The City of Dubuque Zoning Advisory Commission has reviewed the above -cited
request. The application, staff report and related materials are attached for your review.
Discussion
The applicant spoke in favor of the request, reviewing the need for lot split and size of
parcels.
Staff reviewed surrounding property owners, existing development of the property and
need to waive lot frontage for Lot 2 of 1. Planning staff noted that access to Lot 2 of 1
will be through Lot 1 of 1, which is under common ownership.
There were no public comments.
The Zoning Advisory Commission discussed the request, noting that they had no
objection to the submitted plat of survey.
Recommendation
By a vote of 6 to 0, the Zoning Advisory Commission recommends that the City Council
approve the request, waiving the frontage requirement for Lot 2 of 1.
A simple majority vote is needed for the City Council to approve the request.

Description of Proposal
The lot in question is Lot 1 of Arthofer's Skyline Addition. Lot 1 of Arthofer's Skyline
Addition is comprised of lots formerly known as Lot 1 of Siegert's Place 3rd Addition and Lot 6
of Westside Commercial Park. The component lots of Lot 1 of Arthofer's Skyline Addition were
the subject of separate financing arrangements prior to their consolidation into Lot 1 of
Arthofer's Skyline Addition. The owner of Lot 1 of Arthofer's Skyline Addition, Arthofer
Properties, LLC, is now desirous of undoing this consolidation and again dividing the property
along the lines of its component lots. These lots will be renamed Lot 1 and Lot 2 of Lot 1 of
Arthofer's Skyline Addition, respectively. This subdivision will permit the owner /applicant to
more easily address certain financing arrangements with respect to Lot 1 of Arthofer's Skyline
Addition.

INTRODUCTION
The submitted Plat of Survey subdivides the existing Lot 1 of Arthofer's Addition into two
parcels. The subject property is on the south side of Westside Court, which is located
immediately north of Menard's along U. S. Highway 20.
DISCUSSION
The submitted Plat of Survey subdivides an approximately three acre parcel into two
lots. The subject Plat of Survey requires review and approval by the Zoning Advisory
Commission and City Council as Lot 2 of 1 will not have frontage on a public or private
street.
The applicant has provided a description of the proposal that basically indicates that
because of financing arrangements, that the subdivision of Lot 1 Arthofer's Skyline
Addition into two parcels will facilitate the financing arrangements that were made for
purchasing the property from Menard's.
Planning staff does not have an objection to the proposed lot configuration of the
submitted Plat of Survey as access to Lot 2 of 1 is limited to going through Lot 1 of 1 to
access Westside Court. In addition, any potential construction of a building on Lot 2 of
1 would require review and approval through the City's development review process,
which coordinates review with other departments, including Fire, Water, Engineering,
Building Services and Planning Departments. Any concerns about access can be
addressed at that time.
RECOMMENDATION
Planning staff recommends that the Zoning Advisory Commission recommend approval
of the submitted Plat of Survey Lot 1 of Lot 1 and Lot 2 of Lot 1 of Arthofer Skyline
Addition subject to waiving lot frontage requirement for Lot 2 of 1.

RESOLUTION NO. 9-11
A RESOLUTION APPROVING THE PLAT OF SURVEY LOT 1 OF LOT 1 AND LOT 2 OF LOT
1 OF ARTHOFER'S SKYLINE ADDITION.
Whereas, there has been filed with the City Clerk a Plat of Survey Lot 1 of Lot 1 and Lot 2
of Lot 1 of Arthofer's Skyline Addition, and
Whereas, said Plat of Survey provides 0 feet of frontage for Lot 2 of Lot 1 on a public or
approved private street, where street frontage is required by Section 11 -14 of Title 16 of the City
of Dubuque Code of Ordinances, Unified Development code; and
Whereas, said Plat of Survey has been examined by the Zoning Advisory Commission
and had its approval endorsed thereon; and
Whereas, said Plat of Survey has been examined by the City Council and they find that it
conforms to the statutes and ordinances relating thereto.
NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF
DUBUQUE, IOWA:
Section 1. That Section 11 -14 of Title 16 of the City of Dubuque Code of Ordinances,
Unified Development Code, is waived to allow 0 feet of frontage on a public street or an •
approved private street for Lot 2 of Lot 1.
Section 2. That the Plat of Survey Lot 1 of Lot 1 and Lot 2 of Lot 1 of Arthofer's
Skyline Addition is hereby approved and the Mayor and City Clerk are hereby authorized and
directed to endorse the approval of the City of Dubuque, Iowa, upon said Plat of Survey.
