Economic Development Director David Heiar is recommending approval of an
agreement with the County of Dubuque to include a portion of the Seippel Road
property under the County's jurisdiction in the Dubuque Industrial Center Urban
Renewal District and allow staff to finalize such an agreement.

The Dubuque Industrial Center Economic Development District was created on May 2,
1988. The District is an urban renewal area which allows the City of Dubuque to
capture tax increment revenue from improvements made in the District. The original
area included the Dubuque Industrial Center (known as Subarea A) and was expanded
in November 1997 to include the Dubuque Industrial Center West, the County Farm, the
Bergfeld Farm, and the North Siegert Farm (known as Subarea B and C). On April 7,
2008 the Urban Renewal Plan was amended to add Subarea D, an area known as the
Rail Site.
The South Seigert Farm owned by the City, hereinafter referred to as Subarea E, is
needed to be included in the District. It is important for the two nearby industrial areas
to be governed by the same Urban Renewal Plan so that both areas are developed in a
similar fashion. This also provides the City with a revenue source from Subarea A
increments to finance Subarea E improvements.
I concur with the recommendation and respectfully request Mayor and City Council
approval.

Introduction
This memorandum presents for City Council consideration a Resolution approving an
agreement with the County of Dubuque to include property under the County's
jurisdiction in the Dubuque Industrial Center Urban Renewal District.
Background
The Dubuque Industrial Center Economic Development District was created on May 2,
1988. The District is an urban renewal area which allows the City of Dubuque to capture
tax increment revenue from improvements made in the District. The original area
included the Dubuque Industrial Center (known as Subarea A) and was expanded in
November 1997 to include the Dubuque Industrial Center West, the County Farm, the

Discussion
For the City to include Subarea E in the Urban Renewal District, it needs consent from
the County to include a portion of Seippel Road in the district since it is in the County's
jurisdiction.
The attached Resolution approves an agreement between the County and City to
include a portion of Seippel Road that resides in the County's jurisdiction, and allows
staff to finalize such an agreement that is acceptable to the County. The Mayor is then
authorized to sign the agreement. A draft agreement is attached for review.
Recommendation
I recommend the City Council adopt the attached Resolution approving an agreement
between the County and City to include a portion of Seippel Road that resides in the
County's jurisdiction.
Action Step
The action step for the City Council is to adopt the attached Resolution.

APPROVING AN AGREEMENT BETWEEN THE CITY OF DUBUQUE, IOWA AND
DUBUQUE COUNTY, IOWA TO AMEND THE DUBUQUE . INDUSTRIAL CENTER
URBAN RENEWAL DISTRICT TO INCLUDE CERTAIN PROPERTY LOCATED IN
DUBUQUE COUNTY, IOWA
WHEREAS, the City Council of the City of Dubuque, Iowa (the City Council) has
established the Urban Renewal Plan (the Plan) for Dubuque Industrial Center Urban
Renewal Area (the Area) for the purpose of undertaking an urban renewal project; and
WHEREAS, the City Council desires to amend the Plan to include property located
within two miles of the corporate limits of the City of Dubuque but within Dubuque County,
Iowa; and
WHEREAS, Iowa Code § 403.17(4) requires the consent of the Board of
Supervisors of Dubuque County, Iowa (the Board) before the City Council can proceed with
adoption of an amendment to the Plan which would include property located within two
miles of the corporate limits of the City of Dubuque and within Dubuque County, Iowa; and
WHEREAS, the Board has reviewed the proposed amendment to the Plan to
include the County property described therein as Subarea E of the Dubuque Industrial
Center Urban Renewal Area, and has concluded that consent to the amendment of the
Plan to include Subarea E is in the best interests of County; and
WHEREAS, the Board and the City Council desire to set forth their agreement in the
form attached hereto.
NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY
OF DUBUQUE, IOWA:
Section 1. That the Agreement attached hereto is hereby approved on behalf of the
City of Dubuque.
Section 2. That the Mayor is authorized and directed to execute the Agreement on
behalf of the City of Dubuque.
Section 3. That the City Manager is authorized and directed to take such further
action as may be necessary to carry out the intent of the Agreement.

This Agreement, dated for reference purposes the day of
2011, is made and entered into by and between the City of Dubuque, Iowa (City) and
Dubuque County, Iowa (County).
WHEREAS, the City Council of the City of Dubuque, Iowa (the City Council) has
established the Urban Renewal Plan (the Plan) for Dubuque Industrial Center Urban
Renewal Area (the Area) for the purpose of undertaking an urban renewal project; and
WHEREAS, the City Council desires to amend the Plan to include property
located within two miles of the corporate limits of the City of Dubuque but within
Dubuque County, Iowa; and
WHEREAS, Iowa Code § 403.17(4) requires the consent of the Board of
Supervisors of Dubuque County, Iowa (the Board) before the City Council can proceed

of South Fork Subdivision No. 1 in the City of Dubuque, to the south
boundary lines of Lot H of Dubuque Industrial Center West and Lot 1 of
Dubuque Industrial Center West 2nd Addition in the City of Dubuque,
Dubuque County, Iowa, including crossings at the intersections of Old
Highway Road and Chicago Central & Pacific Railroad rights -of -way.
SECTION 2. The Board hereby consents to and agrees on behalf of Dubuque County,
Iowa and authorizes the City Council to proceed with the expansion of the Dubuque
Industrial Center Urban Renewal Area to include Subarea E and to take all such action

with respect to Subarea E as is authorized by the Urban Renewal Plan for Dubuque
Industrial Center Urban Renewal Area.
SECTION 3. This Agreement is intended to meet the requirements of Iowa Code §
403.17(4) with respect to the establishment of an urban renewal area of a city within two
miles of but outside the corporate limits of the city.
