Rosemont Street Petition for Residential Parking Permit District
Public Works Director Mike Koch recommends establishment of a Residential Parking
Permit District on Rosemont Street between Pennsylvania Avenue and Creston Court,
with district parking regulations from 7:00 a.m. to 3:00 p.m. daily, except Saturdays,
Sundays and holidays. It is further recommended that a public hearing be set for
March 1, 2004.

Rosemont Street Petition for Residential Parking Permit District
INTRODUCTION
This is in response to a November 25, 2003 petition to establish a Residential
Parking Permit District (RPPD) on Rosemont Street between Pennsylvania
Avenue and Creston Court.
BACKGROUND
In 1985, the City adopted an ordinance providing for the establishment of
Residential Parking Permit Districts. The purpose of such districts is to reduce
traffic congestion resulting from the use of parking within residential districts by
persons not residing within the district, to protect the residents of these districts
from an unreasonable burden in gaining access to their residences, to preserve
the character of such districts as residential districts, and other various purposes.
A Residential Parking Permit District designation can be made only after a
petition of residents representing 60 percent (60%) of the dwelling units in a
proposed area is received, a parking study is conducted by the City Engineer,
and a public hearing is held by the City Council.
To be eligible for an RPPD designation, the proposed district must include at
least four (4) block faces or contain 50 parking spaces, must have at least 80
percent (80%) of the curbside parking utilized during peak periods, and must
have at least 25 percent (25%) of such utilization by non-residents of the area. A
petition may be considered for an area which contains less than four (4) adjacent
block faces or fifty (50) curb parking spaces if there are extenuating conditions
that render such requirement unreasonable. Upon the recommendation of the
City Manager, such requirement may be waived by the City Council if it finds that
the proposed residential distdct is isolated or separated from other residential
areas by topographical features or by commercial area. Upon designation as an
RPPD, no one can park curbside in the district during the restricted hours without
a residential or guest parking permit.
DISCUSSION
The petition which was submitted on November 25, 2003, represents in excess
of 60 percent (60%) of the dwelling units along Rosemont Street, as is required
under the ordinance. The petition, and a subsequent February 6, 2004 letter of
clarification, requests that the parking restriction be effective between the hours
of 7 a.m. and 3 p.m. daily, except Saturdays, Sundays and holidays.
The City's parking study of this area indicates that during the requested time
period, at least 80 percent (80%) of the curbside spaces were utilized, and at
least 25 percent (25%) of such curbside parking spaces were utilized by non-
resident parkers. The petition, therefore, meets the requirements of the RPPD
ordinance. Street parking, for a distance of approximately 350 feet north of
Pennsylvania Avenue, is currently posted "No Parking School Hours". For the
purpose of the parking study, it was assumed that, if not posted, student parking
would fill this area since it is closer to the school.
On January 27, 2004, Hempstead High School submitted a letter of concern with
regard to the establishment of the Residential Park Permit District.
RECOMMENDATION
Since the parking study indicates that the parking conditions on Rosemont Street
meet the criteria necessary for the establishment of a Residential Parking Permit
District, I recommend that Rosemont Street be designated as a RPPD. I also
recommend that the distdct parking regulations be from 7 a.m. to 3 p.m. daily,
except Saturdays, Sundays and holidays.
I would further recommend that the City Council set a public hearing on the
designation of Rosemont Street as a Residential Parking Permit District between
the hours of 7 a.m. and 3 p.m. daily, except Saturdays, Sundays and holidays.
After the public hearing, the City Council may reject the petition, adopt an
ordinance designating the proposed area as a Residential Parking Permit, or
adopt an ordinance modifying the proposed district. The City Council may also
adopt alternate hours other than the 7 a.m. to 3 p.m. parking restriction daily
except Saturdays, Sundays and holidays.
ACTION TO BE TAKEN
The City Council is requested to adopt the attached resolution setting a public
headng on March 1 on the proposed Residential Parking Permit District on
Rosemont Street.

RESOLUTION SETTING A PUBLIC HEARING ON ESTABLISHING A RESIDENTIAL
PARKING PERMIT DISTRICT ON ROSEMONT STREET FROM PENNSYLVANIA AVENUE
TO CRESTON COURT
Whereas, the City of Dubuque, pursuant to Section 32-383 of the. Code of Ordinances,
has received a petition containing sufficient signatures requesting that an area described as
follows be designated as a Residential Parking Permit District:
Rosemont Street, from Pennsylvania Avenue to Creston Court
Whereas, pursuant to said Section 32-383, the City Manager has caused a parking
study of the area identified above to be undertaken and which study shows at least 80 percent
(80%) of the curbside parking spaces in the proposed parking permit district were utilized
during peak periods, and at least 25 percent of the curbside parking spaces in the proposed
parking permit were utilized by non-resident parking; and
Whereas, the City Manager, based upon the results of the study, and in accordance
with Section 32-383, recommends that the area be designated as a Residential Parking Permit
District and that the City Council set a public hearing on the petition to establish such area as a
Residential Parking Permit District and the hours such parking restrictions are to be in effect.
NOW THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF
DUBUQUE, IOWA:
Section 1. That the City Council finds and determines that a valid petition has bean
received for the designation of Rosemont Street, from Pennsylvania Avenue to Creston Court,
as a Residential Parking Permit District.
Section 2. That the Residential Parking Permit District hours be effective between the
hours of 7 a.m. and 3 p.m. daily, except Saturdays, Sundays and holidays.
Section 3. That the City Clerk be authorized and directed to publish a notice of public
hearing on the designation of the above described area as a Residential Parking Permit
District, to be held on March 1, 2004.

CITY OF DUBUQUE, IOWA, BY MODIFYING SUBSECTION (a) OF
SECTION 32-397 THEREOF PROVIDING FOR THE DESIGNATION OF
ROSEMONT STREET FROM PENNSYLVANIA AVENUE TO CRESTON
COURT AS A RESIDENTIAL PARKING PERMIT DISTRICT
Whereas, Sections 32-381 through 32-393 of the Code of Ordinances of
the City of Dubuque, Iowa, empowers the City Council to establish a Residential
Parking Permit District upon receipt of a valid petition and the finding of certain
conditions; and
Whereas, a valid petition has been received to declare an area described
as follows as a Residential Parking Permit District.
Rosemont Street, from Pennsylvania Avenue to Creston Court
Whereas, the City Manager has caused a parking study of the above
identified area to be conducted, and which study has established that the area
meets the criteria as established in Section 32-383 of the Code of Ordinances of
the City of Dubuque, Iowa:
1. At least 80 percent (80%) of the curbside parking spaces in the
proposed Parking Permit District were utilized during peak periods; and
2. At least 25 percent (25%) of the curbside parking spaces in the
proposed Parking Permit District were utilized by nonresident parkers;
and
Whereas, the City Manager, based upon the petition and the results of the
parking study, recommends to the City Council that the area be designated as a
Residential Parking Permit District dudng the hours of 7 a.m. to 3 p.m. daily,
except Saturdays, Sundays and holidays; and
Whereas, the City Council pursuant to public notice on ,
2004, in the City of Dubuque Telegraph Herald, a newspaper of general
circulation, met in session on the ,2004, at 6:30 p.m. at the
Carnegie Stout Public Library, 360 11TM Street, for the purpose of hearing all
interested persons and representatives of organizations and to consider any and
all objections which have been filed to the proposed designation of the above
area as a Residential Parking Permit District during the hours of 7 a.m. to 3 p.m.,
daily except Saturdays, Sundays and holidays; and
Whereas, all interested parties have been given an opportunity to be
heard and all objections have been duly considered.
NOW THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE
CITY OF DUBUQUE, IOWA:
Section 1. That a petition containing the required number of signatures
and meeting the intent and purpose of Section 32-381 through 32-393 of the
Code of Ordinances of the City of Dubuque, Iowa, has been received by the City
of Dubuque.
Section 2. That any and all objections to the designation of the area as
a Residential Parking Permit District during the hours of 7 a.m. to 3 p.m daily,
except Saturdays, Sundays and holidays be and same are overruled.
Section 3. That the recommendation of the City Manager based upon
the petition and the parking study to designate the area as a Residential Parking
Permit District during the hours of 7 a.m. to 3 p.m. daily, except Saturdays,
Sundays and holidays, is hereby approved and accepted.
Section 4. That the Code of Ordinances of the City of Dubuque, Iowa,
be amended by adding to Subsection (a) of Section 32-397 as follows:
a) The following described area constitutes a Residential Parking Permit
District designated as Residential Parking Permit "F".

b) No vehicles shall park curbside in Residential Parking Permit Distdct F
during the hours of seven o'clock (7:00) A.M. to three o'clock (3:00)
P.M., except Saturdays, Sundays and holidays, without displaying a
valid parking permit issued by the City.

Dear Mr. Koch,
Thank you for your letter of January 14 in which you state that there is a petition to
establish a residential parking permit district on Rosemont Street from Pennsylvania to
Creston~
On three different days we counted 21, 19, and 19 cars which appeared to belong to
Hempstead students on Rosemont parked around 9:00 am. If there is a RPPD on
Rosemont it is likely that those cars will park on another street. On Rosemont, as with
other close streets, we use our security associates during the day to patrol and make
sure that there are no problems. If students are forced to park on other streets, there is
no guarantee that we can check streets farther away. In addition, we have been a good
neighbor by expanding our parking in recent years. We added spaces at the east of our
student lot, had our lot repainted to add more spots, and added staffparking behind the
building along our practice field. We have not been notified of any recent parking
concerns on Rosemont dur~g this school year.
