SUBJECT: Westbrook Park Temporary Location Lease

Leisure Services Manager Marie Ware recommends City Council approval of an
amendment of the lease between the City of Dubuque and Callahan Construction, Inc.
for development of a temporary location for Westbrook Park. This amendment changes
the location of the park from Lots 38 and 39 to Lots 1 and 2. The first site and the
proposed new site are comparable.
I concur with the recommendation and respectfully request Mayor and City Council
approval.

The purpose of this memo is to request Council consideration of an amendment of the
lease between the City of Dubuque and Callahan Construction, Inc. for development of
a temporary location for Westbrook Park.
BACKGROUND
In December 2009 the Council approved a lease for the temporary location of
Westbrook Park to be lots 38 and 39 in Phase 1 of the subdivision. I met on site with
developer Joe Callahan to discuss the location and he now wants to move the park to
what is shown on the attached unapproved plat for phase 2 of lots 1 and 2.
We have purchased a swing, 13' slide, climber and a whirl that are ready to be installed
in their temporary location. This was also agreed upon development by the Council at
that same December 09 meeting.
I have worked with City Attorney Barry Lindahl to amend the lease to reflect the change
in location. In my site visit with Mr. Callahan the first site and the proposed new site are
comparable and will provide what is needed for the equipment we have.
RECOMMENDATION
I recommend approval of the amendment to the lease with Callahan Construction.

FIRST AMENDMENT TO
LEASE AGREEMENT
BETWEEN
THE CITY OF DUBUQUE, IOWA
AND
CALLAHAN CONSTRUCTION, INC.
This First Amendment to Lease Agreement between the City of Dubuque, Iowa,
(City) and Callahan Construction, Inc. (Owner) is made and entered into this day
of , 20
Whereas, City and Owner entered in to a Lease Agreement dated for reference
purposes the 4 day of August, 2010; and
Whereas, City and Owner now desire to amend the Lease Agreement as set
forth herein.
NOW THEREFORE, IT IS AGREED BY AND BETWEEN THE PARTIES AS
FOLLOWS:
Section 1. Section 1.1 of the Lease Agreement is hereby amended to read as
follows:
1.1 Owner hereby leases to City the following described property:
Lots 1 and 2 in Block 2 as shown on Exhibit A attached hereto together
with any and all easements and appurtenances thereto and subject to any
easements and restrictions of record (the "Leased Premises "), for a term
of three (3) years commencing on , 2010 and terminating at
11:59 p.m. on , 2013 subject to all of the terms, covenants,
conditions and agreements contained herein.
Section 2. Exhibit A to the Lease Agreement is hereby deleted and attached
Exhibit A substituted in lieu thereof.
Section 3. The insurance schedule attached to the Lease Agreement is hereby
deleted.
