Minutes_Human Rights Commission 12 9 10CITY OF DUBUQUE HUMAN RIGHTS COMMISSION MEETING MINUTES OF December 9, 2010 Commissioner Allen called the special meeting of the Dubuque Human Rights Commission to order at 3:02 p.m. on Thursday, December 9, 2010, at the City Hall Annex, 1300 Main Street, Dubuque, Iowa. Roll Call: Present: Anthony Allen, Chair Lori Apel Marcos Rubinstein Absent: Fred Davis Staff: Carol Spinoso Commissioner Rubinstein moved pursuant to section 21.5(1)(f) of the Iowa Code, to proceed to closed session to deliberate a contested case — DHRC #4259, Tony Seals vs. Linwood Cemetery and Cambridge TEMPositions. Commissioner Stewart seconded. Roll Call: Allen Yes Apel Yes Rubinstein Yes Stewart Yes Sutton Yes All in favor of proceeding to closed session (3:05 p.m.) Commissioner Rubinstein moved to return to open session. Commissioner Stewart seconded. Roll call: Allen Yes Apel Yes Rubinstein Yes Stewart Yes Sutton Yes All in favor of returning to open session (6:10 p.m.) R.R.S. Stewart Lynn Sutton, Vice Chair Commissioner Stewart moved to modify the recommended decision by striking the last paragraph on page 17, and inserting a new paragraph of findings agreed to during deliberations. Under Order on page 19, changing the first sentence to read, "The Complainant's charge of retaliation against Respondent, Cambridge TEMPositions is denied. Adding "The Complainant's charge of retaliation against Respondent Linwood Cemetery is affirmed" and adding a section for damages as agreed to during deliberations. Commissioner Rubinstein seconded. Roll call: Allen Yes Apel Yes Rubinstein Yes Stewart Yes Sutton Yes Motion to adjourn by Commissioner Rubinstein. Second by Commissioner Sutton. All in favor.
