Property Damage
This is a claim in which the claimant alleges that the siding on her garage was damaged
after her garbage can was emptied and tossed up against the garage during regular
sanitation pick-up.
According to the report of Paul Schultz, Solid Waste Management Supervisor, after an
investigation of the of the alleged property damage was conducted by Lead Sanitation
Driver Dave Sitzmann, it is Mr. Schultz's conclusion that damage to claimant's siding was
likely caused during regular solid waste pick-up. However, Mr. Schultz states that the
crews deny any willful inappropriate throwing of any empty refuse container or recycling
bin that would have cracked the siding.
It is therefore the recommendation of Paul Schultz to approve this claim for the amount of
the submitted estimate of $45.00. The Legal Department concurs with this
recommendation.

The claim and estimate of $45.00 is approved as filed.
From Lead Sanitation Driver Dave Sitzmann'sinvestigation at the site of
the alleged property damage, his photos and measurements in the alley and of
the garage siding, conversations with the refuse and recycling crew members
collecting this alley, I have concluded that our solid waste container handling
likely damaged Sharon Krohn's garage siding. However, the crews deny any
willful inappropriate throwing of any empty refuse container or recycling bin that
would have cracked the siding.
The alleged property damage occurred at approximately 7 AM on
February 2, 2004 in the alley behind 1610 Rhomberg. Ms. Sharon Krohn called
our office and spoke to me conceming her property damage. My understanding
was that neither she nor her witness observed our crews handling their
containers that morning. She alleged that the refuse crew must have thrown her
empty garbage container back onto the garage apron and that the axle on the
container hit the brand new siding and poked a hole in it. Our photo recorded a
hole in the second tier of siding approximately one foot above the apron.
