Minutes Civil Service 10 28 03CIVIL SERVICE COMMISSION Date: Tuesday, October 28, 2003 Time: 3:00 p.m. Place of Meeting: City Hall - Conference Room A Present: Chairpemon Merle Duehr, Commissioner Loras Kluesner; Absent: Commissioner Dick Wertzberger Also Present: Personnel Manager Randy Peck; Water Plant Manager Bob Green, Michael Lightfoot, Terry Shaffer Approve Minutes of October 10, 2003 Kluesner moved to approve the minutes of October 10, 2003; Seconded by Duehr, passed unanimously. Request of Michael Lightfoot and Terry Shaffer to Address the Commission Regarding "Bumping Rights" Terry Shaffer explained that he had held the position of Maintenanceworker in the Parking Division and that he had over twenty years seniority with the City. When the City Council eliminated the position of Maintenanceworker in the Parking Division he was assigned as a Maintenanceworker in the Operations and Maintenance Department to fill a temporary vacancy. His question to the Commission was whether he should have been allowed to "bump" into any Maintenanceworker position rather than being placed in a "temporary" position since he had senior'Ay over most of the employees currently filling Maintenanceworker positions. He questioned whether the Civil Service law had been followed correctly with regard to bumping procedures. He also questioned what department he was in - street, sewer maintenance or refuse. Personnel Manager Randy Peck explained that when the position of Maintenance- worker in the Parking Division was eliminated the City created a position in the Operations and Maintenance Department to accommodate Mr. Shaffer. The position he was put into had been a Lead Mechanic that was temporarily vacant. The position was reclassified to Maintenanceworker and Mr. Shaffer placed into it. Since that the time the individual who had previously filled the position of Lead Mechanic had resigned and the position was not a permanent placement for Terry. Mr. Peck further explained that he had had a conference cell with Dave Baker, President of the Teamster's Union, which represents all Maintenanceworker positions, the Teamster's attorney, and Barry Lindahl, Corporation Counsel for the City and it was their opinion that the proper procedure had been followed in this case. Upon being questioned by the Commission, Mr. Shaffer said them were throe things he wanted: (1) A letter from the City verifying that the position he was in was permanent; (2) What department he was in; and (3) Were the proper bumping procedures under Chapter 400 followed correctly. Commissioner Kluesner moved to petition Corporation Counsel Barry A. Lindahl to provide a written opinion on whether the proper procedure under the Civil Service law had been followed. Seconded by Duehr, passed unanimously. Chairman Duehr stated that another meeting would be scheduled on this subject following receipt of the written opinion from the attorney. 3. Amend Certified List for Equipment Operator II by Adding John Gillen and Troy Kapparos = There Kluesner moved to amend the Certified List for Equipment Operator II by adding employees John Gillen and Troy Kapparos. Seconded by Duehr, passed unanimously. Establish Passing Point and Certify List for Position of Water Meter Repairworker I Kluesner moved to establish the passing point for the position of Water Meter Repairworker at 66 (71%). Seconded by Duehr, passed unanimously. The envelopes were opened and the names of those individuals with 66 or higher correct answers were read. Kluesner moved to certify the list for Water Meter Repairworker I as read. Seconded by Duehr, passed unanimously. being no further business the meeting adjourned at 3:44 p.m. Approved at meeting of Chairperson
