 3 -0. Ms. Takes asked that her recommendation that a new test be given in October 2010 be recorded in the minutes. 2. Establish Passing Point and Certify List for Engineering Technician Motion by Schilling to establish the passing point for the position of Engineering Technician at 61 percent and above correct answers. Seconded by Takes. Motion carried 3 -0. Schilling moved to certify the list as read for one year. Seconded by Takes. Motion carried 3 -0. 3. Hearing on Appeal of Jerome Welsh The Commission heard testimony regarding the appeal of Jerome Welsh requesting he be reinstated as Landfill Foreman. Appearing for the City of Dubuque: City Attorney Barry Lindahl Appearing for Mr. Welsh: Teamsters Local 120 Eastern Iowa Director Dave Baker Opening statements were given by Mr. Lindahl and Mr. Baker. Witnesses for the City of Dubuque: Don Vogt, Randy Peck, Doug Hughes. Exhibits: 1 and 2 were entered without objection. Witnesses for Mr. Welsh: Jerome Welsh, John Gotto, Doug Hughes. Exhibits: 1- 9 were entered without objection. Summations were provided by Mr. Lindahl and Mr. Baker. Motion by Takes to uphold the City's position supporting the demotion. Seconded by Schilling. Motion carried 2 -1 with White voting nay.
