SUBJECT: Agreement with Anna Kim for Rehabilitation of 1195 Thomas Place
Housing and Community Development Department Director David Harris recommends
City Council approval of an agreement with Anna Kim, the new owner of 1195 Thomas
Place, extending the deadline to complete repairs required for installation of City
sanitary sewer to April 1, 2005, and putting the agreement in her name.
I concur with the recommendation and respectfully request Mayor and City Council
approval.

Re: Agreement with Anna Kim for rehabilitation of 1195 Thomas Place
The City Council approved an agreement for the rehabilitation of 1195 Thomas Place, in
January, with Thomas and Rebecca LeClere. Since that time, the LeCleres, acting
through Richard Cade, have attempted to market the property for purpose of resale.
At this time, Anna Kim has agreed to purchase and rehabilitate the property. She expects
to close on the sale this month. She has requested that the agreement signed with the
LeCleres be rewritten in her name, to extend the 12-month timeftame for completion of
repairs ftom date of her purchase. For that reason, the attached agreement specifies this
deadline as 1 April 2005.
The requested action of the City Council is to approve the attached agreement, with Anna
Kim as the owner of 1195 Thomas Place, and extending the deadline for completion of
repairs required for installation of City sanitary sewer to 1 April 2005.
AGREEMENT BETWEEN
THE CITY OF DUBUQUE
AND
ANNA KIM
FOR THE REHABILITATION OF
1195 THOMAS PLACE
This Agreement is made and entered into by and between the City of Dubuque,
Iowa (City) and Anna Kim, this - day of , 2004.
WHEREAS, Anna Kim is the owner of the residence at 1195 Thomas Place (the
Property), which Property is in need of substantial repairs to make it habitable; and
WHEREAS, Anna Kim is willing to complete the necessary repairs for the
Property; and
WHEREAS, the Property is currently served by a private waste disposal system
which is defective; and
WHEREAS, the City is willing to assist Ms. Kim with the installation of a legal
waste disposal system but only upon the terms and conditions set forth herein.
NOW, THEREFORE, IT IS AGREED BY AND BETWEEN THE PARTIES AS
FOllOWS:
1. Anna Kim shall complete the repairs to the Property set forth on Schedule
A, attached, by no later than April 1, 2005, and in the event she does not,
this Agreement shall automatically terminate on April 1, 2005. All such
repairs shall be in compliance with applicable City codes, regulations and
ordinances.
2. Upon completion of the repairs set forth in Paragraph 1 to the City's
satisfaction, Ms. Kim shall be required to connect the Property to the
public sanitary sewer. The City shall assist Ms. Kim with the cost of
connection to the public sanitary sewer system. Ms. Kim shall pay the first
$4,500 of such costs and the City shall pay the costs in excess of $4,500.
3. This Agreement shall be assignable by Ms. Kim to a bonafide purchaser of
the Property. In the event of such assignment, Ms. Kim shall give the City
written notice thereof within seven (7) days after such assignment.
IN WITNESS WHEREOF, the parties hereto have caused this Agreement to be
executed as of the day and year first above written.

SCHEDULE A
1. Rebuild approximately is-feet of retaining wall at the street.
2. Repair or replace upper sidewalk steps; approximately 11 risers.
3. Repair stucco on house exterior, where deteriorated.
4. Replace rotted windowsills on front porch.
5. Install new exterior windows (storm sash will take care of this) on front porch and
othen.vise wnere missing or broken on house; 14 windows.
6. Repair/replace rotted or missing soffit and fascia.
7. Install new asphalt shingle roofing, with adequate flashing and venting.
8. Instal! adequate eavestrough/downspout system to drain roof water away from
house; This should include removal of the "yankee" gutter system and
replacement with a seamless aluminum system. Replacement of the existing
system is not required but is recommended, as a more cost-effective solution.
9. Remove and re-frame rear porch/addition; to include installation of complete new
roof structure and asphalt shingle roofing. This does not require installation of
new windows, doors or siding: what is included is to replace the existing rotted
structure and maintain a roofing system over the rear entry.
10. Remove all debris from yard area.
11. Instal! plastic "bubb!e" covers over window wells, to replace existing rotted
boards and keep water from entering basement.
12.lnstail a drain system to direct water run-off away from house to the street, while
eliminating present erosion problems that have caused the street retaining wall to
partiaiiy collapse. This should include a poured-concrete "trough" with a catch
basin and 4-inch pipe installed through the retaining wall at the street; this is the
recommended solution to this problem.
13. Rebuild approximately 20-feet of rear retaining wall.
14.Remove existing dead/deteriorated trees; including at top of upper sidewalk
steps and at rear retaining wall.
