Agreement for Design & Engineering Services — Strand Associates, Inc.

INTRODUCTION
This memorandum is to seek approval and execution of Amendment No. 2 to the October 15, 2008
Agreement for design and engineering services between the City of Dubuque and Strand
Associates, Inc. (Strand) for the Bee Branch Creek Restoration Project.
On August 18, 2010, the City Council approved authorization to negotiate a professional services
agreement with Strand for design and engineering services for the Bee Branch Creek Restoration
Project (Project). On October 22, 2008, the City Manager executed that agreement with Strand in
the amount of $1,392,000.
Under the 2008 agreement, construction - related services were to be provided by the City "unless
otherwise stipulated through an amendment to this Agreement."
Amendment No. 2 will cover the addition of construction - related services (contract administration;
construction staking; and construction records) in the not to exceed amount of $309,900 from
Strand ($92,800), IIW Engineers & Surveyors, PC ($202,400), and Ken Saiki Design, Inc.
($14,700). City staff is providing day -to -day construction observation. Strand, IIW, and Ken Saiki
are to assist with the evaluation of potential project changes, interpretation of specifications during
construction, construction staking, and other engineering services as needed on the project as it
moves towards completion. The cost of services is on an "as needed" basis. The $309,900 fee is
well within the expected construction engineering fees associated with the $10.8 million Lower Bee
Branch Project.
BUDGET IMPACT
The not -to- exceed services amount of $309,900 for Amendment No. 2 will be covered in the Bee
Branch Creek Restoration Capital Improvement Project (7201654) with a current balance of
$3,655,031.29.
ACTION TO BE TAKEN
The execution of Amendment 2 to the October 15, 2008 Agreement for Design and Engineering
Services between Strand Associates, Inc. and the City of Dubuque for the Bee Branch Restoration
Project is requested.

This is Amendment No. 2 to the referenced Agreement.
Under Scope of Services, DELETE Item 9., Construction- Related Services, as written and
REPLACE with the following:
"9.
Construction- Related Services
Construction- Related Services for Phase 1 Construction, which was bid on
May 25, 2010, under Contract 2 -2010, Lower Bee Branch Creek Restoration, consists of
the following:
a. Contract Administration
(1) Attend up to 18 construction status meetings.
(2) Review shop drawings and material samples.
(3) Develop drawings and specifications for up to 12 change orders with one
drawing anticipated for each change order.
(4) Provide review comments for up to 12 partial payment requests.
(5) Issue up to 18 request for information bulletins.
b. Construction Staking
(1) Provide construction staking in conjunction with contractor's needs and as
requested by OWNER.
(2) On average, staking will include utility construction and is anticipated to
require up to 1 stake for each 50 -foot section of trench. Channel
construction is anticipated to require up to 3 stakes for each 50 -foot
section of channel roadway. Roadway construction is anticipated to
require up to 3 stakes for each 25 -foot section of roadway. Stakes will also
be furnished for each new structure and for each utility fitting.
c. Construction Records
(1) Obtain X, Y, Z coordinates at available changes in slope and direction for
buried utilities and finished earth work features constructed on this
PROJECT subject to access as provided by contractor.
(2) Plot information obtained in item C.1. to prepare a record drawing and
submit electronic file with three hard copies to OWNER.
(3) Provide updated volume calculations for combined channel/basin
stage /storage and submit to ACOE for concurrence."

Under Service Elements Not Included, DELETE Item No. 5.
Under Compensation, ADD the following:
"OWNER shall compensate ENGINEER for Construction- Related Services on an hourly rate
basis plus expenses an estimated fee of $309,900. Hourly costs shall be based on ENGINEER's
standard rate schedule. Expenses will be invoiced at cost plus 10 percent.
ENGINEER will suspend Services when the not -to- exceed fee is reached. Services will resume
only upon written authorization by OWNER.
The estimated distribution of the fee between the members of ENGINEER's consultant team is
as follows:
Strand Associates, Inca IIW Engineers and Surveyors, P.E. Ken Saiki Design, Inc.
Under Schedule, CHANGE the following components as noted:
