Maritime Security Act Plan for Rivers' Edge Plaza
On November 25, 2003 the Federal Government published the final rules regarding the
Maritime Security Act. At this point the regulations only require plans for businesses
that have vessels that travel along open waterways on a regular basis or property
owners who own land where vessels with occupancy of more than 150 passengers may
dock. Based on these regulations, the City was required to submit a plan for the Rivers'
Edge Plaza by December 31, 2003.
Fire Chief Dan Brown and Police Chief Kim Wadding recommend City Council approval
of the Maritime Security Plan for the Rivers' Edge Plaza

Madtime Secudty Act plan for Rivers Edge Plaza
Introduction
The purpose of this memorandum is to request City Council approval of the Madtime Security
plan for the Rivers Edge Plaza.
Discussion
On November 25, 2003 the Federal Government published the final rules regarding the
Maritime Secudty Act. These regulations apply to ports and involve businesses located on
waterways that engage in madtime activity. These regulations require that the property owners
and business provide and submit a plan that addresses secudty at all threat levels, MARSEC 1,
MARSEC 2 and MARSEC 3 with MARSEC 3 the highest threat level. At this point the
regulations only require plans for businesses who have vessels that travel along open
waterways on a regular basis or property owners who own land where vessel with occupancy of
more than 150 passengers may dock. Based upon these regulations, the city is required to
submit a plan for the Rivers Edge Plaza.
This plan is required to be submitted to the United States Coast Guard by December 31, 2003
or a fine of up to $25,000 may be issued. There are no previsions in the current regulations to
request an extension to this deadline. Once the plan is submitted, the Captain of the Port
(COTP) will determine whether a plan is necessary and, if necessary, review our plan for
completeness. Attached is a copy of the plan that was submitted to the Coast Guard on
December 31, 2003.
In addition to the plan submitted, we have also submitted a request for exemption. Section
105.106 33CFR allows municipalities to submit a request for exemption for public access areas.
If granted this exemption would relieve us from the responsibility of screening passengers and
their baggage when arriving and departing from Rivers Edge Plaza. No Date has been given on
when exemptions will be announced.

Dear Commander Englebert:
In cooperation with our Rivers' Edge Plaza security plans, we are requesting to
designate the Rivers' Edge Plaza as a public access area as defined by Section
105.106 33CFR Navigation and Navigable Waters Chapter I of the Coast Guard,
Department of Homeland Security, Subchapter H - Maritime Security. The Rivers'
Edge Plaza is an open-air plaza located in the Port of Dubuque on the east edge of
Dubuque.
The plaza contains a small decorative concrete area with a metal unenclosed gazebo
that connects to an attractive river walk. The plaza does extend to the water allowing
occasional use by passenger vessels for passenger and crew loading and unloading.
The plaza is an unsecured public area with no assigned personnel and is open only to
pedestrian traffic. If you have any questions, please feel free to contact me at my office

DESCRIPTION: The Rivers Edge Plaza mooring point is a public access area with a
river walk on top of a floodwall. The moodng point is separated between the waterfront
and the city by a floodwall consisting of a concrete wall encased in an earthen berm.
Access through the floodwall consists of a pedestrian walkway/gate. The gate is solid
steel connected to the concrete wall that provides a water tight seal at times of high
water. The Rivers Edge Plaza contains a concrete surface with a concrete ramp that
extends to the water for use by passenger vessels to place gangway ramps for
passenger and crew loading and unloading. Additionally, the Rivers Edge Plaza
contains an open-air gazebo with 24-hour decorative lighting along the dyer walk and
contains public access emergency 911call boxes.
Normal pedestrian traffic is less than 50 persons at any one time except when excursion
vessels such as the MN Delta Queen, MN Celebration and/or MN Mississippi Queen
are present or the occasional special event. The MN Celebration does make regular
weekly trips with the loading and unloading of passengers at the Rivers Edge Plaza.
Section One: Security Administration and Organization of the Facility
The security for the Rivers Edge Plaza is the pdmary responsibility of the Dubuque
Police Department. The Dubuque Police Department is a nationally accredited agency
consisting of 92 sworn police officers certified by the State of Iowa. Emergency
response for fire and emergency medical services is the responsibility of the Dubuque
Fire Department. The fire department consists of 89 full-time career firefighters. The
fire department provides paramedic EMS (emergency medical service) and technician
level ^ hazard materials response.
The Facility Security Officer (FSO) is designated as the on-duty Shift Commander at the
Dubuque Police Department. The FSO is available on a 24-hour basis and can be
contacted through the Dubuque Law Enforcement Emergency 911 Communication
Center 589-4424.
Section Two: Personnel Training
All police department sworn personnel are certified through the Iowa Law Enforcement
Academy and maintain that certification through a minimum of 12 hours of annual
continuing education pertaining to law enforcement. The Dubuque Fire Department
employs a full-time training officer and maintains all ongoing training records for all
firefighters in the agency. All training is maintained at national certification training
levels. The fire department is equipped and trained to respond to all water hazards.
Section Three: Drills and Exercises
Emergency Response Personnel train on an annual basis for all types of hazards, both
natural and man-made. The annual training is done in conjunction with the City of
Dubuque Multi-hazard plan that includes tabletop, functional, and full-scale exercises.
All the drills and exercises are documented and reviewed.
Section Four: Records and Documentation
Records and documentation of events, training, and facility maintenance are kept by
each responding city agency. All records and documentation are maintain and classified
within the policy and procedures of each city agency.
Section Five: Response to Change in MARSEC Level
The City of Dubuque coordinates and leads a local Threat Assessment Team consisting
of public, private, and community agencies. The Threat Assessment Team conducts
ongoing training and informational meetings to all members. A Threat Assessment
Team Procedural Manual has been developed and implemented for response regarding
any change in Homeland Security or MARSEC levels.
Response in the upgrade of Homeland Secudty and MARSEC levels hardens security
of potential targets and activates procedural responses as outlined in the Threat
Assessment Procedural Manual and requires immediate notifications to primary and
secondary contacts. Vessel notification is the responsibility of the vessel and not of the
facility.
Section Six:
Procedures for Interfacing with Vessels
All vessels requesting to moor at the Rivers Edge Plaza must provide telephone and fax
numbers to the Dubuque Police Department 589-4410 two-hours prior to docking and
file a Declaration of Security as require in Section Seven.
Section Seven: Declaration of Security (DOS)
The City of Dubuque Declaration of Security form (see attached) for mooring at the
Rivers Edge Plaza shall be completed by each passenger vessel certified to carry more
than 150 passengers and completed in its entirety two-hours prior to docking. The
Declaration of Security will be faxed to the Dubuque Police Department 563-589-4497.

Section Eight: Communications
The Dubuque Law Enforcement Emergency 911 Communication Center is the conduit
for all communications involving facility security. Additionally, the Dubuque Fire
Department has a mobile communication command center with capabilities of cell
telephone and fax, public safety radio system, and madne radio. An interoperability
system has recently been purchased to link radio communications between public
safety and madne radio.
Section Nine: Security Systems and Equipment Maintenance
The Rivers Edge Plaza does not contain any security equipment or systems.
Section Ten:
Security Measures for Access Control, including Designated
Public Access Areas
Security measures for access control regarding a change in MARSEC levels include:
MARSEC I Routine Patrol. Public continues to have access to four Emergency
911 Call boxes.
MARSEC II
Declaration of MARSEC II level change, extra patrol attention,
Threat Assessment Procedural Manual procedures activated.
Public continues to have access to four Emergency 911 Call
boxes.
MARSEC III
Declaration of MARSEC III level change, extra patrol attention,
Threat Assessment Procedural Manual procedures activated.
Close floodwall walkway gate to isolate and contain the Rivers
Edge Plaza. Public continues to have access to four Emergency
911 Call boxes.
Section Eleven: Security Measures for Restricted Areas
The Rivers Edge Plaza is a public access area and does not contain any restricted
areas.
Section Twelve: Security Measures for Handling Cargo
The Rivers Edge Plaza is a public access area and does not allow for the handling of
cargo.
Section Thirteen: Security Measures for Delivery of Vessel Stores and Bunkers
The Rivers Edge Plaza is a public access area. The security for delivery of vessel
stores and bunkers is the responsibility of the individual vessel and must be reported on
the Declaration of Secudty form two-hours prior to mooring.
Section Fourteen: Security Measures for Monitoring
Secudty measures for monitoring regarding a change in MARSEC levels include:
MARSEC I Routine Patrol. Public continues to have access to four Emergency
911 Call boxes.
MARSEC II
Declaration of MARSEC II level change, extra patrol attention,
Threat Assessment Procedural Manual procedures activated.

Section Fifteen: Security Incident Procedures
All security incidents are reported to the Dubuque Police Department 911
Communications Center. Once received, an appropriate response is initiated and
documented. This response made include a patrol, investigative, tactical, or situational
response. All responses are conducted through the policies and procedures of the
police depa~u,ent or through the Dubuque County Multi-hazard plan evacuation annex.
Section Sixteen: Audits and Security Plan Amendments
The City of Dubuque Threat Assessment Team and plan has been established by
Dubuque Public Safety Agencies. The Dubuque Police Department has an officer
assigned to secudty assessment for strategic city infrastructures that will be used to
audit and maintain annual site assessment regarding facility use and threat vulnerability.
Section Seventeen: Facility Security Assessment (FSA) Report
