Dear Jeanne,
Thank you for your letter indicating the appointment of Council Member David Resnick and Jason Hartman (City
Manager's Representative) to our Board of Directors for the 2011 year. Of course, this leads me to inquire as to
the appointment of the third member representing the Dubuque City Council. After reviewing the video of the
December 6th City Council Meeting where the appointments were discussed and just two representatives were
appointed, I feel it necessary to provide some clarification on this subject because the Council received some
misinformation voiced by Council Member Braig as to the relationship between our agency and the city. I hope
this will be helpful.
First, the provision that the City of Dubuque be represented with 3 people on our board of directors does not have
anything to do with the bylaws of our agency. This provision is included in the 28E Agreement that the City of
Dubuque entered into with the counties of Dubuque, Delaware and Jackson establishing Operation: New View
CAA as a public nonprofit entity and as "the community action agency" under federal and state law to receive
funding and operate programs to address poverty conditions in this geographic area. The 28E Agreement
outlines that the public officials sector of the agency board of directors consist of 9 representatives, including 2
county board of supervisors members from each of the 3 counties and 3 members of the Dubuque City Council.
This agreement has worked very well for many years and has provided valuable oversight and involvement to the
agency and its work in addressing poverty and partnering with other community organizations that serve low -
income people.
Secondly, by not appointing its three representatives, the City is not only out of compliance with the terms of the
28E Agreement, but it puts our agency out of compliance with federal and state law concerning the makeup of the
board of directors of a community action agency. A community action agency is required to maintain a tripartite
board which consists of equal numbers (one -third each) of representatives from 3 sectors: elected public officials;
private community interests; and low- income interests. Our board consists of 27 people with 9 representatives in
each sector. Without the city's third representative, we only have 8 public officials which puts us out of
compliance with this legal requirement.
Again, I do hope this information is helpful to you and the council. On behalf of our board of directors, we
respectfully request that the council reconsider this matter and appoint an additional representative to serve on
our board of directors. I would be glad to answer any questions or provide any additional information that you
may need. Our thanks for your continued support on behalf of the people we serve.
