The application, staff report and related materials are attached for your review. Discussion James Steiner, representing the University of Dubuque, spoke in favor of the request, reviewing the project, access, and off - street parking for the new Performing Arts Center. Staff reviewed the location of the project and existing and proposed off- street parking to serve the new facility. Staff noted that the proposed parking lot will need to comply with parking lot design standards of the UDC. There were no public comments. Masterpiece on the Mississippi Dubuque as acnr 11111 2007 January 10, 2011 The Zoning Advisory Commission discussed the request, noting that the timing of events at the new center as well as on- street and off - street parking as it affects traffic circulation in the neighborhood. Recommendation By a vote of 6 to 0, the Zoning Advisory Commission recommends that the City Council approve the request, with the requirement for landscape islands in the parking lot on the south side of Bennett Street as per the UDC. A simple majority vote is needed for the City Council to approve the request. A super majority vote is needed for the City Council to modify the condition recommended by the Commission. If you have any questions, please let me know. Thanks, Keith Housing: The University's new Student Housing will be located at the site of the current practice football field. During construction, Potterveld apartments will be demolished and the practice football field will take its location to make room for the new housing project. The new Student Housing will consist of three, 37,000 square foot residential buildings. Two of the three buildings will house 168 new students spread out of over four floors and the other building will house 158 students and a Resident Director. Adjacent to the new housing project, on the western part of the property will be the new parking location. As part of the construction of the new parking lot, the University will be replacing the detention pond with storm chambers. PAC: The new Fine and Performing Arts, Worship and Campus Center will be located on our current Bennett Street parking lot. During this last summer, the University created two new parking lots to replace the parking where the new building will be located. The Performing Arts Center is roughly 80,000 square feet. Currently in the Performing Arts Center is a 995 seat auditorium, black box theater, rehearsal room, cafe,student convenience store, classrooms, and faculty offices. This building is being built for educational proposes and to develop the University's Fine and Performing Arts and Worship programs. A new Student Housing Center will consist of three buildings that will house 494 students, a new parking lot, and replacing the old detention pond with an underground storage system. These buildings will be heated and cooled by Geothermal. A new University Preforming Arts. Center will house a 995 seat auditorium, a black box theater and a rehearsal room. This building will be heated and coold by Geothermal. The parking location for this building will be located off of Bennett Street and extending towards West 3rd Street. Property History: This portion of the University of Dubuque campus is currently the site of a 149 -space off - street parking lot. Prior to development of the subject parcel for parking, it was developed with single - family homes. Physical Characteristics: The subject property is located at the corner of Bennett, McCormick and Grace Streets. The property generally slopes to the southwest. Conformance with Comprehensive Plan: The 2030 Future Land Use Map of the Comprehensive Plan designates the property for institutional use. The proposed project implements the Land Use and Urban Design Goals: 1.1, 1.5, 1.8, 5.3, 6.2, 7.2, 7.3, 9.1, 9.2 and 9.4. Streets: Access to the proposed Performing Arts Center will be from access to both McCormick and Bennett Streets. Planned District Staff Report - University of Dubuque Performing Arts Center Page 2 Sidewalks: There are sidewalks currently along all three street frontages serving the subject parcel. These sidewalks will remain as part of the development of the new Performing Arts Center. Parking: A total of 112 new off - street parking spaces will be constructed as part of the new Performing Arts Center. 106 of these spaces will be located in a new parking lot to be built across Bennett Street, and another six spaces will be built on a drive area connecting Bennett and McCormick Street. These six spaces will be accessible parking spaces adjacent to the main entrance into the Performing Arts Center. The existing 149 space lot will be removed which currently occupies the area designated for the new Performing Arts Center. The University of Dubuque has however added a total of 142 parking spaces on the west side of McCormick Street with recent parking lot construction as well as providing an additional 106 spaces in a new lot on the south side of Bennett Street. In summary, there will be a net increase of 105 off - street parking spaces in the Bennett, McCormick and Grace Street area even with the loss of the 149 -space parking lot. Lighting: New outdoor lighting will require use of cut -off luminaries to reduce the lighting impact to adjacent properties. Signage: No signage has been proposed as part of new Performing Arts Center. Bulk Regulations: As shown on the attached conceptual plan. Permeable Area ( %) & Location (Open Space): The proposed project to construct a new Performing Arts Center will be located in an area currently utilized for off- street parking. The increase in permeable area is negligible. Storm water control facilities will be reviewed in detail through the site plan review process. Landscaping /Screening: A detailed landscape plan will be required as part of the submittal of the site plan for the Performing Arts Center. Landscape and plantings around the Performing Arts Center will be provided as well as screening of the proposed drive area from McCormick and Bennett Streets. The proposed off - street parking lot on the south side of Bennett Street will be required to provide screening/ setbacks adjacent to residential properties in compliance with the Unified Development Code design standards for parking lots. Phasing of development: The University of Dubuque is proposing to begin construction in May 2011 subject to approval of this Institutional District amendment. Impact of Request on: Utilities: Existing utilities are adequate to handle the proposed project. Planned District Staff Report - University of Dubuque Performing Arts Center Page 3 Traffic Patterns /Counts: The Performing Arts Center will principally impact traffic patterns when performances are scheduled for the 995 -seat auditorium. These performances will commonly be scheduled for evenings and weekends when off - street parking is readily available in surrounding parking Tots. Public Services: Existing public services are adequate to serve the proposed development. Environment: No adverse impact to the environment is anticipated if adequate erosion control is provided during all phases of construction. In addition, storm water control will be necessary as part of this development to alleviate negative impacts on the environment caused by water runoff and soil erosion. Adjacent Properties: The proposed Performing Arts Center should have limited impact on surrounding residential properties. The location of the Performing Arts Center is within the existing campus on land currently occupied by 149 -space parking lot. The new building will be built for educational purposes and to develop the University's fine and performing arts and worship programs. Staff anticipates the most likely impact for this new development would be on occasions when the 995 seat auditorium holds a performance that attracts a significant number of patrons from outside the University of Dubuque campus. CIP Investments: None. Staff Analysis: The University of Dubuque is proposing construction of an 80,000 square foot Performing Arts Center. The new building will include a 995 -seat auditorium, a black box theater, rehearsal room, cafe, student convenience store, classrooms and faculty offices. Attached to this staff report is a conceptual layout for the Performing Arts Center and associated off - street parking as well as elevations of the proposed Performing Arts Center. The subject property is currently zoned ID Institutional. District. The Institutional District requires that substantial on- campus expansions be reviewed by the Zoning Advisory Commission and City Council as an Institutional District amendment. The Performing Arts Center is located on the site of a current 149 space off - street parking lot. The University of Dubuque has in the last year added 142 additional parking spaces on the west side of McCormick Street in anticipation of losing this parking lot. Further, a new 106 space parking lot on the south side of Bennett Street is proposed as part of the Performing Arts Center. Planning staff believes that the proposed 106 space parking lot on the south side of Bennett Street will be more than adequate for the additional classroom space and faculty offices to be included in the Performing Arts Center. Staff anticipates the only time that the lot would not be sufficient for operation of the Performing Arts Center is Planned District Staff Report - University of Dubuque Performing Arts Center Page 4 when a performance is scheduled in the 995 -seat auditorium that attracts a significant number of patrons who do not live on campus. The ID Institutional District requires one parking space for each six permanent seats in an auditorium. This ratio, when applied to the 995 -seat auditorium, would require 166 off - street parking spaces. Planning staff does not believe a parking lot of 166 spaces will be necessary, as these performances would undoubtedly be held during the evening or on weekends when the surrounding parking lots on the west side of McCormick Street would be available. In addition, on- street parking is available on Bennett Street and a portion of Grace Street as well as McCormick Street. The proposed layout of the parking lot, as shown on the conceptual plan provided by the University of Dubuque, does not comply with the Unified Development Code design standards for parking Tots. Specifically, the parking lot does not appear to be set back 10 feet from Bennett Street and landscape islands are necessary. Appropriate screening can still be provided along Bennett Street with the available space and the proposed parking lot does comply with required setbacks where it abuts privately owned residential property. Compliance with the Unified Development Code requirement for landscape islands will result in the Toss of five parking spaces. Planning staff requests that the Commission include in their recommendation whether the setback along Bennett Street is adequate and the inclusion of landscape islands is required. Planning staff did inquire with University officials as to the future plans for the vacant property on the north side of Bennett Street immediately west of the Meyers Center. University officials indicated this space is being reserved for a future campus building and did not want to use it for a parking lot. The University of Dubuque has been working to foster a pedestrian- oriented campus with off - street parking positioned around the perimeter of the campus. The creation of a pedestrian- oriented campus is a balance between providing sufficient off - street parking to avoid unreasonably impacting adjacent residential areas and still creating a walkable campus. The University of Dubuque's approach to developing the campus promotes sustainability as it reduces the growth of the campus in terms of land area while still providing sufficient space for new and updated facilities. Planning staff recommends that the Zoning Advisory Commission review Section 5- 22(D) that establishes the criteria for review of Institutional District amendments. NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF DUBUQUE, IOWA: Section 1. That Title 16 of the City of Dubuque Code of Ordinances, Unified Development Code, be amended by providing for the approval of an amended campus development plan for the University of Dubuque ID Institutional District, a copy of which is on file with the City of Dubuque Planning Services Department. Section 2. Institutional District Regulations. A. Use Regulations The following regulations shall apply to all uses made of land in the above - described ID Institutional District: 1. Principal permitted uses shall be limited to: a. Offices for administrative personnel or other institutional employees and affiliates. b. Churches, libraries, and museums. c. Recreational or athletic facilities for the primary use and benefit of institutional residents or affiliates. f. Single - family, two- family or multi - family dwellings for the housing of institutional residents or affiliates. 2. Accessory Uses. The following uses shall be permitted as accessory uses in the above - described ID Institutional District. a. Located entirely within a principal building, bookstores, or bars seating not more than seventy -five (75) persons at one time and located not closer than two hundred feet (200') from the nearest Residential or Office Residential District. All uses customarily incidental to the principal permitted uses in conjunction with which such accessory uses operated or maintained, but not to include commercial use outside the principal building. 3. No conditional uses shall be allowed. B. Lot and Bulk Regulations Development of land in the ID Institutional District shall be regulated as follows: The proposed Performing Arts Center and proposed parking lot at the corner of Bennett, McCormick and Grace Streets shall be constructed in substantial conformance with the attached amended campus development plan. C. Performance Standards The development and maintenance of uses in this ID Institutional District shall be established in conformance with Section 5 -22 of the Unified Development Code and the following standards: 1. The storm water control shall be designed and built in accordance with City Regulations subject to review and approval by the City of Dubuque Engineering Department. That appropriate erosion and sediment control will be installed prior to commencement of any land disturbing activity related to the subject project, including all required state and city permits related to erosion control. Landscaping shall be provided in compliance with Article 13 of the Unified Development Code. 5. All utilities, including telephone and cable television, shall be installed underground. 6. Final site plans shall be submitted in accordance with Articles 12 and 13 of the Unified Development Code. D. Parking Requirements The off - street parking requirements for the principal permitted uses for the herein described ID Institutional District shall be regulated as follows. 1. The number, size and layout of off - street parking shall be in substantial compliance with the amended campus plan. 2. The design of the parking lot shall comply with Article 13 of the Unified Development Code. 3. Any significant expansion or reduction in the number of off - street parking spaces must be reviewed by Planning Services staff for compliance with the adopted Institutional District regulations. E. Sign Regulations The sign regulations shall be the same as that which are allowed in the ID Institutional District as established in Article 15 of the Unified Development Code. F. Additional Standards That all previously approved campus development plans are hereby amended to allow for the attached campus development plan. G. Transfer of Ownership Transfer of ownership of property in this ID Institutional District requires rezoning of the property to an appropriate zoning district. H. Modifications Any modifications of this Ordinance must be approved by the City Council in accordance with zoning reclassification proceedings of Article 9 of the Unified Development Code.
