This memorandum is to seek your approval and execution of Amendment No. 2 to the July 19, 2010
Agreement for Construction - Related Services between the City of Dubuque and Strand Associates,
Inc. (Strand) for the Water Pollution Control Plant (WPCP) Modifications Project (Project).
Mercury Spill- Related Services ($50,000)
This fee anticipates approximately 300 hours dedicated to project management (meeting
attendance, pay application /claim review, communications among involved parties), technical, spill
cost accounting and office production services related to the September 23, 2010 mercury spill.
Managing contract paperwork associated with the mercury spill environmental remediation was not
included in the original contract scope of work. The City will seek reimbursement of these costs from
Miron during the dispute resolution process.
Limited Concrete Testing Services ($10,000)
The contract documents require Miron Construction, Inc. as the general contractor to provide primary
concrete testing services for the project. The City does not have any direct work experience with
Miron's testing firm Chosen Valley, so city staff has coordinated with Strand to have on -call
verification testing done by IIW Engineers during the most critical structure pours.
The estimated $60,000 will be paid for out of the contingency funds of the Waste Pollution Control
Plant Modifications Project (CIP 7101837).
ACTION TO BE TAKEN
The execution of Amendment No. 2 to the July 19, 2010 Strand Associates agreement is requested.

Water Pollution Control Plant Modifications
This is Amendment No. 2 to the referenced Agreement.
Under Scope of Services, ADD the following:
"Limited Concrete Testing Services
Provide limited concrete testing services on an as- needed basis. The main concrete
testing for the project is being provided by the contractor. However, OWNER wishes to
have additional concrete testing conducted as a second check of the concrete and
contractor's concrete testing. Concrete testing may include slump tests, air entrainment
tests, and concrete cylinder breaks. This scope includes a maximum of 20 separate
testing events. Each event includes travel to and from the site, on -site slump and air
entrainment testing, up to four cylinder breaks and cylinder holding, and reporting of
results.
Mercury Spill- Related Services
Provide services related to the cleanup of the September 23, 2010, mercury spill
including approximately 300 hours of ENGINEER's time for project management,
technical, and office production (clerical /secretarial) services. Tasks associated with
these services include the following:
1. Communicating with OWNER, OWNER's mercury spill consultant(s) and
contractor(s), the WPCP contractor, and regulatory agencies as needed.
2. Attending meetings as requested by OWNER.
3. Reviewing and responding to pay applications and claims from the contractor
and OWNER."
