This is a claim in which the claimant alleges that during the early morning of January 3,
2004, Police suspected two missing Elm Street Facility residents to be occupying one of
the motel rooms at the Glenview Motel. Mr. Conrad alleges the Police therefore obtained
a search warrant and forced entry into the room at the Glenview Motel.
According to the report of Kim Wadding, Police Chief, Police did receive information that
two individuals who were wanted by the iowa Department of Corrections Elm Street
Facility for failing to return to the facility, were staying the Glenview Motel in room #19.
Further information indicated that the subjects may be in possession of firearms.
Therefore a search warrant was obtained to enter room #19 at the Glenview Motel to
apprehend these individuals. The officers knocked repeatedly and gave verbal commands
to open the door. After waiting several seconds and getting no response, the officers
forced the door and entered the room. Clothing and personal items belonging to the two
subjects were found but no one was present.
Chief Wadding states that Mr. Conrad, who is the owner of the Glenview Motel, was
unaware the two individuals were wanted by authorities. Although reasonable force was
used to enter room #19, damage did occur to the door, and it is therefore the
recommendation of Chief Wadding to approve this claim for $404.50. The Legal
Department concurs with this recommendation.
