Van Milligen, City Manager SUBJECT: Purchase of Service Agreement- Dubuque Area labor Management Council During the Fiscal Year 2005 budget process, the Mayor and City Council provid d $15,051 for a Purchase of Services Agreement with the Dubuque Area labor- Management Council. Budget Director Dawn Lang is recommending execution of the attached agreem nt with the Dubuque Area Labor-Management Council to provide funding for improvem nt and expansion of labor-management cooperation in the public and private sector in t e Dubuque area. Van Milligen, City Manager FROM: Dawn Lang, Budget Director SUBJECT: Purchase of Service Agreement - Dubuque Area labor- Management Council Attached for City Council approval is the Purchase of Services Agreement with t e Dubuque Area Labor-Management Council for the City's financial support for Fiscal Year 2005. The adopted Fiscal Year 2005 operating budget provides a payment of $15,051 0 the Dubuque Area Labor-Management Council to provide services related to the maintenance and expansion of a cooperative labor-management resource cente , the maintenance of a speakers bureau, publication of a bimonthly newsletter, expan ion of educational incentives and outreach, expansion of existing membership, and fac litation of a cooperative effort between labor and management in the City of Dubuque. It is my recommendation that the City Council approve the attached purchase of services agreement with the Dubuque Area Labor-Management Council and aut orize the Mayor to execute the contract on behalf of the City. Attachment DUksf CITY OF DUBUQUE AND DUBUQUE AREA LABOR MANAGEMENT COUNCIL PURCHASE OF SERVICES AGREEMENT I THIS AGREEMENT, emered ;nto Ih. ,,1 d,y of '""I 2004 by ood be1wB~" the City of Dubuque, Iowa, herein referred to as the "City" and the Dubuque Area L bor- Management Council, herein referred to as the "Agency". WHEREAS, the Agency represents itself as technically and professionall qualified to provide a forum to improve and expand labor-management coopera ion in the public and private sector within the Dubuque area; and WHEREAS, the City has deemed it to be in the public interest to provide financial assistance to be used to cover general operating expenses of the Age cy's program. NOW THEREFORE, the parties hereto agree as follows: 1. Scope of Service The Agency shall provide, within the city of Dubuque, services related to he maintenance and expansion of a cooperative labor-management resourc center; the maintenance of a speakers bureau; publication of a bimonthly newsletter; expansion of educational incentives and outreach; expansion of existing membership; and facilitation of a cooperative effort between labo and management in the city of Dubuque. 2. Time of Performance The services of the Agency are to commence on July 1, 2004, and terminate June 30, 2005. 3. Compensation The City shall pay the Agency the amount of $15,051, which amount shal constitute full and complete compensation for its share of all services to b rendered. Such sum shall be payable by the City to the Agency within ten (10) days of the signing of this contract, upon receipt of a requisition for such sum. I 4. Discrimination In carrying out the program, the Agency shall not discriminate against an\ employee or applicant for employment because of race, creed, color, sex age, national origin, religion, or disability. The Agency shall take affirmative ac ion to insure that applicants for employment are employed and that employees re treated during employment without regard to their race, creed, color, sex, age, national origin, religion, or disability. Such action shall include but not be limited to the following: employment, upgrading, demotion or transfer; recruitmen or recruitment advertising; layoff or termination; rates of payor other forms (f compensation; and selection for training, including apprenticeship. The Agency assures that all qualified applicants will receive consideration for employn ent without regard to race, creed, color, sex, age, national origin, religion, or disability. The Agency agrees and will undertake whatever affirmative measures arE necessary so that no person shall on the grounds of race, color, religion, ex, national origin, age, degree of handicap or disability be excluded from participation in, be denied the benefits of, or be subjected to discriminatio under any program or activities funded in whole or in part with any of the funds ade available to the Agency under the terms of this Agreement. 5.
