Approval of Minutes of October 28, 2003 and December 4, 2003 Meetings
Commissioner Duehr moved to approve the minutes of October 28, 2003 and
December 4, 2003. Seconded by Kluesner, passed unanimously.
Appeal of Jeffrey D. Simons of His Dismissal from the City of Dubuque
Water Department and Specification of Charges
Commissioner Kluesner moved to receive and file the communication of Jeffrey
D. Simons and to schedule the hearing on his appeal for January 23, 2004 at
3:00 p.m. in City Hall - Conference Room A

Opinion from Barry Lindahl Regarding Grievance of Terry Shaffer
Mr. Shaffer explained that he felt when the position of Maintenanceworker in the
Parking Division was eliminated due to budget cutbacks that he should have
been allowed to "bump~ into another position. He also questioned that he was
placed in the position of Maintenanceworker in the Operations and Maintenance
Department, but that he did not know what department he was assigned to in
that department. Mr. Shaffer further requested that he be listed as a
'permanent' full-time employee.
The City responded that the issue of "bumping rights" did not come into effect in
this case because there was no "diminution of employees" - that there currently
are nineteen Maintenanceworker positions within the Ci[y organization and
nineteen employees classified as Maintenanceworkers. Mr. Peck further
explained that the employee is assigned to the Operations and Maintenance
Department and there are no other departments within the department. There
are various activities and it is the responsibility of the Department Manager to
make assignments of personnel to those activities. With regard to being listed
as a "permanent" full-time employee, there is no such designation. A~I City
employees are regular full-time employees and no position is designated
permanent.
Commissioner Duehr moved to receive and file the opinion from Corporation
Counsel Barry A. Lindahl. Seconded by Kluesner, passed unanimously.
The Commission scheduled a meeting to discuss a grievance from Terry Dolan for 3:00
p.m., Tuesday, January 20, 2004 in City Hall - Conference Room A.
