City Engineer Gus Psihoyos is recommending acceptance of the construction contract
for the 2010 Drain Tile Project, as completed by Drew Cook & Sons Excavating, in the
final contract amount of $20,272.84, which is a 19.1% increase from the original
contract amount of $17,019.50. The cost increase was the result of adding an
additional location to the project scope.
I concur with the recommendation and respectfully request Mayor and City Council
approval.

The enclosed resolution provides for the acceptance of the construction contract for the 2010
Drain Tile Project.
BACKGROUND
The 2010 Drain Tile Project added one storm sewer intake and extended approximately 655
lineal feet of 6 -inch drain tile to three locations —Earl Drive, Embassy West Drive, and Raven
Oaks Drive.
Based on Iowa Code § 384.103 and § 364.12(3)(c), and through the competitive quotation
process for public improvements, this project was awarded on April 20, 2010 to Drew Cook &
Sons Excavating of Dubuque, Iowa. The project was completed in the amount of $20,272.84,
which is a 19.1% increase from the original contract amount of $17,019.50. The cost increase
came about as the result of adding an additional location (Crissy Drive) to the project scope.
The 2010 Drain Tile Project was completed by Drew Cook & Sons Excavating, in the final
contract amount of $20,272.84.

I recommend that the City Council accept the improvements and authorize the payment of the

ACCEPTING THE 2010 DRAIN TILE PROJECT AND AUTHORIZING THE PAYMENT
OF THE CONTRACT AMOUNT TO THE CONTRACTOR
Whereas, the Public Improvement Contract for the 2010 Drain Tile Project (the
Project) has been completed and the City Engineer has examined the work and filed a
certificate stating that the Project has been completed according to the terms of the
Public Improvement Contract and that the City Engineer recommends that the Project
be accepted; and
NOW THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY
OF DUBUQUE, IOWA:
Section 1. The recommendation of the City Engineer is approved and the Project
is hereby accepted.
Section 2. The Finance Director is hereby directed to pay to the Contractor from
the Drain Tile Program appropriation for the contract amount of $20,272.84 less any
retained percentage provided for therein as provided in Iowa Code chapter 573, and to
pay such retainage only in accordance with the provisions of Iowa Code chapter 573.
