SUBJECT: Building Code Ordinance - Certificate of Occupancy Standards
Building Services Manager Rich Russell is recommending City Council approval of an
amendment to the City Ordinance by adding a requirement that structures may not be
occupied until the required site plan improvements have been made. This amendment
will bring the regulations in the 2000 International Building Code into conformance with
the requirements of the City of Dubuque Zoning Ordinance.
I concur with the¡ recommendation and respectfully request Mayor and City Council
approval.

RE: Building Code Ordinance-Certificate of Occupancy Standards
INTRODUCTION: The purpose of this memo is to recommend the amending of
the City Ordinance by adding a requirement that structures may not be occupied
until the required site plan improvements have been made.
DISCUSSION: This ordinance helps specify that site plan improvements must be
completed prior to the issuance of a Certificate of Occupancy. The adoption of
this ordinance will bring the regulations in the 2000 International Building Code
into conformance with the requirements of the City of Dubuque Zoning
Ordinance.
Planning Services Manager Laura Carstens processed a similar change to
Section 4-4.2(B) of the Zoning Ordinance in July and August 2003. I have
attached a copy of Ordinance 69 -03 for your information.
RECOMMENDATION: I recommend the ordinance be adopted by the City
Council. I have attached an ordinance for their use.

AN ORDINANCE AMENDING APPENDIX A (THE ZONING ORDINANCE) OF THE CITY
OF DUBUQUE CODE OF ORDINANCES SECTION 4-4.2(B) APPLICATION AND
SCOPE OF SITE PLAN REVIEW AND APPROVAL BY ADDING A NEW PARAGRAPH
REQUIRING INSTALLATION AND COMPLETION OF SITE PLAN REQUIREMENTS
PRIOR TO THE ISSUANCE OF OCCUPANCY PERMITS.
NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF
DUBUQUE, IOWA:
Section 1. That Appendix A (The ;Zoning Ordinance) of the City of Dubuque Code of
Ordinances is hereby amended by adding Section 4-4.2(B): Application and Scope of Site Plan
Review and approval by adding a new paragraph requiring installation and completion of storm
water detention facilities as shown below.
4-4.2(8): Application and Scope of Site Plan Review and Approval. No building
permit or occupancy permit shall be issued, and no construction, grading or other
land development activity listed below may be commenced on property unless a site
plan has been submitted and approved forsuch activity as set forth in this section.
Development activities subject to the requirements of this section may hereafter be
carried out only in substantial conformance with the approved site plan and any
conditions or restrictions attached thereto. Any substantial deviation from the
approved site plan, unless approved in advance by the City Planner, shall be
deemed a violation of this ordinance.
No occupancy permits for a new development shall be issued until all stoìm water
control, sanitary sewer. water mains, off-street parking facilities and all other site
plan requirements have been constructed and approved by the City, and are fully
operational.
Section 2. The foregoing amendment has heretofore been reviewed by the Zoning
Advisory Commission ofthe City of Dubuque, Iowa.
Section 3. This ordinance snail take effect immediately upon publication, as provided by
law.

ORDINANCE NO. 26-04
AN ORDINANCE AMENDING THE CITY OF DUBUQUE CODE OF
ORDINANCES SECTION 11-2 INTERNATIONAL BUILDING CODE-
AMENDMENTS BY ADDING A NEW SECTION REQUIRING
INSTALLATION AND COMPLETION OF SITE PLAN REQUIREMENTS
PRIOR TO ISSUANCE OF CERTIFICATES OF OCCUPANCY.
NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF
THE CITY OF DUBUQUE, IOWA:
Section 1. That Section 11-2 of the City of Dubuque Code of
Ordinances is hereby amended by adding Section 110.3: Certificate issued and
requiring installation and completion of site plan improvements prior to issuance
of Certificates of Occupancy.
Section 110.3: Section 110.3 "Certificate issued", is hereby
amended by adding a new section as follows:
Section 110.3 Certificate issued. After the building official inspects
the building or structure and finds no violations of the provisions of
this code or other laws that are enforced by the department or other
City departments, the building official shall issue a certificate of
occupancy that shall contain the following:
1. The building permit number.
2. The address of the structure.
3. The name and address of the owner.
4. A description of that portion of the structure for which the
certificate is issued.
5. A statement that the described portion of the structure
has been inspected for compliance with the requirements
of this code for the occupancy and division of occupancy
and the use for which the proposed occupancy is
classified.
6. The name of the building official.
7. The edition of the code under which the permit was
issued.
8. The use and occupancy, in accordance with Chapter 3.
9. The type of construction as defined in Chapter 6.
10. The design occupant load.
11. If an automatic sprinkler is provided, whether the
sprinkler system is required.
12. Any special stipulations and conditions of the building
permit.
No occupancy permits for a new structure shall be issued until all

facilities and all other site plan requirements have been constructed
and approved by the City, and are fully operational.
Section 2. This ordinance shall take effect immediately upon publication,
as provided by law.
