SUBJECT: Vacating Petition - The Northerly Portion of the Alley West of South
Grandview Avenue Between Altman Street (a/k/a St. Joseph Street) and
Whelan Street
In response to a request from six property owners to vacate the northerly portion of an
alley wést of South Grandview Avenue between Altman Street and Whelan Street,
Public Works Director Mike Koch states that the City has no plans for the utilization of
that portion of alley to be vacated, except for reserving the utility easements as noted.
Public Works Director Mike Koch recommends that the portion of alley be vacated, that
the purchase price be established at the cost of surveying and platting, plus processing,
publication, and filing fees of $1 00, and that a public hearing be set for March 15, 2004.
I concur with the recommendation and respectfully request Mayor and City Council
approval.

INTRODUCTION
This is a request from six property owners for the vacating of the northerly portion
of an alley west of South Grandview Avenue between Altman Street and Whelan
Street.
DISCUSSION
The attached plats show the proposed alley area to be vacated. The abutting
properties are owned by: Michelle Kenline; Harry A. and Margaret J. Blewett;
Grand Estates, LC; Eldon T. and Marjorie .E. Herrig; Dubuque Golf & Country
Club; and Michael H. Bradley.
The area to be vacated will be divided into six lots. The vacated area is an
existing 20-foot wide alley on which public utilities exist. Perpetual easement
rights will be reserved on all lots for maintenance of the utilities.
The property has been valued at the cost of surveying and platting, plus
processing, publication, and filing fees of $100.00.
RECOMMENDATION
The City has no plans for the utilization of the alley to be vacated, except for
reserving the utility easements as noted.
I recommend that the areas indicated by proposed Lots 8A, 9A, 10A, 17A, and
20A of Grand View Place and Lot 1A of South Grandview Place on the attached
plats be vacated, and that a public hearing be set for the disposition of the City's
interest in the subject area on March 15, 2004. I further recommend that the
purchase price be established at the cost of surveying and platting, plus
processing, publication, and filing fees of $100.00.
ACTION TO BE TAKEN
The recommendation of the City Manager should be approved and a public
hearing should be scheduled on the disposal of the property through adoption of
the enclosed resolution.

RESOLUTION OF INTENT TO DISPOSE OF CITY INTEREST IN LOTS
SA, 9A, 10A, 17A, and 20A OF GRAND VIEW PLACE AND LOT 1A OF
SOUTH GRANDVIEW PLACE, DUBUQUE, IOWA
Whereas, Michelle Kenline, Harry A. and Margaret J, Blewett, Grand
Estates, LC, Eldon T. and Marjorie E. Herrig, Dubuque Golf & Country Club, and
Michael H, Bradley have requested the vacating of the northerly portion of the
alley west of South Grandview Avenue between Altman Street (aka St. Joseph
Street) and Whelan Street; and
Whereas, Schneider Land Surveying & Planning, Inc, has prepared and
submitted to the City Council plats showing the northerly portion of the alley west
of South Grandview Avenue between Altman Street (aka St. Joseph Street) and
Whelan Street; and assigned lot numbers thereto, which hereinafter shall bø
known and described as Lots 8A, 9A, 10A, 17A, and 20A of Grand View Place
and Lot 1A of South Grandview Place, in the City of Dubuque, Iowa; and
Whereas, the City Council of the City of Dubuque, Iowa has determined
that this northerly portion of the alley west of South Grandview Avenue between
Altman Street (aka St. Joseph Street) and Whelan Street; is no longer required
for public use, except for utility easements as noted, and vacating and sale of
said portions of alley known as Lots 8A, 9A, 10A, 17A, and 20A of Grand View
Place and Lot 1A of South Grandview Place in the City of Dubuque, Dubuque
County, Iowa should be approved.
NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF
THE CITY OF DUBUQUE, IOWA:
Section 1, That the City of Dubuque intends to dispose of its interest in
proposed Lots 8A, 9A, 10A, 17A, and 20A of Grand View Place and Lot 1A of
South Grandview Place in the City of Dubuque, Iowa,
Section 2. That the conveyance of the following proposed lots in the
City of Dubuque, Iowa to the petitioners listed below be contingent upon the
payment of surveying and platting, processing, publication and filing fees,

maintaining water, sewer, drainage, gas, telephone, television cable, fiber optics,
and electric lines as may be authorized by the City of Dubuque, Iowa.
Section 4. That the City Clerk be and is hereby authorized and directed
to cause a notice of intent to dispose of said real estate to be published in the
manner as prescribed by law.

Dear Honorable Mayor and City Council Members:
I present this letter on behalf of the Dubuque Golf & Country Club which owns
the land adjacent to an alley that runs along Lots 20, 21, and 22 in Grand View Place. The
Dubuque Golf & Country Club concurs in the request to vacate the,alley adjacent to its property.
The Dubuque Golf & Country Club has paid for the cost of surveying ($299.78)
the portion that is adjacent to its property and desires to acquire the newly platted property
known as Lot 20a.
The Dubuque Golf & Country Club will pay the publication and filing fees of
$100.00 associated with the vacating process.
We understand that the City may desire to reserve any existing utility easements
in the former right-of-way and Dubuque Golf & Country Club would be willing to accept a Quit
claim Deed for Lot 20a after the plat has been recorded with existing utility easements, if any,
reserved.
Please let me know if anything else is required from the Dubuque Golf & Country
Club.
