Madison Street Sanitary Sewer EXtension Project
INTRODUCTION
The enclosed resolution provides for the award of the Madison Street Sanitary
Sewer Extension Project.
DISCUSSION
The project was approved for the Fiscal Year 2001 Capital Improvement
and provides for the construction of ~pproximately 435 feet of gravity
Program,
sanitary sewer and 395 feet of private forcemain.
The project will provide sewer service to three homes and one apartment building
along Madison Street. An 8"-diameter gravity !sewer pipe will be installed from
Ellis Street to the backyards of the two homes at 1829 and 1849 Madison Street.
Sanitary sewer grinder pumps will be installedi for one home at 1910 Madison
Street and the apartment building at 1921 Madison St. and both will be tied into
the Clarke Drive sanitary sewer. The pumps fqr 1910 and 1921 Madison Street
were needed due to the grade, existing retaining walls, and the lack of access for
equipment to tie those two properties into the grhv ty sewer.
Sealed bids were received on January 13, 2004. A summary of the bids is as

Top Grade Excavating of Epworth, Iowa, submitted the Iow bid in the amount of
$90,460.09. This included a base bid for the above-mentioned project of
$81,720.09, with an alternate of $8,740.00 for piping that was in disrepair. The
total amount of the base bid and the alternate is 7.44% under the engineer's
estimate of $97,733.45.
RECOMMENDATION
I recommend that the contract be awarded to Top Grade Excavating in the
amount of $90,460.09.

AWARDING CONTRACT
Whereas, sealed proposals have been submitted by contractors for the
Madison Street Sanitary Sewer Extension Project pursuant to Resolution No.
497-03 and notice to ~idders published in a newspaper published in the City of
Dubu~lue, Iowa on the 8m day of January, 2004.
Whereas, said sealed proposals were opened and read on the 13th day of
January, 2004, and it has been determined that the bid of Top Grade Excavating
of Epworth, Iowa, in the amount of $90,460.09 was the lowest bid for the
furnishings of all labor and materials and performing the work as provided for in
the plans and specifications.
NOW THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE
CITY OF DUBUQUE, IOWA:
That the contract for the above improvement be awarded to Top Grade
Excavating and the Manager be and is hereby directed to execute a contract on
behalf of the City of Dubuque for the complete performance of the work.
BE IT FURTHER RESOLVED:
That upon the s~gning of said contract and the approval of the contractor's
bond, the City Treasurer is authorized and instructed to return the bid deposits of
the unsuccessful bidders.

RESOLUTION WITH RESPECT TO THE ADOPTION OF THE
RESOLUTION OF NECESSITY PROPOSED FOR THE MADISON
STREET SANITARY SEWER.EXTENSION PROJECT
Whereas, the City Council has proposed a Resolution of Necessity for the
Madison Street Sanitary Sewer Extension Project has given notice of the public hearing
thereon as required by law; and
Whereas, the public hearing has been held, all persons offering objections have
been heard and consideration given to all objections and is pending before this Council;
and
Whereas, this is the time and place set as provided for the taking of action on the
proposed Resolution of Necessity.
NOW THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY
OF DUBUQUE, IOWA:
That the proposed Resolution of Necessity described above is hereby:
Adopted, without amendment, and all objections filed or made having been duly
considered are overruled.
Adopted as amended by the Schedule of Assessments attached hereto as
Exhibit A, and made a part hereof by reference. All objections filed or made

Sanitary Sewer Extension Project.
BACKGROUND
The project was approved for the Fiscal Year 2001 Capital Improvement Program,
and provides for the construction of approximately 435 feet of gravity sanitary
sewer and 395-feet of private forcemain.

RECOMMENDATION
I recommend that the City Council establish th~ date of January 5, 2004 for the
public hearing and authorize the City Clerk to advertise for proposals.
City staff is currently working with these property owners to secure the necessary
easements to complete this project. To allow eXtra time for these restrictions, the
contractors will be required to guarantee their bids for a period of ninety (90} days
instead of the normal thirty (30) days. This shbuld not be a problem because of
winter construction difficulties.

Notice of public headng on proposed plans and specifications, proposed
form of contract and estimate of cost for the Madison Street Sanitary Sewer
Extension Project.
NOTICE IS HEREBY GIVEN: The City Council of Dubuque, Iowa will hold
a public headng on the proposed plans, specifications, form of contract and
estimate of cost for the Madison Street Sanitary Sewer Extension Project in
accordance with the provisions of Chapter 384, City Code of Iowa, at 6:30 p.m.,
on the 19th of January, 2004, in the Public Library Auditorium, 360 West 11th
Street, in Dubuque, Iowa. Said proposed' plansi specifications, form of contract
and estimate of cost are now on file in the office of the City Clerk. At said
headng any interested person may appear and file objections thereto or to the
cost of the improvements.
Any visual or hearing-impaired persons !needing special assistance or

Whereas, proposed plans have been duly Prepared and approved by the City
Council of the City of Dubuque and are now on file in the office of City Clerk showing
among other things the plans, specifications, form of contract, estimated cost and
preliminary plat and schedule showing the amoun! proposed to be assessed against
each lot and the valuation of each lot as filed by the City Council, for the Madison Street
Sanitary Sewer Extension Project. ~
NOW THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY
OF DUBUQUE, IOWA:
That the City Council deems it advisable and necessary for the public welfare to
make the herein mentioned improvements, and unless property owners at the time of
the final consideration of this proposed resolution have on file with the City Clerk
objections to the Resolution of Necessity, they shall be deemed to have waived all
objections pertaining to the regularity of the proceeding and the legality of using the
special assessment procedure.
Said improvements shall be constructed and done in accordance with the plans
and specifications which have been approved by the City Council and now on file with
the City Clerk. That the cost and expense of making such improvement will be
assessed partially or totally against privately owned property lying with the assessment
limits, and in an amount not to exceed that provided by law, and in proportion to the
special bener~s conferred.
The portion of the cost which shall be borne by the City will be paid from the
Sanitary Sewer Construction Fund, and special assessment bonds may be issued in
anticipation of deferred payments of assessments when a contract has been performed
and accepted, and the proceeds thereof used to pay the contractor.

Whereas, sealed proposals have been submitted by contractors for the Madison
Street Sanitary Sewer Extension Project (the Project) pursuant to Resolution No. 497-
03 and notice to bidders published in a newspaper published in the City of Dubuque,
Iowa on the 5~ day of December, 2003.
Whereas, said sealed proposals were opened and read on the 18th day of
December, 2003, and
Whereas, the City Council has deemed it advisable to reject all bids and to re-bid
the Project.
NOW THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY
OF DUBUQUE, IOWA:
Section 1. That the bids for the above Project be rejected and the Manager

Due to an error in the bidding process, Assistant City Engineer Gus Psihoyos
recommends rejection of the bids and recommends the City Council authorize the re-
bidding for January 13, 2004. By re-bidding the project on this date, the public hearing
already set for January 19, 2004 does not have to be rescheduled.

INTRODUCTION
The enclosed resolution provides for the rejection of the bids for the Madison
Street Sanitary Sewer Extension Project.
DISCUSSION
Sealed bids were received on the Madison Street Sanitary Sewer Extension
Project on December 18, 2003.
Due to an error in the bidding process, it will be necessary to rebid the project.
RECOMMENDATION
I recommend that all bids be rejected and that the Council authorize the
rebidding of the Madison Street Sanitary Sewer Extension Project for January 13,
2004. By re-bidding the project on this date the public headng already set for
January 19, 2004 does not have to be rescheduled.
ACTION TO BE TAKEN
The City Council is requested to reject all bids and to authorize the rebidding of
the Madison Street Sanitary Sewer Extension Project for January 13, 2004 by the

TO COMMENCE A PUBLIC IMPROVEMENT PROJECT TO EXTEND
SANITARY SEWER ON MADISON STREET
Whereas, the City Council is considering commencing a public
~mprovement project to construct a sanitary sewer system on Madison Street;
and,
Whereas, in connection with the construction of the sanitary sewer
system, it will be necessary for the City to acquire easements [or the installation,
maintenance, and repair of said sewer; and
Whereas, Iowa Code Chapter 6B requires an opportunity for public in put

RESOLUTION OF NECESSITY
Whereas, proposed plans have been duly prepared and approved by the City
Council of the City of Dubuque and are now on file in the office of City Clerk showing
among other things the plans, specifications, form of contract, estimated cost and
preliminary plat and schedule showing the amount proposed to be assessed against
each lot and the valuation of each lot as filed by the City Council, for the Madison Street
Sanitary Sewer Extension Project.
NOW THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY
OF DUBUQUE, IOWA:
That the City Council deems it advisable and necessary for the public welfare to
make the herein mentioned improvements, and unless property owners at the time of
the final consideration of this proposed resolution have on file with the City Clerk
objections to the Resolution of Necessity, they shall be deemed to have waived all
objections pertaining to the regularity of the proceeding and the legality of using the
special assessment procedure.
Said improvements shall be constructed and done in accordance with the plans
and specifications which have been approved by the City Council and now on file with
the City Clerk. That the cost and expense of making such improvement will be
assessed partially or totally against privately owned property lying with the assessment
limits, and in an amount not to exceed that provided by law, and in proportion to the
special benefits conferred.
The portion of the cost which shall be borne by the City will be paid from the
Sanitary Sewer Construction Fund, and special assessment bonds may be issued in
anticipation of deferred payments of assessments when a contract has been performed
and accepted, and the proceeds thereof used to pay the contractor.

NOW THEREFORE, BE IT RESOLVED BY THE COUNCIL OF THE CITY
OF DUBUQUE, IOWA:
That the Madison Street Sanitary Sewer Extension Project is hereby
ordered to be advertised for bids for construction.
BE IT FURTHER RESOLVED, that the amount of the secudty to
accompany each bid shall be in an amount which shall conform to the provisions
of the Notice to Bidders hereby approved as a part of the plans and
specifications heretofore adopted.
That the City Clerk is hereby directed to advertise for bids for the
construction of the improvements herein provided, to be published in a
newspaper having general circulation in the City of Dubuque, Iowa, which notice
shall not be less than four days nor more than forty-five days pdor to the receipt
of said bids at 2:00 p.m. on the 18th of December 2003. Bids shall be opened
and read by the City Clerk at said time and will be submitted to the Council for
final action at 6:30 p.m. on the 19th of January, 2004.

Madison Street Sanitary Sewer Extension Project
INTRODUCTION
The enclosed resolutions authorize the bidding procedure for the Madison Street
Sanitary Sewer Extension Project.
BACKGROUND
The project was approved for the Fiscal Year 2001 Capital Improvement Program,
and provides for the construction of approximately 435 feet of gravity sanitary
sewer and 395-feet of private forcemain.
DISCUSSION
The project will provide sewer service to three homes and one apartment building
along Madison Street. An 8" diameter gravity sewer pipe will be installed from
Ellis St. to the backyards of the two homes at 1829 and 1849 Madison Street.
Sanitary sewer grinder pumps will be installed for one home at 1910 Madison St.
and the apartment building at 1921 Madison St. and both will be tied into the
Clarke Dr. sanitary sewer. The pumps for 1910 and 1921 Madison St. were
needed due to the grade, existing retaining walls, and the lack of access for
equipment to tie those two properties into the gravity sewer.

RECOMMENDATION
I recommend that the City Council establish the date of January 5, 2004 for the
public hearing and authorize the City Clerk to advertise for proposals.
City staff is currently working with these property owners to secure the necessary
easements to complete this project. To allow extra time for these restrictions, the
contractors will be required to guarantee their bids for a period of ninety (90) days
instead of the normal thirty (30) days. This should not be a problem because of
winter construction difficulties.

NOTICE IS HEREBY GIVEN: The City Council of Dubuque, Iowa will hold
a public headng on the proposed plans, specifications, form of contract and
estimate of cost for the Madison Street Sanitary Sewer Extension Project in
accordance with the provisions of Chapter 384, City Code of Iowa, at 6:30 p.m.,
on the 19th of January, 2004, in the Public Library Auditorium, 360 West 11th
Street, in Dubuque, Iowa. Said proposed plans, specifications, form of contract
and estimate of cost are now on file in the office of the City Clerk. At said
headng any interested person may appear and file objections thereto or to the
cost of the improvements.
