Van Milligen Dubuque kratig 1111-America City ' 2007 SUBJECT: Collective Bargaining Agreement between the City of Dubuque and the Dubuque Professional Firefighters Association, Local #353 Personnel Manager Randy Peck recommends approval of the three year Collective Bargaining Agreement with the Dubuque Professional Firefighters Association, Local #353 for the contract period beginning July 1, 2011. In the first year of the contract, Fiscal Year 2012, the employees will receive no pay increase; however, they will receive Martin Luther King's Birthday as an additional holiday. With the subsequent addition of this holiday to non - represented employees, City Hall will be closed on the third Monday of each January. In Fiscal Year 2013 and Fiscal Year 2014, employees will receive a 2.5% raise in each of those years. In addition, beginning in Fiscal Year 2013, employees will begin receiving an increase in the amount of payout at retirement of their unused sick leave. Van Milligen, City Manager FROM: Randy Peck, Personnel Manager SUBJECT: Collective Bargaining Agreement between the City of Dubuque and the Dubuque Professional Firefighters Association, Local #353 DATE: February 2, 2011 We have reached a three year agreement with the Dubuque Professional Firefighters Association, Local #353 for the contract period beginning July 1, 2011. The changes to the agreement are as follows: Effective July 1, 2011 ARTICLE 9, NONDISCRIMINATION Add sexual orientation to paragraph 2. ARTICLE 24, HOLIDAYS Add Martin Luther King's Birthday (third Monday in January) to the Holiday Schedule. ARTICLE 27, FUNERAL LEAVE Add stepmother and stepfather to the definition of members of the employee's family. ARTICLE PREGNANCY LEAVE An employee's pregnancy, child birth or related medical condition is regarded as a temporary disability. The commencement and duration of leave, availability of extensions, accrual of seniority and other benefits and privileges, reinstatement, and payment under the City's health insurance, disability insurance or sick leave plan, formal or informal, shall be applied to a disability due to the employee's pregnancy, child birth or related medical condition on the same terms and conditions as they are applied to other temporary disabilities. Sick leave benefits, to the extent of an employee's accumulated sick leave shall be granted, if requested by the employee, for the period that the employee is disabled because of the employee's pregnancy, child birth or related medical condition. The employee may use other available paid leaves such as vacation, compensatory time or casual day or a leave of absence without pay during the period of temporary disability. A leave of absence without pay beyond the period of temporary disability may be granted in accordance with Article 29, LEAVE OF ABSENCE WITHOUT PAY, of this Agreement. The employee is responsible for providing timely notice of the period of leave requested. The City reserves the right to require that the employee's disability resulting from pregnancy be verified by medical certification stating that the employee is not able to reasonably perform the essential functions of her position. Effective July 1, 2012 ARTICLE 12, WAGE PLAN Effective July 1, 2012 through June 30, 2013, the Wage Plan in effect June 30, 2012, shall be increased by 2.5% across the board. ARTICLE 26, SICK LEAVE Delete the first sentence of Section 5 and all of Section 6 and insert the following: Any unused portion of sick leave shall accumulate from fiscal year to fiscal year to a maximum of one - hundred twenty (120) sick days. Employees will be paid 100% of accrued sick leave at retirement. Payment will be based on the employee's regular (straight time /base) rate of pay at retirement. Payment will be made bi- weekly over a five year period. In order for a retiring employee to be eligible for such payment, he /she shall have completed twenty (20) years of continuous service in a full time position or retired as a result of a disability and must be eligible for pension payments from the Municipal Fire and Police Retirement System of Iowa Pension System immediately upon retirement. In the event a retired employee dies before all of the unused sick leave is paid, such payment will cease at the time of the retired employee's death. The regular (straight time /base) rate of pay for employees assigned to a forty (40) hour work week shall be based upon two thousand eighty (2,080) hours per year and one (1) sick day shall equal eight (8) hours. The regular (straight time /base) rate of pay for employees assigned to a fifty - six (56) hour work week shall be based on two thousand nine hundred twelve (2,912) hours per year and one sick day shall equal twelve (12) hours. RP Alb Effective July 1, 2013 ARTICLE 12, WAGE PLAN Effective July 1, 2013 through June 30, 2014, the Wage Plan in effect June 30, 2013, shall be increased by 2.5% across the board. The Agreement is consistent with the Agreement with the Teamsters Local Union No. 120 and the City Council's wage guidelines for the Fiscal Years beginning July 1, 2011, July 1, 2012 and July 1, 2013. I recommend that the Agreement be approved and that the attached Resolution be adopted. cc: Dan Brown, Fire Chief Prepared by: Personnel Department; Address: City Hall, 50 W. 13` Street; Telephone: 563 - 589 -4125 RESOLUTION NO. 49 -11 APPROVING THE AGREEMENT BETWEEN THE CITY OF DUBUQUE, IOWA, AND DUBUQUE PROFESSIONAL FIREFIGHTERS ASSOCIATION, LOCAL #353 AND AUTHORIZING THE MAYOR TO SIGN THE AGREEMENT Whereas, the Sixty -Fifth General Assembly adopted the Public Employment Relations Act, Chapter 20, Code of Iowa; and Whereas, the City of Dubuque is public employer within the meaning of Section 3 (1) of the Public Employment Relations Act; and Whereas, the Dubuque Professional Firefighters Association, Local #353, is an employee organization within the meaning of Section 3 (4) of the Public Employment Relations Act; and Whereas, the Dubuque Professional Firefighters Association, Local #353, submitted a request to bargain collectively on behalf of the employees within its representation; and Whereas, bargaining between the parties has occurred and an agreement has been concluded. NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF DUBUQUE, IOWA: Section 1. That the terms of the agreement be approved and the Mayor authorized and directed to sign the collective bargaining agreement.
