Minutes Civil Service 1 20 04 CIVIL SERVICE COMMISSION Date: Tuesday, January 20, 2004 Time: 3:00 p.m. Place of Meeting: City Hall - Conference Room A Present: Chairperson Dick Wertzberger, Commissioners Merle Duehr, Loras Kiuesner Approval of Minutes of January 8, 2004 Commissioner Kluesner moved to approve the minutes of January 8, 2004. Seconded by Duehr, passed unanimously. = Request to Schedule Entrance Examination for the Position of Cashier Commissioner Duehr moved that an entrance examination for the position of Cashier be scheduled for Wednesday, February 18, 2004 at 6:30 p.m. at a location to be determined and that the application deadline be established as 5:00 p.m. on Friday, February 6, 2004. Seconded by Kluesner, passed unanimously. w Grievance of Terry Dolan Against the City of Dubuque Mr. Dolan explained that when the entrance examination for the position of Truck Driver was posted he requested to be placed on the certified list without having to take the written examination as he had previously held the position of Truck Driver. He stated he had taken and passed the exam for Truck Driver in 1998 and was in the position. He took a promotional exam for the position of Sanitation Driver - the position he currently holds - and would now like to have the opportunity to return to the position of Truck Driver. He was told that since it was an entrance exam he would have to take and pass the test to be on the certified list, which he did. Personnel Manager Randy Peck stated the Civil Service law provides that for promotional exams an employee who has been in the position for which the test is being given may request to be placed on the certified list without taking the written exam. However, he said the law does not provide for this for entrance examinations and the City's interpretation is that since it is not provided for, it is prohibited. Teamster representative Dave Baker stated the Union's position was that the law should be looked at to the advantage of the employee and that there would be no harm to the employer if an employee who has been in the position is added to the certified list. He further stated that he disagreed with the statement that if the Civil Service law does not provide for it, it is prohibited. Following discussion by the Commission, Duehr moved to uphold the position that for entrance examinations, if a person has previously held the position the employee could request to be placed on the certified list without taking the written exam. Seconded by Kluesner, passed unanimously. Commission directed that a statement to this effect should be added to position postings.
