The final plat of Harvest View Estates Sixth Addition was approved by the City Council
at the July 6, 2010 meeting. As part of Resolution No 245 -10, the developer had 180
days in which to submit the necessary securities to the City of Dubuque. The developer
is now requesting an extension of 180 days for providing the required securities for
public improvements.
Planning Services Manager Laura Carstens recommends City Council approval of the
requested 180 -day extension by rescinding Resolution No 245 -10 and adopting a new
resolution approving the final plat.

INTRODUCTION
This memorandum transmits a request by the developer of Harvest View Estates Sixth
Addition for an extension to provide securities. A resolution is attached.
DISCUSSION
The final plat of Harvest View Estates Sixth Addition was approved by the City Council
at the July 6, 2010 meeting. As part of Resolution No. 245 -10, the developer had 180
days in which to submit the necessary securities to the City of Dubuque. The developer
is now requesting an extension of 180 days for providing the required securities for
public improvements. A new resolution and a copy of the materials sent to City Council
for their July 6, 2010 meeting are attached.
RECOMMENDATION
The requested extension for submittal of securities has been reviewed by City Planning
Services and Engineering staff and they have no objections to the requested extension.
City staff recommends City Council approval an extension of 180 days by rescinding
Resolution No. 245 -10 and adopting the new resolution approving the final plat.

Westside Arterial Development, LLC, as owner of the real estate underlying the above plat, through
inadvertence, did not execute the acceptance and furnish the guaranties required pursuant to Section
6 of Resolution No. 245 -10. We apologize for any inconvenience that may have caused.
We respectfully request that Resolution No. 245 -10 be returned to the agenda for the City
Council at the next appropriate time and that the Council reapprove the same resolution. The
required acceptance and guaranties will be promptly filed thereafter.

RESOLUTION NO. 26-11
A RESOLUTION AUTHORIZING THE RE- APPROVAL OF THE FINAL PLAT OF
HARVEST VIEW ESTATES SIXTH ADDITION IN THE CITY OF DUBUQUE, IOWA
Whereas, there has been filed with the City Clerk a Final Plat of Harvest View
Estates Sixth Addition in the City of Dubuque, Iowa; and
Whereas, upon said final plat appears a street to be known as Millstone Drive
(Lot A) together with certain public utility, storm sewer and water main easements,
which the owner by said final plat has dedicated to the public forever; and
Whereas, the preliminary plat has been examined by the Zoning Advisory
Commission and had its approval endorsed thereon; and
Whereas, said final plat has been reviewed by the City Planner and had her
approval endorsed thereon; subject to the owner's agreeing to the conditions noted in
Section 3 below; and
Whereas, said final plat has been examined by the City Council and they find
that it conforms to the statutes and ordinances relating to it, except that streets and
public utilities have not yet been completely constructed or installed.
NOW THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY
OF DUBUQUE, IOWA:
Section 1. That Resolution No. 245 -10 is hereby rescinded.
Section 2. That.the dedication of Millstone Drive (Lot A) and the easements
for public utilities, storm sewer and water mains, as they appear on said final plat, be
and the same are hereby accepted; and

Section 3. That the Final Plat of Harvest View Estates Sixth Addition is hereby
approved by the Mayor and City Clerk are hereby authorized and directed to endorse
the approval of the City of Dubuque, Iowa, upon said final plat, provided the owners of
said property herein named, execute their written acceptance hereto attached agreeing:
(a) To reduce Millstone Drive (Lot A) to grade and to construct
longitudinal sub - drain, concrete curb and gutter with hot mix
asphaltic concrete, or concrete paving with integral curb, all in
accordance with the City of Dubuque standard specifications, all in
a manner acceptable to the City Engineer, in conformance with
construction improvement plans approved by the City Engineer,
and inspected by the City Engineer.
(b) To install sanitary sewer main and sewer service laterals into each
individual lot, water main and water service laterals into each
individual lot, storm sewers and catch basins, street lighting with all
appurtenances, and erosion control devices all in accordance with
the City of Dubuque standard specifications, all in a manner
acceptable to the City Engineer, and in accordance with
construction improvement plans approved by the City Engineer,
and inspected by the City Engineer.
(c) To connect storm facilities to an approved storm water detention
facility in a manner acceptable to the City Engineer, in accordance
with the City of Dubuque standard specifications approved by the
City Engineer, and inspected by the City Engineer.
(d) To construct said improvements, prior to the two (2) years from the
date of acceptance of this resolution, at the sole expense of the
owners, or future owner.
(e) To maintain the public improvements, for a period of two (2) years
from the date of the acceptance of those improvements by the City
Council of the City of Dubuque, Iowa, at the sole final expense of
the owners, or future owner.
And, further provided that said Westside Arterial Development, LLC, as owners of
said property, shall secure the performance of the foregoing conditions provided in this
Section by providing guarantees in such form and with such sureties as may be
acceptable to the City Manager of the City of Dubuque, Iowa.
Section 4. Sidewalk installation shall be the responsibility of the owner
abutting the public rights -of -way, including lots with multiple frontages, as required by
City Code 10 -1 -2.

Section 5. The maintenance expenses incurred by the City of Dubuque for the
storm water detention facility on Lot A Harvest View Estates First Addition shall be
assessed against the lot owners of all additions in Harvest View Estates as indicated in
the preliminary plat, in equal amounts, and the City Manager shall certify such costs to
the City Clerk, who in turn shall promptly certify such costs to the Dubuque County
Treasurer, and such costs shall then be collected with and in the same manner as
general property taxes in accordance with provisions of law.
Section 6. That the final acceptance of the public improvements shall occur
upon certification of the City Engineer to the City Council that the public improvements
have been completed in accordance with the approved improvement plans and City
standards and specifications and accepted by City Council Resolution.
Section 7. That in the event Westside Arterial Development, LLC, fails to
execute the acceptance and furnish the guarantees provided in Sections 2 and 3 hereof
within 180 days after the date of this Resolution, the provisions hereof shall be null and
void and the acceptance of the dedication and approval the plat shall not be effective.

DISCUSSION
The submitted Final Plat continues the development of Harvest View Estates
Subdivision. The subject property allows for the development of approximately 58
condominium units. The Final Plat provides for the extension of Millstone Drive built to
the City's residential street standard of 31 feet of paving with a 50 -foot right -of -way.
The Final Plat also provides for the extension of City water and sewer to serve the
proposed new buildings. The subject property is in compliance with the City of
Dubuque's storm water control policies and regulations:

Traffic Patterns: There are no traffic counts available for the existing portion of
Millstone Drive. Based on the Institute of Traffic Engineers Trip Generation
Manual, approximately 340 average daily trips will be generated by the proposed
development when fully built out.
Public Services: Existing public services are adequate to serve the site.
Environment: Staff does not anticipate any adverse impact to the environment
provided adequate erosion control is practiced during all phases of construction,
and that adequate storm water control is provided as part of the development of
this subdivision in accordance with City of Dubuque Policies and Regulations.
Adjacent Properties: The impact to adjacent properties will primarily include
additional vehicle trips generated on Millstone Drive, as it is the only access for the
new residents to utilize.
Recommended Conditions on Plat: None.
Staff Analysis: The submitted Final Plat of Harvest View Estates Sixth Addition
subdivides the 7.835 acre parcel into four building lots. Lot 1 and Lot 2 will be further
subdivided as six unit condominium buildings are built in the future. Lot 3 and Lot 4 are
currently zoned R -1 and would need to be further subdivided for development of single -
family residential homes. Millstone Drive will be extended as a public street as part of
the proposed subdivision. Millstone Drive will be built to the City's residential street
standard of 31 -foot of paving and 50 -foot of right -of -way.
The subject property was previously sold by Harvest Development Group, LLC, to KZ
Investments, LLC. More recently, Westside Arterial Development, LLC has purchased
the property and is proposing development of approximately 58 condominium units
arranged in six -unit buildings along the proposed extension of Millstone Drive. Lots 1
and 2 will be further subdivided as each six -unit condominium building is constructed.
These plats would be considered simple plats, which the City Planner can sign off on
and do not require City Council review and approval.
The submitted Final Plat of Harvest View Estates Sixth Addition is in substantial
compliance with the Comprehensive Plan that designated this parcel for a mixture of
single - family, two- family and multi - family residential.
