Kennedy Reconstruction (Spring Valley Road to Barony Drive) INTRODUCTION The enclosed resolutions provide for the acceptance of the Construction contract for the John F. Kennedy Reconstruction Project. DISCUSSION This reconstruction was a joint project between the Iowa Department of Transportation and the City of Dubuque. IDOT reconstructed John F. Kennedy in the vicinity of the Northwest Artedal intersection; however, the City, in conjunction with IDOT, also included the reconstruction of Kennedy Road from the Northwest Arterial southerly to tie in the curb and gutter at Spring Valley Drive, and northerly to the City limits to complete the reconstruction and widening of Kennedy Road from Spring Valley to the northerly City limits. A portion of the northerly section will be paid for by Dubuque County since the City limits runs down the middle of Kennedy Road from the soccer complex to Barony Drive. The project consisted of the complete reconstruction of the existing base and pavement surface. The street was built 41 feet wide from back-of-curb to back- of-curb from Spring Valley to the City limits just south of Barony Drive. The pavement is concrete with curbing. The widening of the pavement is to improve traffic flow at the soccer complex and West 32"d Street by the construction of left- turn bays at the major intersections. At the public hearing on this project, the City Council chose to eliminate all public sidewalks for the length of the project. The F!ynn Company has completed this reconstruction from Spring Valley Road to Barony Drive in the amount of $1,305,965.90, which is 15.5% over the contract amount. Since the final construction costs were higher than the original estimate, the Code of Iowa dictates that the assessments to the property owners cannot be increased. To allow sufficient administrative time to process financial assistance payments for Iow- to moderate-income families, the adoption of the preliminary schedule of final assessments will be delayed approximately 45 days. In its place is a resolution adopting a preliminary schedule of final assessments. Property owners may use this period to apply for and receive final assistance that may reduce the amount of the assessment payable by the property owner. RECOMMENDATION I recommend that the City Council accept the improvements, accept the final contract at $1,305,965.90, and adopt the preliminary schedule of final assessments. The project, as outlined, will require $929,018.44 in City construction funds and $3,857.09 for assessments to the City, for a total City cost of $932,875.53. Low- to moderate-income property owners subject to street assessments will be eligible for financial assistance ranging from 20 to 100 percent of the street assessment for owner-occupied resident property, depending on family size and income level. This financial assistance program is made available through the 1% Local Option Sales Tax. The cost of the water services will be assessed directly to the benefited individual properties. Neither the 1% Local Option Sales Tax nor the City's special assistance to Iow- to moderate-income families is available to fund the water services since these are direct property owner benefits. ACTION TO BE TAKEN The City Council is requested to adopt the final resolutions accepting the improvements, establishing the final contract amount, and approving the preliminary schedule of final assessments. Kennedy Reconstruction (Spring Valley Road to Barony Drive) Project has been completed and the City Manager has examined the work and filed his certificate stating that the same has been completed according to the terms of the contract, plans and specifications and recommends its acceptance. NOW THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF DUBUQUE, IOWA: Section 1. That the recommendation of the City Manager be approved and that said improvement be and the same is hereby accepted. BE IT FURTHER RESOLVED that the City Treasurer be and he is hereby directed to pay to the contractor from the Street Construction Fund, the Local Option Sales Tax Fund, and the Water Depreciation Fund in amounts equal to the amount of his contract, less any retained pementage provided for therein. Kennedy Reconstruction (Spring Valley Road to Barony Drive) Project has been completed and the City Engineer has submitted his final estimate showing the cost thereof including the cost of estimates, notices and inspection and all miscellaneous costs. NOW THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF DUBUQUE, IOWA: Section 1. That the cost of said improvement is hereby determined to be $1,365,604.23 and the said amount shall be paid from the Street Construction Fund, Local Option Sales Tax Fund, and the Water Depreciation Fund of the City of Dubuque, Iowa. Section 2. That $118,740.51 of the cost thereof shall be assessable upon private property and $1,012,580.76 shall be paid from the Street Construction Fund, the Local Option Sales Tax Fund, and the Water Depreciation Fund.
