Fremont Avenue Reconstruction Project
INTRODUCTION
The enclosed resolutions authorize the public bidding procedure for the Fremont
Avenue Reconstruction Project.
DISCUSSION
The Fremont Avenue Reconstruction Project will involve the complete
reconstruction of the existing base and paved surface, 37 feet wide from
Simpson Street to St. Joseph Street. The pavement will be concrete with new
curb and gutter. The project will include: storm sewer repair; sanitary sewer
main and manhole replacement; and replacement of lead water services.

I recommend that the City Council give preliminary approval to the Resolution of
Necessity and establish March 1, 2004 as the date of the public hearing.

The project, which is budgeted in the Fiscal Year 2003 Street Program, will
require $672,195.13 in City funds.
Low- to moderate-income property owners subject to street assessment will be
eligible for financial assistance ranging from 20 to 100 percent of the street
assessment for the owner-occupied resident property depending on family size
and income level. This financial assistance program is made available through
the One Percent Local Option Sales Tax.
ACTION REQUESTED
The City Council is requested to give preliminary approval to the Resolution of
Necessity, to approve the preliminary assessment schedule, to establish the date
of the public hearing, and to authorize the City Clerk to advertise for proposals
through the adoption of the enclosed resolutions.

FIXING DATE OF HEARING ON PLANS AND SPECIFICATIONS
Whereas, the City Council of the City of Dubuque, Iowa has given its
preliminary approval on the proposed plans, specifications, and form of contract
and placed same on file in the office of the City Clerk for public inspection of the
Fremont Avenue Reconstruction Project.
NOW THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE
CITY OF DUBUQUE, IOWA:
That a public hearing will be held on the 1st day of March, 2004, at 6:30
p.m. in the Public Library Auditorium at which time interested persons may
appear and be heard for or against the proposed plans and specifications, form
of contract and cost of said improvement, and the City Clerk be and is hereby
directed to cause a notice of time and place of such hearing to be published ~n a
newspaper having general circulation in the City of Dubuque, iowa, which notice
shall be not less than four days nor more than twenty days pnor to the day fixed
for its consideration. At the hearing, any interested person may appear and file

ORDERING BIDS
NOW THEREFORE, BE IT RESOLVED BY THE COUNCIL OF THE CITY
OF DUBUQUE, IOWA:
That the Fremont Avenue Reconstruction Project is hereby ordered to be
advertised for bids for construction.
BE IT FURTHER RESOLVED, that the amount of the security to
accompany each bid shall be in an amount which shall conform to the provisions
of the Notice to Bidders hereby approved as a part of the plans and
specifications heretofore adopted.
That the City Clerk is hereby directed to advertise for bids for the
construction of the improvements herein provided, to be published in a
newspaper having general circulation in the City of Dubuque, Iowa, which notice
shall not be less than four days nor more than forty-five days prior to the receipt
of said bids at 2:00 p.m. on the 4t~ day of March, 2004. Bids shall be opened and
read by the City Clerk at said time and will be submitted to the Council for final
action at 6:30 p.m. on the 15th day of March, 2004.

RESOLUTION OF NECESSITY
Whereas, proposed plans have been duly prepared and approved by the
City Council of the City of Dubuque and are now on file in the office of City Clerk
showing among other things the plans, specifications, form of contract, estimated
cost and preliminary plat and schedule showing the amount proposed to be
assessed against each lot and the valuation of each lot as filed by the City
Council, for the Fremont Avenue Reconstruction Project.
NOW THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE
CITY OF DUBUQUE, IOWA:
That the City Council deems it advisable and necessary for the public
welfare to make the herein mentioned improvements, and unless property
owners at the time of the final consideration of this proposed resolution have on
file with the City Clerk objections to the Resolution of Necessity, they shall be
deemed to have waived all objections pertaining to the regularity of the
proceeding and the legality of using the special assessment procedure.
Said improvements shall be constructed and done in accordance with the
plans and specifications which have been approved by the City Council and now
on file with the City Clerk. That the cost and expense of making such
improvement will be assessed partially or totally against privately owned property
lying with the assessment limits, and in an ambunt not to exceed that provided by
law, and in proportion to the special benefits conferred.
The portion of the cost which shall be borne by the city will be paid from
Road Use Tax, Sanitary Sewer Construction Fund, Watermain Construction
Fund, and special assessment bonds may be issued in anticipation of deferred
payments of assessments when a contract has been performed and accepted,
and the proceeds thereof used to pay the contractor.
The above resolution was introduced, approved and ordered placed on file

time and place of such hearing to be published in a newspaper having general
circulation in the City of Dubuque, Iowa, which notice shall be published once
each week for two consecutive weeks, the first publication of which shall be not

RESOLUTION OF NECESSITY
Whereas, proposed plans have been duly prepared and approved by the
City Council of the City of Dubuque and are now on file in the office of City Clerk
showing among other things the plans, specifications, form of contract, estimated
cost and preliminary plat and schedule showing the amount proposed to be
assessed against each lot and the valuation of each lot as filed by the City
Council, for the Fremont Avenue Reconstruction Project.
NOW THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE
CITY OF DUBUQUE, IOWA:
That the City Council deems it advisable and necessary for the public
welfare to make the herein mentioned ~mprovements, and unless property
owners at the time of the final consideration of this proposed resolution have on
file with the City Clerk objections to the Resolution of Necessity, they shall be
deemed to have waived all objections pertaining to the regularity of the
proceeding and the legality of using the special assessment procedure.
Said improvements shall be constructed and done in accordance with the
plans and specifications which have been approved by the City Council and now
on file with the City Clerk. That the cost and expense of making such
improvement will be assessed partially or totally against privately owned property
lying with the assessment limits, and in an amount not to exceed that provided by
law, and in proportion to the special benefits conferred.
The portion of the cost which shall be borne by the City will be paid from
Road Use Tax, Sanitary Sewer Construction Fund, Watermain Construction
Fund, and special assessment bonds may be issued in anticipation of deferred
payments of assessments when a contract has been performed and accepted,
and the proceeds thereof used to pay the contractor.
The above resolution was ~ntroduced, approved and ordered placed on file
with the City Clerk this 2nd day of February, 2004.

FIXING DATE OF HEARING ON RESOLUTION OF NECESSITY
Whereas, the City Council of the City of Dubuque, Iowa, has given its
preliminary approval on the proposed plans, specifications and form of contract
and placed same on file in the office of the City Clerk for public inspection for the
Fremont Avenue Reconstruction Project; and
Whereas, the proposed Resolution of Necessity for said improvement has
been introduced and is now on file in the City Clerk's office for public inspection.
NOW THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE
CITY OF DUBUQUE, IOWA:
That on the 1st day of March, 2004, a public hearing will be held at 6:30
p.m. in the Public Library Auditorium in the City of Dubuque at which time the
owners of property subject to assessment for the proposed improvement or any
other person having an interest in the matter may appear and be heard for or
against the making of the improvement, the boundaries of the district, the cost,
the assessment against any lot, or the final adoption of a Resolution of Necessity
and the City Clerk be and is hereby authorized and directed to cause a notice of
time and place of such hearing to be published in a newspaper having general
circulation in the City of Dubuque, Iowa, which notice shall be published once
each week for two consecutive weeks, the first publication of which shall be not
less than ten days prior to the day fixed for its consideration. Unless property
owners at the time of the final consideration of this proposed resolution have on
file with the City Clerk objections to the Resolution of Necessity they shall be
deemed to have waived all objections thereto.

advertised for bids for construction.
BE IT FURTHER RESOLVED, that the amount of the security to
accompany each bid shall be in an amount which shall conform to the provisions
of the Notice to Bidders hereby approved as a part of the plans and
specifications heretofore adopted.
That the City Clerk is hereby directed to advertise for bids for the
construction of the improvements heroin provided, to be published in a
newspaper having general circulation in the City of Dubuque, Iowa, which notice
shall not be less than four days nor moro than forty-five days prior to the receipt
of said bids at 2:00 p.m. on the 4th day of March, 2004. Bids shall be opened and
read by the City Clerk at said time and will be submitted to the Council for final
action at 6:30 p.m. on the 15th day of March, 2004.

The City is conducting an open forum discussion to acquaint the residents along the
project with the proposed improvements and project schedule. Representatives of the
City staff will be available to discuss the scope of the project, construction phasing,
timing, special assessment procedures, availability of financial assistance, as well as to
answer any other questions relating to the project. Feel free to stop in at any time
during the above hours for an informal discussion. This meeting should offer mutual
benefit in that it gives the City the opportunity to explain the design of the project, and
also allows the public to express their concerns and opinions regarding the proposed
design. Consideration will be given to all comments and suggestions.
Fremont Avenue was budgeted for reconstruction as part of the Fiscal Year 2003 Street
Program. The project consists of the complete reconstruction of base and pavement
surface. The pavement surface will be portland cement concrete with all new curbing.
Fremont Avenue will remain its current width of 37-foot.
Fremont Avenue was originally constructed with asphalt in 1923, with an overlay of that
section in 1966 and 1989.
The project will include the replacement of: all water valves; 13 lead water services;
storm sewer; and 1,200 feet of 8-inch sanitary sewer.

Property owners will be asked to remove their vehicles from the job site during the day;
however, after work hours, owners will be provided access to their residences.
This informational meeting is being held to offer the property owners along the project
as much information as possible in anticipation of the City Council's public hearing on
the project, scheduled for March 1,2004.
The project completion for the roadway is set for October 1,2004.
The construction project will include:
Length (Footage) 1,643 feet
Roadway Width The street will be 37 feet wide.
Pavement Thickness 8" portland cement concrete.
Pavement Base 4" granular base (minimum). Extra thickness as needed for
stability.
Longitudinal Drain Tile Subdrains are to be installed along the project.
Storm Sewer New storm sewer system and intakes.
Water Services Approximately 13 water services will be replaced as part of
the project.
The cost of installing water services is a direct benefit only to
the affected property, and this cost is assessed to each
respective lot. The City's 1% Local Option Sales Tax
funding does not apply to this assessment.
Sidewalks Approximately 30% of the sidewalks will be removed and
replaced as part of the project.
Traffic Control The City will stage the construction work so that either St.
Josepl~ or Simpson Street intersection is accessible at all
times.

PROJECT ASSESSMENT INFORMATION
Based upon the City's street assessment policy, 16.4 percent of the street costs are
being assessed on this project, along with the assessment values of the water service
lateral replacements.
Final assessments will be calculated after the completion of the project in October,
2004, and after a final cost has been developed. The final assessment may be no
greater than the estimated assessment you have already received but could be less
than the estimated amount. Assessments may be paid in full or over a ten-year period
with interest, currently at the rate of nine percent.
STREET ASSESSMENT POLICY (ADOPTED APRIL 18, 1983)
Reconstruction: Complete removal of the existing pavement and base and replacement
with new base, curb and pavement.
For Resident Properties: (i.e., R., R., R.), along a collector street: 85% of the cost of a
31 -foot wide street is assessed (less 20% rollback).
Local Option Sales Tax Funds will be utilized to reduce the amount to be assessed by
75%.
All property included within the area described so as to include one-half of the privately-
owned property between each street to be improved and the next street, whether such
privately-owned property abuts upon the street to be improved or not shall be assessed.
In no case shall property situated more than 300 feet from the street being improved be
assessed.
FINANCIAL ASSISTANCE AVAILABLE
Financial assistance is available for a portion or the entire street paving and water
service lateral assessments. Low- and moderate-income property owners subject to the
assessments will be eligible for financial assistance ranging from 20% to 100% of the
assessment for owner-occupied residential properties, depending on family size and
income level. This financial assistance is funded through 1% Local Option Sales Tax
Funds. After .final assessments are mailed upon completion of the project, property
owners may apply for this financial assistance. Information required to be submitted
with the application would be a-copy of your latest Federal Income Tax return, and
supporting W-2's. Information regarding the level of financial assistance as compared
to family size and income level will be available at the meeting.
