SUBJECT: Final Plat Stone Brook Center Second Addition
INTRODUCTION
The submitted final plat of Stone Brook Center Second Addition is located along U.S.
Highway 20 north of the access ddve for Bardngton Lakes Subdivision. The submitted
final plat subdivides the existing property into four building lots suitable for commercial
development.
DISCUSSION
The submitted final plat of Stone Brook Center Second Addition provides for the
subdivision of a portion of the property and providing for the creation of four commercial
building lots and the construction of two new public streets to be called Stone Valley
Drive and Boulder Brook Court. Access to this subdivision is from U.S. Highway 20. As
part of f~ture reconstruction of U.S. Highway 20, access to this subdivision will be
shifted to the east side of the property from a new frontage road constructed as part of
the highway project. Access to the subdivision will still be by way of Stone Valley Drive.
The IDOT has received a copy of this final plat and does not object to the approval of
the final plat. A copy of the letter from Fred Dean of the IDOT is attached and also
contains a diagramed illustration of how future access to the subdivision will be
maintained.
City water and sewer is available to the site, and storm water detention is being
provided on Lot D of the subdivision.
RECOMMENDATION
The submitted final plat of Stone Brook Center Second Addition is in substantial
compliance with City of Dubuque Subdivision Regulation, and I would recommend
approval of the plat as submitted.

Utilities: The property can be adequately served from the 12' water main along U.S.
Highway 20 and an 8" sanitary sewer interceptor now extended along the South Fork of
the Catfish Creek.

Traffic Patterns: Future access to Highway 20 will be from frontage roads with no direct
access to Highway 20 itself. Average daily counts along this section of Highway 20 are
estimated at 17,820. The IDOT has established a Corridor Preservation Zone for U.S.
Highway 20 and information related to the corridor has been attached to this staff report.
The IDOT has no objectJon to the approval of this plat.
Public Services: Existing public services are adequate to serve the site.
Environment: Staff does not anticipate any adverse impact to the environment provided
adequate erosion control is provided during all phases of development of the property.
Adjacent Properties: The surrounding properties are primarily in agricultural use with the
exception of property west of Highway 20. The DMASWA landfill and a construction
company lie across Highway 20 from the property in question, and three residences lie
across Highway 20 to the northwest. Any new development will be subject to City site
development standards.
Recommended Conditions on Plat: None.
Staff Analysis: The subject property was formerly owned by the Dubuque Metropolitan Area
Solid Waste Agency and was rezoned in September 1999 to C-3 General Commercial District.
The submitted final plat subdivides the subject property into six (6) lots providing space for
development of new commercial businesses. The subject property is to be served by public
streets to be named Stone Valley Drive and Boulder Brook Court. This subdivision will be
served by public streets with 60-foot rights-of-way and 37-feet of paving, which is typical for
commercial subdivisions.
The entire parcel can be served by City sanitary sewer and water mains. Storm water
detention will be provided in the north corner of the site. Extension of a 16" water main will be
made along Highway 20 while a sanitary sewer main extension will be constructed from the
City's South Fork interceptor line.
The City has sent notification to IDOT as required by the Corddor Preservation Zone. The
applicant and IDOT officials are in agreement with future access to the subdivision. Attached
to this staff report is a letter and a diagram from Fred Dean of the IDOT who indicated that
there are no objections to the submitted final plat.
The submitted final plat is in substantial compliance with the City of Dubuque Subdivision
Regulations and Planning Services staff recommends approval of the plat as submitted.

In response to your November 12, 2003 letter in regards to the final plat and improvement plans
for the Stone Brook Center Second Addition. which fails within the U.S. 20 Corridor
Preservation Zone (CPZ), the following comments are submitted for your consideration in this
matter.
The attached graphic details the proposed backage road (to serve the Neztrop development in the
future), as well as the current corridor preservation zone and development moratorium areas. It
should be noted that it might be some time before the future backage mad is constructed in this
area. These improvements will only be required when the U.S. 20 and Southwest AtteriaI
interchange in constructed.
Due to funding constra/nts, the initial implementation plan for the Southwest Arterial is to
consh-uct a two-lane highway, with an at-grade intersection at U.S. 20 in the vicinity of Seippel
Road. When the two-lane highway(the Interim Project) is constructed, no access changes would
be required for the Neztrop development, llae development would continue to have direct access
to U.S. 20 west of Cousins Road.
The Interim Project is expected to serve projected traffic needs through the Year 2015.
Considering that funding has not been identified to construct the U.S. 20 and Southwest Arterial
interchange at this time and that the interchange is not required to serve traffic needs for over ten
yeats, the proposed backage road east of your property may not be constructed for 15
years or longer.
We appreciate the flexibility provided in ensuring that the proposed development is compatible
with the future roadway improvements.
In addition, be advised as parcels within Stone Brook Center that fall within all or part of the
CPZ are developed, which require the issuance of building permits, we are to have the
opportunity to review and comment.
Finally, we would appreciate notification of the final action taken in regards to the final plat and
improvement plans.

RESOLUTION NO. 61-04
A RESOLUTION APPROVING THE FINAL PLAT OF STONE BROOK CENTER
SECOND ADDITION IN THE CITY OF DUBUQUE, IOWA
Whereas, there has been filed with the City Clerk a final plat of Stone Brook
Center Second Addition in the City of Dubuque, Iowa; and
Whereas, upon said final plat appears streets to be known as Stone Valley Drive
(Lot A) and Boulder Brook Court (Lot B), together with certain public utility easements,
which the owners by said final plat have dedicated to the public forever; and
Whereas, the preliminary plat has been examined by the Zoning Advisory
Commission and had its approval endorsed thereon; and
Whereas, said final plat has been reviewed by the City Planner and had her
approval endorsed thereon, subject to the owners agreeing to the conditions noted in
Section 2 below; and
Whereas, said final plat has been examined by the City Council and they find that
it conforms to the statutes and ordinances relating to it, except that no streets or public
utilities have yet been constructed or installed.
NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY
OF DUBUQUE, IOWA:
Section I. That the dedication of Stone Valley Drive (Lot A) and Boulder
Brook Court (Lot B), together with the easements for public utilities as they appear
upon said final plat, be and the same are hereby accepted; and
Section 2. That the Final Plat of Stone Brook Center Second Addition is
hereby approved and the Mayor and City Clerk are hereby authorized and directed to
endorse the approval of the City of Dubuque, Iowa, upon said final plat, provided the
owners of said property herein named, execute their written acceptance hereto
attached agreeing:
(a)
To reduce Stone Valley Drive (Lot A) and Boulder Brook Court (Lot B) to grade
and to construct concrete curb and gutter and to hard surface with asphaltic
concrete, or with concrete paving with integral curb. all in accordance with the
Resolution No. - 04

City of Dubuque standard specifications, all in a manner acceptable to the City
Engineer, in conformance with construction improvement plans approved by the
City Engineer, and inspected by the City Engineer.
(b)
To install sanitary sewer mains and sewer service laterals into each individual lot,
water mains and water service laterals into each individual lot, storm sewers and
catch basins, boulevard street lighting and erosion control devices all in
accordance with the City of Dubuque standard specifications, all in a manner
acceptable to the City Engineer, and in accordance with construction
improvement plans approved by the City Engineer, and inspected by the City
Engineer.
(c)
To construct a storm water detention facility in a manner acceptable to the City
Engineer, in accordance with the City of Dubuque standard specifications, in
accordance with construction improvement plans approved by the City Engineer,
and inspected by the City Engineer.
(d) To construct said improvements, prior to two (2) years from the date of
acceptance of this resolution, at the sole expense of the owners, or future owner;
(e)
To maintain the public improvements, for a period of two (2) years from the date
of the acceptance of those improvements by the City of Dubuque, Iowa, at the
sole expense of the owners, or future owner;
And, further provided that said NFTTROP, L.L.C., as owners of said property,
shall secure the performance of the foregoing conditions provided in this Section by
providing guarantees in such form and with such sureties as may be acceptable to the
City Manager of the City of Dubuque, Iowa.
Section 3. Sidewalk installation shall be the responsibility of the owner
abutting the public rights-of-way, including lots with multiple frontages, as required by
City Code 41-161 through 41-164. The responsibility shall extend to all successors,
heirs and assignees. Sidewalk installation will not be required until the development of
the lot has been completed, except as required herein. In sparsely developed
subdivisions, sidewalks on developed lots will not be required until 50% of the lots
approved by the plat have been developed. All vacant lots shall have sidewalks
installed upon development of 80% of the lots approved by the plat.
Section 4. The developer will maintain the detention facility constructed as
part of Stone Brook Center Second Addition until it has been fully completed and 80%
of the sum of the platted lots in the entire Stone Brook Subdivision are fully developed
and the remaining 20% of these lots have installed adequate erosion control measures
as approved by the City. Upon the City's acceptance of the detention facility, the
maintenance expenses incurred by the City of Dubuque for the storm water detention
facility (Lot D) shall be assessed against the lot owners of Stone Brook Subdivision, in

equal amounts, and the City Manager shall certify such costs to the City Clerk, who in
turn shall promptly certify such costs to the Dubuque County Treasurer, and such costs
shall then be collected with and in the same manner as general property taxes in
accordance with provisions of law.
Section 5. That the final acceptance of all public improvements shall occur
upon certification of the City Engineer to the City Council that all public improvements
have been completed in accordance with the improvement plans and City Standards
and Specifications and accepted by City Council Resolution.
Section 6. That in the event NEZTROP, EEC., fails to execute the
acceptance and furnish the guarantees provided in Section 3 hereof within 180 days
after the date of this Resolution, the provisions hereof shall be null and void and the
acceptance of the dedication and approval the plat shall not be effective.
