City Engineer Gus Psihoyos is recommending acceptance of the construction contract
for the Woodland Drive Stormwater Project, as completed by McDermott Excavating, in
the final contract amount of $21,942.75, which is an 18.8% decrease from the original
contract amount of $27,018.20.
I concur with the recommendation and respectfully request Mayor and City Council
approval.

INTRODUCTION
The enclosed resolution provides for the acceptance of the construction contract for the
Woodland Drive Stormwater Project.
BACKGROUND
On November 12, 2010, the Engineering Department awarded McDermott Excavating
for the construction of approximately 60 feet of curb and gutter and 1,820 square feet of
a pervious pavement runoff collection system in front of the north entrance to Kennedy
Elementary School. This collection system was necessary to relieve the ponding issues
in this corridor due to the street grade. This area in the past had significant ice build -up
from sump pumps and poor drainage. All of the sump pump drains in the area have
been connected to the storm sewer. Pervious asphalt pavement was installed to assist
in reducing the icing in the area.
Based on Iowa Code § 384.103 and § 364.12(3)(c), and through the competitive quotation
process for public improvements, this project was awarded on November 2, 2010 to
McDermott Excavating of Dubuque, Iowa, in the amount of $27,018.20.
The Woodland Drive Stormwater Project was completed by McDermott Excavating of
Dubuque, Iowa, in the final contract amount of $21,942.75, a 18.8% decrease from the
original contract amount of $27,018.20.

RECOMMENDATION
I recommend that the City Council accept the improvements and authorize the payment
of the contract in the amount of $21,942.75 to McDermott Excavating for the Woodland

ACCEPTING THE WOODLAND DRIVE STORMWATER PROJECT AND
AUTHORIZING THE PAYMENT OF THE CONTRACT AMOUNT TO THE
CONTRACTOR
Whereas, the Public Improvement Contract for the Woodland Drive Stormwater
Project (the Project) has been completed and the City Engineer has examined the work
and filed a certificate stating that the Project has been completed according to the terms
of the Public Improvement Contract and that the City Engineer recommends that the
Project be accepted; and •
NOW THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY
OF DUBUQUE, IOWA:
Section 1. The recommendation of the City Engineer is approved and the Project
is hereby accepted.
Section 2. The Finance Director is hereby directed to pay to the Contractor from
the Woodland Storm and Curb and Catch Basin Replacement fund appropriations for
the contract amount of $21,942.75 Tess any retained percentage provided for therein as
provided in Iowa Code chapter 573, and to pay such retainage only in accordance with
the provisions of Iowa Code chapter 573.
