ing that he had let the contract for
constructing cement sidewalk in front
of his property on Dodge Street, was,
on motion of Ald. O'Rourke, received

AN ORDINANCE establishing a grade
on West Twelfth Street and Grove
Terrace from Bluff Street to Ar-
lington Street in the City of Du-
buque, Iowa.
Be It Ordained by the City Council of
the City of Dubuque:
Section 1. That a grade on West
Twelfth Street and Grove Terrace
from Bluff Street to Arlington Street
in the City of Dubuque, Iowa, be and
the 'same is hereby adopted and es-
tablished, as shown by the red line on
the profile of said street and grade
prepared by the City Engineer and
accepted by the City Council on the
17th day of September, 1908, being'
No. 655. and marked "Profile and
Grade of West Twelfth Street and
Grove Terrace from Bluff Street to
Arlington Street, b. m.'s door sill of
house 98 on Grove Terrace, elevation
104.71; east end of north curb of Ar-
lington Street, elevation, 123.32." Said
grade beginning at the west lot line

REPORTS OF OFFICERS.
Mayor Schunk stated that under re-
ports of officers Ald. O'Rourke had a
matter to bring before the Council.
Ald. O'Rourke then stated that in the
Matter of saloon license to begin Oc-
tober 1, 1908, and payment to be
made in advance, he had been spoken
to by many parties and had given
much thought to the matter himself
and had arrived at the conclusion that
payment on the saloon license should
be deferred to the quarter beginning
January 1st, 1909, and moved that
that portion of the Ordinance relating
to the payment of the License for con-
ducting saloons within the limits of
the City of Dubuque be deferred to
the quarter beginning January 1st,
1909.
Ald. Rand moved as an amendment
that the matter be referred to the
Committee of the Whole
Amendment lost by following vote:

Original motion was then carried by

described by laying down a permanent
sidewalk thereon composed of cement

That the City Engineer be and he
is hereby directed to prepare a plat
showing generally the location, na-
ture and extent of the proposed im-
provement on the east side of Alta
Vista street between Julien avenue
and West Fifth street, and in front of
and abutting lots 1 of Mineral lot 82,
lots 28, 29, 37, 38 39, 40, 41, 42, 43,
44, 45, Oxford Heights Sub. lot 1 of
Sub. 1 and 2 of 6 of Mineral lot 79
and Sub. 7 of Min. lot 79, and the
kind of material to be used, and an
estimate of the entire cost thereof and
the amount and cdst of such improve-
ment, and the amount and cost there-
of, to be paid by the city, if any, and
the cost thereof and amount assessa-

improvement per front foot, and to
file such plat and estimate in the of-
fice of the City Recorder; that after

REPORTS OF COMMITTEES.
Ald. Saul, Chairman of the Com-
mittee on Streets, reported as follows:
Your committee on streets would
respectfully report that on the re-
quest of the Mayor of East Dubuque
and street commissioner of the satins
city, we have loaned the rock crusher,
engine, elevator and such other ap-
purtenances as belongs thereto to the
City of East Dubuque with the under-
standing that said machinery is to be
returned this fall and to be set up in
perfect running order wherever in this
city this committee directs.

Alcl. Saul moved the adoption of the
report of the committee on streets.
Carried.
Ald. Martin, Chairman of the Com-
mittee on Police and Light, reported
that he had received a communication
from the Union Electric Company
stating that it was impossible to keep
the arc lamp on the corner of Coates
avenue and Waller street in shape to
burn, owing to the action of the boys
in the neighborhood breaking the
globes and lamps. After - much dis-
cussion Ald. O'Rourke moved that
the matter of the lamp on the corner
of Waller street and Coates avenue
be referred to the Chief of Police to
look after. Carried.
Ald. Martin stated that parties in-
terested in the proposed sewer at Gar-
field and Middle avenues were anxious
to have the alley opened up and sewer
ordered as soon as possible.
Ald. Frith moved that the commit-
tee clerk be instructed to notify all
parties interested in this matter to
appear at the meeting of the commit-
tee of the whole. Carried.
Alcl. O'Rourke, chairman of the
committee on sprinkling, moved that
the City Recorder be and is hereby in-
structed to notify the Union Electric
Company to cease sprinkling for the
present year on the 1st day of Octo-
her, 1908, for the reason that the
funds in some of the road districts
will not permit the expenditure of
money for sprinkling therein, and also
for the further reason that the
sprinkling season, as provided for in
the contract with said Union Electric
Company, expires on the above date.

Ald. Haas stated that work had been
started on the Seventeenth street
storm water sewer, and moved that
Mr. John Rohn be appointed inspector.
Ald. O'Rourke moved as are amend-
ment that the matter of appointing an
inspector for Seventeenth street storm
water sewer be referred to the com-

Ald. Rand asked the City Attorney
if he was ready to report to the Coun-
cil on the matter of the vacation of
the alley between 17th and 18th and
Sycamore and Lynn Streets.
City Attorney Lyon stated that
:v ben th Council acted on the peti-
tion of the Dubuque Butchers' Asso-
ciation, asking for the vacation of the
alley about nineteen years ago, they
in i r'.ed to vacate the alley to the
Butchers' Association, which com-
pany have since occupied said alley
and have erected buildings on part of
same, and if the Council now should
attempt to open said alley they could
be enjoined on the ground that same
has been occupied ever since by said
association or by their successors and
assigns.
After much discussion Alcl•. Rand
moved that the Ordinance committee
be instructed to draw up an ordinance
vacating all the alley except that part
of the alley back of the two lots on
Sycamore Street not owned by the
Union Slaughter House.
Ald. O'Rourke moved as an amend-
ment that the matter be referred to
the Committee of the \Vhole to view
the grounds for early action and all
parties to be notified to be on the
grounds at 9 o'clock Friday morning.
Amendment carried.

Mayor Schunk stated the meeting
was called for the consideration of
the one mill road levy collected by the
Supervisors of Julien Township.
Also the improvement of Davis
Avenue.
Also matter of placing cement curb
around parking on Grandview Ave-
nue.
Also matter of covering Alta Vista
Street from Julien Avenue to West
Fifth Street with Tarvia.
Also to take action on communica-
tion of John Deery.
Also to take action on sidewalk res-
olutions.
Ald. Singrin stated that in June,
1908, the City Council had instructed
the City Attorney to bring proceed-
ings against the Board of Supervisors
of Dubuque County to compel them
to expend money collected by said
board from the county road fund on
the improvement of certain streets
within the city limits and adjacent
thereto, and asked whether the City
Attorney had started these proceed-
ing's.
City Attorney Lyon stated that he
had not started proceedings against
the county, but would start same at
once, stating that in his opinion the
one mill road levy of Julien Township
could be collected by mandamus pro-
ceedings.
Ald. O'Rourke moved that the City
Attorney be instructed to present a
petition Monday morning to the Dis-
trict Court of Dubuque County for an
injunction against the Board of Su-
pervisors of said county, enjoining
said board from expending any money
derived from the one mill road levy
collected in Julien Township. Car-
ried.
Ald. Rand moved that the rules be
suspended to grant permission to par-
ties interested in improvement of
Grandview Avenue to address the
Council. Carried.
Mr. John Phillips and Sam Swift
then addressed the Council, asking
that a concrete curb about four
inches wide and about four inches
above the surface of the street be
placed on Grandview Avenue around
the parking to be placed in the center
of said streets and also that the city
have some of the extra filling from
the street in front of their property
hauled onto their lots instead of haul-
ing same to North street.
Ald. Saul stated that curb was nec-
essary around the parking, and as the
petitioners who had just addressed
the Council represented about five
hundred feet abutting on said street
their petition should be granted.
Ald. Frith moved that Mr. John
Phillips and Sam Swift be allowed to
make a contract themselves for a
concrete curb around the parking on
Grandview Avenue abutting their
property, and the City Engineer give
them the proper stakes. Carried.
Ald. O'Rourke stated that Alta Vis-
ta Street, now being improved, was
ready for the top covering, and the
property owners on said street were
anxious to have a covering of tarvia
put on said street and were willing to
pay half the expense of said improve-
ment if the city would pay the other
half.
Ald. Frith moved that Alta Vista
Street from Julien Avenue to West
Fifth Street be covered with tarvia,
one -half the expense to be paid from
the Second Ward Road fund, the
other half to be paid by the abutting
property owners. Carried.
Communication from Mr. John
Deery, stating that Gottfried Block -
linger, of Dubuque, captain of the U.
S. Battleship Illinois, would on Octo-
ber 30th,' 1908, be elevated to the
rank of Admiral and suggesting that
the City Council take action with a
view to presenting Captain Blockling-
er with an admiral's flag on this oc-
casion.
Ald. Frith moved that the Mayor
appoint a. committee of three citizens
of this city to act with him in arrang-
ing for the presentation of an admir-
al's flag to C aptain Blocklinger on the
occasion of his elevation to the rank
of admiral. Carried.
Mayor Schunk then announced the
appointment of Mr. John Deery, Pet-
er Diene and Geo. W. Healey as the
committee to assist him in the mat-
ter of securing and presenting an ad-
miral flag to Captain Blocklinger.

a grade be properly established on

M. Biehl, stating that the improve-
ment of Precht's Lane as it is now

REPORTS OF COMMITTEES.
Ald. O'Rourke, chairman of the
Committee on Finance, reported that
the committee had made arrange-
ments for securing $15,000.00 from
local banks for the Treasurer to meet
running expenses of the various de-
partments of the city.
On motion. of Ald. Frith action of
the Committee on Finance was ap-
proved.
Ald. O'Rourke moved that the
Street Commissioner and Sidewalk In-
spector be instructed to inspect the
sidewalk hack of Cooper's barn, be-
tween West Fifth and West Sixth
Streets and report back to the Coun-
cil at the next meeting.
Ald. Martin, chairman of the Com-
rnittee on Police and Light, reported
that policemen were in need of caps
for the winter. Ald. Frith moved that
the Police Committee advertise for
bids supplying policemen with caps.

Ald. Rand, chairman of the Com-
mittee on Claims, presented the fol-
lowing:
To the Honorable Mayor and City
Council:
Gentlemen: The undersigned, Com-
mittee on Claims and City Attorney,
would respectfully report:
That there were two cases pending
in the District Court of Dubuque
County, Iowa, against the City, being
No. 15,587. Law, Margaret Sear vs.
City of Dubuque, in which ten thou-
sand dollars ($10,000.00) damages
was claimed for personal injuries sus-
tained by reason of being thrown
from a wagon on Seventh Avenue, due
to the defective condition of said
street, and No. 15,586, Law, Henry
Sear vs. City of Dubuque, in which five
thousand dollars ($5,000.00) damages
was claimed, by reason of the injury
sustained by his wife.
This accident occurred on March
5th, 1907, and the plaintiff injured.
During the progress of the trial
of the case of Margaret Sear an agree-
ment of settlement was reached in
said case, and also to include the case
of Henry Sear, the amount being fixed
at five hundred dollars ($500.00) and
court costs.
The undersigned, believing it to be
to the best interest of the City to ac-
cept said offer, authorized the City
Attorney to settle said cases for that
amount, which he accordingly did,
and we therefore recommend that
our action and the action of the City
A ttorney, in making said settlement be
approved and that a warrant be or-
dered drawn in favor of the Mayor for
the sum of five hundred dollars
(8500.00) to complete the settlement
of said two cases.
We would further report that the
court costs in said cases amount to
$54.60 and would recommend that a
warrant for that sum be ordered
drawn in favor of the Mayor, in full
settlement thereof.

ings, reported having made arrange-
ments to have the roof of the Cen-
tral Engine House repaired and put
in shape for the winter.
Ald. Rand moved that the Commit-
tee on Public Grounds and Buildings
be empowered to have the city car -
renters make necessary repairs on the
City Hall doors; also at the Patrol
House. Carried.
Ald. Rand moved that • the Com-
mittee on Public Grounds and Build-
ings be empowered to have men to
help Park Custodians to trim trees
in the City Parks. Carried.
MOTIONS AND RESOLUTIONS.
Ald. O'Rourke moved that the Side-
walk Inspector be instructed to have
the necessary repairs made on the
election booths and to have the booths
hauled to the various voting precincts
of the city and to keep an account of
the expenses incurred. Carried.
Ald. Martin moved that the Com-
mittee Clerk notify the parties inter-
ested in the opening of the proposed
alley between Middle and Reed Ave-
nues and Lincoln and Rhomberg Ave-
nues to be present at the next meet-
ing of the Committee of the Whole.

Ald. Martin stated that people liv-
ing in the vicinity of the elley north
of Hennepin Street were anxious to
have the alley opened and put in a
passable condition and moved that the
Street Commissioner be instructed to

of Hetherington Sub. Such sidewalk
to be constructed of materials and in
the manner as follows, to -wit: Eight
inches of cinders, 3 inches of concrete
and one inch of cement wearing sur-
face. Said sidewalk to be completed
on or before the 15th day of Novem-
ber, 1908, and the cost of the same be
taxed against said premises and col-

property owner be and is authorized
to construct said sidewalk at his own

trol and regulation of telephone com-
panies operating here, I would state:
First, the latter part of code, section
955, gives to special charter cities the
following power: "They may also
grant individuals or private corpora-
tions the authority to erect, maintain
or purchase * * *. telephone sys-
tems, for the term of not more than
twenty -five years and may renew' or
extend the term of such grants for a
period not exceeding twenty -five
years, but no exclusive franchise shall

Mayor Schunk in the chair.

Mayor Schunk stated that the meet-
ing was an adjourned meeting of the
regular meeting of October 15th,
and was called to take up and con-
sider all matters which may properly
come before the regular session of
the City Council.
Ald. Singrin stated that there were
several parties present in the Council
Chamber who wished to address the
Council in reference to the improve-
ment of Davis Avenue and moved that
the rules be suspended to allow par-
ties interested in the improvement of
Davis Avenue permission to address
the Council. Carried.
Mr. Chris. Voelker, Peter Klauer
and F. N. Schroeder then addressed
the Council, asking that the Council
allow the county to proceed with
placing Davis Avenue in shape for
travel.
After considerable discussion, the
Council members of the Council ex-
plained that they wished the injunc-
tion to remain, and the City would
put Davis Avenue in permanently
good condition immediately after the
City obtains the money collected by
the County and which the City claims
is due them from the County.
Ald. Saul moved that rules be sus-
pended to allow Mr. John Phillips
permission to address the Council in
reference to parking in center of
Grandview Avenue and cement curb
around the parking. Carried.
Mr. John Phillips then asked that
Council have parking in center of
Grandview Avenue graded to a height
of six inches instead of 12 inches
above the surface of the street, as
planned and that the City Engineer
be instructed to give him the stakes
for a four -inch concrete curb to be
placed around the parking in front
of his property. Alds. Saul and
O'Rourke then spoke in reference to
the height of parking and stated that
it would be an impossibility to have
property owners on the street to sign
any more waivers to change the plans
of the improvement of Grandview
Avenue and on motion the City Engi-
neer was instructed to give the lines
for concrete curb to Mr. Phillips at
once.

the City Engineer to be instructed to
give the proper lines.
Petition of E. J. Sauer, asking that
he be granted the use of a space of
200, feet on the north side of First
Street, east of the ground, already:
allotted to, the United States Govern-
ment, for the purpose of loading sand,
and gravel for export purposes; also,
that• he be granted permission to have,
the railroad tracks extended across;
First Street from their present ter-
minus to his loading plant on First
Street, was, on motion of Ald. Frith,
referred, to the Committee of the
Whole to view the grounds and Com
mittee Clerk to notify Mr. Sauer to_
be present on the grounds.
Notice of claim of damages of Alice,
O'Hearn, mother of Gertrude O'Hearn,
asking damages of $300.00 for acci-
dent claimed to have been sustained:

Petition of C. Jacobi, asking that -
the Council adopt a resolution grant-
ing consent to operate a saloon in
the City of, Dubuque, was, on motion
of Ald. Singrin, granted.
Whereupon Ald. Singrin offered the-
following resolution:

be thus granted, extended or renewed,
and no franchise shall be granted or
authorized until after notice of the
application therefor has been publish-
ed once each week, etc."
This provision of the code seems to
have been enacted in this form with
the adoption of the code in 1897.
The Iowa Telephone company, re-
ferred to in the resolution, received
its franchise in 1882, running for a
period of twenty years. This has ex-
pired and has not been renewed.
Code, Sec. 2158, the provisions of
which have been the law in this state
for many years prior to the year 1882,
reads as follows: "Any person or firm
and any corporation organized for
such purpose, within or without the
state, may construct a telegraph or
telephone line along the public roads
of the state, and may erect the neces-
sary fixtures therefor," etc.
The supreme court of Iowa, in the
cases of Chamberlain vs. Iowa Tele-
phone Co., 119 Iowa, page 619, has
construed this section as applying to
cities and towns, and holds in this
case that telephone companies have
the right to use the streets of any
city for the purpose of its business
regardless of any franchise or grant
of right from the city. This case arose
in the city of Des Moines, which is
not a special charter city, and where
the franchise of the company had ex-
pired and an attempt at ouster was
resorted to by plaintiff.
The case of the state vs. Nebraska
Telephone company, in- the 127 Iowa,
page 194, follows this holding and this
case arose in the city of Council
Bluffs, a special charter city.
Under the rulings of the supreme
court, therefore, in the construction
of these statutes and under existing
legislation, it would seem that the
power of cities and towns over tele-
phone and telegraph companies, at
least as to those already established
and doing business in such cities, is
limited to that of ordinary regulation
of a police nature. The code section
applicable would be the following in
Sec. 959: , "Such cities (special char-
ter) shall have power to regulate tele-
graph, district telegraph, telephone,
5 * subways and wires, and
provide the manner in which and the
places,where the same shall be placed,
including the right to construct sub-
ways under and erect poles upon and
along the streets, alleys and public
places; to compel companies having
wires on the same street or alley to
use the same poles or subways upon
reasonable terms," etc.
This section would not confer the
power to exclude a company from op-
erating its business, or to so interfere
with its operations by regulations un-
reasonable and tending to hinder, to
the extent of positive restriction, the
conduct of its business.
Second. The matter of taxing tele-
phone companies is fully covered by
the statutes of the state, and under
existing legislation, all taxation of
telephone companies is under direc-
tion of the executive council (sections
1328 to 1331), and no other taxation
is premissible. Code Sec. 1330, as it
appears in the supplement of 1907,
expressly states that: "Said assess-
ment shall include all property of
every kind and character, whatsoever,
real, personal or mixed, used by said
companies in the transaction of tele-
graph and telephone business; and the
property so included in said assess-
ment shall not be taxed in any other
manner than as provided in this act."

of the Water Works department,
would respectfully recommend that
said bonds be approved, properly re-
corded and placed on file.
Also, your Committee on Finance
herewith presents the receipt of the
City Treasurer for $130.52, the amount
derived from the sale at par of im-
provement bond No. 654, issued for
the construction of a sanitary sewer
in Yale Street from Alta Vista Street
to the center of Harvard Street.
Also, your Committee on Finance,
to whom was referred the petition of
William Hintrager, asking that on ac
count of the City having condemned
a strip of land through lot 6 of Min-
eral Lot 79 for street purposes, and
having awarded him the slim of
$1,000.00 in payment for said strip,
that said amount be deducted from
the assessed valuation of said lot;
would respectfully recommend that
the prayer of the petitioner
be granted, and the Treasurer he
instructed to accept taxes on said
property for the year 1907 on a valu-
ation of $800.00.

each lot or parcel of real estate sub-
ject to assessment or such improve-
ment and file the same in the office of
the City Recorder, who will thereupon
publish the notice of said assessment

O'Farrell Contracting Co. for the im-
provement of Sixth Street from Main
to Locust Street, amount $2,167.79,

Ald. O'Rourke, chairman of the
Committee of the Whole, reported as
follows:
Your Committee of the Whole, to
whom was referred the petition of
Louis Smith et al, asking that the
City Council use its influence with the
Union Electric Co. to have the car
line extended on Asbury Street to the
end of the present improvement,
would respectfully recommend that
the prayer of the petitioners be grant-
ed and that the Committee Clerk be
instructed to notify said company of
the request made and urge compli-
ance therewith.
Also, your Committee of the Whole,
to whom was referred the resolution
offered by Alderman Haas, providing
for the acquisition by the City of the
sanitary sewer in Thirtieth Street
from the west side of Couler Avenue
to the present sewer in the alley be-
tween Couler Avenue and Jackson
Street, would respectively recommend
that said resolution be adopted and
that the City Attorney be instructed to
prepare the papers necessary for a
legal transfer of said sewer.
Also, your Committee of the Whole,
to whom was referred the petition of
St. Joseph's Mercy Hospital et al, ask-
ing that the grade on James Street
from its intersection with West Third
Street to Peabody Avenue be changed
so as to conform with present im-
provements made on said street and
with the present street level; also for
the establishment of a permanent
grade on Peabody Avenue, would re-
spectively recommend that the prayer
of the petitioners be granted and that
the City Engineer be instructed to
prepare profiles of said streets show-
ing grades thereon as petitioned for.
Also, your Committee of the Whole
would respectfully recommend that
the Assistant City Engineer be in-
structed to give the Park Committee
such aid as may be necessary in pre-
paring the preliminary plans for the
improvement of the Eagle Point Park.
Also, your Committee of the Whole,
reporting on the question raised by
the Fifth Ward Non- Partisan Club, of
the safety of the Bijou Theatre, would
respectfully report that the original
petition from said club was referred
May 22, 1908, to the Chief of the Fire
Department for investigation. On
June 19th, 1908, the report of said
Chief was presented to the City Coun-
cil, which report stated that in his
opinion, all the requirements provided
by law for the protection of life in
case of fire in such buildings had been
complied with, but deeming decision
in the matter was of too much im-
portance to rest upon any one officer,
he recommended that the Committee
of the Whole accompany him through
the building in order that any over-
sight of his might be discovered and
ordered remedied. Accordingly, this
report, together with a supplementary
petition from the Fifth Ward Non -
Partisan Club, asking for an early re-
port on the question, was referred to
this committee to view the grounds..
On Tuesday, October 6, 1908, accom-
panied by the Chief of the Fire De-
partment, Chief of Police, City Engi-

viewed the premises from basement to •
upper gallery, gave particular atten-
tion to the manner in which the mov-
ing picture machine is incased, the
wiring of the building, the manner of
heating same and also the number and
acessihility of the exits and fire es-
capes, all of which we find to be satis-
factory. Additional safeguards, such
as Babcock fire extinguishers in vari-
ous parts of the building, a section of
hose attached to water main on the
stage, asbestos curtain to prevent a
possible fire spreading from the stage
to the body of the theatre, an electric
connection direct to the Fourth Street
Engine House and a member of the
Fire Department present on the
stage at every performance, reduces •
the possibility of fire gaining headway
and therefore the danger of loss of
life from fire to the minimum. We
recommend that the said petitions, to-
gether with the report of the Chief of
the Fire Department, all of which are
hereto attached, be received and filed.
Also, your Committee of the Whole,
to whom was referred the petition of
Nic Smith, stating that he had paid
an assessment of $6.71 on the west
one -half of Lot 6 of L. H. Lang -
worthy's Add., for the construction
of a sewer in White Street, and
that it is impossible for him to con-
nect with the same because another
lot intervenes between his property
and the sewer, and asking therefore
that the said amount be ordered re-
funded, would respectfully recom-
mend that the prayer of the petitioner
be granted and that a warrant in said

amount be ordered drawn from the
Special Bonded Fund and that the
City Treasurer be instructed to make
a note of the particular piece of prop-
erty that is hereby exempted.
Also, your Committee of the Whole,
to whom was referred the claim of
John J. McCollins for $75.00 for dam-
ages alleged to have been sustained
by him by reason of his horse and
buggy being run into by the Fire De-
partment, would respectfully report
that there is no liability on the part
of the City for this accident; we
would therefore recommend that said
claim be received and filed.

RESOLUTIONS AND MOTIONS.
Ald. Frith offered the following:
Be it Resolved by the City Council
of the City of Dubuque, That all side-
walks on Grandview Avenue be con-
structed of cement material according
to the plans and specifications for the
improvement of said street and the
Ordinance Committee be hereby in-
structed to draft an Ordinance to that
effect at as early a date as possible.
Ald. Frith moved the adoption of
the resolution. Carried.
Ald. Frith stated that some of the
buildings now being repaired for use
as electric theatres are not properly
equipped with exits in case of fire
and moved that the matter of exam-
ining into the conditions of various
buildings to be used as electric thea-
ters be referred to the Committee on
Fire and Chief of the Fire Depart-
ment to view the grounds and build-
ings. Carried.
Ald. O'Rourke stated that the side -
walk Ordinance now in force was too
lengthy and should be revised.
Ald. Martin moved that the Ordi-
nance in relation to the laying and
relaying of permanent and temporary
sidewalks be referred to the City At-
torny and Ordinance Committee to re-
vise the Ordinance. Carried.
Ald. O'Rourke offered the follow-
ing:
Be it Resolved by the City Council
of the City of Dubuque, That the City
Engineer be and he is hereby directed
to prepare a profile showing a pro-
posed grade on Seventh Avenue from
Rhomberg Avenue to the entrance to
the Eagle Point Park and to submit
the same to the City Council at its
next session.

Mayor Schunk stated that the meet-
ing was an adjourned meeting of the
Adjourned Regular Session of Octo-
tober 22nd. 1908, of the regular ses-
sion of October 15th, 1908, and was
called to take up and consider all mat-
ters which may properly come before
a regular session of the City Council.
PETITIONS AND COMMUNICA-
TIONS.
Petition of the Ideal Directory Com-
pany, Incorporated, asking that they
be granted permission to place and
maintain for a period of five years on
the prominent street corners of the
City thirty Ideal Directories and
agreeing to pay to the City for such
privilege each year one -tenth of the
gross receipts during said term, on
motion of Ald. Frith, was referred to
the Committee of the Whole.
Petition of Mrs. Anna Lorenz, ask-
ing that she be granted permission to
erect a frame barn on Lot 297, sides
to be covered with metal and with
shingled roof, and having consent of
the adjoining property owners at-
tached to her petition, was, on mo-
tion of Ald. Frith, referred to the
Chief of the Fire Department and
Committee on Fire.
Petition of Sara H. Ham, asking
that the Treasurer be instructed to
allow the taxes on Lot 531, Ham's
Addition, to remain a lien on said
property for the present, was, on mo-
tion of Ald. Rand, referred to the
Committee of the Whole.
Petition of James A. Ryan et al,
asking that the petition of Mr. E. J.
Sauer for the use of 200 feet of the
north side of First Street, east of the
ground allotted to the United States
Government and also for permission
to have railroad track extended across
First Street be not granted, was, on
motion of Ald. O'Rourke, referred to
the Committee of the Whole.
Petition of Prof. Albert Kuhn, ask-
ing that the Council take immediate
action in reference to the proposed
extension of Louisa Street, was read,
and on motion of Ald. Rand, the rules

were suspended to allow Prof. Kuhn
permission to address the Council.
Prof. Kuhn then stated that his
house, which was on the land through
which the street was proposed to be
extended, was burned down and be-
fore rebuilding the house he wished
to have the Council make decision as
to whether the street is to be ex-
tended.
On motion of Ald. Rand, the peti-
tion of Prof. Kuhn was referred to
the Committee of the Whole and the
Committee Clerk to notify Prof. Kuhn
and all other property owners inter-
ested in the proposed extension of
Louisa Street to be at the meeting of
the Committee.
Petition of George Grundy et al.,
asking that the Council have a water
plug placed on Bennett Street for the
protection of their property from fire,
was on motion of Ald. Rand referred
to the Committee of the Whole.
Petition of the Old Veteran Fire-
men's Association of the city, asking
that the city grant them the perma-
nent use for their meetings of a va-
cant room in the Ninth Street Engine
House, was on motion of Ald. Martin
referred to the Committee on Fire.
Claim of Christ Ellermann for
$1,000 damages, claimed to have been
done to his property by reason of the
improvement of Klingenberg Street,
was on motion of Ald. Haas referred
to the Committee of the Whole.
Notice of claim of Lizzie J. Post for
$7,500 damages for injuries claimed to
have been sustained by reason of
falling on a defective sidewalk on
South Locust Street, was on motion of
Ald. O'Rourke referred to the Com-
mittee on Claims and City Attorney.
Notice in District Court of Dubuque
County ordering that the City Council
certify to the court all actions and
proceedings of the City Council in
reference to the brick paving of White
Street, with appeal bond of M. Kass -
ler in the sum of $200 attached there-
to was on motion of Ald. Frith re-
ferred to .the City Attorney.
REPORTS OF OFFICERS.
The report of the Water Works
Trustees for the quarter ending Octo-
ber 1st, 1908, was presented, and on
motion of Ald. Martin was referred to
the Special Water Works Auditing
Committee.
REPORTS OF COMMITTEES.
Ald. Martin, chairman of the Com-
mittee of Police and Light, reported
that the committee had advertised for
bids for supplying the police depart-
ment with winter caps and would re-
port their action at the next session
of the council.
Ald. Frith, chairman of the com-
mittee on Fire, reported that the com-
mittee had visited all the electric
theatres in the city and recommended
the following changes to be made in
the various buildings:
At The Clay Theatre, an entrance
to be placed on the north side of the
building, also that the front doors be
changed to open outward.
At The Dreamland, all doors to be
changed to open outward and an ad-
ditional door opening outward and an
additional back stairs be placed in the
rear of said building.
At The Star Theatre, all doors be
made to open outward and an addi-
tional back door be placed in the rear
of said building.
On motion of Ald. Frith, the Chief
of the Fire Department to have said
changes as recommended complied
'.vith at once.
Ald. Frith, chairman of the Com-
mittee on Fire, moved that the City
Recorder be instructed to advertise
for bids for furnishing the City of Du-
buque with fuel and feed for the var-
ious departments for the ensuing year
and present the bids to the Council at
their next session. Carried.
Ald. Rand, chairman of the Com-
mittee on Public Grounds, moved that
the City Recorder be instructed to ad-
vertise for bids for repairing and tak-
ing care of the Town Clock for the
ensuing year, and to present the bids
to the Council at the next session.
Carried.
Ald. Frith, chairman of the Com-
mittee on Harbors, moved that the
City Recorder be instructed to adver-
tise for bids for the privilege of con -
ucting a skating rink in the Ice Har-
bor during the winter of 1908 -9 and to
present the bids to the Council at the
next session. Carried.
Ald. Martin, chairman of the Board
of Health, reported as follows:
Your Board of Health begs to re-
port that at a session of said board the
following' motion was unanimously
ado :
"Regularly moved and seconded
that, without entering into any con-
tract in any manner or form whatso-
ever, the Board of Health of Dubuque
City, Iowa, does hereby designate Dr.

William G. Becker, of Dubuque, Iowa,
as the duly constituted physician to
act in the care of all cases of infec-
tious or contagoius diseases arising in
said City of Dubuque, (except cases of
smallpox), as contemplated in Code
Section 2570a, as contained in the
Supplement of 1907, without obliga-
tion or liability as to compensation or
otherwise on the part of said City.
"The said Dr. William G. Becker is
to agree, by reason of being designat-
ed as the physician, to take care of
such cases above referred to, that he
will not charge the County of Du-
buque to exceed Four Hundred
($400.00) Dollars per year for the
services rendered as aforesaid, nor to
incur any liability or obligation in any
manner or form in so far as said City
of Dubuque is concerned."
Which we submit to your honorable
body for approval.
Also, your Board of Health would
respectfully recommend that owing to
the condition of the Health fund, the
services of the 1-Ieat and Milk Inspec-
tor and Foreman of the Garbage
Dump be dispensed with from Nov-
ember 1st, 1908, to March 1st, 1909.

with the exception of that portion re-

of the report of the Board of Health
in reference to dispensing with the
services of the Foreman of the Gar-
bage Dump from November 1st, 1908,
to March 1st ,1909, be approved. Car-

MOTIONS AND RESOLUTIONS.
Ald. O'Rourke moved that the Chief
of Police see the manager of the
La.gomarcino -Grupe Co. in reference
to a car of apples being sold around
the city by non - residents. Carried.
Ald. Frith offered the following:
Whereas, It is deemed necessary
and expedient to improve the south
side of Hart Street, between Cooler
Avenue and Francis Street, in front
of and abutting the premises herein-
after described by laying down a per-
manent sidewalk thereon, composed
of cement material four feet wide
Theerfore, Be it Resolved by the
City Council of the City of Dubuque:
That the City Engineer be and he is
hereby directed to prepare a plat
showing generaly the location, nature
and extent of the proposed improve-
ment on the south side of Hart Street,
between Couler Avenue and Francis
Street, and in front of and abutting
lot N. r/ of lot 10 of Tivoli Add.,
owned by Jacob Marschal Est., and
the kind of material to be used, and
an estimate of the entire cost thereof
and the amount and cost of such im-
provement, and the amount and cost
thereof, to be paid by the city, if any,
and the cost thereof and amount as-
sessable upon each lot or parcel of
land adjacent to or abutting upon
such improvement per front foot, and
to file plat and estimate in the office
of the City Recorder; that after the
filing of said plat.and estimate in his
office, the City Recorder shall notify
said abutting and adjacent property
owners, as provided by ordinance,
that such plat and estimate are on
file, the location and nature of the im-
provement, kind of material to be
used, and an estimate of its cost, and
the time before which objections
thereto can he filed, and the time
fixed for hearing, which time shall
not be less than five (5) days after
the service of such notice, and after
such service shall have been made,
the City Recorder shall, at the next
regular session of the City Council,
notify the Council thereof in writing,
with a copy of such notice accom-
panying the same.

enth street between Jackson and

construction of an eight -inch tile pipe
Sanitary Sewer in West Third street,
College avenue and Allison Place,
from the present manhole at the in-
tersection of Booth and West Third
streets, thence westerly in College av-
enue to Allison Place, thence westerly
in Allison Place to the first angle west
of College avenue, in accordance with
the plans and specifications prepared
by the City Engineer and now on file

It is estimated by the City Engineer
that it will require

Sealed proposals will be received at
the Council Chamber, City Hall, by
the City Recorder until 8:00 p. m.
Thursday, November 5th, 1908, for
the improvement of the following
streets by laying cement sidewalks on
a foundation of eight inches of cin-
ders in accordance with the plans
and specifications prepared by the
City Engineer and now on file in the
office of the City Recorder.
Five foot sidewalk 137.8 feet in
length on the west side of Grandview
Avenue, between Grace Street and
Bennett Street, in front of and abut-
ting on Lot 3, 4 and 5, Hodge's Sub.
Four foot sidewalk 160 feet in
length on the east side of Walnut
Street, between West Eleventh and
Rose Street, in front of and abutting
on Lot 4 of Hetherington's Sub.
Four foot sidewalk 264.4 feet in
length on the east side of Walnut
Street between Rose Street and Chest-
nut Street, in front of and abutting
on Lot 5 of Hetherington's Sub., and
Lots 778 and 779 of A. McDaniel's
Sub.
The work is to be paid for when
said work is completed and as pre-
scribed by the Ordinance relating to
the construction of sidewalks in the
City of Dubuque, work to be com-
pleted on or before the 15th day of
November, 1908. Bidders must state
price per square foot for sidewalks
laid.
Each bid must be accompanied by
a certified check for $25.00 on some
Dubuque bank as a guarantee that a
contract will be entered into if
awarded.
The City Council reserves the right
to reject any and all bids.

REGISTRATION NOTICE.

Dubuque, Oct. 18th, 1908.
Notice is hereby given that the reg-
isters of election duly appointed to
register voters in the city of Dubuque,
Iowa, will be in attendance at the
places hereinbelow mentioned, for the
purpose of making the registry list of
names of such electors as may be en-
titled to vote at this fall election, to
be held Tuesday, November 3rd, 1908.
Said registers will meet at their re-
spective places on Thursday, Friday
and Saturday, October 22nd, 23rd and
24th, 1908, at 8 o'clock a. m., and be
in session until 9 o'clock p. m. of said
days.
Said registers will thereafter meet
on Saturday, October the 31st, 1908,
from 8 o'clock a. m. to 9 o'clock p. m.
of said day for the purpose of correct-
ing the list and adding thereto such
names of voters as may be entitled to
vote.
Said registers will thereafter meet
on Tuesday, November 3rd, 1908,
(election day) and be in session from
the time the polls open until they
close, and register only such voters as
were absent from the city during the
preceding days that the board was in
session, also such voters as did not
become citizens until Monday or
Tuesday, November 2nd and 3rd, 1908.

PETITIONS AND COMMUNICA-
TIONS.
Petition of the Illinois Central Rail-
road Company, asking that they be
given permission to extend their side-
track known as the Becker coal track,
from the terminus of said track, just
south of Wall Street in Block 20 and
west of Cedar Street, crossing Wall
Street, Cedar Street and Pine Street
in said city and connecting with the
tracks of the C. G. W. R. R. Co. in
Block 17, was read and on motion of
Ald Singrin, rules were suspended to
allow Mr. T. J. Fitzpatrick, attorney
for the Illinois Central, permission to
address the Council. Ald. Frith then
moved that the petition of the Illi-
nois Central R. R. Co. be referred to
the Committee of the Whole to
view the grounds and Mr. Fitzpatrick
be notified to be present at the meet-
ing. Carried.
Petition of Miss S. J. Goldthorpe et
al asking that an electric arc lamp be
placed at the intersection of Tenth
and Bluff Streets, was, on motion of
Ald. Frith, referred to the Commit-
tee of the Whole.
Petition of W. D. Middlesworth et
al, remonstrating against the proposed
erection of a retaining wall in Alice
Street (also known as Ardmore
Terrace) and asking that the Street
Committee and City Engineer investi-
gate the matter, was on motion of Ald.

sioner to stop any work on said Street,

Petition of the Young Women's
Christian Association, by Miss Augusta
Eighmey, president, asking that their
property, known as lot 101 and N. 18

said property on the list for exemption
