HF 2041 Land Use Bill

I am writing to encourage you to oppose efforts to change Land Use authority of local
governments. Recently HF 2041 was introduced which would change the current land
use law to say that the power of a city to acquire property outside the city does not
include the power to acquire property outside the city by eminent domain.
The city of Dubuque has existing sanitary sewer in the county. In order to connect
properties located within the city of Dubuque that are currently on septic systems, we
anticipate the need to run sewer lines through private property to provide this service to
city residents. In order to accomplish this, the city must have the authority to condemn
property that lies outside the city limits when the property owner is unwilling to
negotiate. HF 2041 would eliminate our ability to do this.
Additionally, the Dubuque Regional Airport has recently completed a $14 million runway
expansion and has plans for the construction of a new terminal facility. In both
instances, eminent domain may be necessary to achieve these needed expansions.
Even though the city owns the airport it is located in the county.
Please also oppose any efforts to modify Land Use as proposed in HF2041 , which
could eliminate expansion of our sewer system and municipal airport.
