Van Milligen, City Manager SUBJECT: Deed of Gift of Artwork for Grand River Center Assistant City Manager Cindy Steinhauser is recommending that the City Council accept the Deed of Gift recognizing the donation of artwork by Kay Norman and the conditions of the gift, one of which being that the City pay all costs associated with the framing of the artwork. Van Milligen, City Manager FROM: Cindy Steinhauser, Assistant City Manager SUBJECT: Deed of Gift for artwork for Grand River Center Discussion You will recall that as part of the recommendation of artwork for the Grand River Center was the donation of a large oil painting from Kay Norman. This painting will be located in the boardroom of the administrative spaces in the Grand River Center. Attached is a Deed of Gift document recognizing Kay Norman's donation of the artwork and the conditions of the gift. These conditions include that the City pay all costs associated with the framing of the gift. This cost was included in the artwork budget of approximately $56,362.00, which was $33,638.00 under the proposed budget. Corporation Counsel Barry Lindahl has reviewed and approved the language in the Deed of Gift. Reauest The requested action is for City Council to approve acceptance of the Deed of Gift. DEED OF GIFT I (the "Donor") have delivered, and hereby, subject to the conditions contained herein, give the object described below, to the City of Dubuque, Iowa (the "City"), for display in the City's river front convention center. 3' x 5' multi-media painting, entitled Rhythm of Nature (the "Painting"). Conditions of the gift: 1. 2. The Donor retains all copyright, trademark and associated rights of Donor in the Painting; If the Painting is not displayed in the City's river front convention for a continuous period of three (3) months or more, of if the City decides to no longer display the Painting for any reason, the Painting shall revert to and be delivered to the Donor or, as the case may be, to the Donor's heirs, Sarah E. Norman, Heather A. Norman and/or Jennifer S. Norman or their descendants. The City shall pay all costs associated with the framing of the Painting. 3. Dated: ,2004. Kathryn A.
