Chief of Police Kim Wadding is recommending City Council approval of an amendment
to City of Dubuque Code of Ordinances Section 38-31 Services Charges by adding the
requirement of a service charge of $10 for a non-law enforcement local criminal history
record request.

INTRODUCTION:
The purpose of this memorandum is to request consideration to amend the City of
Dubuque Code of Ordinances Sec. 38-31 Service Charges by adding the requirement
of a service charge for a non-law enforcement local criminal history record of $10
payable to the City of Dubuque.
BACKGROUND:
As a continuation of the budget concerns related to various reductions primarily
associated with state revenue losses to the City of Dubuque, each city department was
asked to develop expenditure reductions andlor revenue enhancements to offset the
reductions. As part of the FY2005 budget process, it has been recommended to add a
research fee for local criminal records requests.
Originally proposed during the budget reductions for FY2004, the research fee allows
the police department to capture the cost of staff time and processing associated with a
local non-law enforcement criminal history records request. Currently, the police
department estimates approximately 265 local non-law enforcement criminal history
records are requested per month.
DISCUSSION:
Area employers, landlords, schools, and others use the non-law enforcement criminal
history requests to inspect and review the criminal arrest histories and the background
of potential employees, rente"rs, youth workers and others who are or would be
associated with their organization. Local non-law enforcement criminal history requests
have proven an important aid to area businesses and organizations and we would
estimate some reduction of requests with the added fee. Based upon 265 local criminal
history requests per month, we project annual revenue of $25,000 to $31,800.
RECOMMENDATION:
Based upon these estimates, we recommend amending the City of Dubuque Code of
Ordinances Section 38-31 Service Charges to include the adoption of a $10 service
charge for non-law enforcement criminal history requests. Barry has reviewed and
edited the attached ordinance.
ACTION REQUESTED:
The action requested is to submit the ordinance amendment to the City Council for
consideration.

AMENDING THE CITY OF DUBUQUE CODE OF ORDINANCES SECTION 38-31
SERVICE CHARGES BY ADDING A SERVICE CHARGE FOR A NON-LAW
ENFORCEMENT LOCAL CRIMINAL HISTORY RECORD
NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY
OF DUBUQUE, IOWA:
Sec. 38-31. Service Charges:
(a) Persons requesting assistance from the Police Department for
opening any motor vehicle or gaining entrance to any structure shall pay to
the City a twenty-five dollar ($25.00) service charge per call.
(b) Non-Law Enforcement persons requesting a local criminal history
record from the Police Department shall pay to the City a ten dollar ($10.00)
service charge per local criminal history record requested.
(c) Nothing in this Section shall be interpreted as requiring or assuring
any specific response by the Police Department
