Hearing on Appeal of Jeffrey Simons' Termination from Employment with the City
of Dubuque
The hearing was called to order at 3:05 p.m. Chairperson Wertzberger swore in
witnesses Randy Peck, Bob Green, Mike Brekke, Angela Uthe
Attorney C.J. May, was present to defend Mr. Simons and Corporation Counsel was
present to represent the City of Dubuque.
Corporation Counsel Lindahl reviewed the specification of charges outlining the
incidents that led to Mr. Simons' termination from employment with the City of
Dubuque.
Attorney May stated they were at the hearing on the basis that Mr. Simons had been
confronted about an issue three weeks after it had happened. He pointed out that Mr.
Simons had been a remarkable employee who had been commended for his work and
that, to date, he had not had any other disciplinary action against him.
After hearing the evidence presented and the receipt of exhibits from both parties,
Duehr moved to modify the termination to time off as suspension without pay for period
December 12, 2003 through January 23, 2004 and that Mr. Simons return to regular
full-time employment with the City of Dubuque Water Department effective January 26,
2004. Seconded by Kluesner. Motion carried by the following vote: Duehr - Aye,
Kluesner - Aye, Wertzberger - Nay.
There being no further business, Kluesner moved to adjourn. Seconded by Wertzberger.
Unanimously approved and meeting adjourned at 5:40 p.m.
