NOW THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF DUBUQUE, IOWA: Resolution No. Page 2 -10 Section 1. That the application of the Dubuque Metropolitan Area Solid Waste Agency ( DMASWA), the property owner, for voluntary annexation of approximately 17829 acres of land of territory Tying outside of the corporate limits of the City of Dubuque, Iowa, as shown on Exhibit A and legally described as Lot 1 Landfill West Subdivision in Section 1, Township 88 North, Range 1 East of the 5th P.M.; Southwest% of the Southeast'/ in Section 1, Township 88 North, Range 1 East of the 5 P.M.; Lot 2 of the Southeast'/ of the Southeast% in Section 1, Township 88 North, Range 1 East of the 5 P.M.; and Lot 1 Landfill South Subdivision, in Section 6, Township 88 North, Range 2 East of the 5 P.M.; all in Dubuque County, Iowa, is hereby approved'for annexation to the City of Dubuque, Iowa. It was anticipated that the Zoning Advisory Commission would hold a public hearing on DMASWA's rezoning request at their November 3, 2010 commission meeting. Unfortunately, an error was found in the vicinity map that was mailed out with the public meeting notification prior to the Commission's meeting on November 3 Subsequently, DMASWA staff and Planning staff recommended that the Commission table the item to allow property owners to be re- notified with a corrected vicinity map. The Zoning Advisory Commission will hold a public on December 1, 2010 and will send their recommendation to the City Council for the December 20, 2010 Council meeting. DMASWA support staff has requested that the annexation public hearing be moved to the December 20, 2010 council meeting to coincide with the recommendation on rezoning from the Zoning Advisory Commission. ACTION STEP Planning staff requests that the City Council table the public hearing on voluntary annexation of property owned by DMASWA to the December 20, 2010 City Council meeting.
